For CDBG-R Funds

Jefferson County, Alabama, and a consortium of municipalities located within Jefferson County (excluding Birmingham, Bessemer, Hoover, County Line, West Jefferson, Sumiton, Argo, and Helena), received from the U.S. Department of Housing and Urban Development an annual grant for the 2008 Program Year from the Community Development Block Grant program, HOME program, and the Emergency Shelter Grant program.

Pursuant to the requirements of the Housing and Community Development Act of 1974, as amended, Jefferson County, Alabama is hereby publishing the Proposed Substantial Amendment to the Consolidated Plan 2008 Action Plan. The Final Substantial Amendment to the Consolidated Plan 2008 Action Plan will be developed after receiving citizen comments and views at a public hearing to be held on Monday, May 18, 2009, at 2:00 p.m. at the Jefferson County Courthouse, 716 Richard Arrington Jr. Blvd. North, Suite A-420 (Downtown Birmingham). Comments regarding this proposal will be received until 5:00 PM on Friday, May 22, 2009. Special accommodations are available, upon request, for those with disabilities. This is a summary of the proposed Substantial Amendment to the Consolidation Plan 2008 Action Plan for Community Development Programs. The Proposed Substantial Amendment to the Consolidated Plan 2008 Action Plan has been developed so as to give maximum feasible priority to activities which will principally benefit low and moderate income persons and families. In addition, the projected use of funds is consistent with Jefferson County’s goal of:

a) Stabilizing low and moderate income neighborhoods located in consortium cities and unincorporated Jefferson County;

b) Providing safe and affordable housing;c) Providing jobs for low and moderate income persons and families; andd) Improving the economic life in Jefferson County by encouraging business

development.

The purpose of this Amendment is to include in the Consolidated Plan 2008 Action Plan the CDBG-R funding under the American Recovery and Reinvestment Act of 2009. The purpose for CDBG-R funds under this amendment is to reduce the current rate of foreclosures through housing counseling by a HUD certified housing counseling agency and to improve energy efficiency and a green environment in the homes of low and moderate income home-owners under Jefferson County Housing Emergency Grant Program.

Activities to be Undertaken:

(1) Foreclosure Legal Aid: This activity will provide assistance to Legal Services Alabama to provide foreclosure prevention services to lower income homeowners.

(2) Job Retention: This activity will provide assistance to Child Care Resources which provides child care to low and moderate income families thus enabling household adults to maintain existing jobs.

(3) Improve energy efficiency and a green environment in the homes of low and moderate income home-owners under Jefferson County’s Housing Emergency Grant Program.

(4) Housing Program Delivery: Direct program delivery costs for Jefferson County’s Housing Emergency Grant Program.

(3) Administration: a) Eligible Pre-Award Administrative Costs for Jefferson County, Alabama – Those costs directly related to preparing the application for submission to HUD. b) Eligible Administrative Costs – (1) Accounting for use of grant funds; (2) Preparing reports to HUD; (3) Program audits; (4) Administering the grant; and (5) Staff salaries and training for staff who will administer the program and for case managers. c) Administrative Costs – 10 percent maximum to the grantee and its sub-grantees.

La modificación sustancial al plan de acción 2008 ha sido desarrollado para darle máxima prioridad a actividades q principalmente beneficiaran a personas y familias de bajos y moderados ingresos. En adición, el uso proyectado de los fondos es consistente con la meta del condado de Jefferson de:

a) Estabilizar los vecindarios de bajos y moderados ingresos localizados en las ciudades aledañas y no incorporadas al condado de Jefferson.

b) Proveer vivienda de bajo precio y segura.c) Proveer trabajos para personas y familias de bajos y moderados ingresos d) Mejorar la vida económica del condado de Jefferson impulsando el desarrollo de

negocios.

El propósito de esta modificación es incluir en el plan de acción 2008 la financiación del CDBG-R bajo la ley de recuperación y reinversión del 2009. El propósito de los fondos para el CDBG-R bajo esta modificación es reducir la actual cantidad de embargos (foreclosures) a través de una conserjería de vivienda hecha por una agencia certificada por la HUD y para mejorar la eficiencia energética y promover un ambiente verde y ambiental en los propietarios de hogares de bajos y moderados recursos bajo el programa de donaciones de emergencia del condado de Jefferson.

(2) Retención de trabajos: Esta actividad proveerá asistencia a Child care resources la cual presta servicios de cuidado infantil a familias de bajos y moderados ingresos, por tanto permitiendo a los adultos de la casa a mantener sus empleos.

