A BILL To provide for additional supplemental appropriations for
disaster relief.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE; TABLE OF CONTENTS. 3
(a) SHORT TITLE.—This Act may be cited as the 4
‘‘Additional Supplemental Appropriations for Disaster Re-5
lief, 2019’’. 6

SEC. 2. STATEMENT OF APPROPRIATIONS. 1
The following sums in this Act are appropriated, out 2
of any money in the Treasury not otherwise appropriated, 3
for the fiscal year ending September 30, 2019. 4
TITLE I 5
DEPARTMENT OF AGRICULTURE 6
The following sums in this title are appropriated, out 7
of any money in the Treasury not otherwise appropriated, 8
for the fiscal year ending September 30, 2019, and for 9
other purposes, namely: 10
AGRICULTURAL PROGRAMS 11
PROCESSING, RESEARCH AND MARKETING 12
OFFICE OF THE SECRETARY 13
For an additional amount for the ‘‘Office of the Sec-14
retary’’, $3,005,442,000, which shall remain available 15
until December 31, 2020, for necessary expenses related 16
to losses of crops (including milk and harvested adulter-17
ated wine grapes), trees, bushes, and vines, as a con-18

sequence of Hurricanes Michael or Florence, other hurri-1
canes, typhoons, volcanic activity, or wildfires occurring 2
in calendar year 2018 under such terms and conditions 3
as determined by the Secretary of Agriculture (referred 4
to in this title as the ‘‘Secretary’’): Provided, That the 5
Secretary may provide assistance for such losses in the 6
form of block grants to eligible states and territories and 7
such assistance may include compensation to producers, 8
as determined by the Secretary, for past or future crop 9
insurance premiums, forest restoration, and poultry and 10
livestock losses: Provided further, That of the amounts 11
provided under this heading, tree assistance payments 12
may be made under section 1501(e) of the Agricultural 13
Act of 2014 (7 U.S.C. 9081(e)) to eligible orchardists or 14
nursery tree growers (as defined in such section) of pecan 15
trees with a tree mortality rate that exceeds 7.5 percent 16
(adjusted for normal mortality) and is less than 15 per-17
cent (adjusted for normal mortality), to be available until 18
expended, for losses incurred during the period beginning 19
January 1, 2018, and ending December 31, 2018: Pro-20
vided further, That in the case of producers impacted by 21
volcanic activity that resulted in the loss of crop land, or 22
access to crop land, the Secretary shall consider all meas-23
ures available, as appropriate, to bring replacement land 24
into production: Provided further, That the total amount 25

of payments received under this heading and applicable 1
policies of crop insurance under the Federal Crop Insur-2
ance Act (7 U.S.C. 1501 et seq.) or the Noninsured Crop 3
Disaster Assistance Program (NAP) under section 196 of 4
the Federal Agriculture Improvement and Reform Act of 5
1996 (7 U.S.C. 7333) shall not exceed 90 percent of the 6
loss as determined by the Secretary: Provided further, 7
That the total amount of payments received under this 8
heading for producers who did not obtain a policy or plan 9
of insurance for an insurable commodity for the applicable 10
crop year under the Federal Crop Insurance Act (7 U.S.C. 11
1501 et seq.) for the crop incurring the losses or did not 12
file the required paperwork and pay the service fee by the 13
applicable State filing deadline for a noninsurable com-14
modity for the applicable crop year under NAP for the 15
crop incurring the losses shall not exceed 70 percent of 16
the loss as determined by the Secretary: Provided further, 17
That producers receiving payments under this heading, as 18
determined by the Secretary, shall be required to purchase 19
crop insurance where crop insurance is available for the 20
next two available crop years, excluding tree insurance 21
policies, and producers receiving payments under this 22
heading shall be required to purchase coverage under NAP 23
where crop insurance is not available in the next two avail-24
able crop years, as determined by the Secretary: Provided 25

