President’s Message Jessie L. Cormier, CP, LCP

President 2011-12

It has been said that to know where you are going, you need to know who you are and where you’ve been. Before being appointed president–elect and installed as president at LSPA’s Annual Meeting on September 17, 2011, I have been an active member of LSPA. Since becoming a member in 1989 (if memory serves), I’ve been CLE chairperson, Certification chairperson, Historian, Archives chairperson, NALA Liaison, District Director, Newsletter chairperson and LCP Review Course chairperson. I can confidently say that I know where LSPA has been and who we are. LSPA is 26 years strong. At the time we came into existence, there were paralegal associations in the major population areas of Louisiana, some of which continue to flourish and some have dissolved. LSPA exists to support local paralegal associations and individual paralegals in areas without a local association. My vision of LSPA includes being: A resource of information and assistance A network of colleagues A mentor to those entering the profession A source of continuing paralegal

education opportunities

A sponsor of paralegal certification in Louisiana

A supporter of national paralegal certification

Every president, every officer and every member who ever served LSPA has contributed to the current well-being of this association. I am thankful for every one of those dedicated paralegals. I’d like LSPA’s members to share their thoughts and comments regarding the benefits and programs you want LSPA to provide. What is your vision for LSPA in the future? LSPA 2011 OUTSTANDNG PARALEGAL OF THE YEAR

The Outstanding Paralegal of the Year Award is awarded only to those individuals who have shown the qualities of a truly “Outstanding Paralegal”. Sonjanita Jordan exhibits these qualities and was chosen as the 2011 LSPA Outstanding Paralegal of the Year. This year Rhonda McManus and Sonjanita Jordan were nominated for this award. The committee of attorneys charged with the responsibility of reviewing the information provided and selecting the recipient of the award had a very difficult job. Both nominees exhibited the qualities that make them truly “Outstanding” Paralegals. In addition to the nomination by a member of LSPA, Sonjanita was recommended for this award by several people whose lives she has touched in the past few years. As her current employer said “Ms. Jordan’s energy seems limitless.” In addition to her OPY, Sonjanita was winner of a scholarship from the Lone-Wa Missionary Baptist Church in Monroe, the Kinsey Memorial Funds Scholarship Award from the University of Louisiana at Monroe, the Shades of Black Scholarship/Book Award from the University of New Orleans, the Sherman Davis Extra Mile Award and the Sherman Davis Exemplary Award. She has successfully completed a Business/Computer Skills program at the Opportunities Industrialization Center of Ouachita, Inc., Paralegal Certification Program at the University of New Orleans, Jackson Hewitt Tax Course, Southern University Louisiana Economic Development Small Business Proposal Writing Class, as well as other courses, seminars and workshops.

Sonjanita C. Jordan Sonjanita has volunteered to serve various organizations including the Opportunities Industrialization Center of Ouachita, Inc., the Living Word International Church, the Veterans Celebrate Freedom Fund Raiser in Slidell, the University of New Orleans Team Teach Program, and the UNO Paralegal Studies Program. In November, 2010 she served as the O.I.C. Career Day Speaker. As LSPA’s District Director for the New Orleans area, Sonjanita continued to provide help to the former Director of the UNO Paralegal Studies Program, the graduates, and prospective employers.

In addition to her involvement in LSPA where she serves as Professional Development Committee Chair, Sonjanita is currently a Director of the Citizens United International Advisory, Secretary of the Concerned Citizens 4 St. Tammany Parish, Employment Committee Chair and on the Paralegal Advisory Board of the Herzing University, and a member of the New Orleans Paralegal Association. She has served as Vice President of Dove Outreach, Inc., Louisiana Chair for the National Congress of Black Women, O.I.C. Alumni President, Advisory Board for JAG (Jobs of America’s Graduates), and has served in various positions on the LSPA board. The former Director of the UNO Paralegal Studies Program says that Sonjanita “has proven herself to be a dedicated and professional student of law, a teacher and advisor for legal students and someone truly in love with the practice of law.” Sonjanita’s excellent grades and motivation earned her high marks by her instructors and students and enabled her to teach a number of paralegal courses. Although the Paralegal Studies Program was discontinued, Sonjanita continues to provide assistance with job placements. “She already is an outstanding example of what a paralegal can and should bring to the practice of law.” The Director of Programs and Training of the Opportunities Industrialization Center of Ouachita, Inc. tells us that in her volunteer work for the organization Sonjanita exhibited “an untiring effort to achieve perfection” with a “creative mind and independent work ethic” and “exceptional decision making abilities”. “Her sincerity and integrity have earned her respect and admiration”. She is ‘very organized, efficient, extremely competent, and has an excellent rapport with people of all ages.” Sonjanita is “truly professional”, “industrious and dedicated”.

