LOCAL GOVERNMENT ACT 1999

Regulations by the Local Government Superannuation Board

THE Local Government Superannuation Board makes thefollowing regulations pursuant to Part 2 of Schedule 1 of the LocalGovernment Act 1999.

The rules constituting the Local Government SuperannuationScheme known as Local Super are amended with effect from1 June 2003 as follows:

1. Rule 2 (a) is amended by inserting a definition of ‘AllocatedPension’ immediately after the definition of ‘Additional TransferValue’ as follows:

‘Allocated Pension means a pension that satisfies thestandards set out in regulation 1.06 (4) of the SuperannuationIndustry (Supervision) Regulations.’

2. A new Rule 75 (d) is inserted immediately after Rule 75 (c)as follows:

‘(d) On and from 1 June 2003 a Member who is entitled to anAllocated Pension may elect by notice in writing to theBoard (which notice may be received by the Boardbefore 1 June 2003), in a form approved by the Board, tohave the Member’s pension payments made bycancellation of Units in one or more of the InvestmentPortfolios to which the Member’s Allocated Pensionbenefit is applied in the proportions selected by theMember. The Board must give effect to a Member’selection made pursuant to this Rule 75 (d) as soon as isreasonably practicable after written notice of the electionhas been received. If a Member does not make anelection pursuant to this Rule 75 (d) or if at any time theBoard is unable to implement the Member’s election thepension payments will be made by cancellation of Unitsin one or more of the Investment Portfolios to which theMember’s Allocated Pension benefit is applied inproportions determined by the Board.’

3. Rule 87 (e) is amended by deleting the last paragraph andsubstituting the following:

‘the Board must allocate assets of the Fund representing thosebenefits to notional Units:

(iv) in respect of the period while the Member remains inthe Service of a Council—in the Growth Portfolio; and

(v) in respect of the period immediately following theMember’s cessation of service and prior to any otherprovision of these rules applying to the investment ofthe Member’s benefit—as follows:

(A) if and while the Member is under age 55 years—to the Growth Portfolio;

(B) if and while the Member is at least age 55 yearsbut is under age 60 years—to the ConservativeGrowth Portfolio;

(C) if and while the Member is at least 60 years—tothe Cash Portfolio.’

4. A new Rule 87 (ea) is inserted immediately after Rule 87 (e)as follows:

‘(ea) Notwithstanding any election made by a Memberunder these rules or the application of Units in respectof benefits required by any other provision of this Rule87, upon the Board being notified of the death of aMember the Board must switch all Units (includingnotional Units) representing the Member’s deathbenefit to Units in the Cash Portfolio with effect fromthe earlier of:

(i) the date when the Board receives from a Councilnotice in a form prescribed by the Board of thedeath of the Member; and

(ii) the date when the Board receives notice of theMember’s death by way of certified copy of thedeath certificate for the Member.’

5. Rule 87 (f) is amended by deleting the last paragraph andsubstituting the following:

‘the Member is deemed to have elected:

(iii) for the period up to 1 June 2003—to apply such all orpart of the then balance (as the case may be) of theirMember’s Credit and the other amounts referred tounder Rule 87 (a) (including any future contributionsto be applied to the Member’s Credit or otheramounts) to the Growth Portfolio; and

(iv) for the period from 1 June 2003—to apply such all orpart of the then balance (as the case may be) of theirMember’s Credit and the other amounts referred tounder Rule 87 (a) (including any future contributionsto be applied to the Member’s Credit or otheramounts) as follows:

(A) if and while the Member is under age 55 years—to the Growth Portfolio;

(B) if and while the Member is at least age 55 yearsbut is under age 60 years—to the ConservativeGrowth Portfolio;

(C) if and while the Member is at least 60 years—tothe Cash Portfolio.’

NOTICE is hereby given pursuant to section 6 (2) of the NationalElectricity Law, which forms the Schedule to the NationalElectricity (South Australia) Act 1996, and clause 8.3.9 (d) of theNational Electricity Code approved under section 6 of theNational Electricity Law, that amendments are made to clauses3.7.2, 3.7.3 and 3.13.3 and new clause 3.7A is inserted in Chapter3 of the National Electricity Code. These amendments to theNational Electricity Code are introduced to improve marketinformation and commence on 31 January 2003.

