TENDER FOR RATE CONTRACT FOR PLASTICWARE, FILTRATION PRODUCTS AND OTHER LAB

CONSUMABLES (FOR CLASS I AND CLASS II LOCAL SUPPLIER AS PER MAKE IN INDIA)

Director, CSIR - Central Leather Research Institute, Adyar, Chennai - 600 020, INDIA, (CLRI) invites sealed offers from manufacturers for purchase of item listed below. The tender is only open for local suppliers as per Public procurement Preference to Make in India, Order No. P-45021/2/2017-PP (BE-II) dt 16th September, 2020.

This rate contract would be operated till 30th June, 2021. On review, if the performance of the firm is found satisfactory, the rate contract would be renewed on yearly basis for a period of two additional years based on the new price list for the corresponding period subject to the discount and all other agreed terms and conditions being the same.

Important Note:

CSIR- CLRI would also provide the desired documents as mandated under notification

No. 45/2017 and 47/2017 of Ministry of Finance for availing concessional

GST/ IGST @ 5%.

A Pre-Bid Conference will be held at 11.00 a.m. on 15th December , 2020 at Heritage Hall, CLRI

Chennai. All Interested bidders are requested to attend.

Eligibility Criteria

1. Manufacturers having minimum local content of 20% and more or 50% and more are eligible to participate as per public procurement preference to Make in India, Order No. P-45021/2/2017-PP (BE-II) dt 16th September, 2020. Bids will be accepted from manufacturer only.

2. The following documents are to be submitted to be eligible for award of rate

contract :

a. Copies of 5 concluded Rate contract from ICAR/ICMR/CSIR or any other

govt. organization in the last three financial years

b. Copies of 3 purchase orders received valuing Rs. 1,00,000/- or more OR 5 purchase orders valuing Rs. 50,000 or more in each case from any CSIR/ICAR/ICMR or any govt. Research Institutes (for the period above mentioned by you or your authorized dealer).

c. Current price list as per our format in excel format (.xls) with local content.

(Annexure A) – CD / Pen drive

d. A certificate indicating, the name, address, email address of the

Distributor, who is going to supply the material. (Annexure B)

e. A certificate regarding the Discount extended by the manufacturer.

f. A certificate regarding the Discount extended by the Dealer. (This must be

on the dealer’s letter head.) If no discount is to be extended by the dealer

the same may be stated.

g. Self-Certification regarding Local Content in each of the product offered to be provided on company letter head (Annexure I)

h. Code of Integrity and no conflict of interest for public procurement

Terms & Conditions

1. Bids are invited from manufacturers who are local supplier as per Department for

Promotion of Industry and Internal Trade, Ministry of Commerce and Industry Order

No. P-45021/2/2017-PP ( BE-II) dated 16th September, 2020

Class – I Local supplier – whose goods offered for procurement has local content equal to or more than 50% as defined below:

Class – II Local supplier – whose goods offered for procurement has local content more than 20% but less than 50% as defined below: Local content : Means the amount of value added in India, which shall, unless otherwise prescribed by Nodal Ministry, be the total value of item procured ( excluding net domestic indirect taxes) minus the value of imported content in the item ( including all custom duties) as a proportion of the total value, in percent. Bidder is required to indicate percentage of local content and provide self-certification that the items offered meet the local content requirement for Class –I Local Supplier /Class – II Local Supplier as the case may be. Further the bidders shall also give details of the location(s) at which the local value addition is made.

False declarations will be in breach of the Code of Integrity under Rule 175(1)(i)(h) of the General Financial Rules 2017 for which a bidder or its successors can be debarred for up to two years as per Rule 151 (iii) of the General Financial Rules along with such other actions as may be permissible under law. A supplier who has been debarred by any procuring entity for violation of above cited order shall not be eligible for preference under above Order for procurement by any other procuring entity for the duration of the debarment.

2. Requirement of Registration ( Order No. F.No.6/18/2019-PPD dated 23.07.2020 of

Department of Expenditure, Ministry of Finance, Government of India refers )

I. Any bidder from a country which shares a land border with India will be eligible to

bid in this tender only if the Bidder is registered with the Competent Authority

i.e Registration Committee constituted by the Department for Promotion of

Industry and Internal Trade, Ministry of Commerce and Industry, Government of

India.

II. “Bidder” (including the term ‘tenderer’,’ consultant’ or’ service provider’ in

certain contexts) means any person or firm or company, including any member

of a consortium or joint venture (that is an association of several persons, or

firms or companies), every artificial juridical person not falling in any of the

descriptions of bidder stated herein before, including any agency branch or

office controlled by such person, participating in a procurement process.

III. Bidder from a country which shares a land border with India “ for the purpose of

above order/ this tender means:-

a. An entity incorporated, established or registered in such a country ; or

b. A subsidiary of an entity incorporated , established or registered in such a

country ; or

c. An entity substantially controlled through entities incorporated ,

established or registered in such a country ; or

d. An entity whose beneficial owner is situated in such a country: or

e. An Indian (Or other) agent of such an entity or

f. A natural Person who is a citizen of such a country ; or

g. A Consortium or joint venture where any member of the consortium or

joint venture falls under any of the above.