The Ministry Director of the Living the Word International Church was so impressed by Sonjanita’s commitment and dedication to tasks that had been assigned to her that Sonjanita was asked to oversee the Youth Sunday School which ministers to children from seven to ten years of age. “This facet of the ministry now runs like a well-oiled machine. . . The children not only enjoy themselves in Sunday School, they are excited about learning.” Sonjanita exhibited leadership ability, a positive attitude, and proved to be conscientious and trustworthy as well as a joy to work with. Her prior employer advised “Ms. Jordan has exhibited qualities of trustworthiness, diligence and competence. She is very well organized and carries out any tasks requested in an efficient and intelligent manner.” Sonjanita’s current employer with the Louisiana State Bar Association advised that Sonjanita “has been a tremendous asset to the LSBA”. She “demonstrates every day that she is a conscientious, dependable team player, who is willing to help co-workers and other departments.” She is impressed by Sonjanita’s work ethic, excellent time management, organization and communication skills, and her “keenly-developed gift for attention to detail”. In addition, she is ethical and “a woman of character and grace” with “a strong moral compass” who is well respected by her co-workers and clients. She fosters “personal and professional growth for her co-workers” and “creatively used adverse work situations as a means for developing new skills and strengthening office relationships”. Her “quest for knowledge and new skills is never ending.”

Congratulations, Sonjanita! You have truly earned the right to be called an “Outstanding Paralegal”. We are proud that you are a member of LSPA.

Highlights of the LSPA 26th Annual Membership Meeting

LSPA held its Annual Membership Meeting on September 17, 2011, in Covington, Louisiana. President Rhonda K. McManus called the meeting to order and welcomed all LSPA members and guests. She then announced Governor Bobby Jindal’s Proclamation of September 11-17, 2011, as Paralegal Week in Louisiana. The current officers, district directors and committee chairs were recognized and commended for their voluntary contribution, hard work and successful progress during the year. All NALA certified paralegals, advanced paralegals and Louisiana certified paralegals were recognized. Charter member, Jimmie Murvin, ACP, LCP, was commended for her long-term membership and many years of service to LSPA. President McManus recognized LSPA Past Presidents and extended appreciation for their service and contributions to LSPA and to the paralegal profession in Louisiana. New members were welcomed and challenged to actively support their local and state paralegal associations and to become involved. The business session began with the minutes of the 25th LSPA Annual Membership Meeting, which were read and approved. The annual report of the Treasurer was read and approved. The Louisiana Certified Paralegal Exam update of LCP Board Certifying Chair, Shonnie Broussard, was presented by President McManus. Jessie L. Cormier, CP, LCP, was recognized as Louisiana’s newest Louisiana Certified Paralegal, having obtained her LCP credential in the Fall of 2010. Parliamentarian, Camille Moran, CP, read the rules of the annual meeting. She then presented in detail the proposed LSPA Bylaw amendments, which were approved. Treasurer, Rebecca B. Maum, presented each line item of the proposed Budget for the coming term, which was approved. President McManus acknowledged that Shondra D. Broussard, CLA, LCP, will continue her term as LCP Certifying Board Chair, and Stacy J. Koon will

continue her term as District I Director for the New Orleans area. President McManus announced that Jessie L. Cormier had been appointed as President-Elect in August 2011, and, according to the Bylaws, Jessie L. Cormier, CP, LCP, will serve LSPA as President during the coming term of 2011-2012. The Election process began and the following LSPA officers were elected: First Vice President: Debbie Billiot, of Lafayette Secretary: Sandy Pourciaux, CP, of Lafayette Treasurer: Rebecca B. Maum, of Baton Rouge NALA Liaison: Deborah Fontenot, CP, of Lafayette Members were provided the opportunity to elect a district director for each of their districts, however, none were elected during the meeting. It was acknowledged that, in accordance with the Bylaws, district directors may be appointed during the coming term. Incoming President, Jessie L. Cormier, announced the appointment of Camille Moran, CP, as Parliamentarian. Jimmie Murvin, CP, LCP, then administered the Installation of new LSPA officers.