As required by clause 8.3.9 (d) of the National Electricity Code,a copy of the ACCC’s letter granting final authorisation dated 3October 2002 is set out below.

Closure of the Gawler Ranges National Park

PURSUANT to Regulation 8 (3) (d) of the National ParksRegulations 2001, I, Edward Gregory Leaman, the Director ofNational Parks and Wildlife, close to the public the whole of theGawler Ranges National Park from sunrise on Sunday, 2 March2003 until sunset on Saturday, 8 March 2003.

The purpose of the closure is to ensure the safety of the publicduring a feral animal-culling program within the reserve duringthe periods indicated.

Use of Firearms within the Reserve

Pursuant to Regulations 8 (4), 20 (1) and 41 of the NationalParks Regulations 2001, I, Edward Gregory Leaman, the Directorof National Parks and Wildlife grant permission to members of theSporting Shooters Association of Australia (South AustralianBranch) in possession of both a current Hunting Permit and afirearm to enter and remain in the Gawler Ranges National Parkfrom sunrise on Sunday, 2 March 2003 until sunset on Saturday, 8March 2003, for the purpose of taking feral animals.

Preamble

1. A seat of a member of the Legislative Council has become vacant by resignation of theHonourable Michael John Elliott, M.L.C.

2. A person must be chosen to occupy the vacant seat by an assembly of the members of both Housesof Parliament.

3. It is necessary to make provision in relation to the constitution and proceedings of that assembly.

Short title1. This proclamation may be cited as the Constitution (Legislative Council Casual Vacancy)

Proclamation 2003.

Commencement2. This proclamation comes into operation on the day on which it is made.

Provisions relating to the assembly of members3. The following provisions apply in relation to the constitution and proceedings of an assembly of

the members of both Houses of Parliament to choose a person to occupy the vacant seat in theLegislative Council caused by the resignation of the Honourable Michael John Elliott, M.L.C.:

(a) the assembly will meet at 12.30 p.m. on Monday, 17 February 2003, at the Legislative CouncilChamber;

(b) the Honourable Ronald Roy Roberts, M.L.C., is appointed to preside over the assembly;

(c) Janice Maxine Davis is appointed to be clerk of the assembly;

(d) the following rules are to be observed at the assembly and applied as the method by which thedecision of the assembly will be evidenced:

(i) the presiding officer will take the chair;

(ii) the clerk of the assembly will read this proclamation;

(iii) the presiding officer will invite nominations for the vacant seat from the members ofthe assembly;

(iv) nominations will first be made without debate;

(v) a nomination will not be accepted by the presiding officer unless—

(A) the nomination is seconded; and

(viii) the presiding officer will announce to the assembly the name of the person chosen tooccupy the vacant seat;

(ix) the President of the Legislative Council must be informed in writing of the decision ofthe assembly and notice of the decision must be published in the Gazette.

Commencement2. These regulations will come into operation on 1 March 2003.

9B. Speed-limit applying in built-up areas(1) Despite anything in Part 3 of the Rules (Speed-limits), a driver must not drive a

vehicle on any length of road in a built-up area at a speed exceeding 50kilometres per hour unless a speed-limit sign indicating a number higher than 50applies to that length of road.

Maximum penalty: $1 250.

(2) Nothing in subregulation (1) authorises the driving of a vehicle on a length ofroad at a speed exceeding any lower speed-limit applying to the driver of thevehicle on that length of road by virtue of the Rules or another law of the State.

DEVELOPMENT ACT 1993

Seasonal Workers Accommodation Plan Amendment Reportprepared by the Council for Public Consultation

NOTICE is hereby given that the Naracoorte Lucindale Councilhas prepared a draft Plan Amendment Report dealing with theissues associated with seasonal workers accommodation and themanner in which it is provided across the council area.

Matters addressed in the draft Plan Amendment Report include:

• The inclusion of new council-wide policies and designcontrols that are specific to development of workersaccommodation.

• The adjustment of existing Residential, Country Township,Town Centre Zones to accommodate suitable forms ofmedium density housing and to support the provision ofworkers accommodation.

• Updating the provisions of the Commerce/Industry Zone toallow workers accommodation to be established in theNaracoorte Showgrounds and Smith Street Bowling Club.

