Each tender should be posted separately. Tender

received late will not be accepted. Any alterations, modifications to bids received after opening of tender shall not be considered unless called for by the GSECL in negotiations.

(2) Tenderers should quote the reference of payment of EMD i.e. DD. No. & Date or Bank guarantee issued by following banks will only be accepted.

(a) All Public sector Banks (All Nationalized banks) (b) Private Banks, which are IDBI Bank, AXIS Bank, HDFC Bank, ICICI Bank, The Kalupur Co-

operative commercial Bank. The bank guarantee of any other Co-Operative Banks and other Scheduled Banks etc. will

not be accepted. (3) Tenderers should submit latest Bank Solvency Certificate for 20% value, of the estimated

cost of any Nationalized Bank. (4) The tender without payment of Tender Fee & EMD will not be opened or considered. (5) Tenderers shall note that they possess separate P.F. Code No. in their name (under

Employee provident fund organization, Regional office, Ahmedabad directive) obtained from the concerned authorities of their respective jurisdictions.

(6) Tenderers shall also certify that quoted tender is ‘UNCONDITIONAL’ on tender covers itself. (7) The tender’s documents are of two bid systems. [A] The technical bid, which is to be

submitted in separate sealed envelope mentioning ‘TECHNICAL BID’ on envelope with details given special note for pre qualification with mentioning of E.M.D. & Tender fee payment. [B] The commercial [price] bid, which is to be submitted with the rest page of tenders including Schedule-B in separate sealed envelope mentioning ‘COMMERCIAL BID’. Both the bids should be submitted in another separate sealed cover on due date of submission with Tender Notice number, Sr. No. & name of work superscripted thereon and with note ‘TENDER- DO NOT OPEN’ written prominently.

(8) No work order will be issued to party not possesses own Service Tax number. (9) Subletting of tender is not permitted.

CIRCULAR – I The following are the major obligations to be filled by the Contractors as per the Contract Labour (R&A) Act 1970 and rule mentioned there under:

1. License to be obtained before starting the work where number of contract labourers in ten or more.

2. Payment to contract labourers has to be made in presence of IRO/LWO. Wages rates for

contract labourers are applicable as per the terms and a condition of the license Minimum rate of the wages for unskilled labour, semiskilled labour and for skilled labour notified from time to time by the competent authority under the said Act.

3. Contractor shall have to maintain the muster roll and wages register in respect of his contract

labour. 4. Contractor is required to issue employment card, wages slip and attendance card to their

labourers. 5. The Contractor has to maintain the register No.13 containing details of contract labour

employed by him. 6. Earned Leave register/card as per the Factories Act. And Rules. 7. Other registers required under contract labour Rules and the Factories Act and Rules. 8. Contractor shall have to obtain insurance policy in respect of the contract labour engaged by

him to cover them under Workmen’s Compensation Act. 9. To send half-yearly return to licensing officer as per Rule 82 (1) as per scheduled time. 10. Before starting the work as per the contract awarded to him, he should make arrangement to

enter into the agreement in the prescribed format on the stamp paper as applicable before fulfilling the above requirement the contractor is instructed not to start the work. The responsibility will be on his head in case he fails.

The Contractor are informed to adhere to the rules and regulations applicable to them, particularly in respect of the labourers engaged by them, the contractor not fulfilling the obligations will not be allowed or continue with work/not be held qualified to carry out the work at Wanakbori TPS.

GENERAL CONDITION OF CONTRACT

SUB: - Work of As & When Required Maintenance / Repairing Work of Air Compressor, K.G.Khosla make 2HA2QT & “MELLCON” make Air Dryer Units of Unit-7.

WAGES TO BE PAID & TIME OF PAYMENT ETC. BY THE CONT RACTOR: (a) The contractors shall pay minimum rates fixed under the minimum wages act. The wages of

every contract labour employed by him under this contract shall be paid by him before the expiry of 7th day of the last day of the month in respect of which the wages are payable (i.e. wages of a month have to the paid by him in the first week of the next month). The payment shall be disbursed in the presence of management representative during the working hours in factory premises and the contractor shall get the entries certified in the register of wages by the representatives of the company. Any default will result in cancellation of contract forthwith or also the contract shall be punishable to the extent of Rs. 100/- fine per each day.

