THE CORPORATION OF THE DISTRICT OF NORTH VANCOUVER

TEMPORARY USE PERMIT 108.17 This Temporary Use Permit 108.17 is hereby issued to allow a presentation centre building and sales centre use on the parcel located at 1990 Belle Isle Place, legally described as Amended LOT 45

(Explanatory Plan 4259) Block 16 District Lot 764 Plan 8967 subject to the following terms and conditions: A. The following requirements are hereby imposed under Section 497 of the Local Government Act:

1. This Temporary Use Permit is valid for a period no longer than 3 years from the date of

issuance.

2. Subject to compliance with District of North Vancouver bylaws, and prior to the expiry of the initial 3 year term, the applicant may request an extension to the permit. Records of complaints or bylaw infractions will be reviewed when considering any request for extension.

B. The following conditions are hereby imposed under Subsection 493 (2) (b) of the Local

Government Act:

1. The temporary use is permitted in accordance with the drawings dated June 7, 2018 and attached as TUP108.17 (A - H).

2. All signage proposed must comply with the District of North Vancouver Sign Bylaw.

3. The temporary use is permitted between the hours of 12pm and 6pm Monday to Thursday and between the hours of 12pm and 6pm on Saturday and Sunday.

4. The temporary use must not unreasonably interfere with orderly and efficient development of

the neighbourhood.

5. The temporary use is subject to conditions identified in Section 414 Good Neighbour Requirements for Employment Zones in the Zoning Bylaw, including:

a) No continuous sound generated on a parcel may exceed a sound level of 60 during the day

and 55 at night. “Continuous sound”, “day”, “night” and “sound level” are defined in Noise Regulation Bylaw No. 7188.

b) Man-made light occurring on a parcel shall not exceed 20 lux maximum (2.0 foot candles)

when measured vertically at 1.5 metres in height along the parcel property line, with readings taken with the light meter aimed directly at the light source. Where the lighting is

a legislated requirement, such as emergency exit lighting, the lighting will be exempt from this regulation.

6. The temporary use will operate at an intensity of use suitable to the surrounding area and will

be compatible with regard to design and operation with other uses in the vicinity; C. The following conditions are hereby imposed under Section 495 of the Local Government Act:

1. The site shall be cleared and left vacant within 30 days of the expiration of this permit.

D. The following conditions are hereby imposed under Section 496 of the Local Government Act:

1. A security deposit of $10,000 is required to ensure compliance with the conditions of this

permit and removal of the presentation centre, equipment and materials from the site at the end of the site’s use, or at expiration of this permit, whichever comes first.

Why?The parcel is zoned RS3 (Single Family

Residential 7,200 Zone) and the proposed

presentation centre is not a permitted use

under the existing zoning. A Temporary Use

Permit is required to permit the proposed

use. Under the Temporary Use Permit the

proposed use may remain for up to 3 years

with the possibility of one 3 year renewal,

for a total possible of 6 years.

When?Council has delegated the issuance of Temporary Use Permits to the General Manager – Planning,

Properties and Permits. The General Manager will consider the issuance of the permit on Friday,

August 24, 2018.
