Whereas

The applicant on behalf of the Insured Persons by an application with declaration, which shall be the basis of

each relevant contract, has applied for insurance and We have agreed to provide such insurance.

We agree only on the basis of the terms and conditions contained in the Policy, and subject to payment of the

relevant premium, to provide insurance cover to the Insured Persons.

Where the application and declaration is in respect of more than one Insured Person, We further only agree

to provide the insurance on the basis that this Policy, notwithstanding any other provision, is deemed and

accepted to constitute separate insurance in respect of each such Insured Person covered.

In the event of Accident, Injury or loss happening during the Period of Insurance, We will provide insurance

as described in the following pages for those Sections you have chosen.

DEFINITIONS

Certain words in the Policy have specific meanings. These words have the same meaning wherever they are used in the Policy or the Certificate of Insurance or subsequently endorsed hereon. These are given below or defined at the beginning of the appropriate Section. In this Policy where consistent with the contents, the singular shall include the plural and vice versa; words importing the masculine gender shall include the feminine and neuter gender; and each of the following words and expressions shall have the following meanings except where the context otherwise requires.

1. Accident

means an event occurring entirely beyond control and caused by violent, external and visible means which causes an Injury during an Insured Journey. The term “Accidental” shall be construed accordingly.

2. Accompanying Infant

means the Insured Person’s accompanying infant who is between age of nine (9) days and two (2) years old and named in the Certificate of Insurance of the AirAsia flight ticket for the Insured Journey.

3. Act of Terrorism

means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group of persons, whether acting alone or on behalf of or in connection with any organizations or government, committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

4. AIDS (Acquired Immune Deficiency Syndrome)

has the meanings assigned to it by the World Health Organization including Opportunistic Infection, Malignan Neoplasm, or any disease or sickness in the presence of a zero-positive test for HIV.

5. AirAsia Common Carrier

means any mechanically propelled air conveyance operated by the AirAsia according to the flight booking number shown in the Certificate of Insurance.

6. Bodily Injury/Injury

means any bodily damage caused directly and independently of all other causes by an Accident as defined above and does not include any illness or naturally occurring medical conditions or degenerative process.

7. Certificate of Insurance

means the document titled “Certificate of Insurance” sent to the Insured Person electronically or otherwise after successful purchase of the insurance cover under this Policy.

8. Common Carrier

means any bus, coach, taxi, ferry, hovercraft, hydrofoil, ship, train, tram or underground train provided and operated by a carrier duly licensed for the regular transportation of fare-paying passengers.

9. Epidemic

means a sudden severe outbreak of disease that spreads rapidly and affects, within a very short period, an inordinately large number of people within a geographical region. For example, SARS.

10. Hijack

refers to any unlawful seizure or exercise of control or threat by force or violence with wrongful intent.

11. Hong Kong

means the Hong Kong Special Administrative Region.

12. Hospital

An establishment which meets all the following requirements:

holds a license as a hospital (if licensing is required in the state or governmental jurisdiction);

operates primarily for the reception, care and treatment of sick, ailing or injured persons as in-patients;

provides 24-hour a day nursing service by registered or graduated nurses;

has a staff one or more licensed physicians available at all times;

provides organized facilities for diagnosis and major surgical facilities; and

is not primarily a clinic, nursing, rest or convalescent home or similar establishment, a place for alcoholics or drug addicts.

13. Immediate Family Member

means the Insured Person’s spouse, parent, parent-in-law, grandparent, grandparent-in-law, son, daughter, brother, sister, grandchild or legal guardian.

14. Incoming Connecting Flight

means AirAsia flight taken by the Insured Person from first point of departure and for which the Insured Person had purchased this Policy.

15. Onward Connecting Flight

means the scheduled flight by any license airline booked by the Insured Person for their onward journey after disembarking from the Incoming Connecting Flight.

16. Infectious Disease

means any kinds of infectious disease which are publicly announced and require quarantine by the government.

17. Insured Journey

means the journey with the period of travel commencing from the Insured Person checking-in for departure in the Hong Kong immigration counter on the flight departure date as stated in Certificate of Insurance for the purpose of commencement of his Insured Journey and until, the Return Flight Arrival Date or the Insured Person’s arrival at Hong Kong immigration counter for returning to Hong Kong after the insured journey, whichever first occurs. If the Insured Person departs on any carrier to travel outside the destination as shown in the Certificate of Insurance, insurance cover will suspend upon the Insured Person’s check-in the immigration counter of the destination, however, cover will resume upon the Insured Person’s check out at immigration upon returning to the destination before the Return Flight Arrival Date. The Policy will terminate if the Insured Person departs from the airport at the destination in the event where the Insured Person changes his/her original scheduled flight and does not travel back as indicated in the original travel itinerary.

18. Insured Person

means any person, (a) who must be the AirAsia guests whose age is at least nine (9) days and not exceed seventy-five (75) years on the commencement date of the Period of Insurance; (b) who is named in the proposal form and in the Certification of Insurance issued by the Company; and (c) to whom an air ticket issued by AirAsia has been purchased.

19. Legal Beneficiary

means where there is no valid will, statutory beneficiary defined by the law, or where there exists a valid will, beneficiary therein named. In any event, death benefit shall be released to the administrator or executor who represents the beneficiary and has been duly granted with a grant of representation.

20. Limb

means a hand or foot.

21. Loss of Limb

means complete severance at or above the wrist or ankle joint or the total and Permanent functional disablement of an entire hand, arm, foot or leg.

22. Loss of or Loss of Use

means the Permanent total functional disablement or complete and Permanent physical severance through or above the wrists or ankle joints, and as used with reference to eyes, shall mean the entire and irrecoverable loss of sight.

23. Loss of Sight

means the total and irrecoverable loss of all sight of an eye rendering the Insured Person absolutely blind in that eye beyond remedy by surgical or other treatment.

24. Maximum Benefit

means the maximum benefit amount of each of the benefits covered under this Policy as stated in the Schedule of Benefits.

25. Medical Expenses

means those necessitated expenses actually paid by the Insured Person to a Qualified and Licensed/Registered Medical Practitioner, physiotherapist, nurse, Hospital and/or ambulance service including expenses for prescribed medicine, surgery, nursing treatment, paramedic services and diagnostic tests.

26. Pandemic

means an outbreak of Infectious Disease, which meets the following criteria set by World Health Organization (WHO) that spreads through population across a large region or worldwide.

Emergence of a disease new to a population,

Agents infect humans, causing serious illness,

Agents spread easily and sustainably among humans.

27. Period of Insurance

means the period between the flight departure date as stated in the Certificate of Insurance and Return Flight Arrival Date except that, for Section 2 (Trip Cancellation), the Period of Insurance shall mean the period between the Certificate of Insurance issue date and the flight departure date from Hong Kong of the Insured Journey.

28. Permanent

means lasting twelve (12) consecutive months from the date of Accident and at the expiry of that period being beyond hope of improvement.