IV. The Beneficial owner for the purpose of (iii) above will be as under:

1. In case of a company or Limited Liability Partnership , the beneficial owner is

the natural person(s), who, whether acting alone or together, or through one

or more juridical person, has a controlling ownership interest or who

exercises control through other means.

Explanation- a. ‘Controlling ownership interest” means ownership of or entitlement to

more than twenty –five per cent of shares or capital or profits of the

company;

b. “ Control’ Shall include the right to appoint majority of the directors or to

control the management or Policy decisions including by virtue of their

shareholding or management rights or shareholders agreements or

voting agreements;

2. In case of a partnership firm., the beneficial owner is the natural

person(s) who, whether acting alone or together, or through one or more

juridical person, has ownership of entitlement to more than fifteen percent

of capital or Profits of the partnership;

3. In case of an unincorporated association or body of individuals, the beneficial

owner is the natural person(s), who, whether acting alone or together or

through one or more juridical person, has ownership of or entitlement to

more than fifteen percent of the property or capital or Profits of such

association or body of individuals.

4. Where no natural person is identified under (1) or (2) or (3) above, the

beneficial owner is the relevant natural person who holds the position of

senior managing official;

5. In case of a trust, the identification of beneficial owner(s) shall include

identification of the author of the trust, the trustee, the beneficiaries with

fifteen percent or more interest in the trust and any other natural person

exercising ultimate effective control over the trust through a chain of control

or ownership.

V. An agent is a person employed to do any act for another, or to represent another

in dealings with third person.

3. Fall Clause

Fall Clause: The price to be quoted (Price as indicated in the price list less discount plus

taxes and duty if applicable) by the Tenderer under the rate contract should in no event

exceed the lowest price at which the Tenderer sells the stores of identical description to

any other organization during the currency of rate contract under identical condition of

sale. If R/C holder reduces its price or sells or even offers to sell the same item/s at a

reduced price during the currency of the rate contract, price will be automatically reduced

with effect from that date for all the subsequent supplies under the R/C.

An undertaking is required to be given by all the manufacturers that the rates offered by

them are not more than the rate offered to any other Government agencies/Institution

and the discount offered is not less than the discount offered to any other Government

agencies/Institutions. In case any such discrepancy is noticed they shall refund the

amount to CSIR - CLRI and also Rate Contract is liable to be cancelled.

4. During the rate contract period, any time bound special offer introduced by

manufacturer / supplier must be offered to CSIR-CLRI and also the same should be

intimated in advance. However, CSIR-CLRI will have the right to reject or avail the

offer.

5. The rate and term of rate contract would also be applicable for the purchase made by

the Scientists / Students of CSIR – CLRI on cash / credit basis and hence, the firms or

their agents are not allowed to charge higher prices than those approved under the Rate

Contract. Concessional GST certificate will be issued for such purchases on demand.

6. Code of Integrity

The bidders/suppliers should sign a declaration about abiding by the Code of Integrity for

Public Procurement in bid documents. In case of any transgression of this code, the bidder is not only liable to be removed from the list of registered suppliers, but it would

be liable for other punitive actions such as cancellation of contracts, banning and blacklisting or action in Competition Commission of India, and so on.

Code of integrity for Public Procurement:

The Purchaser as well as bidders, suppliers, contractors and consultants should observe the highest standard of ethics and should not indulge in the following prohibited practices, either directly or indirectly, at any stage during the procurement process or during execution of resultant contracts:

i) “Corrupt practice”: making offers, solicitation or acceptance of bribe, rewards or gifts or any material benefit, in exchange for an unfair advantage in the procurement process or to otherwise influence the procurement process or contract execution;

ii) “Fraudulent practice”: any omission or misrepresentation that may mislead or attempt

to mislead so that financial or other benefits may be obtained or an obligation avoided. This includes making false declaration or providing false information for participation in a tender process or to secure a contract or in execution of the contract;

iii) “Anti-competitive practice”: any collusion, bid rigging or anti-competitive arrangement,

or any other practice coming under the purview of the Competition Act, 2002, between two or more bidders, with or without the knowledge of the purchaser, that may impair the transparency, fairness and the progress of the procurement process or to establish bid prices at artificial, non-competitive levels;

iv) “Coercive practice”: harming or threatening to harm, persons or their property to

influence their participation in the procurement process or affect the execution of a contract;

v) “Conflict of interest”: participation by a bidding firm or any of its affiliates that are

either involved in the consultancy contract to which this procurement is linked; or if they are part of more than one bid in the procurement; or if the bidding firm or their personnel have relationships or financial or business transactions with any official of purchaser who are directly or indirectly related to tender or execution process of contract; or improper use of information obtained by the (prospective) bidder from the purchaser with an intent to gain unfair advantage in the procurement process or for personal gain; and

vi) “Obstructive practice”: materially impede the purchaser’s investigation into allegations

of one or more of the above mentioned prohibited practices either by deliberately destroying, falsifying, altering; or by concealing of evidence material to the investigation; or by making false statements to investigators and/or by threatening, harassing or intimidating any party to prevent it from disclosing its knowledge of matters relevant to the investigation or from pursuing the investigation; or by impeding the purchaser’s Entity’s rights of audit or access to information;

