We are flat owners and residents of Sandhurst Court. We live in a quiet block of 57 flats nextdoor to the above pub. One side of our building is less than 5 yards from the pub, about 25flats overlook the pub backgarden, the others overlook the street side. There are also otherhouses next door, very close to the pub garden, others are being built. Our residents includethe elderly ~ children and babies. I

We have tried unsuccessfully to sort out the existing problems with the pub 1:enants andowners, before we knew they bad applied for this extension. The notice in tb.e pub window~ that they are applying to continue until lam some nights and 2am on 24 nights a year,although the application details on the internet do not mention this. I

We object to the above extension as the increased noise and security problems would seriouslyaffect our enjoyment of our homes, particularly during the summer. The extension would becontrary to all the Act's four main licensing objectives.

Noise from the pub dj$turbsresidents, including the children, particularly thoseoverlooking the back of the pub arid its garden. The pub have to open their windows, evenin winter, and they ~ways use the garden in wanner weather. Despite cotriplaints,sporadically noise continues Until 11.30 ot midnight, on June 18 2005 it. continued untillam, well beyond the stipulated time. Even itt da~e there are times we cannot hear thetelevision, have a nom1al conversation or enjoy our ~en. ItwiU stop us sleep~ if theyare licensed for Jate night live or recorde4 music as well as dan~. We believe this wouldbe a public nuisance to reSidents as well as ham1ing children who are unable to sleep.

We have tried to reason with the pub tenants but we now realise that they will not stick toany promises to respect their neighbours. There was no improvement even when wecontacted the pub landlords. As the noise is sporadic at the moment it is difficult toanange for the noise team to hear it although may be able to arrange it.

There is a public safety issue as people can climb the pub fence into OI.lr garden. If theyopen later, there is less chance of someone being seen. One actually bloke into ourbuilding. The police deah with him and the pub told our caretaker that he worked there.~ have refused to pay for the ~e and claim the incident did ~ot happen althoughwe have the crime number (121131 8/04) and the police willco~,O201326 1212.Others have climbed over the fence, recently two children, They did nOt cause any troublebut clearly there is asecurit.y issue. The pub owners refuse roraisetheir fence unless wepay for it although it is their responsibilit.y.. The pub is clearly nOt concerned and unlikelyto do anything abo~ Wis.

Customers leaving the pub disturb residents on the street side of the building already, evenwhen they leave in:small groups. Regular late hours will wake up those residents, causinga public nuisance and hann to the children.

There are plenty of other late night venues in Brixton, there is no need for another onenext door to quiet residential housing. The Licensing Act intends to prev$t publicnuisance and disorder and this extension would be contrary to the Act. II

Other local pubs near residential housing have to stop outside noise before normal closingtime -like The Trinity in Trinity Gardens. The Hope and Anchor should haV(~ the sameconstraints. We are not impressed by the responsibility shown by the current tenants whohave ignored their previous promises and we do not believe they will comply lin the future

unless the constraint is enforced.

In conclusion, this extension should be refused on the grounds of all four of the licensingobjectives. In addition, the pub tenants have not shown any responsibility towards theirneighbours so the Hope and Anchor licence should be varied so they have to comply with thesame tenns and conditions on noise levels as other local pubs near homes. They should haveto keep their music and other noise down to a reasonable level for a residential area evenduring daytime, including summer weekends. We believe this would be in lipe withgovernment undertakings to reduce drinking and disorder problems for or~ members of

the public trying to enjoy their homes in peace. I

Noise from the pub disturbs the residents, including the children, particularly thoseoverlooking the back of the pub and its garden. This noise will get fa~ worse if they arelicensed for live or recorded music as well as dancing. Despite complaints, noise oftencontinues until 11.30 or midnight, on June 182005 the noise continueii until lam, wellbeyond the stipulated time. Even during the day, there have been times when we havebeen unable to watch television, have a normal conversation or use out garden. Our sleepwith be badly disturbed if the hours are increased. We believe this caqses a publicnuisance to the residents as well as harming the children who are unable to sleep.

The pub regularly opens their windows, even in winter, or use the garden in warmerweather, increasing the problem. If they had music or performances, nobody overlookingthe garden could sleep.