• Updating the three rural zones to support the establish-mentof temporary forms of workers accommodation which areintended to house workers in association with primaryproduction as well as specific infrastructure or short termdevelopment projects.

• The inclusion of a ‘hostel’ as a Category 2 form ofdevelopment in appropriate zones such as the ResidentialZone, Country Township Zone, and the three existing ruralzones.

The draft Plan Amendment Report and Statement of Investi-gations will be available for public inspection and purchase for$10 a copy during normal working hours at Council’s Offices, 91Ormerod Street, Naracoorte.

The Plan will be on display from 6 February 2003 to 7 April2003.

Written submissions regarding the draft amendment should belodged no later than 5 p.m. on 7 April 2003. BY-LAW MADE UNDER THE LOCAL GOVERNMENT ACT 1999

By-law No. 1—Permits and Penalties

TO provide for a permit system and continuing penalties inCouncil by-laws, to clarify the construction of such by-laws, andto repeal by-laws.

A. All previous by-laws made or adopted by the Council, prior tothe date this by-law is made, are hereby repealed effective fromthe day on which this by-law comes into operation.

Permits

1. (1) In any by-law of the Council, unless the contrary intentionis clearly indicated, the word ‘permission’ means the permissionof the Council given in writing.

(2) The Council may attach such conditions to a grant ofpermission as it thinks fit, and may vary or revoke such conditionsor impose new conditions by notice in writing to the permit holder.

(3) Any permit holder shall comply with every such condition.

(4) The Council may revoke such grant of permission at anytime by notice in writing to the permit holder.

Offences and Penalties

2. (1) Any person who commits a breach of any by-law of theCouncil shall be guilty of an offence and shall be liable to amaximum penalty being the maximum penalty referred to in theLocal Government Act 1999, that may be fixed by by-law for anybreach of a by-law.

(2) Any person who commits a breach of any by-law of theCouncil of a continuing nature shall be guilty of an offence and, inaddition to any other penalty that may be imposed, shall be liableto a further penalty for every day on which the offence iscontinued, such penalty being the maximum amount referred to inthe Local Government Act 1934, as amended, and/or LocalGovernment Act 1999, which may be prescribed by by-law foroffences of a continuing nature.

Construction

3. Every by-law of the Council shall be subject to any Act ofParliament and Regulations made thereunder.

The foregoing by-law was duly made and passed at a meeting ofthe District Council of Peterborough held on 20 January 2003, byan absolute majority of the members for the time beingconstituting the Council, there being at least two-thirds of themembers present.

By-law No. 2—Moveable Signs

TO set standards for moveable signs on streets and roads and toprovide conditions for and the placement of such signs.

Definitions

1. In this by-law:

(1) ‘footpath area’ means that part of a street or roadbetween the property boundary of the street or road andthe edge of the carriageway on the same side as thatboundary; and

(2) ‘moveable sign’ has the same meaning as in the LocalGovernment Act 1999.

Construction

2. A moveable sign displayed on a public street or road shall:

(1) be of a kind known as an ‘A’ Frame or Sandwich Boardsign, an ‘inverted “T”’ sign, or a flat sign;

(2) be well constructed and maintained in good condition soas not to present a hazard to any member of the public;

(3) be of strong construction so as to be stable when inposition and to be able to keep its position in adverseweather conditions with no sharp or jagged edges orcorners;

(4) not be unsightly or offensive in appearance or content;

(5) not contain flashing parts;

(6) be constructed of timber, metal, plastic or plastic coatedcardboard, or a mixture of such materials;

(7) not exceed 1.2 m in perpendicular height, or have a basewith any side exceeding 800 mm in length;

(8) not have a display area exceeding 1 m2 in total or, if thesign is two-sided, 1 m2 on each side;

(9) be stable when in position;

(10) in the case of an ‘A’ Frame or Sandwich Board sign:

(a) be hinged or joined at the top;

(b) be of such construction that its sides shall besecurely fixed or locked in position when erected;

(11) in the case of an ‘inverted “T”’ sign, contain no struts orsupports that run between the display area and the baseof the sign.