Obligations for Proactive disclosures i) The Purchaser as well as bidders, suppliers, contractors and consultants, are obliged

under Code of Integrity for Public Procurement to sue-moto proactively declare any conflicts of interest (coming under the definition mentioned above – pre-existing or as

and as soon as these arise at any stage) in any procurement process or execution of contract. Failure to do so would amount to violation of this code of integrity; and

ii) The bidder must declare, whether asked or not in a bid document, any previous

transgressions of such a code of integrity with any entity in any country during the last three years or of being debarred by any other Procuring Entity. Failure to do so would amount to violation of this code of integrity;

iii) To encourage voluntary disclosures, such declarations would not mean automatic

disqualification for the bidder making such declarations. The declared conflict of interest would be evaluated and mitigation steps, if possible, taken by the purchaser. Similarly, voluntary reporting of previous transgressions of Code of Integrity elsewhere may be evaluated and barring cases of various grades of debarment, an alert watch may be kept on the bidder’s actions in the tender and subsequent contract.

Punitive Provisions Without prejudice to and in addition to the rights of the Purchaser to other penal provisions as per the bid documents or contract, if the Purchaser comes to a conclusion that a (prospective) bidder/supplier, directly or through an agent, has violated this code of integrity in competing for the contract or in executing a contract, the purchaser may take appropriate measures including one or more of the following:

i) If his bids are under consideration in any procurement

a) Forfeiture or encashment of bid security; b) Calling off of any pre-contract negotiations; and c) Rejection and exclusion of the bidder from the procurement process.

ii) If a contract has already been awarded

a) Cancellation of the relevant contract and recovery of compensation for loss incurred by the purchaser;

b) Forfeiture or encashment of any other security or bond relating to the procurement;

c) Recovery of payments including advance payments, if any, made by the purchaser along with interest thereon at the prevailing rate.

iii) Provisions in addition to above:

Removal from the list of registered suppliers and banning/debarment of the bidder from participation in future procurements of the purchaser for a period not less than one year; In case of anti-competitive practices, information for further processing may be filed under a signature of the Joint Secretary level officer, with the Competition Commission of India; Initiation of suitable disciplinary or criminal proceedings against any individual or staff found responsible.

7. Settlement of Disputes

The Purchaser and the supplier shall make every effort to resolve amicably by direct informal negotiation any disagreement or dispute arising between them under or in connection with the Contract.

If, after Twenty-One (21) days, the parties have failed to resolve their dispute or difference by such mutual consultation, then either the Purchaser or the Supplier may give notice to the other party of its intention to commence arbitration, as hereinafter provided, as to the matter in dispute, and no arbitration in respect of this matter may be commenced unless such notice is given. Any dispute or difference in respect of which a notice of intention to commence arbitration has been given in accordance with this Clause shall be finally settled by arbitration. Arbitration may be commenced prior to or after delivery of the Goods under the Contract. The dispute settlement mechanism/arbitration proceedings shall be concluded as under: (a) In case of Dispute or difference arising between the Purchaser and a domestic supplier relating to any matter arising out of or connected with this agreement, such disputes or difference shall be settled in accordance with the Indian Arbitration & Conciliation Act, 1996, the rules there under and any statutory modifications or re-enactments thereof shall apply to the arbitration proceedings. The dispute shall be referred to the Delhi International Arbitration Centre (DIAC), Delhi High Court, New Delhi. The award of the arbitrator so appointed shall be final, conclusive and binding on all parties to this order. The venue of the arbitration shall be the place from where the purchase order or contract is issued. notwithstanding any reference to arbitration herein, (a) The parties shall continue to perform their respective obligations under the Contract unless they otherwise agree; and (b) The Purchaser shall pay the Supplier any monies due to the Supplier.

1.1 The prices quoted by us is not higher than the maximum retail price for the stores and the same is not higher than the price usually charged by us for stores of the same nature, class or description to any other purchaser.

1.2 The price charged for the stores supplied under the contract by us shall in no event exceed the lowest price at which we sell the stores of identical description to any other person during the period till performance of all supply orders placed during the currency of the contract is completed. If at any time during the period we reduce the sale price of such stores or sell such stores to any other person including his dealers at a price lower than the price chargeable under the contract, he shall forthwith notify such reduction or sale to the purchaser and the price payable under the contract for these items of stores supplied after the date of coming into force of

such reduction or sale shall stand correspondingly reduced.

1.3 If it is discovered that we have contravened the above conditions, then without prejudice to any other action which might be taken against us, it shall be lawful for the purchaser to (a) revise the price at any stage so as to bring it in conformity or (b) to terminate the contract and purchase the items of stores at the risk and cost to

us and loss recovered from the vendor.

1.4 During the tenure of the Rate Contract, the benefits of any promotional offers by

the manufacturers will also be passed on to CSIR - CLRI, CHENNAI.

i. बायत के साथ बलूभ सीभा नहीॊ यखन ेवारे फोरीदाताओॊ को अनरुग्नक – F प्रस्ततु कयना होगा। जो पभम अनरुग्नक – F जभा नहीॊ कयत ेहैं, उन्हें गयै-उत्तयदामी भानकय उनकी फोरी को सयसयी तौय ऩय अस्वीकृत कय ददमा जामेगा।

j. बायत के साथ बलूभ सीभा यखन ेवारे फोरीदाताओॊ को अनरुग्नक – G प्रस्ततु कयना होगा। जो पभम अनरुग्नक – G जभा नहीॊ कयत ेहैं, उन्हें गयै-उत्तयदामी भानकय उनकी फोरी को सयसयी तौय ऩय अस्वीकृत कय ददमा जामेगा।

