CONDITIONS OP SALE.

1. The highest Bidder to be the Buyer, and if any dispute

arise between two or more Bidders, the Lot so in dispute shall

be ijnmediately put up again and resold.

2. The Purchasers to give their names and addresses, andto pay dowjt twenty-five per ce7it, on the dollar in part pay-

ment, or the whole of the Purchase-money, if required, in de-

fault of which the Lot or Lots so purchased to be ifmnediately

put up again and re-sold.

3. The Lots to be taken away at the Buyer s Expoise andRisk within three days from the conclusion of the Sale, andthe remainder of the Purchase-money to be absolutely paid,

or otherwise settled for to the satisfaction of the Vendors,

on or before delivery : in defaidt of which Messrs. Geo. A.

Leavitt & Co. will not hold the7nselves respo?isible, if the

Lots be lost, stolen, damaged, or destroyed, but they will be

left at the sole risk of the Purchaser.

4. The Sale of a?iy Painting, Efjgraving., Print, Furni-

ture, Works of Art, or any other article, is not to be set

aside on accoimt of a?iy error in the description. All articles

are exposed for Public Exhibitioji one or more days, and are

sold just as they are without recourse,

5. To preve7it i7iaccuracy i?i delivery and inco?iveftie?ice in

the settlement of the Purchases, no Lot can, on any account

be removed during the Sale.

6. upon failure of complying with the above co?tditions, the

money deposited in part payme7it shall be forfeited; all Lots

uncleared withi7i the tijne aforesaid shall be re-sold by public

or private Sale, without further 7iotice, a7id the dcficie7icy (if

THE S. P. AVERY COLLECTION.

3.1essrs. Geo. A. Leavitt & Co. announce that they will

sell on account of Mr. S. P. Avery, of 86 Fifth Avenue, a

very choice collection of oil paintings by Foreign Artists,

being part of his collection and others consigned to him.

They have never been offered outside of his rooms, and were

painted mostly to his order, many of them being recently im-

ported.

Excellent Masters are represented of known fame as well as

younger and rising geniuses. The subjects are varied and

agreeable, and sizes suitable for general collections.

Mr. Avery's name is a sufficient guarantee that this col-

lection is worthy of e\er}- attention. { " good wine needs no

bush,") and like all the sales made under his control will be

absolute.

"The painting, by P. C. Comte, represents Anne d'Est,

Countess of Gisors, Lady of Montarg'is, daughter of Hercule

d'Est and Renee of France, and widow of the great captain,

Francis of Lorraine, Duke de Guise, swearing her son, the

youthful Henri de Lorraine, Duke de Guise, afterward known as

' Le Balafre,' from a face wound received at Dormans, on his

father's sword, and before a tapestry painting representing the

assassination of the Duke, to vengeance against the Admiral de

Coligny, who, she was convinced, instigated Poltrot de Mere to

the deed. The widow nourished her hate, and implanted it in

her boy by making him take this oath each morning. For this

purpose a sort of memorial altar was erected to the memory of

the late Duke. Above a table, on a black velvet cushion, on

which lay the ducal crown and the Duke's sword, was hung in a

gilt frame, on top of which was the family coat of arms draped

with crape, the rich memorial tapestry. At either side were the

finely-chased suit of armor of the dead man and his green tunic,

stained with blood at the spot where he was shot.

" The young, slender, and light-haired boy, dressed in white,

stands nobly with his hand on the sword, wdiile his mother, in

black, seated behind him, leans forward, with her face next to

his, and her chin on his shoulder, one arm half around him, and

with the other hand holding his disengaged arm. On the refined

and handsome face of the young Duke some signs are already

seen of the effect on his character of the desire for vengeance

which he already feels, and which his mother, by this daily re-

minder of the death scene he had witnessed, keeps fresh and

growing in his young heart. Her tearful, handsome, and deter-

mined face, full in color, forms a good contrast to the lighter flesh

tints of her son. The picture is very admirably painted, in a

serious, careful style, good in drawing, careful as to costume and

historical detail, and pure and real in color."