Outgoing President, Rhonda K. McManus, passed the Torch and the care and keeping of “Ms. LSPA” to the competent and capable, incoming President, Jessie Cormier, CP, LCP, and wished Jessie and LSPA success in the coming term.

Highlights of the First Quarterly Board Meeting of LSPA

The First Quarterly Board Meeting of the

Louisiana Paralegal Association was held on

November 5th, 2011, in Lafayette, Louisiana.

Debbie Fontenot, CP, our NALA Liaison,

graciously offered the use of her offices for this

meeting. We thank her for her hospitality! And

thanks to Debbie Billiot for bringing donuts.

We quickly got down to business. The Board

voted by e-mail to move LSPA’s bank accounts

to Iberia Bank, and the progress toward

completing that process was discussed. Our

newly formed board was off to a running start

with plans for the Mid-year Seminar. To give

you a sneak peak, the spring seminar will be

held at the Paragon Casino in Marksville, and

will include a mix of topics regarding matters

we deal with as paralegals and in our regular

daily lives which everyone can relate to.

Suggested topics include Family Law, Medicare,

Wills, and Mandates which you may find

extremely useful. The topics will be fine tuned

and speakers will be named as we move toward

the beginning of next year, so stay tuned for

updates on the seminar. We also discussed

programs of LSPA, including our scholarship,

subject for the Fall 2012 seminar, status of

membership renewals, a proposal from our

Professional Development Chair, the budget,

the LCP Review Course, LSPA’s web site and

more.

Be sure to check back on future issues of The

Advocate for these updates. Our next meeting

will be held in Alexandria, Louisiana, on January

21, 2012, at the Parish Library starting at 10:00

a.m. Plans are to have the final topics and

speakers for the Spring Seminar, so be sure to

check it out and make plans to join us.

LOUISIANA STATE PARALEGAL ASSOCIATION

Annual Rochelle Scholarship to be Awarded It is nearing that time of year again when the Louisiana State Paralegal Association awards its Rochelle Scholarship. We are pleased to announce that the $500 scholarship will be offered to a paralegal student enrolled in an institutionally accredited Louisiana paralegal program. The Rochelle Scholarship was established during the association’s 1989-1990 fiscal year in honor of Carol Rochelle, a founding member of LSPA. Carol was very dedicated to the paralegal profession and was an advocate of the advancement of paralegal education. While returning from a meeting of the advisory committee prior to the first annual meeting of LSPA, Carol was killed in an automobile accident just outside of Alexandria. Therefore, when the scholarship fund was established, it was only appropriate to name it in Carol’s honor.

Qualifications for the Rochelle Scholarship are as follows: Applicant must be currently enrolled in an institutionally accredited paralegal program in Louisiana which offers a curriculum of at least sixty (60) semester hours. Applicant must have an overall grade point average of at least a 3.0, and must be enrolled in a minimum of six hours of paralegal studies. Applicant must be planning on a future career as a paralegal. Membership in LSPA is NOT mandatory. There is a $5.00 application fee. Applicant and supporting documentation must be returned by January 31, 2012.