further, That, not later than 120 days after the end of 1
fiscal year 2019, the Secretary shall submit a report to 2
the Congress specifying the type, amount, and method of 3
such assistance by state and territory: Provided further, 4
That such amount is designated by the Congress as being 5
for an emergency requirement pursuant to section 6
251(b)(2)(A)(i) of the Balanced Budget and Emergency 7
Deficit Control Act of 1985. 8
FARM SERVICE AGENCY 9
EMERGENCY FOREST RESTORATION PROGRAM 10
For an additional amount for the ‘‘Emergency Forest 11
Restoration Program’’, for necessary expenses related to 12
the consequences of Hurricanes Michael and Florence and 13
wildfires occurring in calendar year 2018, and other nat-14
ural disasters, $480,000,000, to remain available until ex-15
pended: Provided, That such amount is designated by the 16
Congress as being for an emergency requirement pursuant 17
to section 251(b)(2)(A)(i) of the Balanced Budget and 18
Emergency Deficit Control Act of 1985. 19
NATURAL RESOURCES CONSERVATION SERVICE 20
WATERSHED AND FLOOD PREVENTION OPERATIONS 21
For an additional amount for ‘‘Watershed and Flood 22
Prevention Operations’’, for necessary expenses for the 23
Emergency Watershed Protection Program related to the 24
consequences of Hurricanes Michael and Florence and 25

wildfires occurring in calendar year 2018, and other nat-1
ural disasters, $125,000,000, to remain available until ex-2
pended: Provided, That such amount is designated by the 3
Congress as being for an emergency requirement pursuant 4
to section 251(b)(2)(A)(i) of the Balanced Budget and 5
Emergency Deficit Control Act of 1985. 6
RURAL DEVELOPMENT 7
RURAL COMMUNITY FACILITIES PROGRAM ACCOUNT 8
For an additional amount for the cost of grants for 9
rural community facilities programs as authorized by sec-10
tion 306 and described in section 381E(d)(1) of the Con-11
solidated Farm and Rural Development Act, for necessary 12
expenses related to the consequences of Hurricanes Mi-13
chael and Florence and wildfires occurring in calendar 14
year 2018, and other natural disasters, $150,000,000, to 15
remain available until expended: Provided, That sections 16
381E-H and 381N of the Consolidated Farm and Rural 17
Development Act are not applicable to the funds made 18
available under this heading: Provided further, That such 19
amount is designated by the Congress as being for an 20
emergency requirement pursuant to section 21
251(b)(2)(A)(i) of the Balanced Budget and Emergency 22
Deficit Control Act of 1985. 23

GENERAL PROVISIONS—THIS TITLE 1
SEC. 101. In addition to amounts otherwise made 2
available, out of the funds made available under section 3
18 of Food and Nutrition Act of 2008, $25,200,000 shall 4
be available for the Secretary to provide a grant to the 5
Commonwealth of the Northern Mariana Islands for dis-6
aster nutrition assistance in response to the Presidentially 7
declared major disasters and emergencies: Provided, That 8
funds made available to the Commonwealth of the North-9
ern Mariana Islands under this section shall remain avail-10
able for obligation by the Commonwealth until September 11
30, 2020: Provided further, That such amount is des-12
ignated by the Congress as being for an emergency re-13
quirement pursuant to section 251(b)(2)(A)(i) of the Bal-14
anced Budget and Emergency Deficit Control Act of 1985. 15
SEC. 102. For purposes of administering title I of 16
subdivision 1 of division B of the Bipartisan Budget Act 17
of 2018 (Public Law 115–123), losses to agricultural pro-18
ducers resulting from hurricanes shall also include losses 19
incurred from Tropical Storm Cindy and losses of peach 20
and blueberry crops in calendar year 2017 due to extreme 21
cold: Provided, That the amounts provided by this section 22
are designated by the Congress as being for an emergency 23
requirement pursuant to section 251(b)(2)(A)(i) of the 24
Balanced Budget and Emergency Deficit Control Act of 25

1985: Provided further, That amounts repurposed under 1
this heading that were previously designated by the Con-2
gress as an emergency requirement pursuant to the Bal-3
anced Budget and Emergency Deficit Control Act of 1985 4
are designated by the Congress as an emergency require-5
ment pursuant to section 251(b)(2)(A)(i) of the Balanced 6
Budget and Emergency Deficit Control Act of 1985. 7
SEC. 103. (a)(1) Except as provided in paragraph 8
(2), a person or legal entity is not eligible to receive a 9
payment under the Market Facilitation Program estab-10
lished pursuant to the Commodity Credit Corporation 11
Charter Act (15 U.S.C. 714 et seq.) if the average ad-12
justed gross income of such person or legal entity is great-13
er than $900,000. 14
(2) Paragraph (1) shall not apply to a person or legal 15
entity if at least 75 percent of the adjusted gross income 16
of such person or legal entity is derived from farming, 17
ranching, or forestry related activities. 18
(b) A person or legal entity may not receive a pay-19
ment under the Market Facilitation Program described in 20
subsection (a)(1), directly or indirectly, of more than 21
$125,000. 22
(c) In this section, the term ‘‘average adjusted gross 23
income’’ has the meaning given the term defined in section 24

