TAKE NOTICE that the TOWN OF TRINITY Development Regulations Amendment No. 2, 2017, adopted on the 10th

day of July, 2017, has been registered by the Minister of Municipal and Intergovernmental Affairs.

In general terms, the purpose of the Development Regulations Amendment is to add a condition for tourist accommodation developments on a single lot, and a reduction in the minimum building setback along the coastline to 30m, in the Seasonal Residential Use Zone.

The Trinity Development Regulations Amendment No. 2, 2017, comes into effect on the day that this notice is published in The Newfoundland and Labrador Gazette. Anyone who wishes to inspect a copy of the amendment may do so at the Town Office.

the suspension period for reinstatement of his or her driver's licence or driving privileges with an ignition interlock restriction.

(2) An application under subsection (1) shall be made in the form set by the registrar which shall include a notification to applicants that participation in the ignition interlock program could result in the ignition interlock restriction continuing beyond the period of suspension of their driver’s licence and the court ordered prohibition period.

(2) Paragraph 26.1(4)(a) of the regulations is repealed and the following substituted:

(a) is not otherwise prohibited or disqualified from driving under a court order or another provision of the Act, the Criminal Code or a law of another jurisdiction;

2. (1) Subsections 26.2(1) and (2) of the regulations are repealed and the following substituted:

26.2 (1) The registrar may upon review of a person's driving record and the records submitted under section 26.3 in relation to the operation of ignition interlock devices installed by that person, extend the restriction on the person's driver's licence

(a) beyond the expiry of the suspension period under section 65 of the Act and the court ordered prohibition period, notwithstanding subsection 26.1(6); or

(b) beyond the expiry of the mandatory restriction period under section 73.1 of the Act.

(2) Where the registrar intends to extend a person's ignition interlock restriction under subsection (1), the registrar shall give the person notice in writing

(a) that the registrar intends to extend the ignition interlock restriction on the person's driver's licence for the reasons specified in the notice; and

(b) that the person has 15 days, if he or she wishes to object to the extension, to respond in writing to the registrar setting out his or her reasons for objecting to the extension or to

request an opportunity to appear before the registrar to object in person.

(2.1) The notice under subsection (2) shall be given 90 days before

(a) the later of the expiry of the suspension period under section 65 of the Act and the court ordered prohibition period where the extension is under paragraph (1)(a); and

(b) the expiry of the mandatory restriction period under section 73.1 of the Act where the extension is under paragraph(1)(b).

(2) Subsections 26.2(4) to (6) of the regulations are repealed and the following substituted:

(4) After considering the reasons for the person's objection to the extension or where the person does not object, the registrar shall decide whether to extend their ignition interlock restriction and notify the person in writing of the decision at least 45 days before

(a) the later of the expiry of the suspension period under section 65 of the Act and the court ordered prohibition period where the extension is under paragraph (1)(a); or

(b) the expiry of the mandatory restriction period under section 73.1 of the Act where the extension is under paragraph (1)(b).

(5) Notwithstanding subsections (2) to (4), where the registrar becomes aware of information justifying an extension of a person's ignition interlock restriction within 90 days of the expiry of the

(a) suspension period under section 65 of the Act or the court ordered prohibition period where the extension is under paragraph (1)(a); and

(b) mandatory restriction period under section 73.1 of the Act where the extension is under paragraph (1)(b),

the registrar shall immediately give that person notice in writing

(c) that the registrar intends to extend the ignition interlock restriction on the person's driver's licence for the reasons specified in the notice; and

(d) of a time, date and place at which the person may appear to object to the extension.

(5.1) The date at which the person may appear under paragraph (5)(d) shall be before the expiry of the

(a) suspension period under section 65 of the Act and the court ordered prohibition period where the extension is under paragraph (1)(a); and

(b) mandatory restriction period under section 73.1 of the Act where the extension is under paragraph (1)(b).

(5.2) After hearing the reasons for the person's objection under paragraph (5)(d) or where the person does not appear, the registrar shall decide whether to extend their ignition interlock restriction and immediately notify the person in writing of the decision.

(6) A person who has been notified by the registrar of an extension of their ignition interlock restriction under subsection (4) or (5.2) may, within 30 days after receiving notice of the decision, appeal the decision or order to the Trial Division by filing a notice of appeal with the court.