The Rochelle Scholarship is a $500.00 cash reward. Additionally, the recipient receives a free membership to LSPA for one year and free tuition to all LSPA education workshops and seminars for that same year. The recipient is selected after all applications have been reviewed and screened, and finalists have been interviewed, if necessary. The screening and final selection is made by the members of the LSPA Scholarship Committee and the LSPA District Directors. The Rochelle Scholarship will be awarded at the LSPA Mid-Year Seminar on March 30, 2011, in Marksville, Louisiana. As your new LSPA NALA Liaison, I would like for you to know that I am here for your benefit and will be happy to assist you with any NALA. Annual NALA Conference I have attended three NALA conferences, including the 2010 and 2011 conferences held in Jacksonville, Florida and Dallas, Texas, and I can’t wait to go to Omaha. I encourage all of you to consider joining me at the NALA conference to be held in Omaha, Nebraska July 25 – 28, 2012. It is an experience you will never forget. Imagine the opportunity to meet and exchange ideas with over 300 paralegals from across the nation; paralegals with expertise in all areas that you can later contact when you have a question regarding their area of expertise. You will make friends that you will want to see year after year at conference (I have a few I stay in touch with via Facebook). I have attended the seminar/institutes which I can highly recommend. As NALA is a national organization, they obtain the best speakers from across the nation. And the fee is very reasonable. Institutes are presented during the morning and conference events are presented in the afternoons. On a couple of nights there are fun-filled parties held for attendees after the events which wrap up around 7:00 or 7:30 so that you can go enjoy dinner at one of the great nearby restaurants with your new friends. Certified paralegals have met certain certification requirements and generally have an advanced level of competency and minimum number of years experience in the profession. Paralegals who have passed the NALA certification exam are entitled to use the CP or CLA certification mark; or the ACP certification for passing Advanced Certified Paralegal exams. Certain states also have certification exams, such as the Louisiana LCP certification offered exclusively by LSPA. Certificated paralegals have earned a certificate upon successful completion of a paralegal program of study.

LSPA AWARDS RECEPTION September 16, 2011

The LSPA Awards Reception was held in Covington on September 16, 2011. Several awards were presented, including LSPA Outstanding Paralegal for 2011, and other recognitions. Mr. Jack Wilson, of Baton Rouge, served as Emcee for the evening. Mr. Wilson is the brother of Jimmie Murvin, ACP, LCP. LSPA Awards Committee, Debbie Billiot and Jessie Cormier, did an outstanding job on the Awards Reception, with an “Oscars Night” theme. Attendees enjoyed soft drinks and wine, while delicious hors d’oeuvres were provided by Copelands of New Orleans. Everyone received a package which included tiaras and boas to compliment their evening attire for this festive occasion. Program Chair, Karen McKnight, CP, presented door prizes, and Web Site Chair, Debbie Fontenot, CP, served as photographer and captured the delight of award recipients and attendees, including those who visited the photo booth. Article 863 of the Louisiana Code of Civil Procedure imposes significant responsibilities on those who sign pleadings. The mere signature of a lawyer (and an unrepresented party as well) on a pleading makes a multitude of representations to the court. Article 863 contained some pretty strong language in the past, but it is even stronger since its amendment by Acts 2010, No. 540:

Art. 863. Signing of pleadings, effect A. Every pleading of a party represented by an attorney shall be signed by at least one attorney of record in his individual name, whose address shall be stated. A party who is not represented by an attorney shall sign his pleading and state his address. B. Pleadings need not be verified or accompanied by affidavit or certificate, except as otherwise provided by law, but the signature of an attorney or party shall constitute a certification by him that he has read the pleading, and that to the best of his knowledge, information, and belief formed after reasonable inquiry, he certifies all of the following: (1) The pleading is not being presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation. (2) Each claim, defense, or other legal assertion in the pleading is warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law. (3) Each allegation or other factual assertion in the pleading has evidentiary support or, for a specifically identified allegation or factual assertion, is likely to have evidentiary support after a reasonable opportunity for further investigation or discovery. (4) Each denial in the pleading of a factual assertion is warranted by the evidence or, for a specifically identified denial, is reasonably based on a lack of information or belief. C. If a pleading is not signed, it shall be stricken unless promptly signed after the omission is called to the attention of the pleader. D. If, upon motion of any party or upon its own motion, the court determines that a certification has been made in violation of the provisions of this Article, the court shall impose upon the person who made the certification or the represented party, or both, an appropriate sanction which may include an order to pay to the other party the

amount of the reasonable expenses incurred because of the filing of the pleading, including reasonable attorney fees. E. A sanction authorized in Paragraph D shall be imposed only after a hearing at which any party or his counsel may present any evidence or argument relevant to the issue of imposition of the sanction. F. A sanction authorized in Paragraph D shall not be imposed with respect to an original petition which is filed within sixty days of an applicable prescriptive date and then voluntarily dismissed within ninety days after its filing or on the date of a hearing on the pleading, whichever is earlier. G. If the court imposes a sanction, it shall describe the conduct determined to constitute a violation of the provisions of this Article and explain the basis for the sanction imposed.