(3) Mejorar la eficiencia de energía y un ambiente verde y ambiental:A través del programa de donaciones de Jefferson county para familias de bajos y moderados ingresos.(4) Ejecución del programa de viviendaCostos directos de la ejecución del programa de vivienda para el programa de donaciones de emergencia del condado de Jefferson.

(5)Administración: Costos administrativos elegibles para el condado de Jefferson, Alabama- aquellos costos directamente relacionados a preparar la presentación de la aplicación al HUD. THE CDBG-R SUBSTANTIAL AMENDMENT

A. The grantee shall instead identify any other Recovery Act funding to be used in conjunction with each activity and total activity budget from all funding sources. In addition, grantees must provide information concerning CDBG-R assisted activities in an electronic spreadsheet provided by HUD. The information that must be reported in the spreadsheet includes activity name, activity description, CDBG-R dollar amount budgeted, eligibility category, national objective citation, additional Recovery Act funds for the activity received from other programs, and total activity budget. An electronic copy of the spreadsheet and the format will be available on HUD’s recovery website at http://www.hud.gov/recovery. Grantees must include a paper copy of the spreadsheet in their substantial amendment and must submit an electronic of the completed spreadsheet to [email protected].

B. A description of how the distribution and uses of the grantee’s CDBG-R funds will meet the requirements of Title XII of Division A and Section 1602 of the Recovery Act: that, in selecting projects to be funded, recipients shall give priority to projects that can award contracts based on bids within 120 calendar days from the date the funds are made available to the recipients; and that for CDBG-R funds being used for infrastructure investments, recipients shall give reference to activities that can be started and completed expeditiously, including a goal of using at least 50 percent

of the funds for activities that can be initiated not later than 120 calendar days after February 17, 2009.

Response: Jefferson County has reviewed its’ ongoing and planned CDBG-R activities to determine which activities could be awarded based on bids within 120 calendars days from the date the funds are made available. Because of past reductions in CDBG, Jefferson County does not have any infrastructure projects which could be awarded within the 120 calendar days as described above. Jefferson County has, however, reviewed existing housing rehabilitation and public service applications and chosen activities which can, in many instances meet the 120 days award goal. These are as follows:

(1) Foreclosure Legal Aid: This activity will provide assistance to Legal Services Alabama to provide foreclosure prevention services to lower income homeowners. This is a current CDBG proposal which might otherwise be unable to fund due to a limited availability of regular CDBG dollars. This falls under the Public Service eligibility criteria. This award can be made within 120 days of our receipt of funds.

(2) Job Retention: This activity will provide assistance to Child Care Resources which provides child care to low and moderate income families thus enabling household adults to maintain existing jobs. The activity will be funded in its entirety with CDBG-R funds. This is a previous CDBG proposal which Jefferson County was unable to fund due to the limited availability of regular CDBG dollars. This falls under the Public Service eligibility criteria. The proposal was submitted in response to a solicitation for CDBG proposals for the upcoming fiscal year. The award can be made within 120 days of our receipt of funds.

(3) Improve energy efficiency and a green environment in the homes of low and moderate income home-owners under Jefferson County’s Housing Emergency Grant Program. This activity will be funded with CDBG-R and CDBG funds.

Jefferson County through its Housing Emergency Grant Program has a current waiting list of approximately 295 applications from homeowners requesting some type of emergency assistance. The receipt of CDBG-R funds will dovetail with our existing CDBG program and assist us in addressing the emergency housing needs from homeowners who have been waiting approximately 4 ½ years for assistance. We are constantly working these cases and many will be bid and awarded within the 120 day goal. CDBG-R funds will be used to address energy efficiency and green environmental issues. CDBG funds will be used to address the other needs of the homeowner.

C. For each activity, a written description of how the use of CDBG-R funds for the activities proposed will maximize job creation and economic benefit in relation to the CDBG-R funds obligated, and will address the Recovery Act, by:

(A) Preserving and creating jobs and promoting economic recovery;(B) Assisting those most impacted by the recession;(C) Providing investment needed to increase economic efficiency;(D) Investing in transportation, environmental protection, or other infrastructure

that will provide long-term economic benefits;(E) Minimizing or avoiding reductions in essential services; or(F) Fostering energy independence.

Response:

(1) Foreclosure Legal Aid: This activity will provide assistance to Legal Services Alabama to provide foreclosure prevention services to lower income homeowners. The activity will be funded in its entirety with CDBG-R funds.

Assisting those most impacted by the recession: This program will assist those who have been adversely impacted by the recession and predatory lending by providing no-cost legal services to assist them in the retention of their homes. In many cases lenders are more than willing to work with homeowners and Legal Services in finding a payment formula that will work for them.