29. Permanent Total Disablement

means when as the result of Injury and commencing within twelve (12) consecutive months from the date of the Accident, the Insured Person is totally and Permanently disabled and prevented from engaging in or attending any business or occupation. If the Insured Person has no employment or occupation at the time of Injury, Permanent Total Disablement means the inability to perform all of the daily activities in his/her daily life, provided such disability has continued for a period of twelve (12) consecutive months and certified by a Qualified and Licensed/Registered Medical Practitioner to be total, continuous and Permanent for the remainder of the Insured Person’s life.

30. Personal Effects

Means articles of personal possession normally worn or carried by the Insured Person by hand, in trunks, suitcases and like receptacles owned by the Insured Person occurring during the Insured Journey.

31. Pre-Existing Condition

means any disease, Injury, disability or physical condition which existed at the time of applying this insurance or arrangement of Insured Journey in respect of the Insured Person, which presented signs or symptoms of which the Insured Person or Immediate Family Member was aware or should reasonably have been aware.

32. Primary Residence

means the primary house or flat permanently occupied by the Insured Person in Hong Kong for the sole purpose of his private dwelling.

33. Qualified and Licensed/Registered Medical Practitioner

means a medical practitioner qualified by a medical degree and duly licensed or registered to practice medicine and who, in rendering such treatment (surgery or medical procedures for the sole purpose of cure or relief of Injury), is practicing within the scope of his or her licensing and training in the geographical area of practice, and who is neither the Insured Person nor the Insured Person’s Immediate Family Member.

34. Return Flight Arrival Date

The date of arrival at Hong Kong of the return flight chosen by the Insured Person or anyone behalf of the Insured Person when the application for insurance cover under this Policy was made at AirAsia Website. This date of arrival in Our record shall be final and conclusive unless there is manifest error.

35. Serious Bodily Injury or Sickness

means when applied to the Insured Person, is one which requires treatment by a Qualified and Licensed/Registered Medical Practitioner and which results in the Insured Person being certified by that Qualified and Licensed/Registered Medical Practitioner as being dangerous to life and unfit to travel or continue with his original journey. When Serious Bodily Injury or sickness is applied to the Insured Person’s Immediate Family Member, it shall mean injury or sickness certified as being dangerous to life by a Qualified and Licensed/Registered Medical Practitioner and which results in the Insured Person’s discontinuation or cancellation of his Insured Journey.

36. Sickness

means sickness or disease contracted and commencing during the Insured Journey, and excludes any Pre-existing Conditions.

37. Theft

means permanent loss or damage of belongings where there is physical evidence of a break-in of a premise, or the belongings are taken without the Insured Person’ consent.

38. Usual, Reasonable And Customary

means an expense which: (1) is charged for treatment, supplies or medical services medically necessary for caring of Insured Person(s) under the care, supervision, or order of a Qualified and Licensed/Registered Medical Practitioner; (2) does not exceed the usual level of charges for similar treatment, supplies or medical services in the locality where the expense is incurred; and (3) does not include charges that would not have been made if no insurance existed.

39. War

means war, whether declared or not, or any warlike activities, including use of military force by any sovereign nation to achieve economic, geographic, nationalistic, political, racial, religious or other ends.

40. We, Us, Our or the Company

means AXA General Insurance Hong Kong Limited.

GEOGRAPHICAL LIMITS

Cover is provided on worldwide basis. This Policy is only valid for travel originating from Hong Kong.

SECTION 1 – PERSONAL ACCIDENT

We will pay the following benefit per Insured Person in the event of accidental bodily Injury being sustained

by an Insured Person during the Insured Journey.

Provided that:

The maximum amount payable for any and all events arising under this section shall not exceed the Maximum Benefit for each Insured Person.

Extension

(a) Disappearance Accidental death shall not in any way be presumed by reason of the disappearance of the Insured Person except: (x) in the event of the disappearance, or sinking or wrecking of the ship or aircraft in which the Insured Person was travelling at the material time during the course of Insured Journey, (y) the Insured Person remains missing after twelve (12) months, and (z) the Company has reason to believe that the Insured Person has died in the Accident. Accidental death payment is subject to Our receipt of a signed undertaking by the personal representative(s) of the Insured Person’s estate that such payment shall be refunded to Us if it is later discovered that the Insured Person is found to be living and had not suffered death as a result of the Accident.

(b) Free Coverage for Accompanying Infant This section is extended to cover the Accompanying Infant, up to the 10% of Maximum Benefit as stated in the Schedule of Benefits.

Exclusion applicable to Section 1 – Personal Accident

(i) No claims will be payable : (a) Under benefits (1) and (2) unless such benefits occurs within one hundred and eighty (180) days

from the date of Accident; (b) Under benefits (3) and (4), except on proof to Us that the disablement has continued for one

hundred and eighty (180) days from the date of Injury and in all probability, will continue for the remainder of the Insured Person’s life.

(ii) The amount of all benefits (1) to (4) payable for one or more Injuries sustained during the Insured Journey shall not exceed HKD250,000 for Insured Person and HKD25,000 for Accompanying Infant.

(iii) This section exclude cover for illness, sickness, disease, any pre-existing physical or mental defect or infirmity, bacterial or viral infections even if contracted by Accident. This does not exclude bacterial infection that is the direct result of an Accidental cut or wound.

(iv) When a Limb which had been partially dysfunctional or disabled prior to an Injury covered under this Policy and which becomes totally dysfunctional or disabled as a result of such Injury, the percentage of sum insured payable shall be determined by Us in Our sole discretion having regard to the extent of disablement caused by the Injury. No payment however shall be made in respect of the loss of or Loss of Use of one Limb which was totally dysfunctional or disabled prior to the Injury.

SECTION 2 – TRIP CANCELLATION AND TRIP CURTAILMENT

Section 2A – Trip Cancellation

The Company shall reimburse the Insured Person up to the Maximum Benefits as stated in the Schedule of Benefits for the loss of AirAsia ticket fare and/or cost of accommodation paid in advance by the Insured Person and for which the Insured Person is legally liable and which are not recoverable from any other source consequent upon the cancellation of the Insured Journey necessitated by the occurrence of any of the followings, within ninety (90) days before departure date as shown in the Certificate of Insurance (except for sub-paragraphs (3) below): 1. Death, Serious Bodily Injury or Sickness of the Insured Person, or Immediate Family Member of the

Insured Person causing the Insured Person unable to travel under this Policy 2. Receipt of subpoena or witness summons, or being summonsed for jury service or compulsory

quarantine of the Insured Person. 3. Serious damage to the Insured Person’s Primary Residence in Hong Kong arising from fire, flood,

earthquake or similar natural disasters within ten (10) days prior to the departure date which requires the Insured Person’s continued presence on the premises.

This coverage under Section 2A - Trip Cancellation cannot be utilized once the Insured Person has commenced the Insured Journey.