(b) The contractor shall be give his telephone number and address to the Board so that in case of labour trouble etc. the contractor can be contacted. The contractor shall arrange to have his office outside the factory premises and the contractor shall keep himself present through out the work hours.

1. LABOURS LAWS: (a) Person below the age of 18 years shall not be employed for the work. (b) No female worker shall be employed in the night shift between 07-00 PM to 06-00 AM. (c) Contractor shall maintain a valid labour license under the contractor labour (Regulation and

Abolition) Act for the employing necessary manpower to be required by him in the absence of such license the contractor shall be liable to terminated without assign any reasons thereof.

(d) The contractor shall at his own expense comply with all labour laws and keep the Board indemnified in respect thereof. Some of the major liabilities under various labour and industrial laws which the contractor shall comply with are as under:

1. Payment of contributing of way of Employer's contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administrative charges etc. at the rates made applicable from time to time by Government of Gujarat/ Government of India or other Statutory Authorities.

2. Payment of deposit in respect of each contract labour at rate of Rs. 30/- with the office of Commissioner of Labour as per contract labour (Regulation and Abolition) Act.

3. License as prescribed under the contract labour (Regulation and Abolition) Act and rules framed there under depending upon the number of workman employed by the contractor License is compulsory it ten or more labours engaged due date.

4. Identity cards as prescribed under the factories act. With photo affixed there to the same for identification.

5. Payment of retrenchment compensation, notice pay and other liabilities as per Industrial Disputes Act. Any payment to the contractor's employees arising out of any claim or disputes under the industrial Disputes Act. 1947 or any other labour laws.

6. Payment of compensation in case of accidental injury. 7. Provision of crèches if female labour employed is more than 30 numbers. 8. Maternity leave as per the provision of the Maternity Benefit Act.

2. PROVIDENT FUND AND FAMILY PENSION SCHEME:

The contractor shall submit along with his bill (month wise) a statement regarding deductions against employees provident fund and family pension scheme in respect of each concerned

C- employees. Provident fund and family pension scheme at the rate of 8.33% (or at the rate made applicable by the Government from time to time) of Wages. The contractor's contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional Provident Fund commissioner, Ahmedabad.

3. DEPOSIT LINKED INSURANCE SCHEME: The contractor shall have to deposit % of the wages in respect of employees who is a member of the provident fund as the contribution to the Deposit linked insurance scheme with Regional Provident Fund Commissioner, Ahmedabad.

4. ADMINISTRATIVE CHARGES: Administrative charges for maintaining Provident fund account shall be deposited by the contractor with Regional Provident Fund Commissioner, Ahmedabad at the rates applicable.

5. PAID LEAVE FACILITY: Paid leave facility at the rate of one day for every 29 days worked by the contractor labour shall be provided by the contractor to his workers. He shall maintain leave records/leave cards for individual labourers which shall be duly verified and approved certified by the authorized officer of the Board.

6. WORKMEN'S COMPENSATION FUND AND EMPLOYERS LIABILITY INSURANCE: The contractor shall cover all his employees under workmen's compensation fund and under the liability Insurance.

7. The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract no payment for supervision shall be admissible.

8. CONTRACTOR TO INDEMINITY THE BOARD: The contractor shall indemnity and keep indemnified the Board and every member, officer and employees of the G.S.E.C.L. also Engineer in charge and his staff against action proceeding claims, demands, costs and expenses whatsoever arising, out of or in connection with the maters referred in above clauses and elsewhere and against all actions claims, demands, cost and expenses which may be made against the G.S.E.C.L. by any workmen / employees of the contractor or any sub contractor and/ or contractor from any liability any wise any workman employees of the contractor or sub contractor under any laws rules or regulation having the force of low including but not limited to claims against the owner workmen compensation Act 1923. The employees Provident Fund 1952, and or/ the Contract labour (Abolition and Regulation) Act. 1970 the G.S.E.C.L. shall not be liable for in respect of or in consequence of any accident or injury to workman of other person in the employment of the contractor or his sub contractor and the contractor shall identify workman in the G.S.E.C.L. against all such damage and compensation and against all claims, demands, proceeding costs charge and expenses what so ever in respect thereof or in relation there to.