760.1502 of title 7 Code of Federal Regulations (as in 1
effect July 18, 2018). 2
(d) The amount provided by this section is designated 3
by the Congress as being for an emergency requirement 4
pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-5
et and Emergency Deficit Control Act of 1985. 6
SEC. 104. In addition to other amounts made avail-7
able by section 309 of division A of the Additional Supple-8
mental Appropriations for Disaster Relief Requirements 9
Act, 2017 (Public Law 115–72; 131 Stat. 1229), there 10
is appropriated to the Secretary, out of any moneys in the 11
Treasury not otherwise appropriated, for the fiscal year 12
ending September 30, 2019, $610,000,000 to provide a 13
grant to the Commonwealth of Puerto Rico for disaster 14
nutrition assistance in response to a major disaster or 15
emergency designated by the President under the Robert 16
T. Stafford Disaster Relief and Emergency Assistance Act 17
(42 U.S.C. 5121 et seq.): Provided, That the funds made 18
available to the Commonwealth of Puerto Rico under this 19
section shall remain available for obligation by the Com-20
monwealth until September 30, 2020, and shall be in addi-21
tion to funds otherwise made available: Provided further, 22
That such amount is designated by the Congress as being 23
for an emergency requirement pursuant to section 24

251(b)(2)(A)(i) of the Balanced Budget and Emergency 1
Deficit Control Act of 1985 (2 U.S.C. 901(b)(2)(A)(i)). 2
TITLE II 3
DEPARTMENT OF COMMERCE 4
The following sums in this title are appropriated, out 5
of any money in the Treasury not otherwise appropriated, 6
for the fiscal year ending September 30, 2019, and for 7
other purposes, namely: 8
ECONOMIC DEVELOPMENT ADMINISTRATION 9
ECONOMIC DEVELOPMENT ASSISTANCE PROGRAMS 10
(INCLUDING TRANSFERS OF FUNDS) 11
Pursuant to section 703 of the Public Works and 12
Economic Development Act (42 U.S.C. 3233), for an addi-13
tional amount for ‘‘Economic Development Assistance 14
Programs’’ for necessary expenses related to flood mitiga-15
tion, disaster relief, long-term recovery, and restoration of 16
infrastructure in areas that received a major disaster des-17
ignation as a result of Hurricanes Florence, Michael, and 18
Lane, Typhoons Yutu and Mangkhut, and of wildfires, vol-19
canic eruptions, earthquakes, and other natural disasters 20
occurring in calendar year 2018 under the Robert T. Staf-21
ford Disaster Relief and Emergency Assistance Act (42 22
U.S.C. 5121 et seq.), $600,000,000, to remain available 23
until expended: Provided, That such amount is designated 24
by the Congress as being for an emergency requirement 25

pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-1
et and Emergency Deficit Control Act of 1985: Provided 2
further, That within the amount appropriated, up to 2 per-3
cent of funds may be transferred to the ‘‘Salaries and Ex-4
penses’’ account for administration and oversight activi-5
ties: Provided further, That within the amount appro-6
priated, $1,000,000 shall be transferred to the ‘‘Office of 7
Inspector General’’ account for carrying out investigations 8
and audits related to the funding provided under this 9
heading. 10
NATIONAL OCEANIC AND ATMOSPHERIC 11
ADMINISTRATION 12
OPERATIONS, RESEARCH, AND FACILITIES 13
For an additional amount for ‘‘Operations, Research, 14
and Facilities’’ for necessary expenses related to the con-15
sequences of Hurricanes Florence and Michael, Typhoon 16
Yutu, and of wildfires, $120,570,000, to remain available 17
until September 30, 2020, as follows: 18
(1) $3,000,000 for repair and replacement of 19
observing assets, real property, and equipment; 20
(2) $11,000,000 for marine debris assessment 21
and removal; 22
(3) $31,570,000 for mapping, charting, and ge-23
odesy services; 24

(4) $25,000,000 to improve: (a) hurricane in-1
tensity forecasting, including through deployment of 2
unmanned ocean observing platforms and enhanced 3
data assimilation; (b) flood prediction, forecasting, 4
and mitigation capabilities; and (c) wildfire pre-5
diction, detection, and forecasting; and 6
(5) $50,000,000 for Title IX Fund grants as 7
authorized under section 906(c) of division O of 8
Public Law 114–113: 9
Provided, That such amount is designated by the Congress 10
as being for an emergency requirement pursuant to sec-11
tion 251(b)(2)(A)(i) of the Balanced Budget and Emer-12
gency Deficit Control Act of 1985: Provided further, That 13
the National Oceanic and Atmospheric Administration 14
shall submit a spending plan to the Committees on Appro-15
priations of the House of Representatives and the Senate 16
for funding provided under subsection (4) of this heading 17
within 45 days after the date of enactment of this Act. 18
PROCUREMENT, ACQUISITION AND CONSTRUCTION 19
For an additional amount for ‘‘Procurement, Acquisi-20
tion and Construction’’, $25,000,000, to remain available 21
until September 30, 2021, for improvements to oper-22
ational and research weather supercomputing infrastruc-23
ture and satellite ground services used for hurricane inten-24
sity and track prediction; flood prediction, forecasting, and 25

mitigation; and wildfire prediction, detection, and fore-1
casting: Provided, That such amount is designated by the 2
Congress as being for an emergency requirement pursuant 3
to section 251(b)(2)(A)(i) of the Balanced Budget and 4
Emergency Deficit Control Act of 1985: Provided further, 5
That the National Oceanic and Atmospheric Administra-6
tion shall submit a spending plan to the Committees on 7
Appropriations of the House of Representatives and the 8
Senate within 45 days after the date of enactment of this 9
Act. 10
FISHERIES DISASTER ASSISTANCE 11
For an additional amount for ‘‘Fisheries Disaster As-12
sistance’’ for necessary expenses associated with the miti-13
gation of fishery disasters, $150,000,000, to remain avail-14
able until expended: Provided, That funds shall be used 15
for mitigating the effects of commercial fishery failures 16
and fishery resource disasters declared by the Secretary 17
of Commerce, including those declared by the Secretary 18
to be a direct result of Hurricanes Florence and Michael 19
and Typhoons Yutu and Mangkhut: Provided further, 20
That such amount is designated by the Congress as being 21
for an emergency requirement pursuant to section 22
251(b)(2)(A)(i) of the Balanced Budget and Emergency 23
Deficit Control Act of 1985. 24

SALARIES AND EXPENSES 3
For an additional amount for ‘‘Salaries and Ex-4
penses’’ for necessary expenses related to the con-5
sequences of Hurricanes Florence and Michael and Ty-6
phoon Yutu, $1,336,000: Provided, That such amount is 7
designated by the Congress as being for an emergency re-8
quirement pursuant to section 251(b)(2)(A)(i) of the Bal-9
anced Budget and Emergency Deficit Control Act of 1985. 10
FEDERAL PRISON SYSTEM 11
BUILDINGS AND FACILITIES 12
For an additional amount for ‘‘Buildings and Facili-13
ties’’ for necessary expenses related to the consequences 14
of Hurricanes Florence and Michael and Typhoon Yutu, 15
$28,400,000, to remain available until expended: Pro-16
vided, That such amount is designated by the Congress 17
as being for an emergency requirement pursuant to sec-18
tion 251(b)(2)(A)(i) of the Balanced Budget and Emer-19
gency Deficit Control Act of 1985. 20
RELATED AGENCIES 21
LEGAL SERVICES CORPORATION 22
PAYMENT TO THE LEGAL SERVICES CORPORATION 23
For an additional amount for ‘‘Payment to the Legal 24
Services Corporation’’ to carry out the purposes of the 25

Legal Services Corporation Act by providing for necessary 1
expenses related to the consequences of Hurricanes Flor-2
ence, Michael, and Lane, Typhoons Yutu and Mangkhut, 3
and calendar year 2018 wildfires, volcanic eruptions, and 4
earthquakes, $15,000,000: Provided, That such amount is 5
designated by the Congress as being for an emergency re-6
quirement pursuant to section 251(b)(2)(A)(i) of the Bal-7
anced Budget and Emergency Deficit Control Act of 1985: 8
Provided further, That none of the funds appropriated in 9
this Act to the Legal Services Corporation shall be ex-10
pended for any purpose prohibited or limited by, or con-11
trary to any of the provisions of, sections 501, 502, 503, 12
504, 505, and 506 of Public Law 105–119, and all funds 13
appropriated in this Act to the Legal Services Corporation 14
shall be subject to the same terms and conditions set forth 15
in such sections, except that all references in sections 502 16
and 503 to 1997 and 1998 shall be deemed to refer in-17
stead to 2018 and 2019, respectively, and except that sec-18
tions 501 and 503 of Public Law 104–134 (referenced by 19
Public Law 105–119) shall not apply to the amount made 20
available under this heading: Provided further, That, for 21
the purposes of this Act, the Legal Services Corporation 22
shall be considered an agency of the United States Gov-23
ernment. 24