Position

3. A moveable sign shall only be positioned on a public street orroad on the footpath area subject to the following conditions.Where there is no kerb to define the footpath, a set back of400 mm from the edge of the carriageway is required:

(1) in the case of a flat sign, must be in line with and againstthe property boundary of the street or road;

(2) must be no less than 2 m between the sign and anystructure, fixed object, tree, bush or plant (includinganother moveable sign);

(3) must not be placed on a sealed part of any footpath area,unless the sealed part is wide enough to contain the signand still leave a clear thoroughfare at least 1.2 m wide;

(4) not within 3 m of the corner of a street or road;

(5) must be adjacent to the premises of the business to whichit relates.

Restrictions

4. A moveable sign shall:

(1) display material which advertises a business beingconducted on commercial premises adjacent to the sign,or the products available from that business;

(2) be limited to one per business premises;

(3) only be displayed when the business is open;

(4) be securely fixed in position such that it cannot be blownover or swept away;

(5) not be in such a position or in such circumstances thatthe safety of any user of the street or road is at risk;

(6) not be displayed during the hours of darkness unless it isclearly visible;

(7) not to be displayed on a median strip, traffic island or ona carriageway of a street or road.

Exemptions

5. (1) Paragraph 3 (5) and paragraph 4 (1) do not apply to amoveable sign which is used:

(a) to advertise a garage sale taking place from residentialpremises;

(b) as a directional sign to an event run by an incorporatedassociation or a charitable body;

(c) with permission.

(2) Paragraphs 4 (1) and 4 (2) do not apply to a flat sign, themessage of which only contains newspaper head-lines and thename of a newspaper.

Application

6. This by-law does not apply if:

(1) the moveable sign is placed there pursuant to anauthorisation under another Act;

(2) the moveable sign is designed to direct people to theopen inspection of any land or building that is availablefor purchase or lease; or

(3) the moveable sign is related to a State or Common-wealth election and is displayed during the periodcommencing on the issue of the writ or writs for theelection and ending at the close of polls on polling days.

Construction

7. This by-law is subject to any Act of Parliament andRegulations made thereunder.

By-law No. 3—Roads

FOR the management of roads vested in or under the control of theCouncil.

Definitions

1. In this by-law:

(1) ‘authorised person’ means a person appointed anauthorised person pursuant to section 260 of the LocalGovernment Act 1999;

(2) ‘electoral matter’ has the same meaning as in theElectoral Act 1995, provided that such electoral matter isnot capable of causing physical damage or injury to anyperson within its immediate vicinity;

(3) ‘Emergency Vehicle’ has the same meaning as in theAustralian Road Rules 1999 and the Road Traffic (RoadRules—Ancillary and Miscellaneous Provisions) Regu-lations 1999;

(4) ‘road’ has the same meaning as in the Local Govern-ment Act 1999.

Activities Requiring Permission

2. No person shall without permission on any road:

Repairs to Vehicles

(1) perform the work of repairing, washing, painting, panel-beating or other work of any nature on or to any vehicle,provided that this paragraph shall not extend to runningrepairs in the case of breakdown;

Donations

(2) ask for or receive or indicate that he or she desires adonation of money or any other thing;

Preaching

(3) preach or harangue;

Amplification

(4) use an amplifier or other device whether mechanical orelectrical for the purpose of amplifying sound orbroadcasting announcements or advertisements;

Horses, Cattle etc.

(5) ride, lead or drive any horse, cattle or sheep, on anystreet or road in those areas that the Council hasdesignated by resolution;

Camping

(6) camp or remain overnight.

Posting of Bills

3. No person shall, without the Council’s permission, post anybills, advertisements or other papers or items on a building orstructure on a road except for any electoral matter posted on abuilding or structure with the authority of a candidate during thecourse of a Federal, State or Local Government election orReferendum.

Public Exhibitions and Displays

4. No person shall, without the Council’s permission, allow anypublic exhibition or display to occur on a road.

Removal of Animals and Persons

5. (1) If any animal is found on part of a road in breach of aby-law any person in charge of the animal shall forthwith removeit from that part on the request of any authorised person; and

(2) An authorised person may direct any person who isconsidered to be committing or has committed a breach of this by-law to leave that part of the road. Failure to comply with thatdirection forthwith is a breach of this by-law.

Exemptions

6. The restrictions in this by-law do not apply to any PoliceOfficer, Council Officer or employee acting in the course andwithin the scope of that person’s normal duties, or to a contractorwhile performing work for the Council and while acting under thesupervision of a Council Officer, or an emergency worker whendriving an Emergency Vehicle.

