This will ultimately result in increased activity in our economic development arena very soon. Finally, although this recession has had an impact, our region has fared much better than other regions of this state and country. From discussions with many members, business has remained equal to, or in many cases better than last year through the first 6 months of 2010. This is certainly an indication that we have most likely endured the worst of this downturn. It’s all uphill from here! To that end, the Chamber is planning many new programs and services to be introduced in the last half of this year that we believe will help your business become stronger and poised for growth in 2011. Remain vigilant, stay connected, utilize all your resources and position yourself for new opportunities in the months ahead! Enjoy the summer!

around us. The on-going construction and recent expansion approvals for GLOBALFOUNDRIES at the LFTCinsures strong economic activity into 2011 and beyond. The Chamber Provides Valuable Recommendations for Members

When an Ohio-based company in the casino gaming industry needed a marketing and public relations firm to createand execute a 10th anniversary promotional campaign, thecompany’s business manager learned about the business an-niversary consulting services of Bartel Communications, Inc.,through the Internet and the firm’s website. Subsequently, herequested examples of successful business anniversary promo-tional campaigns that Bartel Communications had carried out.One of the case studies Bartel Communications sent was thatof The Chamber of Southern Saratoga County.

In 2007, The Chamber launched a 40th AnniversaryImage Campaign to position itself as an established, dynamicorganization with a significant history of success and achieve-ments. Bartel Communications created the branding message“Marking 40 Years of Passion, Endurance, Loyalty, Strength”and developed an integrated marketing and public relationscampaign. The campaign was a resounding success, resulting in awards from the American Chamber of CommerceExecutives and The American Marketing Association.

“This award-winning anniversary campaign notwithstand-ing, the odds were stacked against us with this prospectiveclient,” says president and chief creative officer Pauline Bartel. Among the references submitted were those of Chamber Presi-dent Peter Aust and Chamber Marketing Director LorettaRigney. “Peter and Loretta were the aces we needed to turnthe odds around in our favor,” Pauline says. “When I receivedthe call that Bartel Communications had won the contract, thebusiness manager told me the element that sealed the deal wasthe recommendation Loretta had provided.”

Congressman Murphy Luncheon ReportOn Wednesday, July 7, Congressman Scott Murphy

joined business leaders from three regional Chambers ofCommerce (Adirondack Regional, Saratoga County andSouthern Saratoga County) for a luncheon at the GideonPutnam Hotel to address issues regarding various federallegislation impacting business. In his opening remarks, hethanked the business community for their persistentmessaging to he and his colleagues on issues that ultimatelyare detrimental to economic growth.

During the question and answer discussion, ChamberPresident Peter Aust facilitated questions from attendees.Some of the issues included how the federal government canassist in the discussions with NYRA and the state of affairs inthe NYS Legislature. Broadband infrastructure and healthreform was addressed with the congressman supporting both.As a final discussion, the congressman again stated his supportof the Employee Free Choice Act or “Card Check” which thebusiness community has strongly opposed. His forthrightnessand honesty in defending his positions was applauded eventhough some of his positions are in contrast to the Chambers.

“Prior Approval” ReinstatedYour Chamber, in partnership with the Chamber Alliance

of NYS, won a hard fought battle over the past two years toreinstate the regulatory legislation to have health insurancepremiums reviewed and approved by the NYS InsuranceDepartment prior to them being billed to insurance holders.We believe that with this regulatory oversight, insurancecarriers will now have to insure their rate increases are fullyjustified by actuarial data and that ultimately this may resultin more accurate rate increases in the future.

The Never-Ending Story in theNYS Legislature

Last week, both the Senate and Assembly left Albany forthe July 4th holiday weekend. Their departure traditionallywould mark the conclusion of what has undoubtedly beenone of the interesting and intense sessions, but it is highlyanticipated that the legislature will return in the near future.The legislative discourse was dominated by polarization onmany issues, sometimes positions broke along traditionalparty lines; others upstate -downstate; rural - urban; labor-business or just personalities.

In the end, a number of bad bills have passed. Thesebills that will adversely impact job creators in the State ofNew York have advanced in one house or the other include:

Service Worker Prevailing Wage Mandates(S.7096-A SCHNEIDERMAN / A.10257-AGianaris) This bill would amend the Labor Law toextend wage mandate requirement to private businesses.This legislation would amend the definition of a public

agency to include electric and gas utilities. Ultimately thelegislation will translate into higher energy cost for allconsumer including businesses, the elderly, schools,daycares, local governments and hospitals. The billpassed the Senate 32-27 and the Assembly 90-43. The bill now goes to the Governor for approval or veto.New York State Workplace Bullying(S.1823-B MORAHAN / A.5414-B Englebright)This legislation would create a new private cause ofaction for employees, this proposal would createpotential opportunities for employees to embellishcertain workplace situations for personal financial gainby claiming to have suffered from ”bullying” while atwork. The bill passed the Senate 45-16 and was held inthe Assembly Labor Committee. Passed Assembly 122-21, but has not passed the SenateIndependent Contractor Classification (S.6194FOLEY / A.8237-B John / S.5847-C ONORATO /A.9706-B (Part SS)) These bills would have a severeimpact on the New York State construction industry, byapplying an unnecessary definition of an independentcontractor to the state’s labor law. Passed Assembly 110-28, passed Senate 43-4

Fortunately, a number of bad bills have not passed. TheChamber, working in conjunction with many, many otherorganizations, has to date prevented a number of bills thatwill adversely impact business from advancing in one houseor the other. They include the following:

IDA Labor Mandates (S.1241 THOMPSON /A.3659 Hoyt) This legislation would impose costlyand burdensome mandates to economic developmentprojects financed by Industrial Development Agencies.Farm Labor Mandates (S.2247-B ONORATO /A.1867-B Nolan / S.7787 ONORATO)This legislation would inappropriately imposeunsustainable wage mandates on private farms andmakes the false assumption that these mandates willhave no impact on our New York farms. These wagemandates will likely result in fewer jobs for New Yorkfarm workers, as more of our food will be produced inother states and other countries.Paid Family Leave Mandate (S.5791 SAVINO /A.8742 Silver) This legislation would mandate that allemployers provide a 12-week paid family leave for itsworkforce, regardless of the size of the business. A ”onesize fits all” mandate of this nature does not adequatelyfactor in the wide range of employment situations thatare in place throughout New York State.

The Chamber has written letters of opposition to ourlegislative leaders regarding these issues in addition to phonecalls and emails. We urge you to continue your personalefforts to oppose these bills as they are expected to beaddressed in future sessions, possibly this year.
