Throughout the 2nd and 3rd quarter, the DPA participated in SFPD’s Executive Sponsor Working Group that addressed DOJ’s Collaborative Reform recommendations concerning bias-free policing, community policing, accountability and SFPD’s Staffing Taskforce. The DPA also spearheaded language access projects in the Language Access Working Group that meets monthly with Police Commission Petra DeJesus, SFPD, city agencies and community advocates. Know Your Rights for Youth Brochure

• Recommendations to SFUSD-SFPD Memorandum of Understanding

Additional policy work on youth included DPA’s proposed recommendations to enhancethe Memorandum of Understanding between the San Francisco Unified School District andSFPD. In addition to discussions with SFPD and SFUSD, the DPA provided suggested revisionsto the San Francisco Board of Supervisors’ subcommittee hearing on June 28, 2019. (DPA’srecommendations accompany this letter—Attachment B). Highlights of those recommendationsare provided below:

1. Require School Resource Officers to Receive Specific Training Concerning PoliceInteractions with Youth.

2. Include That The San Francisco Public Defender Is Available 24/7 For Youth Subjectedto Custodial Interrogation, the Public Defender’s Phone Number and Right to PrivacyDuring Phone in the MOU.

3. Define Exigent Circumstances as an Immediate Threat to the Safety of the Public orOfficers.

4. Collect Data as to Campus Arrests Involving Parent Notification, Custodial Interrogation,and Ability to Speak with An Attorney Before Custodial Interrogation.

5. Include A Provision That Interpreters Will Be Provided for Limited English ProficientStudents and Limited English Proficient Parents During Interviews, Questioning andEncounters with Police.

6. Include SFPD Officers’ Requirement That They Provide Parent Notification Pursuant toDepartment General Order 7.01.

7. Require—Instead of Recommend—That SFPD Officer Notify School Officials of TheirPresence and Purpose on SFUSD Property

• Recorded or Written Consent for Searches of Individuals and Their Belongings

Based upon the President’s Task Force on 21st Century Policing principles, in September2015 the DPA recommended that SFPD modify its consent procedures to require written consentbefore the search of individuals and their belongings when there is no warrant or probable cause.Studies are indicating that African Americans and Hispanics are disproportionately searchedmore often and less likely to be found with contraband that Caucasians1. Consistent with crimeprevention strategies that are effective and foster bias-free policing, the DPA drafted a proposal

for written or recorded consent of individuals and their belongings that includes informingindividuals that they have the right to decline consent. The DPA’ s proposal is currently underDepartment review.

SFPD Manual Revisions

The DPA reviewed and provided suggestions revisions to SFPD’s Elder Abuse Manual,Community Advisory Board Manual, and Reserve Manual. In collaboration with the LanguageAccess Working Group, the Department on the Status of Women, the Domestic ViolenceConsortium, and SFPD, the DPA has drafted a Domestic Violence and Intimate Partner Stalkingmanual that is currently under Department review.

Department of Police Accountability’s Suggested Revisions to SFtISD-SFPD MOU

1. Require SROs to Receive Specific Training Concerning Police-Interactions with Youth

Department of Police Accountabilit’ (DPA) suggests that Section 5 (Hiring and Assignment)include the requirement that School Resource Officers receive training specific to police interactions withyouth that is scenario and skilled based including dc-escalation tactics. information about adolescentdevelopment, recognition of developmental disabilities and mental illness. the effect of trauma onchildren and youth. and other relevant topic to enhance police interactions with youth.

Since 2010. DPA and the Youth Commission have recommended that SFPD provide all itsofficers training specific to youth. At DPA’s and YoLtth Commission’s urging. SFPI) has initiated sometraining with Strategies for Youth. DPA suggests that SFP[) implement the Strategies for Youth trainingand that all SROs be required to take this training as a prerequisite for SRO selection.

2. Include That The San Francisco Public Defender Is Available 24/7 For Youth Subjected toCustodial Interrogation, the Public Defender’s Phone Number and Right to Privacy DuringPhone in the MOU.

DPA suggests the section on Police Interviews Inc tiLde that the San Francisco Public Defender isavailable 24/7 for youth subjected to custodial interrogation and include the Public [)efender’s phonenumber. DPA suggests the following language be added to the last paragraph of Section 1 8:

SFPI) officers shall call the San Francisco Public Defender’s office at 415-523-2773 for the on-call juvenile attorney who is available 24-hours to enable the youth to speak ith an attorneybefore custodial interrogation or the waiver of any Miranda rights. SFUSD and SFPD shall ensurethat youth are provided the right to privacy when talking with legal counsel.

3. Define Exigent Circumstances as an Immediate Threat to the Safety of the Public or Officers

Currently exigent circumstances is defined in the MOU as “circumstances that cause a reasonableperson to believe that prompt action is necessary to prevent physical harm to persons. the destruction ofrelevant evidence, the escape of a person suspected of criminal activity, or other circumstances thatfrustrate legitimate law enforcement concerns.” This definition is too broad.

DPA suggests that exigent circumstances be defined as “an immediate threat to the safety of thepublic or an officer or to prevent the destruction of e idence.”

4. Collect Data as to Campus Arrests Involving Parent Notification, Custodial Interrogation,and Ability to Speak with An Attorney Before Custodial Interrogation.

DPA suggests that the Report section of the MOU include data collection concerning parentnotification, the number of youths subjected to custodial interrogation and the number of youth whospoke with an attorney before custodial interrogation.

5. Include A Provision That Interpreters Will Be Provided for Limited English ProficientStudents And/Or Their Limited English Proficient Parents During Interviews, Questioningand Encounters with Police.

The San Francisco Police Department is required to provide language assistance to LimitedEnglish Proficient individuals (DGO 5.20). DPA suggests that this requirement be incorporated into theMOU.

6. Include SFPD Officers’ Requirement That They Provide Parent Notification Pursuant toDepartment General Order 7.01

Department General Order 7.01 requires SFPD officers to notify parents or a guardian when ayouth is arrested. DPA suggests that SFPD’s obligation to notify parents also be included in thisMOU. Regardless of a school official’s obligation to notify a parent, SFPD officers also have anobligation to notify parents of a child’s arrest and SFPD officers must take steps to ensure that parentnotification has occurred.

7. Require—Instead of Recommend—That SFPD Officer Notify School Officials of TheirPresence and Purpose on SfUSD Property

Currently the MOU states that absent exigent circumstances, SFPD officers “should” notifyschool officials of their presence and/or purpose on SFUSD property. According to SFPD’sdefinitions, (DGO 3.02), “should” is recommended while ‘shall” is reqiLired. DPA suggests thatSEPD officers be required to notify school officials of their presence and thus suggests changingshould to shall.