(2) Job Retention: This activity will provide assistance to Child Care Resources which provides supplemental child care assistance to low and moderate income families thus enabling household adults to maintain existing jobs. The activity will be funded in its entirety with CDBG-R funds.

Preserving and creating jobs and promoting economic recovery: This program will enable parents to look for and maintain employment by providing a low cost alternative to high cost child care.

Assisting those most impacted by the recession; Same as above.

(3) Improve energy efficiency and a green environment in the homes of low and moderate income home-owners under Jefferson County’s Housing Emergency Grant Program. This activity will be funded with CDBG-R and CDBG funds.

(B) Assisting those most impacted by the recession:

Jefferson County through its Housing Emergency Grant Program has a current waiting list of approximately 295 applications from homeowners requesting some type of emergency assistance. The receipt of CDBG-R funds will dovetail with our existing CDBG program and assist us in addressing the emergency housing needs from homeowners who have been waiting approximately 4 ½ years for assistance. These homeowner’s have suffered greatly from a variety factors including recession and its affect on their ability to hold even a minimum wage job; predatory lending practices which appear to be targeted to lower income households and inflation. Approximately 50% of the households within the existing MasterList have incomes of 30% or less of median household income and 70% have incomes of 50% or less of median household income.

(C) Providing investment needed to increase economic efficiency: We feel that economic efficiency is promoted by eliminating, where possible, emergency housing repairs within the 0-80% of median income population. Jefferson County’s proposal will assist this process by enabling qualified homeowners to get assistance without having to pay ruinous financing costs to take care of emergency repairs, thus enabling them to spend more money on essentials such as food, basic clothing and medicine.

D. For each activity, the number of full- and part-time jobs estimated to be createdand retained by the activity (including permanent, construction and temporary jobs).Response:

(1) Foreclosure Legal Aid: This activity will provide assistance to Legal Services Alabama to provide foreclosure prevention services to lower income homeowners.

E. A description of the activities that will be carried out with CDBG-R funds thatpromote energy conservation, smart growth, green building technologies, orreduced pollution emissions.

Improve energy efficiency and a green environment in the homes of low and moderate income home-owners under Jefferson County’s Housing Emergency Grant Program. This activity will be funded with CDBG-R and CDBG funds. This CDBG-R fund will be targeted to homeowners who need assistance in increasing energy efficiency and reducing household pollutants as follows:

(1) Replace outmoded and energy inefficient heating units with an Energy Star Certificated units;

(2) Replace/repair as required septic systems where raw sewage is present either to smell or test including system where sewage is backing up into the home through the drains;

(3) Provide sanitary facilities where none are present;(4) Replace windows (see 6) as required with insulated windows;(5) Replace doors as required with insulated doors;(6) Home Sealing (Energy Star):

Seal air leaks to reduce drafts and get the full performance out of insulation.Always seal air leaks before adding insulation.Add insulation to keep home comfortable and energy-efficient.Usually, the easiest and most effective place to add insulation is in the attic.This can improve comfort throughout the home. The U.S. Department of Energy(DOE) recommends insulation levels for each part of the house, tailored forvarying climates. Visit www.energystar.gov and click on Home Sealing to seerecommended levels of insulation.Choose ENERGY STAR qualified windows when replacing or adding windowsto your home. In addition to making you feel more comfortable, they reduce UV

(7) HVAC Requirements (Energy Star):

a. Duct Sealing:

Poorly performing ducts can leak conditioned air and reduce your system’sefficiency by as much as 20%, by causing it to work harder to keep yourhome at a comfortable temperature. Ducts are commonly concealed inwalls, ceilings, attics, basements, or crawl spaces, which can make themdifficult to access and repair. EPA recommends using a professionalcontractor for duct improvements. Many contractors who install heatingand cooling systems also repair ductwork. Improve your ducts by sealing leaks and insulating the ducts in attics and crawl spaces.

Check, measure, and identify leaks with diagnostic equipment. Repair or replace damaged, disconnected, or undersized ducts. Straighten out flexible ducts that are tangled or crushed. Seal leaks and connections with mastic, metal tape, or an aerosolbased

sealant. Duct tape should never be used because it will notlast. Test airflow after sealing ducts.

Seal all registers and grills tightly to the ducts. Insulate ducts in unconditioned areas, like attics and crawl spaces, with duct insulation that carries an R-value of 6 or higher. Include a new filter as part of any duct system improvements. Conduct a Combustion Safety Test after ducts are sealed to ensure

there is no backdrafting of gas or oil-burning appliances.

CERTIFICATIONS

(1) Affirmatively furthering fair housing. The jurisdiction will affirmatively further fair housing, which means that it will conduct an analysis to identify impediments to fair housing choice within the jurisdiction, take appropriate actions to overcome the effects of any impediments identified through that analysis, and maintain records reflecting the analysis and actions in this regard.