Construction

7. This by-law is subject to any Act of Parliament andRegulations made thereunder.

Application of Paragraph

8. Paragraph 2 (5) of this by-law shall apply only in suchportion or portions of the area as the Council may by resolutiondirect in accordance with section 246 (3) (e) of the LocalGovernment Act 1999.

By-law No. 4—Local Government Land

FOR the management of all land vested in or under the control ofthe Council.

Definitions

1. In this by-law:

(1) ‘authorised person’ means a person appointed anauthorised person pursuant to section 260 of the LocalGovernment Act 1999;

(2) ‘electoral matter’ has the same meaning as in theElectoral Act 1995, provided that such electoral matter isnot capable of causing physical damage or injury to anyperson within its immediate vicinity;

(3) ‘Emergency Vehicle’ has the same meaning as in theAustralian Road Rules 1999 and the Road Traffic (RoadRules—Ancillary and Miscellaneous Provisions) Regu-lations 1999;

(4) ‘local government land’ means all land vested in or underthe control of the Council (except streets and roads);

(5) ‘vehicle’ has the same meaning as in the Australian RoadRules 1999.

Activities requiring permission

2. No person shall without permission on any local govern-mentland:

Vehicles Generally

(1) (a) being the driver of a vehicle, fail to obey theindications given by any sign erected by or with theauthority of the Council, for regulating traffic orindicating the direction or route to be followed bytraffic on that land;

(b) drive or propel a vehicle on any part thereof wherethe Council has excluded vehicles generally (or ofthat class) pursuant to section 359 of the LocalGovernment Act 1934;

Trading

(2) (a) carry on the business of selling or offering orexposing for sale any goods, merchandise, com-modity, article or thing; or

(b) set up a van or other vehicle or stall or otherstructure, tray, carpet or device for the purpose ofbuying or selling any goods, merchandise, com-modity, article or thing;

Overhanging Articles

(3) suspend or hang any article or thing from any building,verandah, pergola, post or other structure where it mightpresent a nuisance or danger to any person using localgovernment land;

Entertainers

(4) sing, busk or play any recording or upon any musicalinstrument so as to appear to be for the purpose ofentertaining other persons;

Donations

(5) ask for or receive or indicate that he or she desires adonation of money or any other thing;

Preaching

(6) preach or harangue;

Distribute

(7) give out or distribute to any bystander or passer-by anyhandbill, book, notice or other printed matter, providedthat this restriction shall not apply to any handbill orleaflet given out or distributed by or with the authority ofa candidate during the course of a Federal, State or LocalGovernment Election or to a handbill or leaflet given outor distributed during the course and for the purpose of aReferendum;

Handbills on Cars

(8) place or put on any vehicle any handbill, advertisement,notice or printed matter except for any electoral matterplaced on a vehicle with the authority of a candidateduring the course of a Federal, State or Local Govern-ment election or Referendum;

Amplification

(9) use an amplifier or other device whether mechanical orelectrical for the purpose of amplifying sound orbroadcasting announcements;

Removing Soil etc.

(10) carry away or remove any soil, clay, gravel, sand, timber,stones, pebbles or any part of the land;

Depositing Soil

(11) Deposit any soil, clay, gravel, sand, timber, stones,pebbles or any other matter on the land;

Picking Fruit etc.

(12) pick fruit, nuts or berries from any trees or bushesthereon;

(13) (a) participate in any game, recreation or amusementwhich involves the use of a ball missile or otherobject which by the use thereof may cause or belikely to cause injury or discomfort to any personbeing on or in the vicinity of that land or detractfrom or be likely to detract from another person’slawful use and enjoyment of that land;

(b) play any organised competition sport, as distinctfrom organised social play, in accordance withparagraph 7 of this by-law;

Athletic and Ball Sports

(14) (a) to which this subparagraph applies, in accordancewith paragraph 7 of this by-law, promote, organiseor take part in any organised athletic sport;

(b) to which this subparagraph applies, in accordancewith paragraph 7 of this by-law, play or practice thegame of golf;

Smoking

(15) smoke tobacco or any other substance in any building orpart thereof;

