Notice is hereby given that the Board of Directors of Harris CountyMunicipal Utility District No. 438 (the “District”), at a meeting held onMay 9, 2017, adopted:

1. Regulations Governing Water and Sewer Lines and Connections,which provides rules and regulations for connection to the District’ssewer system; and

2. a Rate Order providing rules and regulations for connection to theDistrict’s water, sewer and drainage system as well as charges for theseservices.

IN HARRIS COUNTY, TEXAS

House Hahl Commercial Owners Association, Inc. has filed an applica-tion with the Public Utility Commission of Texas to obtain a Certificateof Convenience and Necessity to provide sewer utility service in HarrisCounty.

The requested area is located approximately 25 miles northwest ofdowntown Houston, Texas, and is generally bounded on the north byTrinity Trail, on the east by House Hahl Road, on the south by HouseHahl Road, and on the west by a line 950 feet west of and parallel toHouse Hahl Road.

The total area being requested for the proposed sewer service area in-cludes approximately 43 acres for each service area and 7 current cus-tomers.

TO REQUEST A CONTESTED CASEHEARING, YOUMUSTINCLUDE THEFOLLOWING ITEMS IN YOURREQUEST: yourname, address, phone number; applicant's name and proposedpermit number; the location and distance of your property/activities relative to the proposed facility; a specific description ofhow you would be adversely affected by the facility in a way notcommon to the general public; a list of all disputed issues of factthat you submit during the comment period and, the statement“[I/we] request a contested case hearing.” If the request forcontested case hearing is filed on behalf of a group or association,the request must designate the group's representative for receivingfuture correspondence; identify by name and physical address anindividual member of the group who would be adversely affected bythe proposed facility or activity; provide the information discussedabove regarding the affected member's location and distance fromthe facility or activity; explain how and why the member would beaffected; and explain how the interests the group seeks to protectare relevant to the group's purpose.

Following the close of all applicable comment and request periods,the Executive Director will forward the application and anyrequests for reconsideration or for a contested case hearing tothe TCEQ Commissioners for their consideration at a scheduledCommission meeting.

The Commission may only grant a request for a contested casehearing on issues the requestor submitted in their timely commentsthat were not subsequently withdrawn. If a hearing is granted, thesubject of a hearing will be limited to disputed issues of fact or mixedquestions of fact and law relating to relevant and material waterquality concerns submitted during the comment period.

TCEQmay act on an application to renew a permit for discharge ofwastewater without providing an opportunity for a contested casehearing if certain criteria are met.

If you submit public comments, a request fora contested case hearing or a reconsideration of the ExecutiveDirector's decision, you will be added to the mailing list for thisspecific application to receive future public notices mailed by theOffice of the Chief Clerk. In addition, you may request to be placedon: (1) the permanent mailing list for a specific applicant name andpermit number; and/or (2) the mailing list for a specific county. Ifyou wish to be placed on the permanent and/or the county mailinglist, clearly specify which list(s) and send your request to TCEQOffice of the Chief Clerk at the address below.