ननफंधन औय शतें

1. वाखणज्म औय उद्मोग भॊिारम के आदेश सॊ. P-45021/2/2017-PP (BE-II) ददनाॊक 16 लसतॊफय, 2020 के अनसुाय उद्मोग औय आॊतरयक व्माऩाय को फढावा देने के लरए स्थानीम आऩनूतमकताम से ऑनराइन फोलरमाॊ आभॊत्रित की जाती हैं।

शे्रणी – I स्थानीम आऩनूतमकताम – स्जनके द्वाया साभान की खयीद के लरए ऩेशकश की गई साभग्री, नीच ेमथा ऩरयबार्षत, स्थानीम साभग्री के 50% के फयाफय मा इससे अधधक है:

शे्रणी – II स्थानीम आऩनूतमकताम – स्जनके द्वाया साभान की खयीद के लरए ऩेशकश की गई साभग्री, नीच ेमथा ऩरयबार्षत, स्थानीम साभग्री के 20% से अधधक, रेककन 50% से कभ है :

स्थानीम साभग्री का अथम है बायत भें भलू्म मोस्जत यालश है, स्जस ेनोडर भॊिारम द्वाया ननधामरयत ककमा जाता है, स्जस ेखयीदी गईं भदों के कुर भलू्म (शदु्ध घयेर ूअप्रत्मऺ कयों को छोड़कय) भें से भदों के आमानतत साभग्री का भलू्म (सबी सीभाशलु्क सदहत) घटाकय कुर भलू्म के अनऩुात के अनसुाय प्राप्त ककमा जाता है, प्रनतशत भें।

फोरीदाता को स्थानीम साभग्री के प्रनतशत को इॊधगत कयत ेहुए स्व-प्रभाणन प्रदान कयना होगा कक ऩेशकश की गई वस्तएुॊ, शे्रणी -। स्थानीम आऩनूतमकताम / शे्रणी -। स्थानीम आऩनूतमकताम, मथास्स्थनत, की स्थानीम साभग्री आवश्मकता को ऩयूा कयती हैं। इसके अरावा फोरीकताम को स्थान का र्ववयण देना होगा, जहाॊ ऩय स्थानीम भलू्म भें वरृ्द्ध की गई है।

साभान्म र्वत्तीम ननमभ 2017 के ननमभ 175 (1) (i) (h) के तहत झूठी घोषणाएॊ कयना सत्मननष्ठा सॊदहता का उल्रॊघन होगा, स्जसके लरए फोरीदाता मा उसके उत्तयाधधकारयमों को साभान्म र्वत्तीम ननमभों के ननमभ 151 (iii) के अनसुाय दो सार तक डीफाय ककमा जा सकता है तथा काननू के तहत अनभुन्म अन्म कायमवाई की जा सकती है।

उऩमुमक्त आदेश के उल्रॊघन के लरए ककसी बी क्रम सॊस्था द्वाया डडफाय ककमा गमा आऩनूतमकताम, उऩयोक्त क्रम आदेश के तहत र्ववजमन की अवधध के लरए ककसी अन्म क्रम सॊस्था द्वाया वयीमता के लरए ऩाि नहीॊ होगा।

2. ऩंजीकयण की आवश्मकता (व्मम ववबाग, ववत्त भंत्रारम, बायत सयकाय द्वाया संदमबमत आदेश सं. पाइर सं. 6/18/2019- PPD ददनांक 23.07.2020)

I. बायत के साथ बलूभ की सीभा साझा कयनेवारे ककसी बी देश का फोरीदाता इस ननर्वदा भें फोरी रगाने के लरए तबी ऩाि होगा, जफ फोरीदाता को सऺभ प्राधधकायी अथामत बायत सयकाय के वाखणज्म औय उद्मोग भॊिारम के उद्मोग औय आॊतरयक व्माऩाय सॊवधमन र्वबाग द्वाया गदठत ऩॊजीकयण सलभनत के साथ ऩॊजीकृत ककमा होगा।

II. "फोरीकताम" (कुछ सॊदबों भें 'ननर्वदाकताम', 'ऩयाभशमदाता' मा 'सेवा प्रदाता' शब्द सदहत) का अलबप्राम है खयीद प्रकक्रमा भें बाग रेनेवारा कोई बी व्मस्क्त मा पभम मा कॊ ऩनी, कॊ सोदटममभ मा सॊमकु्त उद्मभ (जो कई व्मस्क्तमों, मा पभम मा कॊ ऩननमों का सॊघ है) का कोई बी सदस्म, प्रत्मेक कृत्रिभ जुरयडडकर व्मस्क्त जो ककसी व्मस्क्त द्वाया ननमॊत्रित एजेंसी शाखा मा कामामरम सदहत फोरीदाता के ऩवूोक्त ककसी बी र्ववयण के अॊतगमत नहीॊ आता है।

