PRIVACY DISCLOSURE STATEMENT

In accordance with Privacy Principle 1.3 of the Privacy Act, we require you to read and sign this acknowledgement. In order to process a Tenancy application, a tenancy application is required under the National Privacy Principles of Privacy Act to be made aware that an organisation may access a database. In addition, a tenancy application is entitled to know what will happen to their information when it is passed onto an agent. In accordance with the National Privacy Principles the database member discloses that in addition to information being supplied to a database company other organisations may receive information from time to time. Other organisations may include debt collection agencies, insurance companies, government departments and other landlord’s or agents. SPECIAL CONDITIONS

1. The tenant agrees that it has been brought to his/her attention that the payments of rent hereunder must be made in

such a manner as to ensure that the rent at all times is seven (7) clear days in advance and paid to the office of John Gribbin Realty, 319 Ross River Road, Aitkenvale. A Rent Card is available on request, tenant/s are to return card at end of the tenancy, if replacement card required the tenant/s is responsible for $15.00 replacement cost. Office hours are 8.30am to 6pm, Monday to Friday and 8.30 to 12.30pm Saturday. If rental is in arrears a Notice to Remedy Breach followed by a Notice to Leave will be issued. The said tenant agrees to pay for all legal and debt collection costs incurred for recovery at the time of payment.

2. The tenant will pay all rent up until the date of vacating as the security bond must be kept intact until an inspection is

made on the property, after which the appropriate refund shall be made to the tenant on completion of the vacate.

3. The tenant hereby acknowledges that should the tenancy have to be terminated for any reason whatsoever at their

request prior to the agreed term as stated on page 1 hereof, then the tenant is liable to a letting fee equal to one week’s rent plus GST and also held responsible for the rent due until such time as a new tenant has entered into a tenancy agreement for the premises. All necessary advertising to be paid for by the outgoing tenant along with all fee’s applicable in the Break lease Agreement.

4. The tenant hereby agrees to be responsible for the cleaning of the carpets by a carpet cleaner. All window furnishings

(blinds, curtains & venetians) are to be cleaned upon vacating and a receipt is to be handed into the Agent upon vacating. If the property is fully furnished you are required to have all the mattresses, lounges and furnishings in the property professionally cleaned upon vacating. The receipt is to be handed into the Agent upon vacate Where applicable, lawns and Gardens are to be kept in a clean and tidy state at all times, which means regular watering and mowing and edging. This clause also refers to a tenant who breaks a lease (e.g.) responsible for total rent payments, maintaining yard, maintaining a pool if one for chemicals etc. and clean the property if it has been vacant for a while.

5. The tenant/s is to report any repairs to the agent, JGR as soon as possible, however if it is deemed to be tenant error,

misuse or negligence that lead to the repair or call out then the tenant will be liable for reimbursement to the owner for ALL Costs involved. No nails, screws or hooks are to go into walls or ceilings without prior written approval from the landlords agent.

6. If pets are on the property, (this must be allowed by the agent in writing) the tenant is responsible for the cost of

fumigation of the premises and the yard with a warranty of no less than 3 months. Animals are not to be kept inside the premises at any time unless otherwise approved in writing from the landlord. If there is a sprinkler system in the property upon vacate a professional receipt from a professional irrigation/sprinkler company is required to prove the system is all in running condition.

7. The tenant must give fourteen (14) days Notice of Intention to Leave in writing no less than 14 days prior to the

end of the fixed term or in the case of a periodic agreement being the minimum required notice of 14 days. On the day of vacate, keys are to be returned to JGR before 10am. Once the vacate inspection has been carried out the tenant will be given 24 hours to attend to any outstanding issues. Should the tenant not attend to these issues, JGR will then have these issues attended to by a professional contractor and costs will be deducted from the tenants bond. Please Note: rent will be charged until ALL cleaning has been completed. A decision has been published from QCAT “it is reasonable to expect a tenant to be liable for rent until the handover has been completed, the keys returned and their obligations to the property as tenants have been finalised- such as affecting repairs or doing cleaning”

8. No inspections will be carried out on Saturdays and Sundays. If a tenant is ending a fixed or periodic tenancy on a

Saturday, the keys are to be handed into office by 10am. Inspection of the premises will take place on the following business day. Tenants are to abide by Condition 7 (above). If tenant is vacating on a break lease situation and hands in keys on a Saturday, the inspection will be carried out on within 3 business day. Rent will be charged up to when a new tenant has commenced rental payments on a signed tenancy agreement.

9. The said tenant hereby acknowledges that the owner of the property reserves the right to inspect the property with a

representative from JGR upon vacating before an application for a bond refund is lodged, should he deem it necessary.

10. The said tenant hereby agrees to show prospective tenants through the property upon giving notice to vacate to enable

JGR. To secure a tenant for the property on behalf of the Landlord. Arrangements for viewing the property with the tenant will be made to cause the least amount of inconvenience possible.

11. The said tenant hereby agrees that there will be no smoking inside the property.

12. The said tenant acknowledges that he/she/they have received copies of the agreement, special conditions, and

Condition Report, Information statement Form 17(a), Body Corporate bylaws (if applicable) and essential terms and Conditions.

ANNEXURE “A”

1. The tenant acknowledges that NO HOT POTS OR PANS are to be placed on the bench tops in the property. If there is any damage to bench tops the said tenant/s will be responsible for the cost of replacement or repair of the bench top.