Section 2B – Trip Curtailment

The Company shall reimburse the Insured Person up to the Maximum Benefits as stated in the Schedule of Benefits for the forfeited AirAsia ticket fare and/or cost of accommodation where the Insured Person has to terminate and cut short the Insured Journey and return to Hong Kong due to the occurrence of any of the following events within the country of arrival: Provided that the loss is caused by: i. Death, Serious Bodily Injury or Sickness of the Insured Person; ii. Death, Serious Bodily Injury or Sickness of the Insured Person’s Immediate Family Members. This coverage Section 2 -Trip Cancellation and Trip Curtailment is effective only if this insurance is purchased before the Insured Person becomes aware of any circumstances which can lead to the disruption or interruption of the Insured Journey.

Exclusion applicable to Section 2 – Trip Cancellation and Trip Curtailment

The Company shall not be liable for any claims or losses directly or indirectly arising out of: 1. Criminal acts by the Insured Person. 2. Cancellation resulting from riot, popular movements, terrorists acts, any effects of a source of

radioactivity, Epidemic, Pandemic, pollution, natural catastrophes or climatic event (lack of snow in a ski trip etc).

3. Pre-Existing Condition. 4. Pregnancy or gynecological disease or their sequel. 5. Government regulation or act, delay or amendment of the booked itinerary, or failure in provision of any

part of the booked itinerary (including error, omission or default) by the provider of any service forming part of the booked itinerary as well as of the agent AirAsia through whom the itinerary was booked, liquidation or default of travel agencies, tour operator and/or AirAsia.

6. Disinclination to travel or cancellation of journey or curtailment of journey due to financial circumstances of Insured Person.

7. Any unlawful act or criminal proceedings of any person on whom the planned itinerary depends on, other than attendance under subpoena as a witness at a court of law.

8. Any circumstances leading to the trip cancellation or trip curtailment already existing and known to the public at the time of applying this insurance or arranging the Insured Journey.

9. Failure to notify and submit the relevant documents to travel agent/tour operator, Common Carrier or AirAsia Common Carrier or hotel operator or accommodation immediately for the application of refund of expenses incurred if it is found necessary to curtail the travel arrangement and failure to submit the relevant documents.

SECTION 3 - TRAVEL INTERRUPTION

Section 3A – AirAsia Flight Delay

In the event of the AirAsia Common Carrier in which the Insured Person has arranged to travel for the Insured Journey is delayed for at least six (6) consecutive hours from the departure time specified in the travel itinerary, due to the natural disaster (e.g. earthquake), adverse weather conditions, strike or industrial action, Act of Terrorism or Hijack (other than aircraft Hijack), or mechanical derangement of AirAsia Common Carrier, the Insured Person is entitled to claim HKD300 for each consecutive six (6) hours delay up to the Maximum Benefit amount specified in the Schedule of Benefits.

Provided that:

1. The period of delay will be calculated from the original scheduled departure time of the AirAsia Common Carrier until the revised departure time of the first available alternative transportation offered by the AirAsia Common Carrier. If the Insured Person has consecutive connected flights, each period of delayed hours of subsequent connected flights cannot be accumulated and the proximate cause of the delay must be due to above-mentioned reason.

2. The delay does not arise from the failure of the Insured Person to confirm the advanced booking or late check-in or late arrival at the boarding gate after checked-in.

3. Confirmed advanced booking is given prior to the commencement of an industrial action affecting the carrier.

4. Official documentation from the AirAsia Common Carrier is submitted in support of any claim under this section of the insurance, which states the cause, date, time and duration of the delay.

5. The Company does not cover strike, industrial or any circumstances leading to the delay already existing and known to the public before the date of applying this insurance or arranging the journey.

6. The Insured Person has to reroute his trip due to cancellation of the public transportation with prior confirmed booking.

Section 3B – Common Carrier Delay

In the event of the Insured Person’s scheduled departure of a Common Carrier is delayed for at least six (6) consecutive hours from the original scheduled time specified in the itinerary supplied to the Insured Person, and this delay is due to adverse weather, equipment failure or strike or Hijack (other than aircraft Hijacking) or other industrial action by any employee of Common Carrier, the Company will pay the Insured Person HKD300 only for the first six (6) consecutive hours of delay, followed by further sum of HKD300 for every six (6) consecutive hours of delay thereafter, up to the maximum limit as specified in the Schedule of Benefits. The period of delay shall be calculated from the original scheduled departure time of the Common Carrier until the commencement of the first available alternative transportation offered by the Common Carrier management. A letter from the Common Carrier or its handling agents confirming the duration and reason of such delay shall suffice as proof for purposes of claim for this benefit.

Exclusion applicable to Section 3B – Common Carrier Delay

The Company shall not be liable for any loss arising from:- 1. The failure of the Insured Person to check in according to the itinerary supplied to him/her 2. The failure of the Insured Person to obtain written confirmation from the Common Carrier or its handling

agents of the number of hours delayed and the reason for such delay 3. Strike or industrial action of companies/carrier involving other than Common Carrier and already in

existence on the date the trip is arranged 4. The late arrival of the Insured Person at an airport (except for late arrival caused by a strike or an

industrial action) 5. Arising from cancellation or rescheduling of the scheduled flight unless due to natural disaster or

equipment failure

Section 3C – Missed Flight Connection

In the event the Onward Connecting Flight is missed at the transfer point due to late arrival of the Incoming Connecting Flight and no replacement is made available within six (6) hours from the scheduled time of connecting departure, the Company will pay the Insured Person HKD750 for every six (6) consecutive hours delay up to a maximum limit of HKD1,500 as specified in the Schedule of Benefits. The Company shall only pay the Insured Person if the delay of the Incoming Connecting Flight is due to any of the following events: 1. Inclement weather at destination or departure. 2. Accident to the Incoming Connecting Flight. 3. Technical fault of the Incoming Connecting Flight.

Exclusion applicable to Section 3C – Missed Flight Connection

The Company shall not be liable for any loss arising from:- 1. Any illegal or unlawful intention act by the Insured Person. 2. Any breach of government regulation or any failure by the Insured Person to take reasonable

precautions to avoid a claim under the Policy following the warning of any intended strike, riot or civil commotion through or by general mass media.

3. The failure of the Insured Person to check-in according to the itinerary supplied to him/her. 4. Strike or industrial action existing on the date the flight or this insurance is arranged. 5. Any prohibition or regulations by any government or immigration authority. 6. The Insured Person is not fit to travel or is traveling against the medical advice of a Qualified and

Licensed/Registered Medical Practitioner. 7. Voluntary cancellation of Insured journey by the Insured Person. 8. The Onward Connecting Flight departure time is less than three (3) hours apart from the scheduled

arrival time of the Incoming Connecting Flight. 9. The Onward Connecting Flight is not in the same airport as the arriving Incoming Connecting Flight. 10. Natural disaster including earthquake, volcanic eruption and its consequences. This Policy shall only pay for claim either under Section 3A AirAsia Flight Delay or Section 3C Missed Flight Connection but not both.

Section 3D – On Time Guarantee

For delay of the scheduled flight of the Insured Journey by more than two (2) hours from the scheduled time of flight departure caused solely by AirAsia Common Carrier, the Insured Person is entitled to claim the actual airfare and charges for the particular flight subject to a maximum of HKD400 per Insured Person, provided that the Insured Person must be medically fit to travel and not be aware of any circumstances which could lead to cancellation or disruption of the flight, otherwise any claim is not payable.