III. उऩयोक्त आदेश / इस ननर्वदा के प्रमोजन के लरए बायत के साथ बलूभ की सीभा साझा कयनेवार ेककसी देश के फोरीदाता से अलबप्राम है :-

a. ऐसे देश भें ननगलभत, स्थार्ऩत मा ऩॊजीकृत कोई सॊस्था; अथवा b. ऐसे देश भें ननगलभत, स्थार्ऩत मा ऩॊजीकृत ककसी सॊस्था की सहामक कॊ ऩनी; अथवा c. ऐसे देश भें ननगलभत, स्थार्ऩत मा ऩॊजीकृत सॊस्थाओॊ द्वाया ननमॊत्रित कोई सॊस्था; अथवा d. कोई सॊस्था, स्जसका राबकायी भालरक ऐसे देश भें स्स्थत है; अथवा e. ऐसी सॊस्था का कोई बायतीम (मा अन्म) एजेंट, अथवा f. ऐसे देश का वास्तर्वक नागरयक; अथवा g. कोई कॊ सोदटममभ मा सॊमकु्त उद्मभ, जहाॊ कॊ सोदटममभ मा सॊमकु्त उद्मभ का कोई बी

सदस्म जो उऩयोक्त भें से ककसी का बी अॊतगमत आता हो।

IV. उऩयोक्त प्रमोजन (iii) के लरए राबकायी भालरक का अलबप्राम है :

1. ककसी कॊ ऩनी मा सीलभत देमता बागीदायी के भाभर ेभें, राबकायी स्वाभी वास्तव भें वह व्मस्क्त होता है, जो अकेर ेअथवा ककसी के साथ लभरकय अथवा एक मा अधधक न्मानमक व्मस्क्त(मों) के भाध्मभ से कामम कयता है तथा ननमॊिक स्वालभत्व का अधधकाय यखता है मा जो अन्म भाध्मभों से ननमॊिण कयता है। स्ऩष्टीकयण - a. “ननमॊिक स्वालभत्व अधधकाय” का अलबप्राम है कॊ ऩनी भें ऩच्चीस प्रनतशत से अधधक शमेयों

मा ऩूॊजी मा भनुापे की हकदायी; b. "ननमॊिण" के अॊतगमत अधधकाॊश ननदेशकों को ननमकु्त कयने अथवा उनके शमेयधायण मा

प्रफॊधन अधधकायों मा शमेयधायकों मा भतदान सभझौत े द्वाया प्रफॊधन मा नीनतगत ननणममों को ननमॊत्रित कयने का अधधकाय शालभर है;

2. साझेदायी पभम के भाभर ेभें, राबकायी स्वाभी वह वास्तर्वक व्मस्क्त होता है, जो अकेर ेमा ककसी के साथ मा एक मा अधधक न्मानमक व्मस्क्त(मों) के भाध्मभ से कामम कयता है, स्जसके ऩास ऩॊद्रह प्रनतशत से अधधक ऩूॊजी मा साझदेायी राब के हकदायी का स्वालभत्व है;

3. व्मस्क्तमों के अननगलभत सॊघ मा ननकाम के भाभरे भें, राबकायी स्वाभी वह वास्तर्वक व्मस्क्त होता है, जो अकेर ेमा ककसी के साथ मा एक मा अधधक न्मानमक व्मस्क्त(मों) के भाध्मभ से कामम कयता है, स्जसके ऩास उस सॊघ अथवा ननकाम के ऩॊद्रह प्रनतशत से अधधक सॊऩस्त्त मा ऩूॊजी मा राब की हकदायी मा स्वालभत्व है;

4. जहाॊ उऩयोक्त (1) मा (2) मा (3) अनसुाय ककसी बी वास्तर्वक व्मस्क्त की ऩहचान नहीॊ की जाती है, तो राबकायी स्वाभी सॊफॊधधत वास्तर्वक व्मस्क्त होता है जो वरयष्ठ प्रफॊध अधधकायी का ऩद धारयत कयता है;

5. ककसी न्मास के भाभर ेभें, राबकायी स्वाभी(मों) की ऩहचान भें न्मास का सॊस्थाऩक, न्मासी, न्मास भें ऩॊद्रह प्रनतशत मा उससे अधधक दहस्सदेाय राबाथी औय कोई अन्म वास्तर्वक व्मस्क्त जो ननमॊिण मा स्वालभत्व के भाध्मभ से न्मास ऩय अॊनतभ प्रबावी ननमॊिण यखता है, शालभर होगा।

V. एक एजेंट वह व्मस्क्त होता है जो दसूये के लरए कोई बी कामम कयने के लरए अथवा तीसये व्मस्क्त के साथ व्मवहाय भें दसूये का प्रनतननधधत्व कयने के लरए ननमोस्जत है।

3. Fall Clause

Fall Clause : दय अनफुॊध के तहत ननर्वदाकताम द्वाया उदृ्धत ककमा जाने वारा भलू्म (भलू्म सचूी भें छूट को घटाकय, राग ूकय औय शलु्क जोडकय दशाममा गमा भलू्म) ककसी बी स्स्थनत भें, ननर्वदाकताम द्वाया दय अनफुॊध की प्रचरन अवधध के दौयान सभरूऩ त्रफक्री की स्स्थनत भें ककसी अन्म सॊगठन को सभान ककस्भ का साभान स्जस कभ कीभत ऩय फचेी जाती है, उस कीभत से ज्मादा नहीॊ होना चादहए। मदद दय अनफुॊध के प्रचरन के दौयान दय अनफुॊध धायक वस्त ुकी कीभत घटाता है मा उसी वस्त ुको कभ कीभत ऩय फेचता है मा फेचने की ऩेशकश कयता है, तो उस तायीख से प्रबावी, दय अनफुॊध के तहत फाद भें की जानेवारी सबी आऩनूतममों की कीभतें अऩने आऩ कभ हो जाएॊगी।

