(2) If an application for a mineral right is made by an

(3) (a) If any question shall arise as 10 the actual area

comprised in any application for a mine ral right, the Direclor

(b) All such surveys shall be conducted in such manner as

the Director mayfrom lime to lime prescribe.

(4) The Director shall notify the applicant of the Board's

decision with respect to Iha application and record such de cis ion .

time before il has been granted or refused , by written notice to the

Director . On receipt of such no tice, the Director shall notify the Minister

(12) Where the Board finds Ihal an applicant has not

compl ied With Ihese Regulations or the Act. or that an application.is

- otherwise incomplete or derective, the Dire ctor shall notify (he

applicant. The appticanl may amend and re-submit his application with

thirty days or such notification.

(13) \foJhere the Board Is of the opini on tha.! an application is

acceptable, it shall inform the Minister who shall cause consultations 10

be held wilh the landowners in the area for which appllcalion has been

made in acco rdance with these Regula!ions,

(14) The Minisler, acting on the advice of the Board, shall

thereafter take appropriate actions as follows •

applicant of such refusal;

(bl in the case of a prospecting licence, informthe applicant

licence, Of any Interest thereIn, whether by way of grant, transfer or

otherwise, or who by any such means obtains exemption from any 01

the provisions of the Act or these Regulations shan be nab!e to ,•

lorfeiture of his Interest in the mining lease, building malerials permil

special slle right or road access licence.

14. (1) Belote making any borehole or drin hole. a holder shan

furnish the particulars of the tocatton and such addlUonal lnformalion

as the DireclOi may require.

(2) Where a core is obtained, il shan be labelled in such

manner thai lis origin can be readily delermined, photographed, and be

kept In core boxes or in such other manner, as the Diredor may direct.

15_ (1) All samples obtained in the course orreconnaissance

and prospecting shall be the property o f the governm ent of Solomon

Islands and shall not be removed from the vIcinity whe re they were

obtained nor disposed or by a holder y,;tho\ltlhe written consent of the

Director.

(2) The Director may In hisdisaetion authorise the removal

of such quantityof samples as he shall determine10 be reasonable and

necessary for the purpos es of sampling and assaying

16. The booodary markers 01any area covered by a mining lease,

buikfrn g malerials permit, speci al site right and roa d access licence

shall be esta blished, m a1ntained and protectedfrom loss or damage by

the holderthereof, who shankeep such markers and the boundary lines

reasonably clear so as to enable such markers and boundary lines to

be readily found and followed .

17. (1) Subject to subregufalion(2) no prospecting 01 mining

shan be carried cut within a distance 0' twenty five metres from a place

of OOTlal, lambu or other site of tradillonalsignificance, and one hundred

melres from any vlnage. occupied house or building.

(2) 'M1ere it is necessatY thai prospecting or mining has to

be carried out in any of the areas aforesaid specified above. the holder

01a mineral right shall meet all costs that are .~easonabl y needed for

effected or made thereon, to ensure compliance with the terms and

conditions of such mineral rights and these Regulations.
