IP in Mauritius
When people think of Mauritius or the Seychelles, their thoughts normally go to sun-drenched white beaches with clear waters and a high-class service for a great holiday. And despite what I say at any IPR conference on the hard work we islanders try to achieve, it is still the image of the IPR lawyer sitting at the beach with his laptop filing marks that prevails.
Practitioners in the Indian Ocean region have to man-age mixed legislation jurisdictions varying from French, Hybrid (French and common law) and fully common law. Madrid ratification has made it easier to file marks in Madagascar, but the enforcement aspects remain blurred and laborious, especially as there is no provision for opposition or publication.
In Mauritius, which is signatory only to the Paris and Berne conventions without any other patent treaty, IPR rights have existed since the early 1900s and the days of British administration. After independence in 1968, new legislation was passed in 1997 for copyright and 2002 for trademarks, endeavouring to bring legislation up to speed with the signed conventions and TRIPS agree-ment. Mauritius is also part of the Hague Convention on the Legalisation of Foreign Documents, an essential part of evidence procedures for court matters.
Nationally, authorities have been set up to implement the legislation, namely the Industrial Property Office, The Anti Piracy Unit of the Police Force, Customs IPR
Unit and The Tribunal of Industrial Property. Patent registration has, however, been slow with effectively about 10 to 15 patent applications since 2000.
The government authorities have put IPR on their priority list, with a well-known US mark enforcing its rights against about 480 outlets and 20 factories. But the downside of enforcement remains the low damages awarded in most cases.
There has been a recent trend in IPR towards the use of the financial services available in Mauritius for structur-ing of IPR rights, royalties and licensing, using special purpose vehicles which benefit from tax deductions in repatriation of profits or royalty collections. Specific events such as the World Cup or Olympics have added to this trend.
On the litigation front, Mauritius Courts have interpret-ed copyright laws to allow right owners and exclusive licencees to stop parallel imports. As for trademarks, there is a case in court which is not yet resolved on the point. It is expected that a judgment would be received by early next year.