(Emphases added.) The changes made in this latest amendment make it plain that plaintiffs must be able to come forward with evidentiary proof to support claims and allegations made in their pleadings, “after a reasonable opportunity for further investigation or discovery.” In addition, defendants are required to present evidentiary proof that their denials of facts are “reasonably based on a lack of information or belief.” The article goes on to provide for the imposition of “appropriate” sanctions against the lawyer or the party, or both, who the court finds has violated these and other provisions of Article 863. These “appropriate” sanctions can include monetary reimbursement for attorney’s fees and other expenses incurred by the opposing party arising out of the violation. However, these sanctions can only be imposed after a contradictory hearing is held and the court includes in its order a description of the conduct that the court finds to be a violation of Article 863. If there ever was a question in any paralegal’s mind about whether it’s “okay” to sign pleadings (whether your lawyer asks or tells you to or not), the strengthened language of Article 863 should answer that question with a resounding “no.” This is also one more excellent example of why paralegals need to learn about and keep updated on all ethical aspects of their work and not rely solely on their lawyers for that knowledge.

LSPA Highlights From Around the State

Highlights from District II (Lafayette and surrounding areas): (District II Director-TBA)

The Lafayette Paralegal Association in District II has been busy this last quarter.

Luncheon Seminars: On September 20, Michael Hebert, Attorney for the Lafayette Consolidated Government spoke regarding the responsibilities of the office, the assistant attorneys used by his office to handle the volume of matters which need to be addressed, and discussed several interesting issues handled by his office, On October 18, Kenneth D. St. Pe’ presented information regarding Nursing Home Care: Issues of Neglect and Abuse. Mr. St. Pe’s practice is devoted to protecting the rights of nursing home residents and their families. He explained the nursing home structure and records, including Care Plans, Medication Administration Records, Special Services and other areas. He also provided information on Nursing Home law and regulations including the Louisiana Residents’ Bill of Rights, Nursing Home Reform Act of 1987, requirements for facilities, and laws regarding standard of care. With so many of us being of the age where we have parents in nursing homes or faced with the decision to place our parents in this type of facility, it was a very interesting presentation regardless of our area of practice. On November 15 the seminar was held at the John M. Shaw United States Courthouse in Lafayette. Christina Dauterive, US District Court Docket/QC Clerk, and the designated “Help Desk” person in Lafayette provided most of the information, with assistance from Cathy Bacon, Deputy in Charge, and Molly Davenport, CLA. We went through many of the items available on their website (www.lawd.uscourts.gov) but didn’t even begin to cover it all. If you work with Federal Court, take some time to check out the website and discover all of the available information, you may be surprised at what you can find. We reviewed the Deficiency Check List (available on the website) and discussed common deficiencies and how to avoid them, and requirements with regard to certain filings. It was an extremely interesting and informative presentation.

Paralegal Week Lafayette Consolidated Government City-Parish President Joey Durel proclaimed the week of September 12 – 16 Paralegal Week in the City/Parish of Lafayette and presented LPA President, Jodie Viguerie with a Proclamation. Also present were LPA Board Members Deborah P. Fontenot, CP, Cheri-lea McDonald, and Kathy Stanley, CLA. The Proclamation can be viewed on the LPA Website at http://www.lpa-la.org/home.html. LPA also hosted a Paralegal Week Social on Wednesday, September 14 from 5:15 to 7:30 p.m. at A La Carte Restaurant. Members of LPA and their guests enjoyed delicious hors d’oeuvres, a complimentary cocktail, and

everyone received a door prize. Sustaining members were on hand to tell us about the services they offer and David with Pro Legal Copies even brought some of his wonderful, fresh cookies he delivers with every copy order. But most of all, everyone had a great time. This is such a wonderful opportunity for members and guests to network and get to know one another better.