(2) Anti-lobbying. The jurisdiction will comply with restrictions on lobbying required by 24 CFR part 87, together with disclosure forms, if required by that part.

(3) Authority of Jurisdiction. The jurisdiction possesses the legal authority to carry out the programs for which it is seeking funding, in accordance with applicable HUD regulations and other program requirements.

(4) Consistency with Plan. The housing activities to be undertaken with NSP funds are consistent with its consolidated plan, which means that NSP funds will be used to meet the congressionally identified needs of abandoned and foreclosed homes in the targeted area set forth in the grantee’s substantial amendment. (5) Acquisition and relocation. The jurisdiction will comply with the acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (42 U.S.C. 4601), and implementing regulations at 49 CFR part 24, except as those provisions are modified by the Notice for the NSP program published by HUD.

(6) Section 3. The jurisdiction will comply with section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u), and implementing regulations at 24 CFR part 135.

(7) Citizen Participation. The jurisdiction is in full compliance and following a detailed citizen participation plan that satisfies the requirements of Sections 24 CFR 91.105 or 91.115, as modified by NSP requirements.

(8) Following Plan. The jurisdiction is following a current consolidated plan (or Comprehensive Housing Affordability Strategy) that has been approved by HUD.

(9) Assessments. The jurisdiction will not attempt to recover any capital costs of public improvements assisted with CDBG funds, including Section 108 loan guaranteed funds, by assessing any amount against properties owned and occupied by persons of low- and moderate-income, including any fee charged or assessment made as a condition of obtaining access to such public improvements. However, if NSP funds are used to pay the proportion of a fee or assessment attributable to the capital costs of public improvements (assisted in part with NSP funds) financed from other revenue sources, an assessment or charge may be made against the

property with respect to the public improvements financed by a source other than CDBG funds. In addition, with respect to properties owned and occupied by moderate-income (but not low-income) families, an assessment or charge may be made against the property with respect to the public improvements financed by a source other than NSP funds if the jurisdiction certifies that it lacks NSP or CDBG funds to cover the assessment.

(12) Excessive Force. The jurisdiction certifies that it has adopted and is enforcing: (1) a policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and (2) a policy of enforcing applicable State and local laws against physically barring entrance to or exit from, a facility or location that is the subject of such non-violent civil rights demonstrations within its jurisdiction.

(13) Compliance with anti-discrimination laws. The NSP grant will be conducted and administered in conformity with title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d), the Fair Housing Act (42 U.S.C. 3601-3619), and implementing regulations.

(14) Compliance with lead-based paint procedures. The activities concerning lead-based paint will comply with the requirements of part 35, subparts A, B, J, K, and R of this title.

(15) Compliance with laws. The jurisdiction will comply with applicable laws.

CDBG-R Specific Certifications

The entitlement community certifies that:

1. The jurisdiction will comply with Title XII of Division A of the American Recovery and Reinvestment Act of 2009.

2. In selecting projects to be funded, the grantee will give priority to projects that can award contracts based on bids within 120 days from the date the funds are made available to the recipients, and will ensure maximum job creation and economicbenefit.

3. When CDBG-R funds are being used for infrastructure investments, the grantee will give preference to quick-start and finish activities, including a goal to use at least50 percent of the funds for activities within 120 days of enactment of the Recovery Act.

4. All iron, steel and manufactured goods used in construction, alteration, repair, or maintenance of a public building or public work project assisted with CDBG-Rfunds under the Recovery Act must be produced in the United States unless the Secretary finds that:

(1) the requirement is inconsistent with public interest; (2) those goods are not reasonably available or produced in sufficient quantity in the

U.S.; (3) or the use of the goods will increase the project cost by more than 25 percent.

5. The President of the Jefferson County Commission certified that any infrastructure investments have received the full review and vetting required by law and that the chief executive accepts responsibility that the infrastructure investment is an appropriate use of taxpayer dollars. Alternatively, a grantee’s chief elected official may certify that infrastructure investments will receive the full review and vetting required by law and that the chief executive accepts responsibility that the infrastructure investment is an appropriate use of taxpayer dollars.

6. For activities carried out with CDBG-R funds using the urgent need national objective where the urgent need is the current economic conditions, the activity isalleviating current economic conditions which pose a threat to the economic welfare of the community in which the activity is being carried out, the recipient is unable to finance the activity on its own, and other sources of funding are not available.

7. The aggregate use of CDBG-R funds shall principally benefit low- and moderate-income families in a manner that ensures that at least 70 percent of the grant is expended for activities that benefit such persons over the life of the CDBG-R grant.
