ORDINANCE NO. CZ18-03

An Ordinance to amend the Zoning Ordinance, Chapter 26 of the Charter Township of West Bloomfield Code of Ordinances, Article 2, Section 2.1 and Article 4, Section 4.30, and Section 4.48; and Article 5, Section 5.11.

THE CHARTER TOWNSHIP OF WEST BLOOMFIELD ORDAINS:

Section 1 of Ordinance

The definition of commercial vehicle as set forth in Chapter 26, Article 2, Section 2.1, which presently reads as follows:

Recreational vehicle shall mean a vehicular unit which provides either temporary living quarters or transportation of recreational, camping or travel apparatus such as campers. The recreational vehicle may have its own motive power or may be designed to be drawn by a motor vehicle. The term recreational vehicle shall include, but is not limited to a motor home, a travel trailer, a truck camper, a folding camper trailer, and/or a fifth wheel.

Recreational unit shall mean any recreational vehicle, off-road or all-terrain vehicle, camper enclosure, trailer, or snowmobile. Units used in conjunction with one another such as snowmobiles mounted on a trailer shall be considered one recreational unit.

Recreational trailer shall mean a vehicle without motive power, designed to be drawn by a motor vehicle and used for carrying property including, but not limited to motorcycles, snowmobiles, off-road vehicles, all-terrain vehicles, recreational units as defined herein, or other equipment for recreational, camping or travel use.

Snowmobiles are recreational units and include motor driven vehicles designed for travel primarily on snow or ice that typically utilize sled type runners or skis, an endless belt tread, or any combination of these.

Watercraft shall mean a vessel designed for navigation on water including any boat, canoe, catamaran, dinghy, personal watercraft, or similar vessel.

Section 4 of Ordinance

Chapter 26, Article 4, Section 4.30, titled Parking and/or Storage of Large Trucks, Equipment, Merchandise, Vehic.le.s, and Vehicle Repair on Residentially Zoned Property is herehy amended as follows:

Sec. 4.30. Parking and/or Storage of Vehicles, Trucks, Trailers, Equipment, Merchandise, and Vehicle Repair on Residentially Zoned Property.

1. Passenger vehicles. The parking of licensed, operative passenger vehicles including cars, vans, pick-up trucks, sport utility vehicles, and cross-over vehicles is permitted on residentially zoned property.

2. Non-passenger vehicles. The parking and/or storage of the following non-passenger trucks and vehicles is prohibited on residentially zoned property, unless the vehicle is housed entirely within an enclosed structure: delivery, box, flatbed, platform, panel, refrigerator, tow, dump, garbage, stake, and cube trucks; transport vehicles, tractor units, cab forward, semi-tractors with or without trailers; buses and limousines. The parking of non-passenger vehicles used by contractors, service, and delivery persons while servicing a residence are permitted for the time period of the service only.

3. Unlicensed or inoperative vehicles. The parking and/or storage of unlicensed or inoperative vehicles on residentially zoned property is prohibited unless housed entirely within an enclosed structure.

4. Trailers. The parking and/or storage of an open or enclosed trailer is prohibited on residentially zoned property unless i) housed entirely within an enclosed structure; or ii) is a watercraft or recreational trailer stored in compliance with the provisions of Chapter 10, Article IV. Trailers used by contractors, service, and delivery persons while servicing a residence are permitted for the time period of the service only.

5. Equipment. The parking and/or storage of earth moving equipment, landscape equipment, mobile cranes, or construction equipment is prohibited on residentially zoned property unless housed entirely within an enclosed structure. Such equipment used by contractors, service, and delivery persons while servicing a residence are permitted for the time period of the service only.

6. Seasonal parking. The parking and/or storage of passenger vehicles equipped with snow plows or salt spreaders is permitted on residentially zoned property during the time period from November 1 to April 1.

7. Merchandise. The outdoor storage of new and/or used merchandise for sale and/or distribution is prohibited on residentially zoned property.

8. Parking on residential lawns. The parking and/or storage of a motor vehicle on a residential lawn is prohibited.

9. Vehicle repair. The repair of any vehicle for payment is prohibited on residentially zoned property.

10. Vehicle parts. The storage of vehicle parts for use in the repair of a vehicle for payment is prohibited on residentially zoned property.

11. Watercraft; recreational vehicles; recreational units. The parking and/or storage of watercraft, recreational vehicles, and recreational units on residential property is regulated by Chapter 10, Article IV.

Section 5 of Ordinance

Chapter 26, Article 4, Section 4.48.2.E, related to temporary permits for the parking of a trailer coach is hereby repealed, and Section 4.48.2.E shall be RESERVED.

Section 6 of Ordinance

Chapter 26, Article 5, Section 5.11.3, related to outdoor storage is hereby amended as follows:

Sec. 5.11. Performance Standards.

3. Outdoor storage. In all zoning districts, outdoor storage of goods, materials, wood, lumber, merchandise, equipment, or vehicles shall comply with applicable provisions of Section 4.30 of this chapter and applicable regulations of Chapter 10, Article IV of the Code of Ordinances. Except as otherwise allowed under Chapter 10 Article IV, all

permitted outdoor storage shall be located in the rear yard only and shall be screened by a solid enclosure consisting of a fence or wall not less than the height of the outdoor storage, subject to the provisions of Section 26-5.13 of this chapter. The area of outdoor storage shall be included in the lot coverage calculation for maximum lot coverage pennitted on a lot as defined in Section 26-2.1 and is subject to the provisions of Section 26-3.5 of this chapter.

Section 7 of Ordinance

Should any section, subdivision, sentence, clause or phrase of this Ordinance, be declared by the Courts to be invalid, it shall not affect the validity of the remainder of the Ordinance or any part other than the part invalidated.

Section 8 of Ordinance

Within fifteen (15) days after adoption, a notice of ordinance adoption shall be published in a newspaper of general circulation in the Township including the effective date of the amendment and the place where and time when a copy of the amendment may be purchased or inspected.

Section 9 of Ordinance

Pursuant to the Michigan Zoning Enabling Act, MCL 125.3401(6), this Ordinance shall take effect upon the expiration of seven (7) days after publication.