2. The pool is a tenant’s responsibility and must be kept clean. The cost of all pool chemicals and cleaning agents are a tenant’s responsibility. When a tenant vacates, a professional pool company must chemically balance the pool and check all the equipment is working. The receipt for the pool hand over is to be handed in upon vacating. NOTE: tenants are responsible to ensure water levels are maintained at all times. Failure to do so will result in tenants being responsible for all costs involved associated with any damage caused by low water levels.

3. The tenants acknowledge that it is their responsibility to take out contents insurance on their personal possessions.

4. Wooden Flooring: The tenant must take all steps to reduce risk of furniture scratching wooden floors by placing protective coverings and or protective caps suitable for furniture footings under ALL furniture items. The tenants and invited guests will also take steps to wear appropriate shoes while walking and or moving on wooden floors. All damage done to the polished floors by tenants during the tenancy must be repaired by the tenants upon vacating at the tenants own expense.

5. Garages and carports are to be used to park cars and motorbikes in, not for the storage of goods or to be used as spare rooms. All vehicles kept on the premises must be registered. Tenants are NOT to PARK vehicles on the grassed areas at the property under any circumstances.

6. Only persons on the lease or as approved persons are to occupy the property. 7. The tenant acknowledges that under legislation each smoke alarm needs to be cleaned and tested at least

once every 12 months. The tenant is not permitted to remove the battery unless it is being replaced with a new one.

8. The tenant acknowledges that all keys signed for at the commencement of the tenancy will be returned, along with any copies the tenant has cut throughout the tenancy. If all original keys that were signed for are not returned upon vacate the locks will be changed at the tenants expense to protect the next tenancy. The tenant agrees that in the event that they (or person/s authorised by tenants to have keys) should lock themselves out of the property after office hours, that they will engage a Locksmith to gain entry at their own costs. Should the office spare keys be needed and supplied during office hours a return deposit of $50 will apply.

Cook Top and Appliances:

The tenant is responsible for the day to day cleaning and care of ALL appliances within the property, using recommended cleaning products only.

All spillage and over boils to the cook top are to be cleaned immediately to avoid damage to the appliance.

All lint filters to the dryer are to be cleaned after each use. Air Conditioners, Dishwashers and Insinkerators:

Filters to air conditioners are to be cleaned on a regular basis to avoid any malfunction of the unit in accordance to the manufactures instructions.

All dishes are to be rinsed of food scrapes etc. prior to being loaded into the dishwasher.

Only food scraps are to be placed in the Insinkerators and at no time are there to be metal objects or any other material other than soft food scraps placed in the device .NO BONES. Water must be freely running into the device during operations as per manufacturer’s instructions.

POOL CARE (if Pool applies)

(Further to Annexure “A”)

The Landlord / Tenant is responsible for a Monthly Service. (Cross which does not apply) The Tenant/s acknowledges that in between each visit they are responsible to attend to the pool in the following manner.

Your pool has been issued a pool safety certificate. It is the tenant’s responsibility to ensure that all climbable objects are kept well away from the pool fence. This includes BBQ’s, chairs, tables or anything that a child could use to climb over the fence or use to get access to the gate latch. Please also ensure that the gate(s) are also able to swing freely and always self close and self latch. DO NOT prop the gate open for any reason at any time.

Fill the pool regularly with a garden hose. Water level must reach to almost the top of the skimmer box. (Where the vacuum attaches.)

Empty skimmer basket and pump basket of debris weekly or when full.

Should the automatic pool cleaner ceases to operate, disconnect it at the skimmer box and check that there is suction at this point. If there is suction leave the cleaner out of the pool and contact your regular pool company to ensure that they check the cleaner on there next visit.

Clean debris from the pool regularly. Following these few simple steps will ensure continued water flow to the pool equipment, thereby avoiding damage to the motor. PLEASE NOTE: Tenants will be charged a call out fee by the pool company if the water is not at the correct level when the technician attends

TERMS AND CONDITIONS

The Tenant/s acknowledges and agrees to the following terms:

1. The Lessor has agreed to permit pet/s at the premises as specified in the General

Tenancy Agreement and this Pet Agreement.

2. Any pet other than the approved pet/s specified in the General Tenancy Agreement

and this Pet Agreement must first be requested by Tenant/s in writing giving full details

and then be approved in writing by the Lessor PRIOR to the pet/s being allowed onto

the premises. Pet approval may be subject to specific criteria and must be complied

with. Approval is NOT guaranteed.

3. The Tenant shall be liable for any damage or injury whatsoever caused by the pets on

the Property, whether they are the pet of a Tenant or guest, Tenant’s pets or their

guests pets and regardless of their approval status.

4. The Tenant accepts full responsibility and indemnifies the Lessor for any claims by or

injuries to third parties or their Property caused by, or as result of actions by their pet/s

or their guests pet/s, and regardless of their approval status.

5. The Tenant agrees to arrange for Flea Fumigation at the end of the tenancy or at a

time during the tenancy as required or requested by the Lessor / Lessor’s Agent to be

carried out by a Company complying with Australian Standards.

6. The pet/s are to be outside at all times, unless specified otherwise in the General

Tenancy Agreement or this Pet Agreement.

7. By signing below you are only asking for approval of the above-mentioned pet/s to be

accepted at the property for which you are applying.

8. If approved, you are required to, at the time of signing the Tenancy Agreement and

associated paperwork, sign the Tenant Agreement section.