Community Service

On Friday, October 21, LPA members Jodie Viguerie, Kaye Pooler, Al Thomas, Molly Davenport, Savannah Stephan, Debbie Fontenot and Kathleen Witkovski volunteered to serve beer and soft drinks at Downtown Alive, at Parc San Souci. The Red Stick Ramblers provided musical entertainment and the weather was perfect, resulting in a great turn-out. What a fun way to provide community service!

Upcoming Events LPA will hold its annual Christmas Social at noon on December 15 at A La Carte Restaurant. We will once again be providing gifts for the Children’s Shelters of Acadiana Youth. On January 17, Bob Viguerie, Jr. will be the guest speaker at our Luncheon Seminar at the Petroleum Club. He will be presenting “Recent Developments in Jurisprudence”. February 21 is the LPA Annual Meeting and election of officers. For more information on these events, please see the LPA website: www.lpa-la.org

Kudos LPA member, Nancy Goodwin was presented with the Founder’s Award by the Lafayette (Louisiana) Commission on the Needs of Women at the 17th Annual Women of Excellence Awards held on October 2, 2011. The Founders’ Award is the highest honor awarded by the Commission and was awarded to Nancy in recognition of her long and distinguished history of service to the community. Nancy is a paralegal with the law firm of Ziegler & Lane and is a “Non-attorney representative” in Social Security matters.

6 Simple Ways to Stay at the Top of Your Game

Has this happened to you? You wake up one day and realize you're no longer the youngest kid on the block.

You've worked as a paralegal for a decade or more.

You're feeling a bit stale.

You wonder if you've made the right career choice.

You consider your options and see only limitations.

You don't feel quite at the top of your game.

It's time to change your mindset! Staying on top of your game requires some work...and I don't mean the kind of work that keeps you behind your desk from 9:00 to 5:00 (or later) every day. I'm talking about the work you must do to keep you and your mind fresh and energized. Here are some simple steps you can take to do just that: 1. Make yourself available to those who may be newer to the career field. If you've been in the profession for a while, you should welcome, encourage, mentor and praise those who are coming after you. They will look to you for advice and direction. Be there for them. They are the future but guidance from those with history is crucial.

2. Never say, 'I can't.' There's absolutely nothing you can't do once you put your mind to it. When you're offered a challenge at work, tackle it with gusto. Ask for help and guidance if you need to. Learn everything that will help you in meeting the challenge. Dig in and work hard. Repeat the mantra of The Little Engine That Could: "I think I can, I think I can, I think I can." Then change that to "I KNOW I can!" You WILL reach the top of the mountain...success is waiting on the other side. 3. Never stop learning. Always embrace change and stay in the know! People who are always learning something new are not only more interesting, but also happier in general. There's always something fresh and exciting going on: new rules, case law, and procedures, as well as new books, courses, technology, and vocabulary. Make a deal with yourself to learn something new every day to keep your motivation in high gear. 4. Credentials do matter. Credentials say a lot about you: your depth of knowledge, credibility, determination, diligence, and more. Don't kid yourself...if you're in competition for a job with a person who has the same amount of education and work experience, your credentials will give you the leg up you'll need.

Be sure to pursue all of the credentialing you can...then be sure to toot your horn. Let people know you have those credentials and how hard you worked for them. Also, put the designation on your business cards and firm letterhead. If you're curious about the authority to do that, see Peel v Attorney Registration and Disciplinary Committee of Illinois, 110 S.Ct. 2281 (1990). 5. Join an association...local, state and/or national. My mother always said, "Birds of a feather flock together." This is certainly the case with professional associations. An association will provide you with continuing education opportunities, as well as connections that will enhance your career. You will make lifelong friends that you can count on for assistance when you need contacts or information from their neck of the woods. This will happen more often than you might think. 6. If joining is good, being a contributing, hard-working member is even better. Just carrying your membership card isn't enough. You'll reap the benefits of belonging to an association when you jump in with both feet, get really involved, and take on responsibilities: write articles, speak at

seminars, plan a retreat....be generous with your time, your ideas and your enthusiasm. When you do this, you'll find your voice, you'll make a difference in the profession, and you'll be more 'professional.' Your challenge: Think about the steps you can take to stay on top of your game. Go new places, nurture your friendships, accept challenges, embrace goals.
