THE COUNTY GOVERNMENT OF KERICHO

PARTIAL WAIVER OF INTEREST ON ALL PLOTS WITHIN KERICHO

COUNTY

PURSUANT to the Public Finance and Management Act, 2012,

section 159 and the Constitution of Kenya 2010, the County Government of Kericho would like to draw attention of all plot owners

within the county’s jurisdiction that there will be a 90 % waiver of interest on the outstanding land rates to those who will pay principal

amount in full together with 10 % of the interest accrued in the next thirty (30) days with effect from 24th April, 2015 to 23rd May, 2015

both days inclusive.

Any outstanding rates arrears after 23rd May, 2015 shall accrue the

interest and penalties prior to this notice as if there was no waiver.

You are requested to take this opportunity to clear your plot arrears within the stipulated period failure to which the county government

will take necessary legal action including the following:

(a) recover all the rates plus interests that may have accrued thereon; or

(b) compel tenants to pay directly to the county Government until the rates and interests are duly recovered; or

(c) cancel and withdraw any licence or permit granted in the

premises in which the rates have not been paid; or

(d) withhold any development and approvals until the total property rates are paid in full.

IN EXERCISE of powers conferred by section 30 (2) (e) and (l) of

the County Governments Act, 2012 of the County Governments Act, 2012 I, Nderitu Gachagua, Governor County Government of Nyeri for

the purposes of strengthening the mechanisms of service delivery to the people of Nyeri wish to make the following changes:

1. The service delivery units (Departments) are reduced from ten (10)

to nine (9).

2. The Department of Public Administration, Information and

Communication is hereby moved to the Governor’s Office under the leadership of the Deputy Governor.

3. The functions previously performed under the Department of

Gender, Culture and Social Development will henceforth be absorbed under a new Department called Special Programs which

will be headed by the County Executive Member formerly in charge of Public Administration. This docket will be responsible

for matters relating to Youth, Sports, Marginalized Groups and Gender.

4. The Chief Officer in the abolished Department of Gender moves to

this new Department.

5. The function of Culture moves to the Department of Trade,

Industrialization and Tourism.

6. The current Executive Secretary for Agriculture, Livestock and Cooperatives Development is relieved of his duties and in his

place, the Executive Secretary for Health in an acting capacity take over the responsibilities of the said Department.

7. The function of Cooperatives Development is moved to the

Department of Trade, Industrialization and Tourism while the Directorates of Fisheries and Livestock are combined into one

Directorate.

8. The function of Sanitation is moved from the Department of

Water, Environment and Natural Resources to the Department Health Services.

9. The Directorate of Revenue moves from the Department of

Finance and Economic Planning to the Department of Public Administration, Information and Communication. Further that the

Department of Finance and Economic Planning is reorganized to combine both Finance and Economic Planning under one Chief

Officer.

APPLICATIONS FOR LICENCES IN THE COFFEE INDUSTRY

NOTICE is given that pursuant to the provisions of the Crops Act, 2013, section 20(6) and the Coffee General Rules, 2012, the Coffee Directorate of AFFA has published the list of applicants for the grant of licenses to various persons who wish to provide services (or trade) in the coffee industry

for the year 2014/2015.

The purpose of the grant of the licenses is to enable the applicants to provide services (or trade) as indicated against the kinds of licenses applied

for.

Please note that the licences shall be issued only to those applicants who have fulfilled ALL the licencing requirements including but not limited

to the issuance of Performance Bonds, Bank Guarantees and proof of engagement of the services of a coffee liquorer licenced by the Authority.

Since the grant of licenses may affect the coffee growers within the country, such person who may be affected by the grant of such license may

raise objections.

Any person or body desirous of making any representations on or objections to any of the grant of such licenses as aforesaid must do so by letter

addressed to the Interim Director General, Agriculture, Fisheries and Food Authority, Tea House, Naivasha Road, off Ngong’ Road, P.O. Box 20064-00200, Nairobi.

The representations and or objections, to be lodged with the Directorate should be done within fourteen (14) days next following the date of the notice in the Kenya Gazette:

(a) Coffee Dealers licences.