There is a public safety issue. People climb the pub fence into our garden. On oneoccasion, they broke into the building and the police were called. The pub has refused topay for the damage they caused and claim the incident did not happen although we havethe crime number ( ) and the police will conflrm. (Emailed statement attached). Othershave climbed over the fence, recently two children. They did not cause any trouble butclearly there is a security issue. The pub owners refuse to raise their fence unless we payfor it although it is their responsibility. (LetterB attached). We are ve~ concerned thatthis will increase if they open later, when there is even less chance of~ing seen. The pubis clearly not concerned and unlikely to do anything about this.

Customers leaving the pub disturb residents on the street side of the building already.There are more problems when the pub has an extension and regular late hours will disturbsleeping residents. The government intends to cut down on binge drinlfing as well ascrime and disorder but the type of behaviour we have seen will increase if the extension isallowed.

There are plenty of other late night venues in the area; there is no need !for another onenext door to quiet residential housing.

Attached is a petition from our flats, requesting that the Hope and Anchor licenseapplication should have some restrictions. As you will see, most of! the building doesnot want to be kept awake anymore -50% of the building overlooks the back of thepub and will be affected seriously. Only a few residents, young singles, wanted tohave music and entertainment next door, the rest of us decided we needed our sleep!

The residents have signed on two sheets, but there are also 4 emailed supporters alsoattached. We have also attached letters and emails confirming the types of problemswe have had with this pub. I

Several people are on holiday, but told us before they left that they would also like tosign the letter when it was finished, would it be possible for these residents to addtheir names to the petition after the August 4 cut off date?

Those of you who are fans of the late night music and noise from the pub will be delighted toknow that they have applied for a late night music, dancing and entertainrnent licence. This willensure that we will continue to enjoy their choice and volume of music until midnight or laterevery weekend in future. The notice in their window is the legal one, not the internet infonnationwhich shows much earlier times. They are applying to continue until 1 ani some nights and 2amon 24 nights a year.

There four main objections possible.as the Licensing Act's objectives are the Preveption of Crimeand Disorder, Public Safety, the Prevention of Harm to Children and the Prevention of PublicNuisance. We can object on all four as:

The pub music sometimes prevents people living nearest the pub from watching TV orcarrying out a normal conversation in the summer. During warm wea.ther, the music movesinto their garden, sometimes drowning out conversations in our garden.The pub tenants say they will turn the music down but they don't.The pub has to open the windows as soon as the room gets hot, even jn colder weather,keeping those nearest the pub awake.The departing clients regularly cause noise on the street side of the building.They refused to increase the fence security unless we pay for their fence which theircustomers are climbing over. They have refused to pay for damage caused by one of theirstaff breaking into our building, claiming that,it did not happen although they know about it

and we have the poljce crime number.It will affect the value of our homes as the noise and security problems will increase.

TheyWe have until August 3 to get a petition or letters to Lambeth Council objecting to this.

Those of you who are fans of the late night music and noise from the pub ~rill be delighted to knowthat they have applied for a late night music, dancing and entertainment licc~nce. This will ensurethat we will continue to enjoy their choice and volume of music until midniight or later everyweekend in future. The notice in their window is the legal one, not the internet information whichshows much earlier times. They are applying to continue until 1 am some nights and 2am on 24nights a year.

There four main objections possible as the Licensing AcmfTMs objectives are the Prevention ofCrime and Disorder, Public Safety, the Prevention QfHarm to Children and! the Prevention ofPublic Nuisance. We can object on all four as:

m. The pub music sometimes prevents people living nearest the pub from watching TV orcarrying out a normal conversation inthe swnmer. During warm weather, 1the music moves into

Attached is a petition from our flats, requesting that the Hope and AJ1chor licenseapplication should have some restrictions. As you will see, most of 1the building doesnot want to be kept awake anymore -50% of the building overlooks the back of thepub and will be affected seriously. Only a few residents, young singles, wanted tohave music and entertainment next door, the rest of us decided we n{:eded our sleep!

