Our financial strength means that we don’t need t o provide any alternative financial provision t o meet our environmental commitment or liabilities associated with operating the Silvercrest facility. We can provide the EPA with confidential details of our financial strength if requested and we will meet the EPA t o discuss this in the future if required.

AlBP trading as Silvercrest Foods operate an existing food processing iiistallation. producing fresh and frozen meat products for the retail and catering sector in Ireland and overseas. T l ie finished product production capacity exceeds 75 tonnes per day and the main products include fresh and frozen burgers, steaks. and mince.

The installation is located less than 0.5km f rom the centre of Ballybay town and includes offices: processing facilities. a packing area. refrigerated storage. and a dissolved-air floatation (DAF) unit. Wastewater arising from the wash do\vn processes oii-site passes through the D A F unit pr ior to discharge to tlie Ballybay town \vastewater treatment \vorks. The installation operates 24 hours per day seven days a week thi.otigliout the pear w i th approximately 120 employees.

Meat arrives at the installat'ion either fresh or frozen and is placed into refrigerated storage units unt i l required. Tlie meat is then, if required. thawed out arid prepared for processing. Depending on the specification o f the product. additional ingredients may be added and blended pr ior to processing. The manufactured beef burgers/other meat products are frozen on tlie production l ine and are packaged and placed into refi-igerated storage. Fresh products are packaged and chil led \vhile awaiting dispatch.

There are currently two parallel processing l i l ies and tlie licence provides [or t w o additional processing lines.

Tlie i i iain wastes arising from tlie process are animal by-products. \vhicli are collected and sent for iwider ing at an approved installation. Other waste include packaging, wste oil (fi-om equipment used on-sile) and fluorescent tubes. These wastes are sent o f f site foi- rwove i -y or disposal at appropriate faci I ities.

The licence sets out in detail the conditions under which .i\IBP trading as Silvercrest I-oods \vi11 operate and manage this installation.

2.1 Installation Management

2.2.1 The licensee shall establish and maintain an Enviroiimental Management System (EMS) within sis months o f tlie date o f grant o f th is licence. The E M S shall be updated on an aiinual basis.

The licensee shall. not later than six months from tlie date of grant o f this licence. submit to the Agency for agreement an EMP. inc luding a time sclieclu le. for acli ieving the Environinen tal 0b.jectives and Targets prepared under Condition 2.2.2.2. 2.2.2,s Maintenance Prograinme

The licensee shall establish and maintain a prograinme for maintenance o f all plant and equipment based on [l ie instructions issued by tlie inanufacttirer/supplier or installer o f tlie equipment. Appropriate record keeping and diagnostic testing shall support this maintenance prograinme. T l ie licensee shall cleai-ly allocate responsibility for tlie planning, management ancl execution o f all aspects o f this programme to appropriate personnel (see Condition 2.1 above).

2.2.2.9 Efficient Process Control

Tl ie licensee shall establish and maiiitain a progranline to ensure there is adequate conti-01 of processes under all modes o f operation. The programme sliall identify the key indicatoi- parameters for process control perlormance. as \vel1 as identifying methods for ineastiring and controll ing these parameters. Abnoi-mal process operating conditions shall be doctiinciited, and analysed to identify any necessary corrective action.

Condition 3. Infrastructure and Operation

3.1 T l ie licensee sliall establish all infrastructure referred to in this licence as required by the conditions o f this licence. Infrastructure specified in the application \vliich relates to the environmental perforinance o f tlie installation and is not specified in tlie licence: shall be installed in accordance with the schedule submitted in the a ppl ica t ion.

3.2 Installation Not ice Board

3.6 Tank. Container aiid Drum Storage Areas

3.7 The licensee sliall have in storage an adequate supply of containment booms and/or suitable absorbent inaterial to coiitain and absorb any spillage at tlie installation. Once used tlie absorbent matei.ial sliall be disposed o f at an appropriate facil i ty.

3.8 Firewater Retention

3.8.1 The licensee sliall car iy out a risk assessment to determine i f tlie activity should have a fire-water retention facil i ty. The licensee shall submit the assessment and a report to the Agency on the findings and recorii i i~endations of tlie assessment \vitli in six months from the date o f grant of th is licence.

I n tl ie event that a significant risk exists for tlie release o f contaminated fii-e-water; the licensee shall: based on the findings of the risk assessment: prepare and implement, wi th tlie agreement of the Agency, a suitable risk management programme. The risk management programme shall be fu l l y iinplemerited wi th in three nionths from date o f notif ication by the Agency.

Condition 4. Interpretation

The survey programme shall be undertaken in accordance with tlie nietliodology specified i n the 'Environmental Noise Survey Guidance Document' as published by tlie Agency.

Pollutant Release and Transfer Register (PRTR)

Tl ie licensee shall prepare and report a PRTR for tlie site. Tl ie substances and/or waste to be included in the PRTR shall be agreed by the Agency each year by reference to EC Regulation N o . \66/2006 concerning the establishment o f the European Pollutant Release and Transfer Register and amending Council Directives 91/689/EEC and 96/6I/EC. The PRTR shall be prepared in accordance w i th any relevant guidelines issued by tlie Agency and shall be submitted electronically in specified format and as pai t o f tlie AER.