(b) Grower Marketer Licences.

(c) Commercial Warehouseman Licence.

(d) Private Warehouseman Licence.

(e) Grower Miller’s License.

(f) Dealers License Applications.

COUNTY

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003,

the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the

above proposed project.

The Proponent (Kizingo Crest Limited) is proposing to construct

Crest Apartments to be located on plot L.R. No. Mombasa/Block XXVI/157, in Kizingo area of Mombasa County.

The proposed project involves the construction, subsequent occupation and possible decommissioning of residential apartments

and auxiliary amenities, christened Crest Apartments that will feature two but combined towers at different floor elevations. Tower one will

rise from ground to 15th floor in tandem with tower two which will then be constructed for a further 9 floors to attain a maximum height

of 24 floors. At completion the project will have 67 apartments designed to cover 44% of the plot area i.e. 0.872 acres.

The following are the anticipated impacts and proposed mitigation measures:

Occupational health and safety of wrkers

The contractor will provide workers with appropriate Personnel Protective Equipment (PPE) and ensure their use.

Workers to be trained on equipment use.

First aid facilities to be available on site.

Contractor to comply with the requirements of the Occupational Safety and Health Act (OSHA) by registering the site as a work place.

All visitors to the site to be provided with PPEs.

Solid wastes at construction site

Procure the services of a NEMA licensed waste handler to manage solid wastes from the construction site.

All recyclable materials should be

collected and sent to a licensed company for recycling.

Increased demand for water for construction use

The contractor will ensure prudential use of water resources during construction by avoiding wastage such as running pipes and taps.

The proponent should meter and monitor the water yields from the borehole on a monthly basis.

Air pollution Contractor to deploy fine dust screens at the project site during construction.

Sprinkle dust producing materials such

as ballast with water during offloading on site.

The contractor has retained sediment binding grass within the site to mitigate

against dust generation by vehicles delivering raw materials on site.

Use serviceable machinery and vehicles for supply of raw materials.

Noise pollution Delivery of raw materials to site to be done only during the day.

No delivery of raw materials should be undertaken during weekends.

Workers on site should be provided with earmuffs to attenuate high noise levels associated with concrete mixing machines, hoists and lift installations during casting works.

Use of serviceable vehicles and machinery is also expected to reduce noise levels.

Insecurity Proponent and contractor to vet all workers on site.

Require certificates of good conduct from potential employees and copies of identification documents for all workers to be retained by the contractor.

Speed and neighborhood safety concerns

Erect speed limit signage along Mwamba Avenue.

Compel drivers to comply with recommended speeds.

The proponent could also consult with KURA to erect one or two speed bumps which oshould be clearly marked with the appropriate signage.

Air emissions Contract to use only serviceable trucks for transportation to and from the site.

Trucks and vehicles to be switched off when idling on site or during offloading of raw materials.

Noise concerns Contractor to use only serviceable trucks for transportation to and from the site.

Trucks and vehicles to be switched off when idling on site or during offloading of raw materials.

Solid waste generation Provide litter bins that encourage the separation of wastes into paper, glass, plastics etc. for recycling.

Contract a NEMA licensed solid waste handler to manage wastes from the development.

Comply with Legal Notice No. 121 of 2006 in management of solid wastes generated by the development.

Increase in electricity demand

Apply to KPLC to obtain a higher capacity transformer for the area to accommodate the new development within the national grid.

The overhead cables traversing the site will be replaced with a suitable capacity underground cable.

Firefighting A fire safety guide to be provided to all tenants.

Firefighting equipment such as extinguishers and water to be provided.

Traffic increase and congestion on Mwamba Avenue

The development will provide for acceleration and de-acceleration lanes for traffic to and from the apartments.

The development should be serviced by

two gates instead of one and provide dedicated entry and exist lanes.

The entrance to the development will be truncated to ensure that vehicles waiting to access the gate do not stop along the road but within the truncation.

THE following notes are for the guidance of persons submitting ―copy‖ for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All ―copy‖ submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(iiust be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

―D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 a.m. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested
