Town Attorney George B. Doyle informed the Town Board that he had sent the Governor of the State of New York the bill in regards to the new trucks.     Mr Nussbaumer of Nussbaumer and Clarke was granted the floor Ito explain to the Town Board Post War Pub lie Works,Planning Cowuission - Town of ~heektowaga Water DrainageProject contract divisions. The Town Board went on record tomeet with Mr. Nusssbaumer, April 7th 1948 to discuss furtherTown Engineerin~ problems.

    Councilman Wroblewski reports holes in road at Beech Read andUnion Road, Cayuga Creek Road and William Street. Supervisor ~advises Mr. Wroblewski that COUl\ty Highway Department waitingfor frost to get out of t:;r'NIl,l before starting actual work onroads. Town Clerk was ordered to notify The Town Highway Supt.,of any work on town roads that should be taken care of immediately.

    Councilman Wroblewski reports that Mr. Weber requests him togo before the Town Board to install a electric street lightat Rowley and Vita Drive. Supervisor will take up matter withMr. Marks of the Electric Company.

    Dr. Reinstein was granted the floor and asked board if FirstPost Was ProJect is to be charged to the Town as a whole-asks if there has been an estimate made for the entire project.Supervisor advises whole project not completed and was startedby the previous administration a.nd Is to be left uP. to the peoplein the district.Supervisor advises that the Town wants to complete lower part Iof the iJroject.

    Mr. Henry Zyenda was granted the floor and asked the Boardfor a boulevard stop sign on every side street approachingWalden Avenue and also requested one side parking only.Ordered referred to the Town Board and the Chief of Police.

    Councilman Neibert requests a directional light to guide people tothe pollee statIon and also signs be placed on important highwaysleading into town reading "Welcome to Cheektowaga ". Supervisorwill have survey made and report to the Town Board on both items.

    The operation in any store, stand, office buildingor other place within the Town of Cheektowaga of any horn, me-gaphone, siren, bell, radio, mechanical piano, phonograph,graphophone, victrola or other sound producing or sound amplifyingmechanism, instrument or device when the sound thereof is suff-iciently audible upon any public street or sidewalk to attrackand congregate a crowd thereon. This subdivision shall not be

    5 Subject to the pr0visions of this section, the creationof any unreasonably loud, disturbing and unnecessary noise in theTown of Cheektowaga is prohibittd. Noise of such character andintensity and duration as to be detrimental to the life or healthof any individual in a residential, apartment-hotel, or businessdistrict, (as defined by the zoning ordinances of said town)is prohibited. Unnecessary noise in any such district duringthe hours 12 o'clock PM to 7 0' clock AM, which unreasonablyinterferes with the sleep, comfort and'repose of individualstherein is prohibited.

    The following acts are declared to be a violationof this section, but said enumeration shall not be deemed to beexelusiv~,namely:

    1. The making of any noise in any street or publicplace or by means of aircraft for commercial advertising purposes.The advertisement or calling attention to any advertisement,article, business, calling or profession upon any public street,sidewalk or entrance to a place of business within the Town ofCheektowaga by means of any horn, megaphone, siren, bell,radio, mechanical piano, phonograph, graphophone, victrola orany other sound producing or sound amplifying mechanism, instrumentor device.

    construed as prohibiting the demonstration or use in any musicalstore of any musical instrument or the giving of musical instruct-ion in any store or other place of business, provided suchdemonstration or use of such musical instrument be not stepped-upby the use of amplifiers, horns or other sound magnifying devices.

    2. The playing of any radio, phonograph or any music-al instrument in any place in a residKNtial or apartment-hoteldistrict at eny time 'between 120' cloc~ and 70' clock AM in suchmanner or with such volume as to annoy or disturb any'personthereby.

    3. The creation of any excessive noise on any streetadjacent to any public or parochial school, college or institut-ion of learning while the same is in session, which unreason-ably interferes with the work of pupils or instructors providedconspicuous signs are displayed on such street indicating, insubstance, that the same is a school street and that quiet isreqUired.

