111. BACKGROUND: Chronic Late Fling of Reports

The City Political Action Committee (City PAC) (“the Committee”) has failed to file six (6) Reports and Disbursements in a timely manner for the 1997- 1998 election cycle (see chart on page 4 ). The reports were filed between thirty- four (34) and eighty-seven (87) calendar days late.

Cover letters, signed by Russell J. Pass as either Acting or Assistant Treasurer, were submitted with the 1997 Mid-Year, 1998 April Quarterly, and 1998 July Quarterly Reports. In the letter dated August 21,1997, Mr. Pass stated that “the issues responsible for the [ 1997 Mid-Year Report’s] tardiness have been dealt with, and subsequent reports will be on time” [emphasis in original]

In a subsequent letter dated March 21.1998, the Committee stated that Russell J. Pass would be nspcrnsible for filins repm on the Tnasurer’s behalf. (Attachment 5). Mr. Pass indicated in the letter dated June 3, 1998 that the Committee believed that the 1998 April Quarterly Report had already been filed “but as you are aware, our processes have been less than flawless over the last several months” (Attachment 1 1). In Mr. Pass’ letter dated September 2, 1998, he said that a copy of the 1998 July Quarterly Report with different information had been sent earlier, “possibly to the Secretary of State, by mistake” (Attachment 14).

On October 14, 1998, a Chronic Late Filer Notice was sent to the Committee for failing to file the 1997 Mid-Year, 1997 Year End, 1998 April Quarterly, and 1998 July Quarterly Reports in a timely manner (Attachment 16): The Notice advised the Committee that any additional late filing of reports may result in legal enforcement action. Subsequent to the mailing ofthe Chronic Late Filer Notice, the Committee failed to file the 1998 12 Day Pre-General and 1988 Year End Reports in a timely manner.

In a letter dated October 15, 1998, the Assistant Treasurer, Mr. Russell J. Pass attempted to explain why the Committee’s reports had been filed late on so many occasions. He briefly described the history and composition of their organization and what they were planning to do to deal with their problems (Attachment 17).

On December 3, 1998, the Committee filed the 1998 30 Day Post-General Report. The Report disclosed a $1,500 contribution to one (1) federal candidate during the 12 Day Pre-General reporting period (10/01/98-10/14/98), thus requiring the timely filing of such a report (Attachment 18).

Mr. Pass submitted a letter dated April 27, 1999 with the 1998 Year End Report (Attachment 21). He stated that the “revision” was necessary to include a transaction “not recorded properly on the earlier report”. The Commission has no record of the tiling of an earlier report.

The Notice was originally sent September 18,1998; it was returned and remailed October 14,1998.

It's purpose was and is to get young people active in the political process fiy giving chun a chance to play a meaningful role in getting candidates ekcted and shaping Wit positions on issaes of concem to thc gmup. The PAC also has a social elemcnt to it, and over the ycar~ its events and canmince rntctings have brought young people tcig&%, resulting in quite a few Wages.

When the organization was wed in Ute mid-19sDs. thete was a gnat deal of enthusiasm for it and its is5uts. Since then, che enthusiasm has waaed, and it has betn difficult bo& to g e ~ people involved and to get them to follow w11 internal pmcwes for reponing i n f m t i m hat ultimately appears on our R C rrporcs.

Our top priority has been to record on Ihe report informadon we know lo be acamc and complete.
