Consideration of Rejecting All Bids and Authorization to Re-Advertise and Receive Construction Bids for Traffic Signal Construction at Rancho Viejo Road and Paseo Espada (CIP 15101)

RECOMMENDATION:

By motion:

1. Reject the bids received for Traffic Signal Construction at Rancho Viejo Road and Paseo Espada (CIP 15101); and,

2. Authorize staff to re-advertise and receive construction bids for Traffic Signal Construction at Rancho Viejo Road and Paseo Espada (CIP 15101).

EXECUTIVE SUMMARY:

Staff is recommending that the City Council reject all bids received for the Traffic Signal Construction at Rancho Viejo Road and Paseo Espada Project (CIP 15101) andre-advertise the bid package.

DISCUSSION/ANALYSIS:

On April 21, 2015, the City Council approved the installation of a traffic signal at Rancho Viejo Road and Paseo Espada to enhance pedestrian safety. The construction of a new traffic signal at Rancho Viejo Road and Paseo Espada is included in the fiscal year 15/16 budget as a Capital Improvement Project (CIP 15101 ). Plans and specifications were prepared and staff advertised for a bid opening that was held on January 21, 2016. Five bids were received and Unique Performance Construction, Inc. was the low bidder at $294,000.

The project specifications required the Contractor to possess both an 'A' contractor's license and a C-1 0 electrical contractor's license. A 'C-1 0' contractor's license is a specialty license for electrical work. A 'C-1 0' electrical contractor's license is required for traffic signal installations because these projects include substantial electrical work. Prior to the bid, Unique Performance Construction, Inc. contacted staff and asked for clarification about the need for both licenses and if a subcontractor could possess the required 'C-1 0' license.

Staff's explanation was interpreted by Unique Performance Construction, Inc. as not requiring the possession of both licenses. Unique Performance Construction, Inc. does not possess both licenses, and that is reflected in their bid. Staffs explanation was not issued as an official addendum to the project specifications.

Staff recommends rejecting all bids and re-bidding the project, as authorized by Public Contract Code section 22038, to avoid potential protests from either Unique Performance Construction, Inc. as the low bidder or from the other four bidders who did not receive an addendum to the project specifications. Staff will revise the specification to clarify the contractor licensing requirements.

FISCAL IMPACT:

Rejection of the bids will incur minor cost to re-advertise the project.

ENVIRONMENTAL IMPACT:

This project has been reviewed in accordance with the California Environmental Quality Act. The City's Environmental Administrator has determined that the project is exempt from environmental review pursuant to CEQA Guidelines Section 15061(b) (3).

PRIOR CITY COUNCIL REVIEW:

Not applicable.
