Recently  Families  for  Freedom  achieved  some victories  challenging  the  power  of  Customs  and 

Border  Patrol.    It’s  been  a  long  struggle  and  it 

continues here in this newsletter we will give you 

a little of the history of our pursuit for information 

and changes regarding CBP enforcement.

In  2008,  Families  for  Freedom  started  receiving 

calls  from  several  New  York  families  who  were 

stopped  by  Customs  and  Border  Patrol  (CBP) 

agents on the Amtrak train or Greyhound bus as 

they were on their way to their jobs or to visit fam­

ily in upstate New York and Chicago. Concerned 

by the significant number of calls, FFF held a rally 

at New York’s Penn Station on April 2, 2008. We 

demanded  a  public  apology,  full  refunds  on  the 

apprehended  passengers’  fares,  among  other 

things. 

Most  of  the  families  reported  that  CBP  officers 

would enter the train or bus and only ask people 

they suspected to be undocumented and/or immi­

grants  for  their  papers.  From  their  experiences, 

we  felt  that CBP was racially profiling people on 

the  train,  based  on  skin  color,  language,  and/or 

accent. A colleague of ours who  is a Caucasian 

immigrant said she was not asked for her Green 

card or passport when CBP boarded.

In partnership with the NYU Law Clinic we decid­

ed  to  file  a  Freedom  of  Information Act  (FOIA) 

request  so  that we could unearth more  informa­

tion  about  who  is  getting  apprehended  on  the 

trains  and  buses  upstate  and  how  CBP  tactics 

implies significant racial profiling by the agency.

In  July  2010,  we  received  data  from  our  FOIA 

request    about  the 

apprehensions  from 

FY2006  –  FY2009. 

With  this  released 

information  our  part­

ners  at  the NYU Law 

Clinic  started  work­

ing with the New York 

Civil  Liberties  Union 

(NYCLU)  to  process  the  data.      Together  in 

November 2011 we released Justice Derailed.  

This  report  is  the  first­ever  in­depth  examina­

tion of  the Border Patrol’s  transportation raids  in 

upstate New York. It paints a disturbing picture of 

an agency resorting to aggressive policing tactics 

in  order  to  increase  arrest  rates,  without  regard 

for  the  costs  and  consequences  of  its  practices 

on New Yorkers’ rights and freedoms. (continued p.2)

Since  the  Occupy  movement  has taken  the  world  by  storm,  Families for  Freedom  has  been  participating in  actions,  workshops  and  more  to draw attention to the fact that banks and  corporations,  supported  by  the government,  continue  to  profit  from immigrant detention and deportation.   

On  December  11th,  Families  for Freedom  participated  in  a  teach  in to  talk about  the devastating affects deportations have on our families to lift up the particular organizing cam­paigns  and  concerns  of  immigrant workers and  to highlight  that global­ized  capital–in  the  form  of  financial institutions,  multinational  corpora­tions, and neoliberal state economic policies–is the impetus for economic migration to the United States. 

Then on December 18th, International Migrants  Day,  under  the  banner  of #ImmigrantsOccupy  we  marched 

with  immigrant  and  worker  rights groups  and  the  Occupy  movement to  highlight  the  importance  of  immi­grants within  the  99%. Together we protested anti­immigrant laws across the country, and took on Wall Street’s construction  of  private,  for­profit immigration  prisons  and  wage  theft from immigrant workers. Even though it was absolutely  freezing, hundreds of people gathered in Foley Square, for a diverse array of music, dance, and street  theater which culminated in  a multi­lingual  General Assembly at Zuccotti Park.  

The  #ImmigrantsOccupy/  #D18 march  came  on  the  heels  of  a December  decision  by  the  U.S. Supreme  Court  to  hear  Arizona’s appeal  of  a  decision  blocking much of  that  state’s  racist  anti­immigrant law, and comes as advocates battle similar legislation in states around the country, including Alabama, Georgia, 

South Carolina and Utah – laws that have already torn immigrant families apart, wreaked havoc on local econ­omies, and made immigrant workers even more  vulnerable  to wage  theft and exploitation.

We  continue  to  participate  in  the Immigrant Workers  Justice Working Group of Occupy Wall Street engag­ing  in  educational  teach  ins  and actions.    On  February  20th  we  will join with members of the OWS Prison Solidarity  group  to  protest  large financial institutions like Wells Fargo for  promoting  for­profit  immigration prisons  and  increasingly  harsh  poli­cies to fill those prisons.