Exclusion applicable to Section 3D – On Time Guarantee

The Company shall not be liable for any loss arising from:- 1. Any illegal or unlawful intention act by the Insured Person. 2. Any breach of government regulation or any failure by the Insured Person to take reasonable

precautions to avoid a claim under the Policy following the warning of any intended strike, riot or civil commotion through or by general mass media.

3. The failure of the Insured Person to check in according to the itinerary supplied to him/her. 4. Strike or industrial action existing on the date the flight is arranged. 5. Any prohibition or regulations by any government. 6. The Insured Person is not fit to travel or is travelling against the medical advice of a Qualified and

Licensed/Registered Medical Practitioner. 7. Delay caused by any circumstances which are beyond AirAsia control such as bad weather, air traffic

control, airport closure, strikes and acts of Gods

Section 3E – Travel Re-route

In the event the Insured Person’s original scheduled time of arrival is delayed for at least six (6) consecutive hours from the itinerary supplied to the Insured Person, and this delay is due to rerouting of the scheduled flight of the Insured Journey, as a result of strike/industrial action, adverse weather conditions or mechanical breakdown, the Company will pay the Insured Person HKD300 for the first six (6) consecutive hours of delay, followed by further sum of HKD300 for every six (6) consecutive hours of delay thereafter, up to the maximum limit as specified in the Schedule of Benefits. The period of delay shall be calculated from the original scheduled arrival time of the scheduled flight until the actual arrival time offered by AirAsia. A letter from AirAsia or its handling agents confirming the duration and reason of such delay shall suffice as proof for purposes of claim for this benefit.

Exclusion applicable to Section 3E – Travel Re-route

The Company shall not be liable for any loss arising from:- (a) Delay in arrival at the destination as a result of delay in departure of the flight. (b) The failure of the Insured Person to obtain written confirmation from AirAsia or its handling agents of

the number of hours delayed and the reason for such delay. (c) Strike or industrial action of companies/carrier involving other than AirAsia and already in existence on

the date the flight is arranged.

Section 3F – Hijack Distress Allowance

In the event the Insured Person’s flight of the Insured Journey is Hijacked outside Hong Kong and the Insured Person is detained for more six (6) consecutive hours, the Company will pay the Insured Person HKD1,000 for the first six (6) consecutive hours of delay, followed by further sum of HKD1,000 for every six (6) consecutive hours of delay thereafter, up to the maximum limit as specified in the Schedule of Benefits. Any claims under Section 3F – Hijack Distress Allowance must be accompanied by a police report or a report issued by the carrier confirming that the Insured Person was a victim of Hijack and the duration of such Hijack.

SECTION 4 – BAGGAGE AND PERSONAL EFFECTS, BAGGAGE DELAY

Section 4A – Baggage and Personal Effects

We will pay to the Insured Person for loss, physical breakage or damage directly resulting from Accident, Theft, burglary, robbery or mishandling by carriers occurring during the Period of Insurance to an Insured Person’s personal baggage, clothing or Personal Effects, subject to the maximum limited stated in the Schedule of Benefits.

Provided that:

1. If the Insured Person is aware of any loss, physical breakage or damage, the Insured Person shall give immediate notice, and in any event within 24 hours of the occurrence, (i) in the case of Theft, loss or wilful damage by a third party, to the police; and (ii) in the case of loss or damage in transit, to the Common Carrier or AirAsia Common Carrier (as the case may be).

2. The Insured Person shall observe ordinary and proper care for the safety of his accompanied personal baggage or Personal Effects and does not leave them unattended in a public place. All personal baggage and Personal Effects are to be examined immediately when received and in the event of any destruction, loss or damage coming to the notice of the Insured Person, the Insured Person shall give IMMEDIATE notice to the parties concerned and request for relevant report.

3. The Company shall not be liable for more than HKD1,000 in respect of any one (1) article, pair or set of articles.

4. The Company will, by payment or at its option by replacement or repair (subject to due allowance for wear & tear), indemnify the Insured Person against each such loss or damage provided that the maximum liability of the Company shall not exceed the afore-mentioned benefit amount.

5. For claim relating to breakage or damage, the claimant has to produce the damaged effects as physical evidence for the Company’s inspection at the claimant’s cost.

All jewelry, articles consisting in whole or in part of silver, gold or platinum objects made with precious materials, precious stones, pearls, watches, articles trimmed with or made mostly of fur, portable photographic, cinematographic, computer, telephone equipment; equipment for the recording of sound or pictures and its accessories, are only covered against Theft and only if carried on the Insured Person.

Extension of Cover for Golfing Equipment:

The Company will pay the Insured Person for Theft of or damage to or loss caused by the AirAsia Common Carrier of golfing equipment belonging to the Insured Person which he/she has checked in for the same flight, subject to the exclusion of the following:- a. Loss of or damage to golf balls; b. Loss of or damage resulting from willful act or negligence of the Insured Person; c. Loss of or damage arising from confiscation or retention by customs or other officials.

Exclusion applicable to Section 4A – Baggage and Personal Effects

The Company shall not be liable for any loss arising from:-

1. The following classes of property: business goods or sample, foodstuffs, animals, motor vehicles (including accessories), motorcycles, bicycles, boats, motors, any other conveyances, household furniture, antiques, keys, musical instruments, object of art, collector’s item, eye glasses, contact or conceal lenses, hearing aids, prosthetic limbs, artificial teeth or dental bridges, stamps, money (including checks, traveler’s checks, etc), plastic money (including the credit value of credit card, Octopus cards, etc), treasury bills, securities, tickets, documents or any other form of negotiable document.

2. Ski set, sailboard, golf clubs, tennis racket and other sporting equipment except while checked in as baggage.

3. Any loss or damage caused by wear and tear, gradual deterioration, moths, vermin, inherent vice, mechanical or electrical breakdown or derangement or damage sustained due to any process initiated by the Insured Person to repair, clean or alter any property.

4. Any loss of or damage to hired or leased equipment and any loss of or damage to property resulting directly or indirectly from insurrection, rebellion, revolution, civil war, usurped power, Act of Terrorism or action taken by governmental authorities in hindering, combating or defending against such an occurrence; secure or destruction under quarantine or customs regulations, confiscation by order of any government of public authority or risk of contraband or illegal transportation or trade.

5. Any loss or damage to property insured under any other insurance, or could be reimbursed for by a Common Carrier or AirAsia Common Carrier, a hotel, and any service providers or otherwise.

6. Any loss of or damage to property which function normal after it has been fixed or repaired by a third party. 7. Any loss of the Insured Person’s baggage when it is left unattended in public place or as a result of the

Insured Person’s failure to take due care and precautions for the safe guard and security of such property. 8. Any loss of data recorded on tapes, cards, diskettes or otherwise. 9. Breakage or damage to fragile articles or brittle articles such as glass or crystal. 10. Loss by any mysterious disappearance. 11. Losses not reported to the police within twenty (24) hours from occurrence of the incident and such police

report is not obtained at the place of loss 12. Loss or damage whilst in the custody of the public Common Carrier, unless reported immediately on

discovery and, in the case of an airline, a property irregularity report obtained. 13. Any damage to sports equipment whilst in use. 14. Any loss claimed under Section 4B – Baggage Delay arising from the same cause. 15. The first HKD100 of each and every claim.

