AUCTION-CUM-TENDER DOCUMENT FOR DISPOSAL OF OLD AND CONDEMNED MACHINERIES/SCRAPS IN “AS IS WHERE IS CONDITION” IN TANTEA FACTORIES Sealed tenders, superscribed as "Tenders for purchase of old condemned

Tea Machineries/Scraps” are invited from the (*) Registered contractors for the purchase

of old condemned Tea machineries listed out in the schedule enclosed,” as is where is

condition” subject to the following conditions so as to reach this office on or before 10.30

AM on 28.12.2018.

GENERAL CONDITIONS

1. ELIGIBILITY FOR PARTICIPATION IN THE TENDER:-

i) The tenderers should be a Registered Contractor (*) of the Corporation.

2. SUBMISSION OF TENDERS:-

(i) If the tender is made by an individual, it should be signed by the individual with his full

name. If it is made by a proprietorship firm, it should be signed by the Proprietor with his

full name. In case of partnership firm, the tender should be signed by the Managing

Partner or any one of the Partner of the firm with his full name. If the tenderer is a

Company, the tender should be signed by the Chief Executive or by the authorized

signatory who shall produce the evidence of the authorization along with the tender. Filled

in Tender form along with required E.M.D shall be received by TANTEA upto 10.30 A.M.

on 28.12.2018.

(ii) Tenders should be given in 2 sealed covers as follows:-

(a) First cover should contain the Earnest Money Deposit as noted in clause 4 below, the

authorization letter to participate in the Tender-cum-auction and other details noted in the

pre-qualification tender form. The cover should be superscribed as “Pre-qualification

tender for the purchase of old condemned Tea Machineries/scraps.”

(*) NOTE: The Tenderers who have not registered their names should register their

names before offering the tenders by paying the Registration fee of Rs 2,000/- (Rupees

two thousand only) in the Form of Demand Draft, otherwise their tender will be rejected.

(b) The second cover should contain the commercial tender with Security Deposit as

noted in clause 5 below and it should be superscribed as “Commercial tender for

purchase of old condemned machineries”. The commercial tender should be in the form

enclosed.

(c) The above two covers should be properly sealed, superscribed and kept in a single

general cover which should be superscribed as "Tender for purchase of old condemned

machineries/scraps". The general cover should be closed, sealed and addressed to the

Managing Director, TANTEA, TANTEA Complex, Coonoor- 643 101, Tamil nadu.

(iii) The Corporation does not take any responsibility for the tenders received without such

superscription and being opened even before the due date.

(iv) The Corporation takes no responsibility for delay or loss or non-receipt of the tender

documents sent by post nor will any request for extension of time for submitting tenders

be considered on any account.

(v) The tenderer should quote their rate in the form enclosed. The rate should be

exclusive of Sales Tax etc., and for taking delivery of the scrap from the Units or the

Corporation. The TCS, duties & other levies etc., will be charged as per the Government

rules.

(vi) Any scoring or overwriting in the rates should be attested by the tenderer with full

signature. The rates should be firm and should not be subjected to any variation clause.

(vii) The rates to be quoted should be valid for 90 days from the date of opening of the

tender.

(viii) Any tender once submitted shall remain in full form as submitted, not withstanding

any modification, correction or cancellation made or attempted to be made in respect

thereof by the tenderer or on his behalf, whether on the ground of mistake or otherwise

and any acceptance by the Corporation of the tender as originally submitted or any part

thereof shall be binding upon the tenderer.

3. OPENING OF TENDERS:-

(i) Tenders received within the scheduled time will be opened as detailed below at 11.00

A.M. on 28.12.2018 in the presence of the representatives of the tenderers who may

be present at that time. The authorized representatives should produce valid

authorization letter to participate in the opening of the tenders.

(ii) First, the envelope containing the pre-qualification tender will be opened. If any

tenderer has indicated/included the price details also in the above envelope or if he has

failed to produce Earnest Money Deposit as noted in clause 4 below the tender will

be rejected.

(iii) Then the commercial tenders of the tenderers whose pre-qualification tenders were

accepted will be opened. The commercial tender without security deposit as noted in

clause 5 below will be rejected.

(iv) Finally, an auction will be conducted and the tenderers/the authorized representatives

of the tenderers who have paid the Security Deposit along with their commercial tenders

will only be allowed to participate in the auction. The rate offered by the authorized

representative of the tenderer in the auction sale will be binding on the respective

tenderer.