TITLE III 1
DEPARTMENT OF DEFENSE 2
The following sums in this title are appropriated, out 3
of any money in the Treasury not otherwise appropriated, 4
for the fiscal year ending September 30, 2019, and for 5
other purposes, namely: 6
OPERATION AND MAINTENANCE, MARINE CORPS 7
For an additional amount for ‘‘Operation and Main-8
tenance, Marine Corps’’, $200,000,000, for necessary ex-9
penses related to the consequences of Hurricanes Michael 10
and Florence: Provided, That such amount is designated 11
by the Congress as being for an emergency requirement 12
pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-13
et and Emergency Deficit Control Act of 1985. 14
OPERATION AND MAINTENANCE, AIR FORCE 15
For an additional amount for ‘‘Operation and Main-16
tenance, Air Force’’, $400,000,000, for necessary ex-17
penses related to the consequences of Hurricanes Michael 18
and Florence: Provided, That such amount is designated 19
by the Congress as being for an emergency requirement 20
pursuant to section 251(b)(2)(A)(i) of the Balanced Budg-21
et and Emergency Deficit Control Act of 1985. 22

TITLE IV 1
CORPS OF ENGINEERS—CIVIL 2
The following sums in this title are appropriated, out 3
of any money in the Treasury not otherwise appropriated, 4
for the fiscal year ending September 30, 2019, and for 5
other purposes, namely: 6
DEPARTMENT OF THE ARMY 7
INVESTIGATIONS 8
For an additional amount for ‘‘Investigations’’ for 9
necessary expenses related to the completion, or initiation 10
and completion, of flood and storm damage reduction, in-11
cluding shore protection, studies which are currently au-12
thorized or which are authorized after the date of enact-13
ment of this Act, to reduce risk from future floods and 14
hurricanes, at full Federal expense, $35,000,000, to re-15
main available until expended, for high priority studies of 16
projects in States and insular areas that were impacted 17
by Hurricanes Florence and Michael, Typhoon Mangkhut, 18
Super Typhoon Yutu, and Tropical Storm Gita: Provided, 19
That such amount is designated by the Congress as being 20
for an emergency requirement pursuant to section 21
251(b)(2)(A)(i) of the Balanced Budget and Emergency 22
Deficit Control Act of 1985: Provided further, That the 23
Assistant Secretary of the Army for Civil Works shall pro-24
vide a monthly report directly to the Committees on Ap-25

propriations of the House and the Senate detailing the al-1
location and obligation of these funds, including new stud-2
ies selected to be initiated using funds provided under this 3
heading, beginning not later than 60 days after the date 4
of enactment of this Act. 5
CONSTRUCTION 6
For an additional amount for ‘‘Construction’’ for nec-7
essary expenses, $740,000,000, to remain available until 8
expended, to construct flood and storm damage reduction, 9
including shore protection, projects which are currently 10
authorized or which are authorized after the date of enact-11
ment of this Act, and flood and storm damage reduction, 12
including shore protection, projects which have signed 13
Chief’s Reports as of the date of enactment of this Act 14
or which are studied using funds provided under the head-15
ing ‘‘Investigations’’ if the Secretary determines such 16
projects to be technically feasible, economically justified, 17
and environmentally acceptable, in States and insular 18
areas that were impacted by Hurricanes Florence and Mi-19
chael, Typhoon Mangkhut, Super Typhoon Yutu, and 20
Tropical Storm Gita: Provided, That projects receiving 21
funds provided under the first proviso in ‘‘Title IV—Corps 22
of Engineers—Civil—Department of the Army—Con-23
struction’’ in Public Law 115–123 shall not be eligible for 24
funding provided under this heading: Provided further, 25

