In order to file a legally, sufficient complaint,.you must s' ,ear before a notary that thecontents of your complaint are true to the best of your know~ledge. The notary/ must represent aspart of the jurat that such swearing occurred. The preferred form is "Subscribed and sworn tobefore me on this ___ day of __, 19__." Dear Mr. Turley:

This is in response to your letter of June 19, 1997, toDetroit City Council Member, Gilbert Hill, requesting comment onthe above-referenced complaint. Specifically, the complaintalleges that various elected officials within the City of Detroithave maintained booths that sell beer to raise campaign fundsduring the City's "Downtown Hoedown." Further, because ofDetroit's proximity to Windsor, Canada, it is alleged that Canadiancitizens may have purchased beer at these booths and, therefore,contributed to the campaign committees of these officials.

Please be advised that Council Member Hill has not engaged infund raising during the hoedown since 1995. When he didparticipate, his volunteers would sell beer for either $4.00 or$7.00 per cup, and his campaign committee would receive a smallprofit from each sale. if Canadian citizens made purchases at hisbooth, neither he nor his campaign volunteers would have had anyreason to know of such purchases. Moreover, the Canadian citizens,if any, would not have known that sorme smfll portion of thepurchase price would be used for political purposes.

5 This LCC license was at all times prominently displayed at eve level on the wall ofthe booth

Furthermore, Mr. Cleveland's aides, working at the booth, wore Clyde Clevelandhats, t-shirts, and buttons, which further served to identify the sponsor of the

Recitals

WHEREAS, CONCESSIONAIRE has been gruned certain exclusive food and beverage

WHRAS, the ORGANIZATION desires to obtain the necessazv license(s) from the

State of Michigan to sell beer and~or wine and/or spirits at the EVENT as a fund raising project

for the ORGANIZATION, and,

WHEREA S, CONCESSIONAIRE desies to assign its rights to sell beer ad/or wine

and/or spirits at the EVENT to the ORGANIZATION as a fund raising project.

NOW, THEREFORE. for and in consideration of the mutual promises and covenants hereinafter

~set forth, the parties her'eto agree as follows

ENGAGEk _EN' TO PERFORM CONCESSION .SERVICES - CONCESSIONA[RE

hereby agrees to engage the ORGANIZATION, and the ORGANIZATION hereby

accepts such engagement, to sell beer anddor wine andi'or spirits at the EVENT EN

accordance w~th the terms, conditions, rules, and provisions herein contained

- O_'NQE$SLON STAN],D AM) PERSONNEL - The ORGANIZATION agrees to fully

start and operate. at the EVENT during the dates hereinafter designated, a concession

stand1 sI, the location of each such stand to be assigned by CONCESSIONAIRE for the

sale of beer an& or wine and Lor spirits as licensed by the State of Michiga The

ORG.ANIZATION agxces to provide at least ten (10) persons. each of whom is either a

membcr or a spouse or child of a member of said ORGANIZATION, and is at least the

minimum age required by the State of Michigan to sell alcoholic beverages. Each stand

shall be operated in accordance with such general methods and plans of operation as may

be promulgated by' CONCESSIONAIRE. All personnel shall abide by such plans,

methods, rules, and procedures established by CONCESSIONAIRE. All personnel

provided by the ORGANIZATION shall conduct themnselves at al times during the

EVENT in a dignified manner and shall perform the ser'vices and work undertaken herein

diligently, efficiently, and courteously, and, in general, shall act in the ORGANIZATION'S

highest traditions of" public service.

3ORGAiATIOlNAL SALES - The ORGANIZATION shall sell beer and/or wine

and/or spirits in containers and a: prices approved by CONCESSIONAIRE. Ech sale

~shall include sales tax. The genernd sales procedure is as follows.

a ORGANIZATION may only sell beer" and/or wine and/or spirits, as

" licensed, from the booth or enclosure and at the location specified by

CONCESSIONAIRE during the EVENT. The ORGANIZATION'S right

to sell expires at the conclusion of the activities on the lass day of the

EVENT unless otherwise advised by CONCESSIONAIRE.

b ORGANIZATION shall receive an allocated inventory of beer and/or wine~and/or spints, containers, ice, C0O, and other supplies and equipmett

necessary for its sales operation, as well as, corn aprons, and a change bank

of coins and currecy at each location.

c ORGANIZATION shall sell only products designated and at prices

established by CONCESSIONAIRE ORGANIZATION shall collect all

revenues from sales including sales tax and follow CONCESSIONAIRE

collection and receti~ng procedures.

