The Smoke Control Areas (Exempted Fireplaces)(Amendment No.2) Regulations (Northern Ireland) 2015

Coming into operation 31st January 2016

The Department of the Environment makes the following Regulations in exercise of the powersconferred by Article 17(7) of the Clean Air (Northern Ireland) Order 1981(1).The Department is satisfied that the classes of fireplace set out in column 1 of the Schedule can,subject to the conditions set out in column 2 of the Schedule, be used for burning fuel other thanauthorised fuels(2) without producing any smoke or a substantial quantity of smoke.

Citation commencement and interpretation

1.—(1) These Regulations may be cited as the Smoke Control Areas (Exempted Fireplaces)(Amendment No.2) Regulations (Northern Ireland) 2015 and come into operation on 31st January2016.

(2) In these Regulations, “the Principal Regulations” mean the Smoke Control Areas (ExemptedFireplaces) (No.2) Regulations (Northern Ireland) 2013(3).

Amendments to the Principal Regulations

2.—(1) The Schedule to the Principal Regulations is amended in accordance with paragraphs(2) to (5).

(2) The classes of fireplace described in the first column under the heading “(1) Class of fireplace”beginning with the words—

(a) “Rais Juno”;(b) “RAIS VIVA 98”;(c) “Sherborne SE NS-3C, Chesham SE NS-3B, Burford SE NS-3A”; and(d) “Vista Magnifico SE NS-1 and Vista Perfetto SE NS-2”;

(1) S.I. 1981/158 (N.I. 4), to which there are amendments not relevant to these Regulations.(2) Fuels declared by the Department of the Environment to be authorised fuels for the purposes of Article 2(2) of the Clean Air

The Smoke Control Areas (Exempted Fireplaces) (No.2) Regulations (Northern Ireland) 2013 (“the2013 Regulations”) specify those fireplaces exempted from the provisions of Article 17(7) of theClean Air (Northern Ireland) Order 1981 (“the 1981 Order”).Article 17 of the 1981 Order generally prohibits the emission of smoke from chimneys in smokecontrol areas. However, under paragraph 7 of Article 17 of the 1981 Order, the Department of theEnvironment may exempt certain classes of fireplaces from the provisions of Article 17 of the 1981Order, if it is satisfied that they can be used for burning fuel other than authorised fuels, withoutproducing any smoke, or a substantial quantity of smoke.These Regulations amend the 2013 Regulations to include a number of additional fireplaces to theSchedule that have been tested and found to be suitable for use in smoke control areas. There arealso amendments to the details of some existing fireplaces.