Section 4B – Baggage Delay

The Company will pay to the Insured Person HKD500 for every six (6) complete hours whereby his checked-in baggage is delayed, misdirected or temporarily misplaced by AirAsia from the time of arrival at the scheduled destination abroad till the Insured Person received his baggage. The maximum amount payable is up to HKD1,000 as specified in the Schedule of Benefits.

Exclusion applicable to Section 4B – Baggage Delay

The Company will not pay for claims in respect of: 1. Baggage delay not immediately reported to AirAsia. 2. Confiscation or detention by customs, immigration and/or public authorities.

3. Baggage delay on the return journey to Hong Kong. 4. Failure of the Insured Person to obtain a written confirmation on the actual date and time of baggage

delivery from AirAsia or their handling agents. This Policy shall only pay for Baggage Delay which subsequently found damage or loss of Personal Effects upon recovery of the delayed baggage at the same time for any one scheduled flight. This Policy shall not pay for Section 4A Baggage and Personal Effects and Section 4B Baggage Delay at the same time for any one scheduled flight.

SECTION 5 – EMERGENCY MEDICAL EXPENSES AND ASSISTANCE

Section 5A – Medical Expenses

We will reimburse the Insured Person the Medical Expenses incurred outside Hong Kong up to the Maximum Benefits as stated in the Schedule of Benefits, which are the Usual, Reasonable And Customary medically necessary expenses incurred within one hundred and eighty-two days (182) from the first day of sustaining an Injury / Sickness suffered by the Insured Person solely, directly, and independently of any other causes provided that the relevant Injury occurred during the Insured Journey.

Follow-up Medical Expenses

This section also insures the Insured Person up to 10% of the Maximum Benefit as stated in the Schedule of Benefits against follow-up Usual, Reasonable And Customary medically necessary expenses charged by a Qualified and Licensed/Registered Medical Practitioner practicing western medicine in Hong Kong for the continuation of medical attention sought for the above Injury within three (3) months after the Insured Person’s return to Hong Kong. This section shall also be extended to cover the medically necessary expenses incurred for the same purpose paid to a Qualified and Licensed/Registered Medicine Practitioner practicing traditional Chinese medicine in Hong Kong subject to an aggregate limit of HKD1,800 and a per visit and per day limit of HKD150. In no event shall the total amount payable under this Section 5A - Medical Expenses exceed 100% of the Maximum Benefit as stated in the Schedule of Benefits.

Provided that:

All first treatment for Bodily Injury must be attended by a Qualified and Licensed/Registered Medical Practitioner outside Hong Kong. The Emergency Medical Evacuation under Section 5B and Repatriation of Mortal Remains/Ashes under Section 5C are provided by an assistance company appointed by us from time to time (“Assistance Company”) to the Insured Person who is insured under this Policy up to the Maximum Benefit as stated in Schedule of Benefits.

Section 5B – Emergency Medical Evacuation

Should the Insurer Person suffer from Bodily Injury occurring within the Period of Insurance and if the Assistance Company and the attending Qualified and Licensed/Registered Medical Practitioner are of the view that the local medical services are inadequate or not available and the medical condition warrants emergency evacuation to another place, the Assistance Company will arrange and We will pay the cost up to the Maximum Benefit for: (i) emergency transport include air ambulance to the nearest and most appropriate Hospital or medical

centre available to the nature of the Insured Person’s Accidental Bodily Injury or sickness suffered; and (ii) medical attendants to accompany the Insured Person enroute on the advice and/or direction of the

attending Qualified and Licensed/Registered Medical Practitioner.

Section 5C – Repatriation/Repatriation of Mortal Remains

Following the Medical Evacuation in Section 5B and if medically necessary, we will pay for services arranged by the Assistance Company up to the Maximum Benefit in respect of: (i) extra costs for economy airfare incurred when the Insured Person suffers a Sickness or Accidental

Bodily Injury such that the Insured Person must fly to Hong Kong immediately on the written advice of a Qualified and Licensed/Registered Medical Practitioner.

(ii) extra costs for economy airfare incurred for a Qualified and Licensed/Registered Medical Practitioner to accompany the Insured Person on the written advice of a Qualified and Licensed/Registered Medical Practitioner.

(iii) reasonable charges in the event of death for burial or cremation of the Insured Person in the locality where death occurs or the reasonable cost of transport of body or ashes to Hong Kong for each Insured Person.

Section 5D – 24-Hour Emergency Assistance Services

A 24-hour emergency assistance hotline service is operated for the benefit of Insured Person so that, in the event of an emergency medical problem or situation covered herein, the following information and referral services will be given to the Insured Person calling Assistance Company at hotline number at 852 3723-3034. 1. Pre-trip Information Services 2. Embassy Referral 3. Lost Luggage Assistance 4. Travel Information 5. Emergency Travel Service Assistance 6. Interpreter Referral 7. Legal Referral

Exclusion applicable to Section 5 – Emergency Medical Expenses and Assistance

The Company shall not be liable for: 1. The first HKD100 for each and every claim (applicable to Section 5A – Medical Expenses only). 2. For any loss caused by Injury which is a consequence of any kind of disease or sickness (applicable to

Section 5B – Emergency Medical Evacuation and 5C – Repatriation/Repatriation of Remains only). 3. For surgery or medical treatment when in the opinion of the Qualified and Licensed/Registered Medical

Practitioner treating the Insured Person, the treatment can be reasonably delayed until the Insured Person returns to Hong Kong.

4. If the purpose of the Insured Journey is to obtain medical treatment or the Insured Journey is undertaken against the Qualified and Licensed/Registered Medical Practitioner's recommendation.

5. Any expenses incurred for services provided by another party for which the Insured Person is not liable to pay, or any expenses already included in the cost of a scheduled Insured Journey.

6. Failure to obtain a written medical report from the Qualified and Licensed/Registered Medical Practitioner.

7. If the Insured Person refuses to follow the recommendation of a Qualified and Licensed/Registered Medical Practitioner to return to Hong Kong or to continue the Insured Journey whilst the Insured Person’s physical condition at the time of recommendation is fit for travel.

8. Any expenses for a service not approved and arranged by the Assistance Company except that this exclusion shall be waived in the event the Insured Person or his/her traveling companion(s) cannot notify the Assistance Company during an emergency medical situation for reasons beyond their control. In any event, the Company reserves the right to reimburse the Insured Person only for those expenses incurred for service which the Assistance Company would have provided under the same circumstances. (For Section 5B - Emergency Medical Evacuation only)

9. Any expenses incurred for the transportation of the Insured Person’s remains not approved and arranged by the Assistance Company. (For Section 5C - Repatriation of Remains only).

10. The follow up treatment expenses obtained outside Hong Kong. 11. Any additional cost of single or private room accommodation at a Hospital or charges in respect of

special or private nursing, non-medical personal services such as radio, telephone and the like; procurement or use of special braces, appliances or equipment.

