As Myanmar has become a business friendly nation after the country opened its doors to foreign investors, the raising numbers for the demand of skilled and unskilled workers for various industries are needless to say. It is important for HR to ensure that salaries that are being offered to such demand must be attractive and competitive as well as to compliance with the local law and practices.
As there are various laws to reference with when it comes to compensation and benefits, we would like to provide some useful guidelines for our clients to align with local requirements for the content of employment contract, leave and holiday policy on this issue.
Employment Contract: Under the employment and Skills Development Law (2013), every employee shall be employed under a written employment contract which shall contain the following minimum terms; • Type of employment • Probation period (no further details are stipulated under the Employment and Skills Development Law (2013), however pursuant to the practice of the Department of Labour, the probation period shall however not exceed three (3) months.) • Wages, Salary • Location of establishment • Term of employment (the term of contact is not regulated under the applicable laws. Pursuant to the practice of the department of Labour, a fixed term contact shall however not exceed two (2) years, but may be renewed for further term(s).) • Working hours • Days-off, holidays and leave • Overtime regulations (every work in excess of eight (8) hours per day or 48 hours per week is considered overtime. Overtime pay shall be calculated as double the basic wage/salary. {(monthly salary x 12 months)/52 weeks/44 (or 48) hrs} x 2.) • Regulations to be followed by the employee • Termination of employment
Leave & holidayOn average, Myanmar has 26 Public Holidays per year. Additional, there is Casual Leave 6 days of paid causal leave per year. Casual leave may not be carried forward to the subsequent year and may not be take for more than 3 consecutive days at a time.
Earned Leave 10 days can be enjoyed if employee has completed 12 consecutive months of service with a minimum of 20 working days per month. Earned leave may be carried forward and can be accumulated up to 3 years.
Medical leave under the Leave and Holidays Act (1951), employees are entitled to 30 days of paid medical leave per year, provided that they have completed 6 months of service. Employees covered by the Social Security Law (2012) may enjoy additional leave in case of certain work injuries and illnesses.
Maternity and Paternity Leave, 14 paid maternity leave (6 weeks before confinement and 8 weeks after confinement). 15 days of paternity leave after confinement of their wife.