That for projects receiving funds provided under this 1
heading, the provisions of Section 902 of the Water Re-2
sources Act of 1986 shall not apply to these funds: Pro-3
vided further, That the completion of ongoing construction 4
projects receiving funds provided under this heading shall 5
be at full Federal expense with respect to such funds: Pro-6
vided further, That using funds provided under this head-7
ing, the non-Federal cash contribution for projects other 8
than ongoing construction projects shall be financed in ac-9
cordance with the provisions of section 103(k) of Public 10
Law 99–662 over a period of 30 years from the date of 11
completion of the project or separable element: Provided 12
further, That up to $25,000,000 of the funds made avail-13
able under this heading shall be used for continuing au-14
thorities projects to reduce the risk of flooding and storm 15
damage: Provided further, That any projects using funds 16
appropriated under this heading shall be initiated only 17
after non-Federal interests have entered into binding 18
agreements with the Secretary requiring, where applicable, 19
the non-Federal interests to pay 100 percent of the oper-20
ation, maintenance, repair, replacement, and rehabilita-21
tion costs of the project and to hold and save the United 22
States free from damages due to the construction or oper-23
ation and maintenance of the project, except for damages 24
due to the fault or negligence of the United States or its 25

contractors: Provided further, That such amount is des-1
ignated by the Congress as being for an emergency re-2
quirement pursuant to section 251(b)(2)(A)(i) of the Bal-3
anced Budget and Emergency Deficit Control Act of 1985: 4

SEC. 701. Not later than 30 days after the date of 7
enactment of this Act, the Secretaries of Labor, Health 8
and Human Services, and Education shall provide a de-9
tailed spend plan of anticipated uses of funds made avail-10
able in this title, including estimated personnel and admin-11
istrative costs, to the Committees on Appropriations: Pro-12
vided, That such plans shall be updated and submitted 13
to the Committees on Appropriations every 60 days until 14
all funds are expended or expire. 15

be awarded directly to the State, unit of general local gov-17
ernment, or Indian tribe (as such term is defined in sec-18
tion 102 of the Housing and Community Development Act 19
of 1974) at the discretion of the Secretary: Provided fur-20
ther, That any funds made available under this heading 21
and under the same heading in Public Law 115–254 that 22
remain available, after the funds under such headings 23
have been allocated for necessary expenses for activities 24
authorized under such headings, shall be allocated to 25

grantees, for mitigation activities in the most impacted 1
and distressed areas resulting from a major disaster that 2
occurred in 2018: Provided further, That such allocations 3
shall be made in the same proportion that the amount of 4
funds each grantee received under this Act and the same 5
heading in division I of Public Law 115–254 bears to the 6
amount of all funds provided to all grantees that received 7
allocations for disasters that occurred in 2018: Provided 8
further, That of the amounts made available under the text 9
preceding the first proviso under this heading and under 10
the same heading in Public Law 115–254, the Secretary 11
shall allocate to all such grantees an aggregate amount 12
not less than 33 percent of the sum of such amounts of 13
funds within 120 days after the enactment of this Act 14
based on the best available data, and shall allocate no less 15
than 100 percent of such funds by no later than 180 days 16
after the enactment of this Act: Provided further, That the 17
Secretary shall not prohibit the use of funds made avail-18
able under this heading and the same heading in Public 19
Law 115–254 for non-Federal share as authorized by sec-20
tion 105(a)(9) of the Housing and Community Develop-21
ment Act of 1974 (42 U.S.C. 5305(a)(9)): Provided fur-22
ther, That of the amounts made available under this head-23
ing, grantees may establish grant programs to assist small 24
businesses for working capital purposes to aid in recovery: 25

Provided further, That as a condition of making any grant, 1
the Secretary shall certify in advance that such grantee 2
has in place proficient financial controls and procurement 3
processes and has established adequate procedures to pre-4
vent any duplication of benefits as defined by section 312 5
of the Robert T. Stafford Disaster Relief and Emergency 6
Assistance Act (42 U.S.C. 5155), to ensure timely expend-7
iture of funds, to maintain comprehensive websites regard-8
ing all disaster recovery activities assisted with these 9
funds, and to detect and prevent waste, fraud, and abuse 10
of funds: Provided further, That with respect to any such 11
duplication of benefits, the Secretary shall act in accord-12
ance with section 1210 of Public Law 115–254 (132 Stat. 13
3442) and section 312 of the Robert T. Stafford Disaster 14
Relief and Emergency Assistance Act (42 U.S.C. 5155): 15
Provided further, That the Secretary shall require grantees 16
to maintain on a public website information containing 17
common reporting criteria established by the Department 18
that permits individuals and entities awaiting assistance 19
and the general public to see how all grant funds are used, 20
including copies of all relevant procurement documents, 21
grantee administrative contracts and details of ongoing 22
procurement processes, as determined by the Secretary: 23
Provided further, That prior to the obligation of funds a 24
grantee shall submit a plan to the Secretary for approval 25