    Nothing contained in this section shall be construedto prevent the production of mus~c in connection with anymilitary, civic or authorized parade, funeral procession orreligious ceremony; nor to prevent any musical performanceconducted under consent of municipal authority.

    The provisions of this section shall not applyto police officers and firemen while in the discharge of duty.

    The superviso~ is hereby authorized, by writtenorder, to suspend any of the provisions of this section inconnection with any holiday celebration or upon any occasionof special public interest, for such time and upon such con-ditions as shall be prescribed by him.

    The provisions of this section shall be liberallyconstrued to prevent excessive, unreasonable, disturbing andunnecessary noise, due consideration being given to thecircumstances, time of day and particular location of eachviolation.

    Any person or corporation violating the provisionsof this section shall be liable to a fine or penalty of notmore than $250.00 for each offense.

    -0-Councilman Nagel speaking from the floor in behalf of Mr. ERnestpokyweczynski, of Dick Road , whose Son is building a home on DickRoad, has experienced difficuly in bUilding a driveway on accountof a low man-hole at the edge of his property. Matter was referredto the Supervisor who in turn w1ll refer to Mr. Elmer Mesmer.

    Councilman Wroblewski speaking from the floor , asks the Town Boardif it is legal to dig top soil in the Town of Cheekt9waga.Town Attorney states there is no local ordinance to probibit same,but there is a state law which does not allow the digging o~top soil in a sub-division. Town Atto~y asks Town Clerk toto nottf:,' one Beatrice Schultz, that the Town will soon draw. up a Iordiaance to tae effect that no digging of top-soil Wil~~lowedin the Town of Cheektaraga.

    Mr. Joseph Pyszczynski was granted the floor and appeared in behalfof the Sisters at Kennedy Road Orphan Home, requests light at ,~Kennedy Road and alao a broken pipe to be repaired at the same t ..addr~ss. ' .,The Supervisor informed mr Pyszczynski that he had brOUght the matterof the l1ght to the attention of Mr. Marks of the Electric Companyand w1ll 1nvest1pate the broken pipe. The Supervisor asked Mr.Pyszczynsk1 to .ake a formal plea to the Town Board at its regularmeeting to be held on May lOth 1948.

    A communicatbn was read from the Supervisor of a scheduledmeeting with the Trustees of the International Railway Companyto be held at the TQwn Hall April 29 th 1948 at 8pm. E.D.S.T.

    The chairman called the meeting to order and directed the Town Clerk tocall roll.

    The chtirman ordered the Town Clerk to read the minutes of the previousmeetings held, March 22nd 1948, March 29th 1948, April 5th 1948,April 19th , 1948 and April 26 1948.

    The second exception was the date set for the Anti-Noise ordiancehearing scheduled for May 10th 1948 should of read May 17th, 1948at 8pm.

    Motion by Napieralski , Seconded by Nagel minutes of previous meetingsbe approved as read, with two exceptions: The resolution r'ead at theApril 5th , 1948 meeting, ~uote Mr. Neibert moves seconded by Mr.Nagel: BE IT RESOLVE that Arthur G. Leupold a duly licensed engineerbe designated to represent the Town of Cheektowaga on all new engineeringprojects which may arise, at fees not to exceed the standard ratesestablished by the American Society of Civil Engineers. Vote of theTown Board , Ayes 5 Nayes 0 Carried unquote. The Town Clerk was inerror and no vote was taken. On this resolution, at the request ofSupervisor Holtz, Mr. Neibert withdrewhis motion and Mr. Nagelhis second. Th~ resolution was ordered to be laid on the table forone month.

    Mr. Andrew Hoerner , president of the Millionaires Club of Cheektowagawas granted the floor and invited the Town Board to the Buffalo Airporton May 6th 1948 at 2 pm to see the Millionaries off ona airplaneride over Niagara Falls. The Town Board &cc~pted thehvitation.

    Mr. Miller representing The Genesee Estates Sub-Division was granted t~efloor and presented to the Town Board a map showing lots only 40 feetin width. Map was ordered returned to Mr. Miller who was asked tocomply with the Town Ord}ance that lots must be at least 50 feet inwidth for residential construction.