सबी ननभामताओॊ को एक वचनफॊध देना होगा कक उनके द्वाया प्रस्तार्वत की जाने वारी दयें ककसी अन्म सयकायी एजेंलसमों / सॊस्थानों को दी जाने वारी दयों से अधधक नहीॊ हैं औय जो छूट का प्रस्ताव ददमा गमा है वह ककसी अन्म सयकायी एजेंलसमों / सॊस्थानों को दी गई छूट से कभ नहीॊ है। मदद कोई र्वसॊगनत ऩाई जाती है, तो वे सीएसआईआय - सीएरआयआई को यालश वाऩस कय देंग ेऔय दय अनफुॊध को ननयस्त बी ककमा जा सकता है।

4. दय अनफुॊध की अवधध के दौयान, ननभामता / आऩनूतमकताम द्वाया शरुू की गई ककसी बी सभमफद्ध र्वशषे प्रस्ताव को सीएरआयआई को प्रस्तार्वत ककमा जाना चादहए औय इसके फाये भें ऩहर े ही सधूचत कयना चादहए। हाराॉकक, सीएरआयआई के ऩास उक्त प्रस्ताव को अस्वीकाय कयने मा स्वीकाय कयने का अधधकाय होगा।

5. दय औय दय अनफुॊध की अवधध सीएसआईआय-सीएरआयआई के वऻैाननकों / छािों द्वाया नकद / के्रडडट आधाय ऩय की जानेवारी खयीद के लरए बी राग ूहोगी औय इसलरए, पभों मा उनके एजेंटों को दय अनफुॊध के तहत अनभुोददत कीभत से अधधक कीभत वसरूने की अनभुनत नहीॊ दी जाती है। भाॊगे जाने ऩय इन खयीदों के लरए रयमामती GST प्रभाणऩि जायी ककमा जाएगा।

6. सत्मननष्ठा सदंहता

फोरीकतामओॊ / आऩनूतमकायों को फोरी दस्तावेजों भें सावमजननक क्रम सॊफॊधी सत्मननष्ठा सॊदहता का ऩारन कयने के फाये भें एक घोषणा ऩय हस्ताऺय कयना चादहए। मदद इस सॊदहता का ककसी बी रूऩ भें उल्रॊघन ककमा जाता है, तो फोरीकताम को न केवर ऩॊजीकृत आऩनूतमकतामओॊ की सचूी से हटामा जा सकता है, फस्ल्क अन्म दॊडात्भक कायमवाई जैस ेअनफुॊध ननयस्त कयना, प्रनतफॊध रगाना औय कारीसचूी भें डारना अतवा बायतीम प्रनतस्ऩधाम आमोग भें कायमवाई कयना आदद ककए जा सकत ेहैं।

सावमजननक क्रम की सत्मननष्ठा सदंहता :

खयीददायों के साथ-साथ फोरीकतामओॊ, आऩनूतमकतामओॊ, सॊर्वदाकतामओॊ औय सराहकायों को उच्चतभ ननैतकता स्तय का ऩारन कयना चादहए औय खयीद प्रकक्रमा के दौयान मा ऩरयणाभी अनफुॊधों के ननष्ऩादन के दौयान ककसी बी स्तय ऩय प्रत्मऺ मा ऩयोऺ रूऩ से, ननर्षद्ध कामम-प्रणारी का ऩारन नहीॊ कयना चादहए :

i) "भ्रष्ि कामम-प्रणारी": खयीद प्रकक्रमा भें अनधुचत राब के फदर ेभें ककसी बी बौनतक राब की ऩेशकश कयना, रयश्वत, ऩयुस्काय मा उऩहाय भाॊगना मा रेना मा खयीद प्रकक्रमा मा अनफुॊध ननष्ऩादन को अन्मथा प्रबार्वत कयना;

ii) "कऩिऩणूम कामम-प्रणारी": कोई चूक मा लभथ्मावणमन जो गभुयाह कय सकती है मा गभुयाह कयने का प्रमास कय सकती है ताकक र्वत्तीम मा अन्म राब प्राप्त ककए जा सकें मा एक दानमत्व से फचा जा सके। इसभें ननर्वदा प्रकक्रमा भें बाग रेने मा अनफुॊध प्राप्त कयने मा अनफुॊध के ननष्ऩादन हेत ुझूठी घोषणा मा गरत जानकायी देना शालभर हैं;

iii) "प्रनतस्ऩधाम ववयोधी कामम-प्रणारी ": दो मा दो से अधधक फोरीकतामओॊ के फीच खयीदाय की जानकायी से मा त्रफना जानकायी के कोई बी लभरीबगत, फोरी भें धाॊधरी मा प्रनतस्ऩधाम-योधी व्मवस्था, मा प्रनतस्ऩधाम अधधननमभ, 2002 के दामये भें आने वारी कोई बी प्रथा, जो ऩायदलशमता, ननष्ऩऺता औय खयीद प्रकक्रमा की प्रगनत भें फाधा डारती हो मा कृत्रिभ, गयै-प्रनतस्ऩधी स्तयों ऩय फोरी भलू्म स्थार्ऩत कयना;

