Note—In a communication received by the Secretary-

General of the United Nations on 2 July, 1974, the Government of the United States of America made the following statement:

" The Government of the United States of America . . . states its objection to reservations with respect to paragraph 3 of Article 27 by Bahrain [see Treaty Series No. 93 (1971), Cmnd. 4911, page 6]; with respect to paragraph 4 of Article 27 by Kuwait [see Treaty Series No. 129 (1969), Grand. 4272, page 7]: with respect to paragraph 2 of Article 37 by the United Arab Republic (now the Arab Republic of Egypt) [see Treaty Series No. 19 (1965), Cmnd. 2565, page 113], by Cambodia (now the Khmer Republic) [see Treaty Series No. 98 (1965), Cmnd. 2897, page 5] and by Morocco [see Treaty Series No. 106 (1968), Cmnd. 3861, page 4], respectively. The Government of the United States, however, considers the Convention as continuing in force between it and the respective above-mentioned States except for the provisions to which the reservations are addressed in each case."

* On ratifying Additional Protocol II the Govern­ ment of the French Republic reaffirmed the declaration made at the time of signature (see Treaty Series No. 123 (1973), Cmnd. 5510, page 5), and subsequently made the following supplementary declaration:

" Le Gouvernement Francais est dispose a cpnsiderer que les engagements qu'il a pris au litre du Protocole No. II annexe au Traite de Denuclearisation de I'Amerique Latine, s'appliquent non seulement aux Parties signataires du Traite, mais egalement aux territoires pour lesquels 1'engagement d'appliquer le statut de denuclearisation, conformement a 1'article 1 du Protocole No. I, sera en vigueur."

Translation—The French Government considers that the obliga­

tions it has assumed under Additional Protocol II to the Treaty for the denuclearization of Latin America apply not only to the Parties signatory to the Treaty but also to the territories for which the undertaking to apply the statute of denuclearization, in accordance with Article 1 of Protocol I, is in force.

* On depositing their instrument of ratification in London the Government of Italy confirmed the statement made at the time of signature of the Treaty (see Treaty Series No. 13 (1973), Cmnd. 5266, page 12).

Note—In a Note to the Government of India dated

4 October, 1973, the Government of the United States of America, referring to the statement by India on depositing their instrument of accession to the Treaty on 20 July, 1973 (see Treaty Series No. 123 (1973), Cmnd. 5510, page 8), commented as follows:

" It is the understanding of the Government of the United States of America that the position of the Government of India expressed in the Ambassador's statement is based on the premise that the Treaty does not affect the rights of States under existing international law with respect to activities not prohibited by the Treaty. The Government of the United States concurs in this premise and takes the view that any and all rights existing under inter­ national law prior to the conclusion of the Treaty and not falling within its prohibitions remain unaffected. Note is taken of the fifth preambular paragraph of the Treaty, which reads as follows:

' Convinced that this Treaty will further the purposes and principles of the Charter of the United Nations, in a manner consistent with the principles of international law and without in­ fringing the freedoms of the high seas, . . .' " In addition, the Government of the United

States wishes to state its view that under existing international law the rights of coastal States over their continental shelves are exclusive only for purposes of exploration and exploitation of natural resources, and are otherwise limited by the 1958 Convention on the Continental Shelf [Treaty Series No. 39 (1964), Cmnd. 2422] and other principles of international law."

In their reply to the above Note the Government of India, in a communication dated 30 January, 1974, stated as follows:

"The position of the Government of India regarding the nature of rights enjoyed by a coastal State on and in relation to its continental shelf has already been explained in its statement of 20 July, 1973. In the view of the Government of India, the position expressed in that statement conforms to international law. It is, therefore, the belief of

In a further Note dated 7 June, 1974, the Govern­ ment of the United States of America informed the Government of India that " the views of the Government of the United States of America on this matter remain as previously stated in [their] Note to the Ambassador of India dated October 4, 1973 ".

