See page 12 for more details. Student dies in car crash Christian Huckaby, a sophomore sports management major from Cleve- land, died in a car accident on Oct. 22 while on his way back to school. Huckaby, 19, attended Mercyhurst College North East. According to the Cleveland News- Herald, “(Huckaby) had been ridingin a 1999 Buick driven by 19-year-old Marcus Hawkins of Cleveland.” The News-Herald states the car strucka guardrail in Willoughby Hills, Oh. Willoughby Hills police Sgt. Brian Jackson told the News-Herald that he does not suspect alcohol or drugs were a factor. The News-Herald published that preliminary reports of the accident “…indicate the wet pavement and possibly speed may have contributed to the crash.” Rosenthals file legal papers aginst college, GarveyBy Joshua Wilwohl Editor-in-chiefChuck Rosenthal, Peter Rosenthal and James Rosenthal have begun the legal steps to sue former Mercyhurst College President William P. Garvey, the college and board of trustees chair Marlene Mosco. The Rosenthals file d a writ of sum- mons on Oct. 10 that signals they have considered filing a full civil complaint against Garvey, Mercyhurst and Mosco at a later date. “Our positions with regard to Garveyare on the record,” Peter Rosenthal told the Erie Times-News. “What is happen- ing in Erie is happening everywhere and it is time for Erie to deal with the realityof who Garvey is.” According to the school’s attorneyRichard Lanzillo, a writ of summons only commences a lawsuit, but does not state allegations. Lanzillo said that one reason lawyers file writs of summons is to beat the expiration of the statute of limitations for filing a civil suit. In Pennsylvania, according to Lan- zillo, the current statute of limitations for sexual abuse extends up to 12 years after the victim turns 18. All three Rosenthals are between the ages of 45 and 55. Lanzillo would not comment on the current proceedings of the case. Meghan Corbin, spokeswoman for Mercyhurst, said the college had no comment. The filing of the summons comes two years after Chuck Rosenthal alleged in articles published by the Times-News that Garvey physically and sexuallyabused boys – including Rosenthal – over 30 years ago, while coachingboys’ basketball at St. John the Baptist Catholic Church. Amid the allegations, Garvey announced retirement in December 2004 and stepped down in February2005 after 25 years as president ofMercyhurst.