iv) "अवऩीड़क कामम-प्रणारी": खयीद प्रकक्रमा भें प्रनतबाधगता को प्रबार्वत कयने मा ककसी अनफुॊध के ननष्ऩादन को प्रबार्वत कयने के लरए व्मस्क्तमों मा उनकी सॊऩस्त्त को नकुसान कयना अथवा नकुसान कयने की धभकी देना;

v) “भतबेद”: एक फोरी रगाने वारी पभम मा उसके कोई बी सहमोगी पभम, जो इस खयीद सॊफॊधी कॊ सल्टेंसी अनफुॊध भें शालभर है, की प्रनतबाधगता; मा मदद वे खयीद भें एक से अधधक फोरी के दहस्सेदाय हैं; मा मदद फोरी रगाने वारी पभम मा उनके कलभममों के ककसी अधधकायी के साथ कोई सॊफॊध मा र्वत्तीम मा व्मावसानमक रेन-देन हैं, स्जनका प्रत्मऺ मा ऩयोऺ रूऩ से अनफुॊध अथवा ननर्वदा की ननष्ऩादन प्रकक्रमा से सॊफॊध हैं; खयीद प्रकक्रमा भें अनधुचत राब मा व्मस्क्तगत राब के इयादे से के्रता से प्राप्त जानकायी का (बावी) फोरीकताम द्वाया अनधुचत उऩमोग; तथा

vi) “फाधक कामम-प्रणारी”: उऩयोक्त ननर्षद्ध कामम-प्रणालरमों भें से ककसी एक मा अधधक के आयोऩों भें के्रता की जाॊच को बौनतक रूऩ से योकना, जानफझूकय नष्ट कयना, गरत तयीके से फदरना; मा जाॊच की साक्ष्म साभग्री को नछऩाना; मा जाॊचकतामओॊ को गरत फमान देना औय / मा ककसी बी ऩऺकाय को जाॊच से सॊफॊधधत भाभरों के अऩनी जानकायी को प्रकट कयने मा जाॊच को बाग रेने से योकना मा धभकी देना, ऩयेशान कयना मा डयाना; मा के्रता के ऑडडट मा सचूना प्राप्त कयने के अधधकाय से वॊधचत कयना;

सफक्रम प्रकिीकयण के दानमत्व

i) के्रता के साथ-साथ फोरीकताम, आऩनूतमकताम, सॊर्वदाकताम औय सराहकाय, सावमजननक खयीद सॊफॊधी सत्मननष्ठा सॊदहता के तहत ककसी बी खयीद प्रकक्रमा भें मा अनफुॊध के ननष्ऩादन (उऩयोक्त ऩरयबाषा के तहत - ऩहर ेसे भौजूद मा इसके फाद के ककसी बी स्तय ऩय उत्ऩन्न) भें उत्ऩन्न ककसी बी तयह के भतबदे की स्वमॊ घोषणा कयने के लरए फाध्म होत ेहैं। ऐसा नहीॊ कयने ऩय इस सत्मननष्ठा सॊदहता का उल्रॊघन होगा; तथा

ii) फोरी दस्तावेज भें फोरीकताम को, बरे ही ऩछूा जाम मा न ऩछूा जाम, मह घोर्षत कयना होगा कक ककसी बी देश भें र्ऩछर ेतीन वषों के दौयान ककसी बी सॊस्था के साथ ऩवूम भें इस तयह की सत्मननष्ठा सॊदहता का उल्रॊघन ककमा गमा है मा ककसी अन्म क्रम सॊस्था द्वाया डीफाय ककमा गमा है। ऐसा न कयने ऩय इस ेसत्मननष्ठा सॊदहता का उल्रॊघन भाना जामेगा;

iii) स्वसै्च्छक प्रकटीकयण को प्रोत्सादहत कयने के लरए, इस तयह की घोषणाओॊ का अलबप्राम फोरीकताम के लरए इस तयह की घोषणा कयना स्वत् अमोग्मता नहीॊ होगी। घोर्षत भतबेद का भलू्माॊकन कय मदद सॊबव हो तो, के्रता द्वाया याहत कदभ उठामे जाएॊगे। इसी प्रकाय सत्मननष्ठा सॊदहता के र्ऩछर ेउल्रॊघनों का स्वसै्च्छक रयऩोदटिंग का भलू्माॊकन ककमा जा सकता है औय र्वलबन्न ग्रेडों के डीफायभेंट को छोडकय ननर्वदा औय उसके फाद के अनफुॊध भें फोरीकताम के कामों ऩय एक सतकम ननगयानी यखी जा सकती है।