The licensee shall prepare. to the satisfaction of tlie Agency: a test programme for abatement equipment to be installed on the proposed cooking process line. Th is prograinme shall be submitted to tlie Agency in advance of implementation.

This programme. fo l lowing agreement wi th the Agency. shall be implemented prior to coininencement o f cooking on the proposed new process line.

The criteria for the operation o f tlie abatement equipment as determined by the test pi-ogramme. shall be incorporated into the standard operating procedures.

T l ie test programme shall include as a minimum. the fol lowing:

(i) Establish al l criteria for operation. control and management o f the abatement equipment to ensure compliance with tlie emission limit values specified in this licence.

( i i ) Assess the performance o f any monitors on the abatement equipment and establish a maiiitenance and calibration programme for each inonitor.

A report on the test programme shall be submitted to the Agency within one inoiit l i o f CO m p I et i on.

The licensee shall. within sis months o f the date o f grant o f this licence, develop and establish a Data Management System for collation. archiving. assessing and graphically presenting the environmental monitor i i ig data generated as a i.esii1t of this licence.

Condition 7. Resource Use and Energy Efficiency

7.1 Tl ie licensee shall carry out an audit o f tlie energy efticiency o f tlie installation wi th in one year o f tlie date o f grant o f this licence. The audit sliall be carried out iii accordance with tlie guidance published by the Agency; "Guidance Note on Energy Efficiency Auditing". The energy efticiency audit shall be repeated at intervals as required by the Agency.

The audit shall identify all opportunities fo r energy use reduction and efficiency and the reconiinendations o f tlie audit w i l l be incorporated into tlie Schedule o f Environmental Objectives and Targets under Condition 2.2.2.2 above.

The licensee shall identify opportunities for reduction in the quantity o f water used on site including recycling and reuse initiatives, wherever possible. Reductions i n water usage shall be incorporated into the Schedule o f Environmental Objectives and Targets.

The licensee shall undertake an assessment o f the efficiency of use o f raw materials in all processes. having particular regard to the reduction in waste generated. The assessment should take account of best international practice for

Condition 12. Financial Charges and Provisions

12.1 Agency Charges

12.1.1 The licensee shall pay to the Agency a n annual contribution ol‘E7.34.3, o r such sum as the Agency from time to t ime determines, having regard to variations in the estent of reporting. auditing. inspection. sampling and analysis or other functions cari-ied out by the Agency. tou;ards tlie cost o f inionitoriiig the activity as tlie Agency considers necessary for the performance o f i ts functions under the Environmental Protection Agency Acts 1992 to 2007. The first payment shall be a pro-rata amount for tlie period from the date o f this licence to the 31 st day o f December. and shall be paid to the Agency \vithin one month from the date o f the licence. I n subsequent years the licensee shall pay to the Agency such revised annual contribution as the Agency shall f rom t ime to time consider necessary to enable performance by the Agency o f its relevant functions under the Envii-onmental Pi-otection Agency Acts 1992 to 2007. and all such payments shall be made within one month o f the date upon ‘which demanded by the Agency.

I n the event that the frequency 01- extent o f monitor ing or other functions carried out by the Agency needs to be increased the licensee shall contribute such slims as determined b y the Agency to defraying its costs in regard to items not covered by the said annual contribution.

12.2 Water Services Authority Charges

12.3.1 The licensee shall as part of the A E R provide an annual statement as to the measures taken or adopted at the site in relation to the prevention o f environmental damage. and the financial provisions in place in relation to the under\vriting o f costs for remedial actions fo l low ing anticipated events (including closure) or accidents/iiicidents. as niay be associated with the carrying on o f the activity.

12.3.2 The licensee shall arrange for the completion. by an independent and appropriately qualif ied constiltant. of a comprehensive and fu l l y costed Environmental Liabil it ies Risk Assessment (ELRA) , wh ich addresses the liabilities from past and present activities. The assessment shall include those liabilities and costs identif ied in Condition IO for execution o f the Decommisssioniiig Plan. A i-eport on this assessmelit shall be submitted to the Agency for agreement wi th in twelve months of date of grant of this licence. The E L R A sliall be reviewed as necessary to reflect any significant change on site, and i n any case every three years fo l low ing init ial agreement: review results are to be not i f ied as part o f the AER.

12.3.3 As part o f the measures identif ied in Condition 12.3.1 the licensee shall. to the satisfaction o f the Agency. make tinancial provisioii to cover any liabilities identif ied i n Condition 12.3.2. The amount of indemnity held shal l be re\,ie\ved and revisecl as necessary, but at least annually. Proof of renewal or revision of‘ siicli financial indemnity shall be included in the aniitial ‘statement o f measures‘ repoit identified in Condi t ion 12.3. I .