13. The extra expenses arising from private room or semi-private room. 14. Expenses related to cosmetic surgery, visual apparels and refraction or hearing-aids, and prescriptions

therefore except as necessitated to correct a condition resulting solely from external Accidental Bodily Injury occurred during the Period of Insurance.

15. Expenses related to dental care or treatment, except as necessitated and emergency treatment by Accidental injuries to sound natural teeth.

16. Expenses related to medical care or treatment or related services, pertaining to Bodily Injury arising out of the use or operation of a motor vehicle, except to the extent that reimbursement of eligible expenditure provided by this insurance for such injuries exceeds the amount of benefits available to each Insured Person under all other policies or plans of insurance or indemnity.

17. Expenses related to psychiatric, psychological disorder and insanity (including any related primary/basic signs and symptoms).

18. Expenses related to any and all conditions arising from surgical, mechanical or chemical methods of birth control and any and all conditions or treatments pertaining to infertility.

19. Expenses related to treatment or services undertaken without the related recommendation of a Qualified and Licensed/Registered Medical Practitioner; routine physical examinations or health check-ups not incidental to the treatment or diagnosis of a suspected covered Sickness or Bodily Injury sustained during the journey covered by this insurance and occurring or arising during the Period of Insurance.

20. Emergency medical evacuation or repatriation/repatriation of mortal remains or costs not approved and arranged by the Assistance Company or its authorized representative, except when We reserve the right to waive this exclusion at Our full discretion and decision.

21. The cost of burial in Hong Kong.

SECTION 6 – HOME CARE BENEFIT

We will, in the event of Theft to Insured Person’s Principal Residence, provide indemnity to Insured Person up to the Maximum Benefits by cash payment, repair or reinstatement, at Our option, against physical loss of or damage to the Home Contents within Insured Person’s Primary Residence in Hong Kong which was left vacant when Insured Person is on an Insured Journey. “Home Contents” means household furniture and furnishing, clothing and Personal Effects belonging to Insured Person who permanently resides in Hong Kong and fixtures and fittings Insured Person owns (for which Insured Person is responsible) not being landlord’s fixtures and fittings. Home Contents shall exclude deeds, bonds, bills of exchange, promissory notes, cheques, travellers’ cheques, securities for money, documents of any kind, cash, currency notes, articles of gold, silver or other precious metal, jewellery, furs, watches, precious or semi-precious gems, livestock, antiques and artifacts.

Exclusion applicable to Section 6 – Home Care Benefit

We will not pay for claims arising directly or indirectly from, in respect of, or due to: 1. Consequential loss or damage of any kind. 2. Losses recoverable from any other insurance taken up by the Insured Person. 3. Wear, tear, depreciation, the process of cleaning, dyeing repairing or restoring any article, the action of

light or atmospheric conditions, moth, insects, vermin or any other gradually operating cause. 4. Any loss or damage occasioned through the willful act of the Insured Person or with the connivance of

the Insured Person. 5. Any loss (whether temporary or permanent) of the insured property or any part thereof by reason of

confiscation, requisition, detention or legal or illegal occupation of such property or of any premises, vehicle or thing containing the same by any government authorities.

6. Electrical or mechanical breakdown. 7. Business or professional use in respect of photographic and sporting equipment and accessories and

musical instruments. 8. Motor vehicles, boats, bicycles and any equipment or accessories relating thereto. 9. Identity paper, credit and payment cards, transport tickets, cash, stocks and securities. 10. Musical instruments, objects of art, antiques, collector’s items, furniture. 11. Perishables and consumables.

GENERAL EXCLUSIONS

This Policy does not cover claims:- 1. Directly or indirectly occasioned by, happening through or in consequence of:-

(i) Pre-Existing Condition, congenital and/or heredity condition. (ii) war, invasion, acts of foreign enemies, hostilities or war-like operations (whether War be declared

or not), civil war, mutiny, riot or civil commotion assuming the proportions of or amounts to popular rising (except as specified under individual Sections), military rising, insurrection, rebellion, revolution, military or usurped power, martial law, confiscation or nationalisation or requisition or destruction of or damage to property by or under the order of any government or public or local authority.

(iii) the Insured Person’s direct participation in terrorist acts. (iv) wilfully self-inflicted Injury or illness, insanity, the effect or influence (temporary or otherwise) of

alcohol, or the use of drugs (other than drugs taken in accordance with treatment prescribed and directed by a Qualified and Licensed/Registered Medical Practitioner, but not for the treatment of drug addiction), self-exposure to needless peril (except in an attempt to save human life or property.

(v) nuclear fission, nuclear fusion or radioactive contamination arising from non terrorist event, whether direct or indirect.

2. In respect of any property more specifically insured or any claim which, but for the existence of this Policy, would be recoverable under any other policy of insurance.

3. In connection with incidents which may give rise to a claim not notified directly in writing to Us within thirty-one (31) days of the expiry of the individual scheduled travel itinerary.

4. If the Insured Person is travelling contrary to the advice of a medical practitioner or for the purpose of obtaining medical treatment or for migration.

5. For pregnancy, miscarriage, childbirth and all complications thereof. 6. If the Insured Person is engaging in any kind of labor or manual work; engaging in offshore activities

like commercial diving, oil rigging, mining or aerial photography; handling of explosives; performing as actor/actress; being a site worker, fisherman, cook or kitchen worker; tour guide or tour escort during the Period of Insurance.

7. In connection with any incidents/circumstances which is existing or announced or publicly known on or before the date of booking the scheduled Insured Journey and/or before the effective date of the Policy.

8. For any Injury, Sickness, death, loss, expense or other liability attributable to venereal disease and/or HIV (Human Immunodeficiency Virus) and/or any HIV related illness including AIDS (Acquired Immune Deficiency Syndrome) and/or any mutant derivative or variations thereof howsoever caused.

9. In connection with encountering murder, kidnap or extortion. 10. In connection with riot and strike, War (whether declared or not), Act of Terrorism, invasion, act of foreign

enemies, civil war, revolution, civil unrest, performing duties as a member of armed forces, or police, or a law enforcing agencies.

11. In connection with the Insured Person willfully exposing himself to needless peril (except in an attempt to save human life), fighting, attack resulting from provocation or deliberate act of Insured Person, suicide, attempted suicide or intentional self-inflicted Bodily Injuries, insanity, abortion, miscarriage, child-birth, venereal diseases, the use of alcohol or drugs other than those prescribed by a Qualified and Licensed/Registered Medical Practitioner; dental treatment unless it is resulting from Accidental Bodily Injury to sound and natural teeth.

12. In connection with nuclear fission, nuclear fusion or radioactive contamination. 13. In connection with any illegal or unlawful act. 14. In connection with the Insured Person engaging in any manual labour or hazardous work that involves

the use of machinery or tools. 15. In connection with utilization of nuclear, chemical or biological weapons of mass destruction. 16. In connection with accident happened whilst engaging in sports or games in a professional capacity or

where an Insured Person would or could earn income or remuneration from engaging in sports or games. 17. In connection with racing (other than on foot), riding or driving in any kind of race, motorcycling, hunting,

mountaineering (necessitating the use of ropes, pitons or guides), skydiving, hang gliding and parachuting.