दंडात्भक प्रावधान

फोरी मा अनफुॊध के अनसुाय अन्म दॊड प्रावधानों के लरए के्रता के अधधकायों के अरावा औय त्रफना ककसी ऩवूामग्रह के, मदद के्रता इस ननष्कषम ऩय ऩहुॊचता है कक (सॊबार्वत) फोरीकताम / आऩनूतमकताम ने अनफुॊध के लरए प्रनतस्ऩधाम कयने मा अनफुॊध ननष्ऩाददत कयने भें सीधे मा एक एजेंट के भाध्मभ से, इस सत्मननष्ठा सॊदहता का उल्रॊघन ककमा है, के्रता ननम्नलरखखत भें से एक मा अधधक उधचत उऩाम कय सकता है:

i) मदद ककसी खयीद भें उसकी फोलरमाॉ र्वचायाधीन हैं a) फोरी प्रत्माबनूत की जब्ती मा नकदीकयण; b) ककसी बी ऩवूम-अनफुॊध वाताम को फॊद कयना; तथा c) खयीद प्रकक्रमा से फोरीकताम की अस्वीकृनत औय फदहष्काय।

ii) मदद कोई अनफुॊध ऩहरे ही प्रदान ककमा जा चकुा है

a) सॊफॊधधत अनफुॊध को ननयस्त कयना औय खयीदाय द्वाया ककए गए नकुसान के लरए भआुवज ेकी वसरूी; b) खयीद से सॊफॊधधत ककसी बी अन्म प्रत्माबनूत मा फाॊड का जब्ती मा नकदीकयण; c) अधग्रभ बगुतान सदहत सबी बगुतान, मदद कोई हो, खयीदाय द्वाया प्रचलरत दय ऩय ब्माज सदहत वसरूी।

iii) उऩयोक्त के अनतरयक्त प्रावधान :

एक वषम की अवधध के लरए के्रता के बर्वष्म की खयीद भें बागीदायी से फोरीकताम ऩॊजीकृत आऩनूतमकतामओॊ की सचूी से हटाना औय फोरीकताम को फनै / डीफाय कयना;

प्रनतस्ऩधी-र्वयोधी कामम-प्रणालरमों के भाभरे भें, बायत के प्रनतस्ऩधाम आमोग के साथ सॊमकु्त सधचव स्तय के अधधकायी के हस्ताऺय के साथ आग ेकी प्रकक्रमा के लरए सचूना दजम की जा सकती है;

स्जम्भेदाय ऩामे गमे ककसी बी व्मस्क्त मा कभमचारयमों के खखराप उऩमकु्त अनशुासनाक मा आऩयाधधक काममवाही की ऩहर

7. वववादों का ननऩिाया

के्रता औय आऩनूतमकताम, अनफुॊध के लसरलसर ेभें अऩने फीच उत्ऩन्न होने वारे र्ववाद मा ककसी बी असहभनत को प्रत्मऺ अनौऩचारयक फातचीत द्वाया सरुझाने के लरए हय सॊबव प्रमास कयेंगे।

मदद इक्कीस (21) ददनों के फाद, ऩादटममाॊ आऩसी ऩयाभशम से अऩने र्ववाद मा अॊतय को हर कयने भें र्वपर यही हैं, तो के्रता मा आऩनूतमकताम र्ववादगत भाभरा भें र्ववाचन शरुू कयने के लरए ककसी दसूये ऩऺ को नोदटस दे सकत ेहैं, इसके फाद मथा प्रदान ककमा जाता है, औय जफ तक कक इस तयह का नोदटस नहीॊ ददमा जाता है, इस भाभर ेभें कोई र्ववाचन शरुू नहीॊ की जा सकती है । इस खॊड के अनसुाय कोई र्ववाद मा भतबेद, स्जसके सॊफॊध भें र्ववाचन शरुू कयने के लरए नोदटस ददमा गमा है, उसका अॊत भें र्ववाचन के द्वाया सभाधान ककमा जाएगा। अनफुॊध के तहत भार की डडरीवयी के ऩहर ेमा फाद भें र्ववाचन शरुू की जा सकती है।

र्ववाद ननऩटान तॊि / र्ववाचन काममवाही ननम्नानसुाय होगी :

(a) इस सभझौत े से जुड़ े ककसी बी भाभर े के सॊफॊध भें के्रता औय स्वदेशी आऩनूतमकताम के फीच कोई र्ववाद मा भतबेद उत्ऩन्न होने ऩय, इस तयह के र्ववाद मा भतबेद बायतीम र्ववाचन औय सरुह अधधननमभ 1996, उसके अॊतगमत फनामे गमे ननमभों के अनसुाय ननऩटाए जाएॊगे औय इसके उऩयाॊत कोई बी सॊवधैाननक सॊशोधन मा ऩनु:अधधननमभन र्ववाचन की काममवाही ऩय राग ूहोंगे। उऩयोक्त र्ववाद को ददल्री अॊतयामष्रीम र्ववाचन कें द्र, ददल्री उच्च न्मामारम, नई ददल्री भें बेजा जाएगा। ननमकु्त ऩॊचाट का अधधननणमम सबी ऩऺों के लरए अॊनतभ, ननणाममक औय फाध्मकायी होगा।

र्ववाचन कें द्र वह स्थान होगा जहाॊ से खयीद आदेश मा अनफुॊध जायी ककमा जाता है।

उऩयोक्त ऩॊचाट भें ककसी फात के होत ेहुए बी,

(a) ऩऺकाय, अनफुॊध के तहत अऩने सॊफॊधधत दानमत्वों को ननवमहन जायी यखेंग,े जफ तक कक वे अन्मथा सहभत न हों; तथा

(b) के्रता, आऩनूतमकताम को देम ऩसै,े मदद कोई हो, तो उसका बगुतान कयेगा।
