To present to the Regulatory Committee an application from Roaming Scotland for exemption from Standard Condition 16(6) relating to the display of “Pre Booked Hire Only” door signs and private hire car vehicle plates. It also seeking approval under condition 17.2 to allow advertising of Roaming Scotland on more than just the rear doors of the vehicle. CLACKMANNANSHIRE COUNCIL

Report to Regulatory Committee

Date of Meeting: 5 March 2019

Subject: Application for Exemption from Private Hire Car Operator Standard Licence Conditions

Report by: Regulatory Services Manager

1.0 Purpose

1.1. The vehicle is to be used exclusively as a tour vehicle for Roaming Scotland.

2.0 Recommendations

2.1. That the Committee permits an exemption for Roaming Scotland for their Private Hire Car from Condition 16(6) relating to door signs and vehicle plates, attaches alternative conditions relative to its use only as a tour vehicle and permits the advertising of the company name in accordance with the example submitted by the company.

3.0 Considerations

3.1. Roaming Scotland operates a Volkswagen Transporter Shuttle vehicle for use by their business as a specialist tour vehicle. Most of these journeys are exempt from the need to have a Private Hire Licence but some shorter journeys and airport transfers, made as part of the business, do require a licence.

3.2. The company advise that the door signs and vehicle plates attached to the vehicle under the standard conditions detract from specialist use of the vehicle in connection with their business as a tour operator.

3.3. Roaming Scotland have had discussions with the Civic Licensing Standards Officer (CLSO) who has determined that the services operated by them are distinct from other private hire car services. The distinction is primarily that the vehicle is being used to transport clients in connection with the tour operator business only. There are no cash payments for hires, the vehicles operate directly from and return to the registered

business address for each journey and a minimum hire charge of £30 is applied to all journeys.

3.4. The “Pre Booked Car Hire” signs on the front doors of the vehicle could be considered erroneous given the operating model which is outlined fully in the applicant’s letter. The vehicles are not likely to be mistaken for a taxi in the circumstances they will be used and the alternative display of PHC vehicle plates further reduce that possibility. The CLSO will present alternatives to the standard PHC vehicle plate display to the Committee.

3.5. Conditions relating to the exclusive use of the vehicles for tour operations can be applied, examples are given at Appendix A to the CLSO’s report.

Civic Government (Scotland) Act, 1982 Private Hire Car Operator Licence Application Martin Haworth, Trading as Roaming Scotland. Exemption from Licence Standard Conditions No 16(6) & Application for Approval for Vehicle Advertising Signage.

1. This report relates to an application for a private hire car operators licence, made by Martin Haworth, trading as (sole trader) Roaming Scotland. Roaming Scotland is a specialist tour operator; the full details of the business can bee seen in the accompanying documentation and on the website https://www.roamingscotland.com.

2. The application seeks to licence a Volkswagen Transporter Shuttle vehicle, to carry 8 passengers for hire and reward as a private hire car.

3. The vehicle is a 2017 model, and is, subject to a safety inspection, a vehicle which is suitable for use as a private hire car in accordance with the Clackmannanshire Council, Licence Standard Conditions.

4. The application is accompanied by a letter seeking, on grant of the licence, to have the Licence Standard Conditions varied to remove condition No 16(6), as it relates to required “pre booked hire” door signage and the position of the required external plates.

5. The reasons for the request for the variation are set out in the letter that accompanies the application.

6. Mr Haworth is also seeking in his application pre-approval in the terms of Condition No 17.2 of the Clackmannanshire Council Licence Standard Conditions, Taxi and Private Hire Car Operator, to apply a full vehicle side advertising area to his vehicle. The advertising will be restricted to his own company logo, and sympathetic graphics along with the contact details of his business and website. It is anticipated that prior to any hearing in relation to this matter Mr Haworth will have prepared an artists impression of the proposed design for approval. Mr Haworth’s covering letter explains the purpose of the request for an enlarged advertising area and I in the specific circumstances of this application and the nature of the business I can see no difficulty with his proposal.

7. Prior to submitting this application, the applicant engaged in lengthy discussions with the Civic Licensing Standards Officer in relation to the variation sought.

8. Having carried out enquiries and in liaison with Mr Haworth, I am satisfied that Roaming Scotland are a legitimate, well established, and genuine specialist tour service that differs significantly from the usual day to day operation of a normal private hire car operator in Clackmannanshire. The majority of the business of the applicant relates to long term

15

contract exclusive hires of over 24 hours, which are currently exempt from the licensing requirements. However some shorter journeys and airport transfers carried out by the business are not exempt and can only be made by a licensed driver in a licensed vehicle.

9. Should this application be granted, I would suggest that the use of gold identification plates securely fitted in an agreed internal position in the vehicle would be adequate to ensure that the vehicle can still be readily identified as a currently licensed private hire car.

10. The Regulatory Committee, in determining this application may wish to consider whether or not it is necessary to impose local conditions which would prevent the use of the vehicle as a “normal” private hire car for frequent, short and local journeys. A restriction such as local condition imposing a minimum fare may be an option. If applied it would be desirable that this was an exclusive local condition, thus preventing the vehicle being used for any type of local, short, low fare type journeys.

11. In the event that variation sought is granted and it is later identified that the vehicle is being used as a “normal” private hire car, then the Regulatory Committee would also have the option of varying the conditions of the Operators Licence to reinstate the Standard Conditions in full. Schedule 1, paragraph 10 of the Civic Government (Scotland) Act, 1982, explains this process which allows the Regulatory committee to vary the conditions of a licence at any time and on any grounds it thinks fit.

12. An example of what may be suitable local licence condition is contained at appendix A. The Committee may wish to apply all or some of these conditions in the event that the licence and variation is granted.

13. I have no concerns about this application.

Appendix A 1 A record of all journeys/hires relating to the use of the licensed vehicle will be kept by the operator who must make these records available on request for inspection by the Civic Licensing Standards Officer, an authorised officer of the Licensing Authority or a Police Constable. 2 All arrangements made to hire the vehicle must be made in advance of the journey commencing. A minimum fare of £30 will be applied to any hire. 3 The gold rear plate supplied by the licensing Authority must be securely and permanently fitted in such a position inside the rear luggage area of the vehicle so that it can be easily shown to the Civic Licensing Standards Officer, an authorised officer of the Licensing Authority or a Police Constable. 4 The gold front plate will be displayed at all times whilst the vehicle is being used as a private hire car in a positon on the front nearside, lower portion of the front windscreen so that it is clearly visible and legible from outside the vehicle.
