Important Information if you buying / Lease houses and apartments in Thailand.

It is important when purchasing property in Thailand you know the options that Thai law allows foreigners to acquire. It is not permitted for foreigners to own land in their own name, it should

either owned by the Thai national or a Thai company, condo can be owned by foreigners in their own name directly (Freehold farang)

Ownerships we share largely into three groups: 1. "Freehold farang" (49%)

2. "Freehold Thai / Company" (51%) 3. Lease hold 30 years.

No 1 and 2: Up to 49% of the area of apartment buildings approved as a

condominium can be owned by foreigners in their own name directly (Freehold farang) remaining can only be owned by either Thai national or Thai company. No. 3 is often used in house and apartments that are not approved as a condominium,

or the 51% that cannot be owned by foreigners directly. Thai law permitting lease hold agreements to maximum 30 years, but it is normal that

the developer promises either 60 or 90 years, this is according to Thai law not binding for any owner after 30 years.

Contract or Lease Contract shall be made both in Thai and English, and it should be on both versions of the contract that it is written in both English and Thai.

A copy of the deed (title deed - Canud) must be obtained from the Land office to check debt or other encumbrances on the property. Claimants should be listed on the

back of the deed if it is registered mortgagees / assets / liabilities of house / apartment.

When buying a used apartment, we recommend that you either transfer the purchase price to your own account in Thailand, and pay to the seller from this, or transfer to a

client account of a lawyer in Thailand that pays to the seller what the contract regulates. When purchase in new projects, it is normal that the transfer goes directly to the developer, it is important that this be done properly so you can get the

"Certificate of remittances," or "Foreign Exchange Transaction Form" as the Land office requires if you buy Condo in your name, but we recommend this for all transfers

of money for real estate in Thailand. It makes it easier if you want to take money out of Thailand again later.

For purchases you deposit for the apartment / house when it is booked, normally

50,000 baht Part of the purchase price paid when the contract is normally 25%, the rest depends on what kind of project / property you buy, but when you move in (property

transferred to you) shall be paid 100%.