18. In connection with trekking at an altitude limit greater than 5,000 meters above sea level or scuba diving to a depth greater than 30 meters below sea level.

19. In connection with the Insured Person engaging in any form of aerial flight or air travel other than as a passenger in a properly licensed multi-engined aircraft being operated by a licensed commercial air carrier or owned and operated by a commercial company.

20. In connection with losses which are indirect and consequential in nature except herein provided. 21. In connection with taking part in performing entertainment or film production.

22. In connection with any loss and expenses that can be reimbursed or recovered from other source except for Section 1 – Personal Accident and Section 3 – Travel Interruption.

23. In connection with any loss resulting directly and indirectly (in whole or in part) from Pandemic or Epidemic.

24. Sanction Limitation and Exclusion Clause No insurer shall be deemed to provide cover and no insurer shall be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose that insurer to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America.

GENERAL CONDITIONS

1. Condition Precedent The due observance and fulfilment of all the terms and conditions of this Policy by the Insured Person, or anyone acting on his behalf insofar as they relate to anything to be done or complied with by the Insured Person, or anyone acting on his behalf, and the truth of the statements and details in every proposal form and declaration shall be a condition precedent to any liability of Us to make any payment under this Policy.

2. Company’s Rights after a Claim We shall be entitled to conduct, in the name of and on behalf of the Insured Person, the defence or settlement of any legal action and take proceedings at Our own expenses and for Our own benefit but in the name of the Insured Person to recover compensation from any third party in respect of anything covered by this Policy and to instruct solicitors of Our own choice for this purpose. In the event of the death of the Insured Person, We shall have the right to have a post mortem at Our own expense.

3. Arbitration and Time Limit If any difference shall arise as to the amount to be paid under this Policy such difference shall independently of all other questions be referred to and resolved by arbitration in accordance with the UNCITRAL Arbitration Rules. The appointing authority shall be the Hong Kong International Arbitration Centre. The number of arbitrator shall be one. The seat of arbitration shall be Hong Kong and the law of the arbitration clause shall be the laws of the Hong Kong SAR. The language to be used in the arbitral proceedings shall be English. And it is hereby expressly stipulated and declared that it shall be a condition precedent to any right of action or suit upon this Policy that the award by such arbitrator or umpire of the amount of the loss or damage if disputed shall be first obtained. In no case whatever shall We be liable for any loss or damage after the expiration of twelve months from the happening of the loss or damage unless the claim is the subject of pending action or arbitration.

4. Premium No refund of premium is allowed once the Certificate of Insurance has been issued.

5. Governing Law and Jurisdiction This policy shall be governed and construed in accordance with the laws of Hong Kong and, subject to General Condition 3 above, the Court of Hong Kong shall have exclusive jurisdiction over any dispute or difference that arises under this Policy.

6. Age Limit Insured Person must be aged between nine (9) days to the age of seventy-five (75) years old. All benefits would be payable according to the age of the Insured Person on the commencement date of the Period of Insurance.

7. Contracts (Rights of Third Parties) Ordinance Any person or entity who is not a party to this Policy shall have no rights under the Contracts (Rights of Third Parties) Ordinance (Cap 623 of the Laws of Hong Kong) to enforce any terms of this Policy.

8. Validity of Policy This Policy is only valid for leisure travel or business travel. Any activities during business travel shall be restricted to administrative and non-manual labour works only. At the time this insurance becomes effective, the Insured Person must be fit to travel and not be aware of any circumstances which could lead to cancellation or disruption of the Insured Journey, otherwise any claim could be forfeited.

9. Amendment and Renewal Upon issuance of the Policy, all the insurance details, including the Insured Persons, insurance start date, insurance end date and destinations, are confirmed and final and cannot be changed. This Policy may not be renewed or extended. However, if the return flight is rescheduled by AirAsia, the Company will automatically extend the Period of Insurance for a maximum three (3) consecutive days without charge.

10. Trip Duration The maximum Period of Insurance cannot exceed forty-five (45) days per Insured Journey.

11. Duplicate Application (a) An Insured Person shall not be covered under more than one travel insurance policies

underwritten by the Company for the same Insured Journey. In the event that an Insured Person is covered by more than one policies issued by the Company, benefit will be paid by the policy which provides the greatest amount of benefit. Where the benefit under each such policy is identical, the Company will only entertain the claim that Insured Person to be covered under the policy first issued. The Company will refund any duplicated insurance premium that may have been made by the Insured Person and cover of the duplicated insurance shall be void at inception in respect of such particular Insured Person.

(b) In the event that an Insured Person is covered by more than one policy purchased through AirAsia and/or its affiliates, benefit will be paid by the policy which provides the greatest amount of benefit. Where the benefit under each such policy is identical, the Company will only entertain the claim under this Policy if this Policy was the first policy issued among all these policies.

12. Subrogation In the event of any payment made under this Policy, the company shall be subrogated to all the Insured Person’s right of recovery and indemnity against any third party and any amount so recovered shall belong to the Company.

13. Reasonable Care The Insured Person shall act in a prudent manner and exercise reasonable care and prevent Accidents, Injury, illness, loss or damage.

14. Misstatement or Fraud Failure by the Insured Person to comply with the claims procedure or investigation by Us may result in denial of the claim. If any claim shall be fraudulent or intentionally exaggerated or if any false declaration or statement shall be made then the Policy shall be voidable at the entire discretion of the Company and no claim shall be payable by the Company.

15. Claim In the event of a claim, the Insured Person and/or claimant should:- (a) not to admit liability or to give any representations or other undertakings binding upon the Insured

Person except with Our written consent. (b) render his/her full co-operation during the course of investigation or assessment of the claim.

16. Notice of Claim Notice of any claim must be given to the Company within 30 days of the expiry of this insurance or the end of Insured Journey (whichever is the earliest), otherwise the Company shall not be liable for any loss or damage occurring in connection with such event.

17. Proof of Claim A notice of claim shall be submitted together with documentary evidence required under the respective section (if applicable), or other documents and/or information which is prescribed or reasonably required by the Company at the claimant or the Insured Person’s own expense. Failure to provide such documentary evidence within the time required will not invalidate any claim if the claimant or Insured Person can explain that it was not reasonably possible to give such documentary evidence within such time, provided such documentary evidence is furnished as soon as is reasonably possible, and in no event later than one hundred and eighty (180) days from time such request is made by the Company. Any documentary evidence includes but not limited to:- (a) In case of Personal Accident:-

Hospital, Qualified and Licensed/Registered Medical Practitioner’s reports giving details on the nature of the injury and the extent and period of disability, police reports where relevant and if death shall have resulted, a copy of the death certificate and the relevant coroner’s report and letter of administration.