Closed Lands

(16) enter or remain on any part of local government land:

(a) at any time during which the Council has declaredthat the part shall be closed to the public, and whichis indicated by a sign adjacent to the entrance to thatpart;

(b) where the land is enclosed with fences and/or walls,and gates have been closed and locked; or

(c) where admission charges are payable, for thatperson to enter that part without paying thosecharges;

Tents

(17) (except with the Council or other Government authority)erect any tent or other structure of calico, canvass,plastic or similar material as a place of habitation;

Camping

(18) camp or remain overnight;

Fauna

(19) (a) take, interfere with or disturb any animal or bird orthe eggs or young of any animal or bird;

(b) disturb, interfere with or damage any burrow, nestor habitat of any animal or bird; or

(c) use, possess or have control of any device for thepurpose of killing or capturing any animal or bird;

Flora

(20) (a) take, uproot or damage any plant;

(b) remove, take or disturb any soil, stone, wood, timberor bark;

(c) collect or take any dead wood or timber for thepurpose of using the same to make or maintain afire; or

(d) ride or drive any vehicle or animal or run, stand orwalk on any flowerbed or garden plot;

Animals

(21) (a) allow any stock to stray into or depasture therein;

(b) allow any animal to damage any flower bed, gardenplot, tree, lawn or other item or place;

Fires

(22) light any fire except:(a) in a place provided by the Council for that purpose;

or

(b) in a portable barbeque, as long as the barbeque isused in an area that is clear of flammable material;

Fireworks

(23) use, discharge or explode any fireworks;

Swimming

(24) swim or bathe in any pond or lake to which this sub-paragraph 24 applies;

Bridge jumping

(25) jump or dive from any bridge;

Boat Ramps

(26) launch or retrieve a boat to or from any pond or lake towhich this subparagraph 26 applies;

Use of Boats

(27) hire out a boat or otherwise use it for commercialpurposes in any pond or lake;

Toilets

(28) in any public convenience on local government land:

(a) urinate other than in a urinal or pan or defecate otherthan in a pan set apart for that purpose;

(b) smoke tobacco or any other substance;

(c) deposit anything in a pan, urinal or drain that islikely to cause a blockage;

(d) use it for a purpose for which it was not designed orconstructed;

(e) enter any toilet that is set aside for use of theopposite sex except where:

(i) a child under the age of five years accom-panied by an adult person of that other sex;and/or

(ii) to provide assistance to a disabled person;

Cemeteries

(29) comprising a cemetery:

(a) bury or inter any human or animal remains;

(b) erect any memorial.

Posting of Bills

3. No person shall without the Council’s permission post anybills, advertisements or other papers or items on a building orstructure on local government land or other public place except forany electoral matter posted on a building or structure with theauthority of a candidate during the course of a Federal, State orLocal Government election or Referendum.

Prohibited Activities

4. No person shall on any local government land:

Use of Equipment

(1) use any form of equipment or property belonging to theCouncil other than in the manner and for the purpose forwhich it was designed or set aside;

Repairs to Vehicles

(2) perform the work of repairing, washing, painting, panel-beating or other work of any nature on or to any vehicle,provided that this paragraph shall not extend to runningrepairs in the case of breakdown;

Annoyances

(3) annoy or unreasonably interfere with any other person’suse of the land by making a noise or creating adisturbance that has not been authorised by the Council;

Directions

(4) fail to comply with any reasonable direction or requestfrom an authorised person of the Council relating to:

(a) that person’s use of the land;

(b) that person’s conduct and behaviour on the land;

(c) that person’s safety on the land; or

(d) the safety and enjoyment of the land by otherpersons.

(5) throw, roll or discharge any stone, substance or missileto the danger of any person or animal therein;

Glass

(6) wilfully break any glass, china or other brittle material;

Defacing Property

(7) deface, paint, write, cut names or make marks on or fixbills or advertisements to any tree, rock, gate, fence,building, sign or other property of the Council thereinexcept for any electoral matter posted on a building orstructure with the authority of a candidate during thecourse of a Federal, State or Local Government electionor Referendum;

Horses, Cattle and Sheep

(8) (a) send, drive, lead, ride or take any horse, cattle orsheep or permit any horse, cattle or sheep to be sent,driven, led, ridden or taken on any land which theCouncil has, by resolution, declared to be prohibitedfor such purpose;

(b) allow any horse, cattle or sheep to be let loose or leftunattended on any land which the Council has, byresolution, declared to be prohibited for suchpurpose.