4. EARNEST MONEY DEPOSIT:-

(i) Each prequalification tender should be accompanied by an Earnest Money Deposit of

Rs.20,000/-(Rupees twenty thousand only) in the form of Demand Draft drawn on any

nationalized bank in favour of the Managing Director, Tamilnadu Tea Plantation

Corporation Limited payable at Coonoor.

(ii) Tenders without the Earnest Money Deposit will be summarily rejected provided that

any category of tenderers specifically exempted by the Government from the payment of

Earnest Money Deposit will not be required to make such a deposit. However, they should

produce the relevant Government orders as noted in clause(6) below.

(iii) The Earnest Money Deposit will be refunded in the case of unsuccessful tenderers on

application after the rejection of the tenders.

5. PAYMENT OF SECURITY DEPOSIT AND SALE VALUE:

(i) The commercial tender should be accompanied by the Security Deposit in the form of

Demand Draft drawn on any Nationalized Bank in favour of the Managing Director,

Tamilnadu Tea Plantation Corporation Limited, payable at Coonoor for an amount equal

to 25% of the amount quoted by him in the tender for each machinery and it should not be

less than the Earnest Maoney Deposit amount.

(ii) The auction will be conducted from the highest tendered rate and the tenderers who

have paid 25% of the highest tendered rate as “Security Deposit” will only be allowed to

bid in the auction. The Security Deposit already paid along with the commercial tender will

be adjusted against the above Security Deposit(i.e.25% on the highest tendered rate) and

the balance amount of Security Deposit should be paid by cash or Demand Draft before

participating in the auction.

(iii) At the time of auction, the highest auctioner should pay the additional Security Deposit

calculated @ 25% of his highest bid amount less the Security Deposit and Earnest Money

Deposit already paid by him as per clause 4 and 5(1) above, failing which, the Security

Deposit and Earnest Money Deposit paid along with the tender shall be forfeited

immediately and re-auction will be conducted. The defaulter will not be allowed to

participate in the re-auction.

(iv) If the highest rate is not accepted, the Secuirty Deposit/Earnest Money Deposit will be

refunded.

(v) If the highest rate is accepted, the Security Deposit will be adjusted against the Sale

value and the balance 75% of the sale value together with taxes should be remitted within

7 days from the date of receipt of confirmation order.

(vi) If the successful tenderer fails to remit the 75% amount and caution deposit within 7

days from the date of receipt of the confirmation order, the Earnest Money Deposit and

Security Deposit(i.e.25% amount) will be forfeited and further action as deemed fit will be

taken against the defaulter.

6. INSPECTION OF SCRAP MATERIALS AND PLACE OF DELIVERY:

(i) The intending tenderer shall take all necessary precautions to satisfy themselves as to

the conditions of the machinery, existing means of communications, the distance involved

and the exact place where the machineries are available. Every Tenderer is expected,

before quoting the rate, to inspect the place where the Machineries are available.

(ii) The details of the machineries offered for sale are given in the schedule. The scrap

offered for sale can be inspected by the tenderers at Units of the corporation on all

working days during working hours with the permission of the Unit Officers concerned.

The machineries are offered for sale in “as is where is” basis.

7. DELIVERY OF THE MACHINERY:

(i) After remitting the full sale value together with taxes etc, the delivery orders will be

issued.

(ii) The purchaser should take delivery of the old condemned machineries within 30 days

from the date of receipt of the delivery order. If the purchaser fails to take delivery of the

old condemned machineries within the stipulated time, a daily ground rent at the rate of

2% of the accepted value of the old condemned machineries will be levied by the

Corporation, as its discretion.

8. ACCEPTANCE/REJECTION OF TENDERS:

(i) The Corporation reserves the right to reject any or all of the tenders without assigning

any reasons therefore and to split up the tender, as it may deem fit, with the tenderers in

any manner considered beneficial to the Corporation and relax any or all of the tender

conditions in favour of any tenderer in the interest of the Corporation.

(ii) Nothing contained herein shall affect the rights of the Corporation at any stage to

cancel the sale and/ or withhold delivery of the old condemned machineries without

assigning any reason therefor.

9.RESOLVING DISPUTES:

The courts in the Nilgiris will alone have jurisdication to entertain any suit (or)

dispute that may arise between the parties.