3. Sections 26.4 and 26.5 of the regulations are repealed and the following substituted:

26.4 (1) A person who holds a driver's licence with an ignition interlock restriction shall pay

(a) all costs associated with the installation, monitoring, servicing and removal of an ignition interlock device in each motor vehicle the holder operates; and

(b) the administrative fee set by the minister.

(2) Where a person fails to pay an amount described in subsection (1), the registrar may revoke the approval of the person for the use of an ignition interlock device and,

(a) where the suspension period under section 65 of the Act or a court ordered prohibition period for the person has not expired, reinstate the suspension of his or her driver's licenceuntil subsection (1) is complied with or until the expiry of the suspension, whichever occurs first;

(b) where the ignition interlock restriction period under section 73.1 of the Act for the person has not expired, suspend his or her driver's licence until subsection (1) is complied with; or

(c) where the person is driving with an ignition interlock restriction extended under section 26.2, suspend his or her driver's licence until subsection (1) is complied with or until the expiry of the extension under 26.2, whichever occurs first.

(3) The mandatory restriction period referred to in section 73.1 of the Act shall not continue to run while a driver's licence is suspended under paragraph (2)(b).

26.5 (1) A person who holds a driver's licence with an ignition interlock restriction shall bring a motor vehicle in which he or she has had an ignition interlock device installed to an authorized installer or a facility designated by an authorized installer for inspection and maintenance at least once every 60 days.

(2) Where a person fails to comply with the requirements of subsection (1), the registrar may revoke the approval of the person for the use of an ignition interlock device and,

(a) where the suspension period under section 65 of the Act or a court ordered prohibition period for the person has not expired, reinstate the suspension of his or her driver's licence until subsection (1) is complied with or until the expiry of the suspension, whichever occurs first;

(b) where the ignition interlock restriction period under section 73.1 of the Act for the person has not expired, suspend his or her driver's licence until subsection (1) is complied with; or

(c) where the person is driving with an ignition interlock restriction extended under section 26.2, suspend his or her driver's licence until subsection (1) is complied with or until

the expiry of the extension under 26.2, whichever occurs first.

(3) The mandatory restriction period referred to in section 73.1 of the Act shall not continue to run while a driver's licence is suspended under paragraph (2)(b).

4. Paragraph 27(1)(a) of the regulations is repealed and the following substituted:

(a) under the authority of section 60.03, 60.04, 60.2 or 60.5 of the Act;

5. Schedule A of the regulations is amended by deleting the words "Section 60.4 of the Act" wherever they appear and substituting the words "Section 60.03 of the Act".

6. These regulations come into force on the day An Act to Amend the Highway Traffic Act No. 5, SNL2017 c4, comes into force.

paragraph (c) and substituting a semi-colon and the word "and", and by adding immediately after that paragraph the following:

(d) "prohibited proportion" means that on analysis by a peace officer of a sample of a person's breath or blood by an approved screening device or approved instrument as those terms are defined in section 254 of the Criminal Code, the proportion of alcohol in the person's blood is

(i) 50 milligrams or more of alcohol in 100 millilitres of blood where the person is 22 years of age or older and not a novice driver, or

(ii) greater than 0 milligrams of alcohol in 100 millilitres of blood where the person is under 22 years of age or anovice driver.

(2) Subsection 2(2) of the regulations is amended by deleting the word "and" at the end of paragraph (b), deleting the period at the end of paragraph (c) and substituting a semi-colon and the word "and", and by adding immediately after that paragraph the following:

(d) for a vehicle impounded under section 6.1, the applicable period set out in that section.

2. Section 3 of the regulations is amended by deleting the word "and" at the end of paragraph (b), deleting the period at the end of paragraph (c) and substituting a semi-colon and the word "and",and by adding immediately after that paragraph the following:

(d) section 6.1.

3. The regulations are amended by adding immediately after section 6 the following:

6.1 (1) A peace officer shall seize a motor vehicle and impound itwhere

(a) the proportion of alcohol in the blood of the driver operating the vehicle or the person who has care or control of the vehicle meets or exceeds the prohibited proportion; or

(b) the driver operating the vehicle or the person who has care or control of the vehicle fails or refuses to comply with a demand made under section 254 of the Criminal Code.