Removal of Animals and Persons

5. (1) If any animal is found on any part of local governmentland in breach of a by-law:

(a) any person in charge of the animal shall forthwithremove it from that part on the request of an authorisedperson; and

(b) any authorised person may remove it therefrom if theperson fails to comply with the request, or if no person isin charge of the animal.

(2) An authorised person may direct any person who isconsidered to be committing or has committed a breach of this by-law to leave that part of the local government land. Failure tocomply with that direction forthwith is a breach of this by-law.

Exemptions

6. The restrictions in this by-law do not apply to any PoliceOfficer, Council Officer or employee acting in the course andwithin the scope of that person’s normal duties, or to a contractorwhile performing work for the Council and while acting under thesupervision of a Council Officer, or an emergency worker whendriving an Emergency Vehicle.

Application of Paragraphs

7. Any of subparagraphs 2 (13) (b), 2 (14), 2 (24) and 2 (26) ofthis by-law shall apply only in such portion or portions of the areaas the Council may by resolution direct in accordance with section246 (3) (e) of the Local Government Act 1999.

Construction

8. This by-law is subject to any Act of Parliament andRegulations made thereunder.

By-law No. 5—Dogs and Cats

FOR the management and control of dogs and cats within theCouncil’s area.

Definitions

1. In this by-law unless the context otherwise requires:

(1) ‘Act’ means the Dog and Cat Management Act 1995;

(2) ‘approved kennel establishment’ means a building,structure or area approved by the relevant authority,pursuant to the Development Act 1993 for the keeping ofcats and/or dogs on a temporary or permanent basis;

(3) ‘cat’ means an animal of the species felis catus;

(4) ‘council land’ means all parklands, reserves, ornamentalgrounds, streets roads, jetties, bridges, foreshore, publicplaces and other land vested in or under the control of theCouncil;

(5) ‘dog’ means an animal of the species canis familiaris butdoes not include a dingo or cross of a dingo;

(6) ‘premises’ means any domestic and non-domesticpremises, except a kennel establishment in respect ofwhich a development authorisation is in force under theDevelopment Act 1993.

Dog Free Areas

2. No person shall on any Council land to which this paragraphapplies, in accordance with paragraph 7 of this by-law causesuffer or permit any dog under that person’s control, charge orauthority to be, or remain in that place.

Dogs on Leash Areas

3. No person shall on any Council land to which this paragraphapplies, in accordance with paragraph 7 of this by-law, cause,suffer or permit any dog under that person’s control, charge orauthority to be or remain in that public place unless such dog isrestrained by a strong leash not exceeding 2 m in length and eithertethered securely to a fixed object or held by a person capable ofcontrolling the dog and preventing it from being a nuisance or adanger to other persons.

Dog Exercise Areas

4. (1) Any person may enter upon any part of Council land towhich this paragraph applies in accordance with paragraph 7 ofthis by-law, for the purpose of exercising a dog under his or hercontrol.

(2) Where a person enters upon such part of Council land forthat purpose, he or she shall ensure that the dog or dogs under hisor her control remain under effective control (within the meaningof the Dog and Cat Management Act 1995) while on the land.

(3) Signs shall be erected to denote the land to which thisparagraph applies, and information shall be provided to the publicin a manner determined by the Council’s Chief Executive Officerto inform the public about such land.

Limit on Dog Numbers

5. (1) The limit on the number of dogs kept shall be:

(a) in a township:

(i) in a small dwelling, one dog; and

(ii) in premises other than a small dwelling, two dogs;

(b) outside of a township, three dogs (other than workingdogs).

(2) No person shall, without obtaining the written permissionof the Council, keep any dog on any premises where the number ofdogs on those premises exceeds the limit unless the premises arean approved kennel establishment.

Limit on Cat Numbers

6. (1) The limit on the number of cats kept on premises shall betwo.

(2) No person shall, without obtaining the written permissionof the Council, keep any cat on any premises where the number ofcats on those premises exceeds the limit unless the premises are anapproved kennel establishment.

Application of Paragraphs