detailing the proposed use of all funds, including criteria 1
for eligibility and how the use of these funds will address 2
long-term recovery and restoration of infrastructure and 3
housing, economic revitalization, and mitigation in the 4
most impacted and distressed areas: Provided further, 5
That such funds may not be used for activities reimbursed 6
by, or for which funds have been made available by, the 7
Federal Emergency Management Agency or the Army 8
Corps of Engineers, in excess of the authorized amount 9
of the project or its components: Provided further, That 10
funds allocated under this heading shall not be considered 11
relevant to the non-disaster formula allocations made pur-12
suant to section 106 of the Housing and Community De-13
velopment Act of 1974 (42 U.S.C. 5306): Provided fur-14
ther, That a State, unit of general local government, or 15
Indian tribe may use up to 5 percent of its allocation for 16
administrative costs: Provided further, That the first pro-17
viso under this heading in the Supplemental Appropria-18
tions for Disaster Relief Requirements Act, 2018 (division 19
I of Public Law 115–254) is amended by striking ‘‘State 20
or unit of general local government’’ and inserting ‘‘State, 21
unit of general local government, or Indian tribe (as such 22
term is defined in section 102 of the Housing and Commu-23
nity Development Act of 1974 (42 U.S.C. 5302))’’: Pro-24
vided further, That the sixth proviso under this heading 25

in the Supplemental Appropriations for Disaster Relief 1
Requirements Act, 2018 (division I of Public Law 115– 2
254) is amended by striking ‘‘State or subdivision thereof’’ 3
and inserting ‘‘State, unit of general local government, or 4
Indian tribe (as such term is defined in section 102 of 5
the Housing and Community Development Act of 1974 6
(42 U.S.C. 5302))’’: Provided further, That in admin-7
istering the funds under this heading, the Secretary of 8
Housing and Urban Development may waive, or specify 9
alternative requirements for, any provision of any statute 10
or regulation that the Secretary administers in connection 11
with the obligation by the Secretary or the use by the re-12
cipient of these funds (except for requirements related to 13
fair housing, nondiscrimination, labor standards, and the 14
environment), if the Secretary finds that good cause exists 15
for the waiver or alternative requirement and such waiver 16
or alternative requirement would not be inconsistent with 17
the overall purpose of title I of the Housing and Commu-18
nity Development Act of 1974: Provided further, That, 19
notwithstanding the preceding proviso, recipients of funds 20
provided under this heading that use such funds to supple-21
ment Federal assistance provided under section 402, 403, 22
404, 406, 407, 408 (c)(4), or 502 of the Robert T. Staf-23
ford Disaster Relief and Emergency Assistance Act (42 24
U.S.C. 5121 et seq.) may adopt, without review or public 25

comment, any environmental review, approval, or permit 1
performed by a Federal agency, and such adoption shall 2
satisfy the responsibilities of the recipient with respect to 3
such environmental review, approval or permit: Provided 4
further, That, notwithstanding section 104(g)(2) of the 5
Housing and Community Development Act of 1974 (42 6
U.S.C. 5304(g)(2)), the Secretary may, upon receipt of 7
a request for release of funds and certification, imme-8
diately approve the release of funds for an activity or 9
project assisted under this heading if the recipient has 10
adopted an environmental review, approval or permit 11
under the preceding proviso or the activity or project is 12
categorically excluded from review under the National En-13
vironmental Policy Act of 1969 (42 U.S.C. 4321 et seq.): 14
Provided further, That the Secretary shall publish via no-15
tice in the Federal Register any waiver, or alternative re-16
quirement, to any statute or regulation that the Secretary 17
administers pursuant to title I of the Housing and Com-18
munity Development Act of 1974 no later than 5 days be-19
fore the effective date of such waiver or alternative re-20
quirement: Provided further, That of the amounts made 21
available under this heading, up to $5,000,000 shall be 22
made available for capacity building and technical assist-23
ance, including assistance on contracting and procurement 24
processes, to support States, units of general local govern-25

ceive allocations pursuant to this heading, received dis-2

Community Development Act of 1974 (42 U.S.C. 5301 et 4
seq.) related to disaster relief, long-term recovery, restora-5
tion of infrastructure and housing, economic revitalization, 6
and mitigation in the most impacted and distressed areas 7
resulting from a major disaster, including funds provided 8
under section 145 of division C of Public Law 114–223, 9
section 192 of division C of Public Law 114–223 (as 10
added by section 101(3) of division A of Public Law 114– 11
254), section 421 of division K of Public Law 115–31, 12
and any mitigation funding provided under the heading 13
‘‘Department of Housing and Urban Development—Com-14
munity Planning and Development—Community Develop-15
ment Fund’’ of Public Law 115–123, that were allocated 16
in response to Hurricane Matthew, may be used inter-17
changeably and without limitation for the same activities 18
in the most impacted and distressed areas related to Hur-19
ricane Florence. In addition, any funds provided under the 20
heading ‘‘Department of Housing and Urban Develop-21
ment—Community Planning and Development—Commu-22
nity Development Fund’’ in this Act or in division I of 23
Public Law 115–254 that are allocated in response to 24
Hurricane Florence may be used interchangeably and 25