(2) A motor vehicle impounded under subsection (1) shall be held for a period of 7 days where the driver operating the vehicle or the person who has care or control of the vehicle is

(a) 22 years of age or older and not a novice driver and the proportion of alcohol in his or her blood is 50 milligrams of alcohol or more but less than 80 milligrams of alcohol in 100 millilitres of blood; or

(b) less than 22 years of age or a novice driver and the proportion of alcohol in his or her blood is greater than 0 milligrams of alcohol but less than 80 milligrams of alcohol in 100 millilitres of blood,

after which period the vehicle may be released in accordance with subsection 19(1).

(3) A motor vehicle impounded under subsection (1) shall be held for a period of 30 days where

(a) the proportion of alcohol in the blood of the driver operating the vehicle or the person who has care or control of the vehicle is 80 milligrams of alcohol or more in 100 millilitres of blood; or

(b) the driver operating the vehicle or the person who has care or control of the vehicle fails or refuses to comply with a demand made under section 254 of the Criminal Code,

after which period the vehicle may be released in accordance with subsection 19(1).

4. Section 7 of the regulations is repealed and the following substituted:

7. If, at any time before a review or hearing is conducted under these regulations, a peace officer is satisfied that a motor vehicle seized under section 5 or 6.1 had been stolen, the officer may, subject to the

approval of the registrar, release the vehicle to the owner, or a person authorized by the owner to take possession of it.

5. Subsection 9(3) of the regulations is repealed and the following substituted:

(3) Where a vehicle has been seized and impounded under section 5 or 6.1, the notice of impoundment for that vehicle shall contain a statement of the right to apply to the registrar for the release of the motor vehicle under section 17 of these regulations and instructions on applying for a review.

6. (1) Section 17 of the regulations is amended by adding immediately after subsection (2) the following:

(2.1) Where the owner of a motor vehicle impounded under section 6.1 was not the driver or person who had care or control at the time the vehicle was seized, the owner may before the expiry of the impoundment period apply to the registrar for the release of the vehicle on the grounds that

(a) the driver or person who had care or control of the motor vehicle was in possession of the motor vehicle without the knowledge or consent of the owner; or

(b) the continued impoundment of the motor vehicle will

(i) cause the owner to suffer a loss or curtailment of employment or educational opportunities, or

(ii) prevent the owner, or someone under the care of the owner, from obtaining medical treatment.

(2.2) Where the owner of a motor vehicle impounded under section 6.1 was the driver or person who had care or control at the time the vehicle was seized, he or she may before the expiry of the impoundment period apply to the registrar for the release of the vehicle on the grounds that the continued impoundment of the motor vehicle will

(a) cause the owner to suffer a loss or curtailment of employment or educational opportunities; or

(b) prevent the owner, or someone under the care of the owner, from obtaining medical treatment.

(2) Subsection 17(6) of the regulations is repealed and the following substituted:

(6) Where an application is made under subsections (1), (2), (2.1) or (2.2.), the registrar shall consider the report of the peace officer respecting the seizure of the motor vehicle and may consider

(a) the driving record maintained by the registrar of

(i) the person named as the driver or the person in care or control of the motor vehicle in the report of the peace officer,

(ii) the person named as the driver or the person in care or control of the motor vehicle in the application for release by the owner, if that person is not the person referred to in subparagraph (i), or

(iii) the applicant; and

(b) records maintained by the registrar respecting a previous seizure and impoundment under these regulations of a motor vehicle registered in the name of, or owned by, the applicant.

7. Subsection 18(2) of the regulations is repealed and the following substituted:

(2) Where, after considering an application for release under section 17 the registrar is satisfied that the motor vehicle should be released before the impoundment period expires for the reason set out in paragraph 17(1)(b), (c) or (d), 17(2)(b), 17(2.1)(a) or (b) or subsection 17(2.2), the registrar shall

(a) direct that the garage operator with custody of the motor vehicle release the motor vehicle to the owner or a person authorized by the owner; and

(b) where the reason for releasing the motor vehicle is set out in paragraphs 17(1)(b) or (c), 17(2)(b) or 17(2.1)(a), refund the application fee.

2. The Town Clerk of the Town of Witless Bay, Ms. Geraldine Caul, shall set the nomination date of September 5, 2017 for the General Municipal Election for the Town of Witless Bay.
