TENDER NOTICE

Subject: Invitation of tender quotation for supply of cartridges & drums for usein the Ministry of Mines.

Ministry of Mines proposes to procure various cartridges & drums forcomputer printers as per the annexure enclosed. The tender complete in allrespect should be sent in sealed cover and super-scribed as "Quotation for thesupply of cartridges & drums in the Ministry of Mines" and deposited in thetender box kept at the Information & Facilitation center, Garage No. 23, groundfloor, 'A' Wing, Shastri Bhawan, New Delhi at the latest by 19th December, 2016upto 12.00 PM. The quotations should be accompanied by a Demand Drafttowards earnest money of Rs.50,000/- drawn in favor of Pay & Accounts Officer,Ministry of Mines, New Delhi. Quotations received after stipulated date/time andwithout earnest money shall not be entertained. The quotations will be openedon zo" December, 2016 at 3.00 PM by 'Tender Opening Committee' in the Ministryin the presence of the tenderers or their representatives who may like to bepresent.

MINIMUM ELIGIBILITY CRITERIA

The following shall be the minimum eligibility criteria for selection ofbidders at bid stage of the bidding process;-

Self-attested copy of PAN (firm/individual as the case may be).Self-attested copy VAT Registration Certificate.Experience: The Bidder shall have experience in the similar field forminimum 3 years in 3 in the Government Ministries/Departments.The Firm/Agency is not banned/blacklisted by any organization/Govt.Department.

The Annual Rate Contract will be governed by the following terms andconditions:-

In emergency situations, the firm should be in a position to supply cartridges& drums on very short notice request made over telephone. . ..In normal circumstances the cartridges & drums should be delivered In thisMinistry within 2 days from receipt of the job order.

3. The firms must supply its address and telephone Nos. (Office as well as residence)and also mobile phone numbers so as to contact the firm in emergency, if required.The firm should be able to provide toner cartridges on holidays/Sundays andbeyond office hours also.

4. The firm will ensure that the toner cartridges supplied to this Ministry are genuineand contains 3D hologram of the manufacturer. The firm will be held responsiblein case of deficiency in the quality of the product and performance security is liableto be forfeited if the toner supplied by the firm is found to be spurious/fake/refilled.

5. The firm will be liable for any damage caused to the printer/equipment byspurious/fake toner/cartridge/drum supplied.

6. The rates will remain valid for a period of one year from the date of award ofcontract.

7. An earnest money of Rs.50,OOO/- (Rupees fifty thousand only) has to be depositedin the form of bank draft drawn in favor of Pay and Accounts Officer, Ministry ofMines, New Delhi alongwith the quotations. Successful tenderer will have todeposit security money of RS.1,OO,OOO/-(Rupees one lakh only) in the form ofdemand draft in favor of Pay and Accounts Officer, Ministry of Mines, New Delhi assecurity money for the period of contract. Security money will be forfeited if thefirm fails to adhere to any of the terms and conditions. Cutting/overwriting intenders shall not be accepted and shall be rejected.

8. The Ministry will not accept any duplicate/refilled or substandard item. If thesupplier is not able to supply the original items, appropriate action may be takenagainst the firm i.e. imposition of penalty, cancellation of contract includingblacklisting the firm.

9. All item have to be supplied to Room No. 338 'A' Wing, Shastri Bhawan, New Delhiand at any other location as per the needs of the Ministry. The suppliers will beresponsible for delivery of goods in good condition at their own risk and cost.

10. The item should be supplied within two days after receipt of the purchase/supplyorder.

11. In case the successful bidder is found in breach of any condition(s) of the contractat any stage or services of the supplier is not found satisfactory to the Ministry, thecontract may be terminated and performance security is liable to be forfeited if thetoner supplied by the firm is found to be spurious. The decision of the Ministryshall be final and binding in the regard.

12. The EMD shall stand forfeited if the successful bidder, whose tender is accepted,fails or refuses to furnish the security deposit amount in the form of bankguarantee, from any scheduled bank in India within a fortnight from the date ofacceptance of his offer, or fails or refuses to execute the contract.

13. The purchaser shall place an Advance Purchase Order on the bidder whose offerhas been accepted. The bidder shall, within a fortnight of issue of the order, furnishperformance security in conformity with the terms and conditions, in the form of ademand draft or bank guarantee as per the proforma enclosed, form anyscheduled bank in India.

14. Failure to furnish performance security within the stipulated time shall be construeda breach of contract which may result in cancellation of the contract at the risk andcost of the bidder, along with forfeiture of the EMD.

15. The successful bidder shall indemnify the purchaser against all third party claims ofinfringement of patent, trademark, etc., arising from use of the goods.

16. The goods shall be supplied in original packing from the manufacturer clearlyindicating item's Serial No, date, expiry date, price, etc.

17. Replacement under warranty clause shall be made by the successful bidder, atsite, free of all charges.

18. Prices charged by the successful bidder for the goods delivered under the contractshall not be higher than prices quoted in his bid. .

19. Delay by supplier in the performance of its delivery obligations shall render thesupplier liable to any or all the sanctions, forfeiture of its performance security,imposition of liquidated damages and/ or termination of the contract for default.

20. The contract awarded shall be terminated if the firm indulges in any unfairactivities, misrepresentation of facts, submission of improper/forged/fakedocuments/toners/cartridges/drums. In such a case the firm will be liable to bebanned and the performance security will be forfeited.

21. The rates quoted should be exclusive of VAT, if any, which shall be paid by theMinistry as applicable.

22. Payment shall be made to the contractor electronically based on the details ofbank account provided.

23. The contract awarded shall be terminated if the firm indulges in any unfairactivities, misrepresentation of facts, submission of improper/forged/fakedocuments/toners/cartridges/drums. In such a case the firm will be liable to bebanned and the performance security will be forfeited.