without limitation for the same activities in the most im-1
pacted and distressed areas related to Hurricane Matthew. 2
Until HUD publishes the Federal Register Notice imple-3
menting this provision, grantees may submit for HUD ap-4
proval revised plans for the use of funds related to Hurri-5
cane Matthew that expand the eligible beneficiaries of ex-6
isting programs contained in such previously approved 7
plans to include those impacted by Hurricane Florence. 8
Approval of any such revised plans shall include the execu-9
tion of revised grant terms and conditions as necessary. 10
Once the implementing Notice is published, any additional 11
action plan revisions shall follow the requirements con-12
tained therein. 13
(b) Amounts made available for administrative costs 14
for activities authorized under title I of the Housing and 15
Community Development Act of 1974 (42 U.S.C. 5301 et 16
seq.) related to disaster relief, long-term recovery, restora-17
tion of infrastructure and housing, economic revitalization, 18
and mitigation in the most impacted and distressed areas 19
under this Act or any future Act, and amounts previously 20
provided under section 420 of division L of Public Law 21
114–113, section 145 of division C of Public Law 114– 22
223, section 192 of division C of Public Law 114–223 (as 23
added by section 101(3) of division A of Public Law 114– 24
254), section 421 of division K of Public Law 115–31, 25

and under the heading ‘‘Department of Housing and 1
Urban Development—Community Planning and Develop-2
ment—Community Development Fund’’ of division B of 3
Public Law 115–56, Public Law 115–123, and Public 4
Law 115–254, shall be available for eligible administrative 5
costs of the grantee related to any disaster relief funding 6
identified in this subsection without regard to the par-7
ticular disaster appropriation from which such funds origi-8
nated. 9
(c) The additional uses pursuant to this section for 10
amounts that were previously designated by the Congress, 11
respectively, as an emergency requirement or as being for 12
disaster relief pursuant to the Balanced Budget and 13
Emergency Deficit Control Act are designated by the Con-14
gress as being for an emergency requirement pursuant to 15
section 251(b)(2)(A)(i) of the Balanced Budget and 16
Emergency Deficit Control Act of 1985 or as being for 17
disaster relief pursuant to section 251(b)(2)(D) of the 18
Balanced Budget and Emergency Deficit Control Act of 19
1985. 20

TITLE XI 1
GENERAL PROVISIONS 2
SEC. 1101. Each amount appropriated or made avail-3
able by this Act is in addition to amounts otherwise appro-4
priated for the fiscal year involved. 5
SEC. 1102. No part of any appropriation contained 6
in this Act shall remain available for obligation beyond 7
the current fiscal year unless expressly so provided herein. 8
SEC. 1103. Unless otherwise provided for by this Act, 9
the additional amounts appropriated by this Act to appro-10
priations accounts shall be available under the authorities 11
and conditions applicable to such appropriations accounts 12
for fiscal year 2019. 13
SEC. 1104. Each amount designated in this Act by 14
Congress as being for an emergency requirement pursuant 15
to section 251(b)(2)(A)(i) of the Balanced Budget and 16
Emergency Deficit Control Act of 1985 (2 U.S.C. 17
901(b)(2)(A)(i)) shall be available (or rescinded or trans-18
ferred, if applicable) only if the President subsequently so 19
designates all such amounts and transmits such designa-20
tions to the Congress. 21
SEC. 1105. For purposes of this Act, the con-22
sequences or impacts of any hurricane shall include dam-23
ages caused by the storm at any time during the entirety 24

of its duration as a cyclone, as defined by the National 1
Hurricane Center. 2
SEC. 1106. Any amount appropriated by this Act, 3
designated by Congress as an emergency requirement pur-4
suant to section 251(b)(2)(A)(i) of the Balanced Budget 5
and Emergency Deficit Control Act of 1985 (2 U.S.C. 6
901(b)(2)(A)(i)) and subsequently so designated by the 7
President, and transferred pursuant to transfer authori-8
ties provided by this Act shall retain such designation. 9
