• All rates contained herein are net as shown. Agency commis-sions and further discounts apply when noted. Agencies not eligible for certain discounts.• A signed agreement enables advertisers to earn other than the open rate and to qualify for additional discounts. All agree-ments are based on the condition that space or insertion agree-ments are achieved in the contracted period.• The Herald cannot accept display advertising less than one modular unit.•Any discounted programs are not eligible for additional dis-counts.• Publisher will not be bound by any terms or conditions, print-ed or otherwise, appearing on order blanks advertiser’s forms or copy instructions when in conflict with terms and conditions on publisher’s rate card or with Herald policies. • The word “ADVERTISEMENT” must be printed on any ad resem-bling reading matter.• The Titusville Herald shall not be liable for damages arising our of errors in advertisements beyond the amount of paid insertion or space actually occupied by that portion of the advertisement in which the error occurred, and there shall be no liability for non-insertion of any advertisement beyond the amount paid in advance for such advertisement. The Titusville Herald reserves the right to revise, reject, or cancel any adver-tisement.• Advertiser represents and warrants that all statements con-tained in copy submitted by advertiser are true, and the adver-
tiser agrees that it will hold harmless the Publisher from liabil-ity, including reasonable attorneys' fees and other costs of defense arising from any actions or claims for libel, slander, disparagement, trade libel, invasion of privacy, or other causes of action resulting from the publication of the advertiser's copy.• The Titusville Herald shall not be liable for failure to print, publish or circulate any/all parts of an issue in which an ac-cepted advertisement is contained if failure is due to acts of God or government, strikes, accidents, lack of newsprint or cir-cumstances beyond the control of the Herald.• Advertisers and advertising agencies will indemnify and hold harmless The Titusville Herald, its officers, agents, employees and contractors for all contents supplied to the publisher – in-cluding text, representations, illustrations of advertisements printed, and for any claims arising from the contents, including, but not limited to, defamation, invasion of privacy, copyright infringement and plagiarism.• Position is neither sold nor guaranteed except for the back pages and lead-off pages(when available) at a 15% extra charge. No refunds will be made due to the position in which ad appeared, and no order will be accepted on a “position or omit” basis.