At the end of each day's events, ORGANIZATION shall account for all

receipts trom sales and all remainng nventories of merchandise and

supplies and equipmt.m

c. ORGANIZATfION shall provide an mange in charg of" each location

whose responsibilities include money accountability, invenory, receipt of

merchandise and supplies delivered, ad personnel. The manage will also

act as the Iaison between the ORGANIZATION and the

CONCESSIONAIRE.

4 Q At7AIONEXS ES~ - The ORGANIZATION shall provide the following

ax it sole cost and expense from the proceeds of its sales of beer and/or wine and/or sirits.

a. AUl beer and/or wine and/or spirits, as advised by CONCESSIONAIRE,

b licensing fees and bonds, ad

c Liquor liability insurance, and

d. Persone for eac locaton, and

f. Supplies deemed necessary by CONCESSIONAIRE, to include. but not

limited to. conties ice, C02, etc. to be purchased from

CONCESSIONAIRE, to include any necessary utility hook-ups, and

gRental of each location site based upon linear footage, short and long side,,

of each sales locaton sie designated by CONCESSIONAIRE, and

hAdministration tee to CONCESSIONAIRE often percent (10/%)Of gross

sales, excluding sales tax, and

Set-up and tear-down fee

5 SERV1CES TO BE PRO VIDED BY CONCESSINAIRE - tn consideration of the fees

paid by the ORGANIlZATION. CONCESSIONAIR shall provide the ORGANIZATION

with the foUowing

b Booth (s) and tables deeImed necessary by CONCESSIONAIRE for sales,

and

c Oenera liability insurance, and

d Booth (s) and tables deemed necessary by CONCESSIONAIRE for sales,

c Adnunistrative personnel to assist ORGANIZATION with money

verification and accountability, inventory delivery and reconciliatiOl, and

complete coordination and continuity of the flow of activities relating to

the EVENTg, and

f Use of coin aprons, change ftind. general office and storage facilities, and

g. All products, supplies, equipment. etc. necessary for purchase or rental

from CONCESSIONAIRE needed by ORGANIZATION for sale of beer

and/or wine and/or spirits, and

h--Uniform signage and booth decorations as reqlured by

": CONCESSIONAIRE, and

Other miscellaneous goods and sevces deemed necessary or incidental to

ORGANIZATIONS sales.

6. GAaNF ) F ,ORAIAIN- In as much as the

ORGANIZATION shall receive all net profits after those expenses indicated berein, the

~CONCESSIONAIRE guarantees that in no event sall ORGANIZATION receive as its

consideration for the services it performs less than fifteen (15%) percent of poss sales,

after sales tax

7DP DN CNRATR - CONCESSIONAIRE and ORGANIZATION are

independent contractors as relating to this agreement CONCESSIONAIRE may,

however, act as an agent for ORGANIZATION only for the purposes of negotiation and

procurement of beer and or wine and~or spirits and the products related to their sales as

10 b RE - The parties hereby agree that cup inventornes are the most

accurate method of comparing usage (sales) to cash turned in ORGAIZATI:ON agrees

that any discrepancy between verified cups received by or credited to the

ORGANIZATION and actual cash remitted by ORGANIZATION to

CONCESSIONAIRE will be deducted from organization's proceeds, unless such

discrepancy is explained to the rrutual satisfacton of the parties, at which tie wn amount

less than the total discrepancy may b0e deducted from the ORGAN1ZATION'S proceeds

by mutual consent oft-he paurtes.

11 ETRIiREEN - The above provisions contain the entire agreement between the

parties and no statement, promise or re-prescntation made by either party or representativ

of either party not contained herein shall be valid or binding

A. Cases Not Warranting Further Action Relative to Other Cases Pending

Before the Commission

EPS was created to identify pending cases which, due to the lower priority of the

issues raised in the matters relative to others presently pending before the Commission, do

no t v, arrant further expenditure of resources. Central Enforcement Docket (CED) evaluates

c:t h incoming matter using Commission-approved criteria, resulting in a numerical rating

for caI(.h case.

Closing such cases permits the Commission to focus its limited resources on more important

cases presently pending before it. Based upon this review, ,ve ha,,e identified cases that

do not v arrant further action relative to other pending matters. 3 .Attachment I to this report

contains summaries of each case, the EPS rating. and the factors leading to assignment of a

low, priority and recommendation not to further pursue the matter.