Translation—In accordance with Article 27 (3) of the Convention,

the Japanese Government declare that they intend to retain until 31 December, 1980, the benefit of the reservations which they previously formulated, that is, they intend to remain bound, as regards the exclusive right of authors to make or to authorise the translation of their works as envisaged in Article 8 of the said Convention, by the provisions of Article 5 of the Berne Convention of 9 September, 1886, as modified by Article 1 (3) of the Additional Act signed at Paris on 4 May, 1896.

on the Territorial Sea and the Contiguous Zone andto Article 9 of the Convention on the High Seas.The Government of the United States, however,considers those Conventions as continuing in forcebetween it and the German Democratic Republicexcept that provisions to which the above-mentionedreservations are addressed shall apply only to theextent that they are not affected by thosereservations."In a communication received by the Secretary-

General of the United Nations on 15 July, 1974, theGovernment of the Federal Republic of Germanyreferred to their ratification on 26 July, 1973 of theConvention on the High Seas, 1958 and the OptionalProtocol of signature concerning the CompulsorySettlement of Disputes (see Treaty Series No. 123(1973), Cmnd. 5510, page 13) and made the followingstatement:

" The Government of the Federal Republic ofGermany considers the following reservations to beinconsistent with the aims and purposes of theConvention of 29 April, 1958 on the High Seasand therefore to be unacceptable:

1. The reservation made to the Convention bythe Government of Indonesia [see TreatySeries No. 93 (1974), Cmnd. 4911, page 12];

2. The reservation declared at signature of theConvention by the Government of Iran toArticles 2, 3 and 4 and to Article 2, item 3,in conjunction with Article 26, paragraphs 1and 2, of the Convention, the latter in so faras that reservation is to open up the possibilityof refusing permission to lay submarine cablesand pipelines even where certain conditionshave been fulfilled;

3. The reservations and declarations to bequalified in substance as reservations madeto Article 9 of the Convention by theGovernments of Albania [see Treaty SeriesNo. 48 (1965), Cmnd. 2683, page 9], Bulgaria,Mexico [see Treaty Series No. 79 (1966),Cmnd. 3264, page 7], Poland, Romania, theUnion of Soviet Socialist Republics, theByelorussian Soviet Socialist Republic, theUkrainian Soviet Socialist Republic, Czecho­slovakia and Hungary;

4. The declarations made by the Governmentsof Albania, Bulgaria, Poland, Romania, theUnion of Soviet Socialist Republics, the Byelo­russian Soviet Socialist Republic, the UkrainianSoviet Socialist Republic, Czechoslovakia andHungary to the definition of piracy as givenin the Convention in so far as the saiddeclarations are to be qualified as reservations.

The Government of the Federal Republic ofGermany furthermore considers the reservation madeon 27 December, 1973, by the German DemocraticRepublic to Article 9 of the Convention [see TreatySeries 40 (1974), Cmnd. 5759, page 15] to be in­consistent with the aims and purposes of theConvention and therefore to be unacceptable.

This also applies to the declaration made by the Government of the German Democratic Republic on the same date to the definition of piracy as given in the Convention in so far as that declaration is to be qualified as a reservation.

The present declaration does not affect the applic­ ability, in all other respects, of the Convention under international law as between the Federal Republic of Germany and the Parties to the Convention having made the reservations and declarations referred to above."

Notes—In communications dated 31 January, 1974, the

Government of the German Democratic Republic notified the Government of Belgium of the re- application of the 1910 Conventions, with effect from 27 December, 1954, and the 1924 Convention with effect from 17 July, 1958.

In informing other States panics to the Conventions of the above declarations the Government of Belgium stated that it should not be regarded as implying any view on the part of the Government of Belgium as to the date on which the Conventions became effective for the German Democratic Republic.

In a communication dated 31 May, 1974 and received on 18 June, 1974, the Government of Singapore declared that they consider themselves bound as from 9 August, 1965, the date of their independence, by the above three Conventions, which were applied to their territory before the attainment of independence.

In informing other States parties to the Convention of the above declaration, the Government of the United Kingdom stated that it should not be regarded as implying any view on the part of the Government of the United Kingdom as to the date on which the Convention together with supplement became effective for the German Democratic Republic.