(b) In case of Trip Cancellation:- All bills, receipts, tickets, coupons, contracts or agreements relevant to the claim and if the claim is in respect of medical treatments, a full Qualified and Licensed/Registered Medical

Practitioner’s report stipulating the diagnosis of the condition treated, advice on the need of Trip Cancellation or Trip Curtailment and the date when the disability commenced and a summary of the course of treatment including medicines prescribed and services rendered.

(c) In case of Loss of, breakage or damage to Personal Baggage and Personal Effects:- All details including receipts as to date of purchase, price, model and type of items lost or damaged; receipt for obtaining replacement of travel document or travel ticket; a copy of the IMMEDIATE notification to AirAsia Common Carrier or tour operator and their official acknowledgment or confirmation in writing when loss or damage has occurred in transit; certified written copy of IMMEDIATE police report when loss or damage has occurred in other circumstances. Reports to the relevant authorities must be made within 24 hours of the occurrence.

(d) In case of Travel Delay:- Official documentation from the airline/carrier giving the cause, date, time and the duration of the delay.

18. Payment of Claims (a) Except as provided in Section 5B, 5C and 5D, all the payments under this Policy will be payable

to the Insured Person unless the Insured Person is aged below eighteen (18), in which case the Company has the discretion to make payments to the Insured Person’s parent or legal guardian. The Insured Person may designate a beneficiary at the time of concluding this contract of insurance. In case of absence of such designation, any benefits unpaid at the time of death of the Insured Person shall be paid to the Legal Beneficiary.

(b) Any receipt given by the person indicated under paragraph (a) above shall in all cases be full and final discharge of all liabilities of the Company.

(c) Premium and benefits payable under this Policy shall be in the currency of Hong Kong. Payment of claims is based on the exchange rate prevailing at the date of loss.

(d) No payment of claims under this Policy shall carry interest.

19. The total amount payable under each section shall not exceed the maximum limit as stated in the Policy respectively.

Personal Information Collection Statement

AXA General Insurance Hong Kong Limited (referred to hereinafter as the “Company”) recognises its

responsibilities in relation to the collection, holding, processing, use and/or transfer of personal data under the

Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”). Personal data will be collected only for lawful and

relevant purposes and all practicable steps will be taken to ensure that personal data held by the Company is

accurate. The Company will take all practicable steps to ensure security of the personal data and to avoid

unauthorised or accidental access, erasure or other use.

Please note that if you do not provide us with your personal data, we may not be able to provide the information,

products or services you need or process your request.

Purpose: From time to time it is necessary for the Company to collect your personal data (including credit

information and claims history) which may be used, stored, processed, transferred, disclosed or shared by us

for purposes (“Purposes”), including:

1 offering, providing and marketing to you the products/services of the Company, other companies of the

AXA Group (“our affiliates”) or our business partners (see “Use and provision of personal data in

direct marketing” below), and administering, maintaining, managing and operating such

products/services;

2 processing and evaluating any applications or requests made by you for products/services offered by the

Company and our affiliates;

3 providing subsequent services to you, including but not limited to administering the policies issued;

4 any purposes in connection with any claims made by or against or otherwise involving you in respect of

any products/services provided by the Company and/or our affiliates, including investigation of claims;

5 detecting and preventing fraud (whether or not relating to the products/services provided by the Company

and/or our affiliates);

6 evaluating your financial needs;

7 designing products/services for customers;

8 conducting market research for statistical or other purposes;

9 matching any data held which relates to you from time to time for any of the purposes listed herein;

10 making disclosure as required by any applicable law, rules, regulations, codes of practice or guidelines or

to assist in law enforcement purposes, investigations by police or other government or regulatory

authorities in Hong Kong or elsewhere;

11 conducting identity and/or credit checks and/or debt collection;

12 complying with the laws of any applicable jurisdiction;

13 carrying out other services in connection with the operation of the Company’s business; and

14 other purposes directly relating to any of the above.

Transfer of personal data: Personal data will be kept confidential but, subject to the provisions of any

applicable law, may be provided to:

1 any of our affiliates, any person associated with the Company, any reinsurance company, claims

investigation company, your broker, industry association or federation, fund management company or

financial institution in Hong Kong or elsewhere and in this regard you consent to the transfer of your data

outside of Hong Kong;

2 any person (including private investigators) in connection with any claims made by or against or otherwise

involving you in respect of any products/services provided by the Company and/or our affiliates;

3 any agent, contractor or third party who provides administrative, technology or other services (including

direct marketing services) to the Company and/or our affiliates in Hong Kong or elsewhere and who has

a duty of confidentiality to the same;

4 credit reference agencies or, in the event of default, debt collection agencies;

5 any actual or proposed assignee, transferee, participant or sub-participant of our rights or business;

6 any government department or other appropriate governmental or regulatory authority in Hong Kong or

elsewhere; and

7 the following persons who may collect and use the data only as reasonably necessary to carry out any of

the purposes described in paragraphs nos. 2, 3, 4 and 5 of the Purposes specified above: insurance

adjusters, agents and brokers, employers, health care professionals, hospitals, accountants, financial

advisors, solicitors, organisations that consolidate claims and underwriting information for the insurance

industry, fraud prevention organisations, other insurance companies (whether directly or through fraud

Transfer of your personal data will only be made for one or more of the Purposes specified above.

Use and provision of personal data in direct marketing:

The Company intends to:

1 use your name, contact details, products and services portfolio information, transaction pattern and

behaviour, financial background and demographic data held by the Company from time to time for direct

marketing;

2 conduct direct marketing (including but not limited to providing reward, loyalty or privileges programmes)

in relation to the following classes of products and services that the Company, our affiliates, our co-

branding partners and our business partners may offer:

a) insurance, banking, provident fund or scheme, financial services, securities and related products and

services;

b) products and services on health, wellness and medical, food and beverage, sporting activities and

membership, entertainment, spa and similar relaxation activities, travel and transportation, household,

apparel, education, social networking, media and high-end consumer products;

3 the above products and services may be provided by the Company and/or:

a) any of our affiliates;

b) third party financial institutions;

c) the business partners or co-branding partners of the Company and/or affiliates providing the products

and services set out in 2 above;

d) third party reward, loyalty or privileges programme providers supporting the Company or any of the

above listed entities

4 in addition to marketing the above products and services, the Company also intends to provide the data

described in 1 above to all or any of the persons described in 3 above for use by them in marketing those

products and services, and the Company requires your written consent (which includes an indication of

no objection) for that purpose;

Before using your personal data for the purposes and providing to the transferees set out above, the Company

must obtain your written consent, and only after having obtained such written consent, may use and provide

your personal data for any promotional or marketing purpose.

You may in future withdraw your consent to the use and provision of your personal data for direct marketing.

If you wish to withdraw your consent, please inform us in writing to the address in the section on “Access and

correction of personal data”. The Company shall, without charge to you, ensure that you are not included

in future direct marketing activities.

Access and correction of personal data: Under the PDPO, you have the right to ascertain whether the

Company holds your personal data, to obtain a copy of the data, and to correct any data that is inaccurate.

You may also request the Company to inform you of the type of personal data held by it.

Requests for access and correction or for information regarding policies and practices and kinds of data held