Several people are on holiday, but told us before they left that they would also like tosign the letter when it was finished, would it be possible for these residents to addtheir names to the petition after the August 4 cut off date? .

Regarding the incident of the naked nutter, it was Steve who eventually gave a statement to the police andheard from them that he had been at the Hope and Anchor that night, so probabl~, a good idea to have achat with him -he may also know who we could contact at the police...

Here's how it went for me...

I'd been at a wedding on Sat 20th March. After late night drinks back at the happy couples hotel I got back@ 4 am Sunday morning and was having a nightcap @ 4.30 when I heard someone banging on the door.

Going out to investigate I opened the door to see a man in pants and socks near the bin with a steel pole inhis hand (it looked like the end of a clothes rack that I assumed he had got out of Ithe bins -police had itwhen they took him away). Seeing the door opened he approached to let himself in, at which point I said Iwas'nt going to let him and closed and locked the door. I went in and called the po1ice.

About 10 minutes later he was using the pole to smash his way through the glass in the door. Eventually hewas in. I opened my door a bit to see him in the corridor, smeared in blood. I phoned the police again...

A couple of minutes later I heard Steve was out there dealing with him and went Ol~t to led a hand. The guywas babbling but it seemed reasonably non threatening... Steve and I kept him in the lobby until the policearrived, at which point I went off to bed.

It was then Steve who went and gave a statement a couple of days later.

Hope this is useful, let me know if you need anything else. I was called by the polic;e and asked if I wouldgive a statement but they never got back in touch. Would be quite happy to, if necc:asssary.

Having failed to reason with the manager and with the threat of an increase in the noise levelduring summer, we feel now that we have no other alternative but to place a 1:ormal complaintwith regard to the above pub.

Sandhurst Court Ltd repres~nts the Residents of Sandhurst Court. We bought our freehold at theend of April. As you are probably aware, Sandhurst Court is adjacent to the pub and we feel thatthe residents are not taken into consideration with regard to the level of noise. Our residentsinclude the elderly and mothers with babies.

1) Volume of noise. During the summer, when the pub garden is open, the ',olume of the musicis so high that residents closer to the garden cannot hear their televisions I~ven with..theirwindows closed. Those further away have to close their windows, but it is still difficult tolisten to music or the TV or to relax. On occasions the music does not finish untillOpm. Wehave spoken to the Manager who does not lower the volume, although he claims that he has.

We have noticed that in other pub gardens (e.g. Trinity Arms, Brixton) a notice haS beenplaced in the garden, requesting customers to keep the noise at a reasonable level. In addition,their garden closes well before the closing time.

Residents have complained, at first one of the pub managers said they waIlted to beconsiderate but the music was at the same volwrie on later occasions. Th{~ music was notturned down after complaints and has continued until after lOpm. After one Saturday furthercomplaints were made to the other manager. He was not very sympathetic:, the only goodnews was that they would not be using the garden during the colder weath,er, but intended tostart again this summer. This means that the noise will be starting again very soon.

While claiming that he wanted to work with his neighbours, he showed no respect for us, justconfirmed that they would be continuing. This would mean that we cannot. use our gardenduring nice weather, our summer afternoons and evenings would be ruined and ourenjoyment of our homes would be badly affected.

They also have late night licences for their upstairs room and we unden,tand they are trying toextend these.

2) Serious IncidentOn Saturday 20th March -at around 4.00 a.m. a resident heard a man banging at the backdoor. The man had climbed over the wall from the Hope & Anchor. TIle resident went toinvestigate and saw a man in underpants with a metal implement-whic~h we presume he gotfrom rubbish bins outside. Seeing the open door the resident closed it trying to stop himentering the building. The man kept hitting the door and after breaking the windows he wentround to another door and managed to gain entry by smashing the door 'with a large flowerpotfrom the garden. The caretaker intervened to help and called the police who took thetrespasser to the station and took a full statement from our caretaker. I a,ttach anotherstatement, from a resident who witnessed the incident Hope and Anchor staff later told ourcaretaker that he was a chef there.

As you will appreciate this was a very serious incident and we enclose tJl1e receipts for thevarious repairs to the door we had to carry out as a consequence.