9. WORKMAN'S COMPENSATION & EMPLOYER'S LIABILITY INSUR ANCE: Insurance shall be affected for all the contractor's employees engaged in the performance of these contractors. If any of the work is subjected, the contractor shall require the sub contractor to provide workman's compensation and Employers Liability Insurance for the letter's employees are covered under this scheme.

10. The Company reserves the right to terminate this rate contract at any time during contract period without giving notice of termination of any reasons thereof.

11. The Company will be entitled to deduct directly from the bills, to be paid to the contractor any sum of sums payable by the contractor and which sum/sums the GSECL is required to pay as a principal employer on account of Contractor default in respect of all liabilities referred to in above clauses.

12. Nothing in the contract document stated shall anywise constitutes any workman/ employees of the contractor or any sub contractor as or to be workman employees of the owner or place obligationary liability in respect of any such workman/ employee upon the GSECL.

13. Office Correspondence will be carried out in English and if at any time to facilitate the contractor, Gujarati Translation may be furnished if deemed fit the English version will be the contract one the same only will held good for legal matter.

14. Contractor will be responsible and liable to pay difference in wages if any and or observe the revised service conditions that may be awarded by the honorable Industrial Tribunal effective from the dated directed in the award.

15. Rate quoted are firm and hence no price escalation or labour escalation will be applicable towards execution of work.

16. In case of delay in execution of work the penalty as Cl. No. 3 of Tender and contract for work will be applicable.

17. Party shall have to provide at their own the required personal protective equipments of standard make (ISI approved) to their staff during work execution and it will be your responsibility to see that the same are by your staff while at work.

18. The contractor shall deposit 15 days salary at the rate of last drawn salary for every completed one year services for each worker for liabilities of gratuity. -----------------------------------------------------x--------------------------------

GENERAL CONDITIONS OF CONTRACT

SUB: - Work of As & When Required Maintenance / Repairing Work of Air Compressor, K.G.Khosla make 2HA2QT & “MELLCON” make Air Dryer Units of Unit-7 SECTION:

1. The contractor shall at their own expense make all necessary provision for housing water supply and sanitary arrangement for their employee as well as for works and shall pay direct to the authorities concerned all rates and taxes. T

2. he contractor shall make their own arrangements for the necessary approach road, for transport of their materials and be responsible for the Compensation on account of damage to crop on Corporation's property.

3. All the royalty charges Octroi other duties will be paid by the contractor and no extra could be claimed on this account.

4. The organization will supply articles at the place and rates mentioned in schedule `A' of Tender

form. In case of the materials issued either through or with the recommendation of this organization it will be absolutely necessary for the contractor to maintain a correct and honest record of the daily consumption of the said materials/with inside particular reference to the work during the day. The Engineer-in-charge of this department or his authorized agent shall have the right to inspect and check the stores containing these materials and the account for these materials shall be presented for inspection whenever asked for by them. Every facility shall be afforded by the contractors for all these inspections Engineer-in-charge will supply the materials in any quantity as deemed fit.

5. Godown of sheds hired or constructed for storage of controlled materials and more/ particularly of cement shall be such as would prevent the materials from getting damages in any way.

6. It will be absolutely incumbent o the contractors to have on the site of work only such of the

materials as have been dully passed by the Engineer-in-charge Materials that have been rejected must on no account be allowed to remain on the side and in spite of written order to do so any such rejected material is on the site beyond a period of 48 hours, notice the Engineer-in-charge shall have the right to remove it at the risk and cost of the contractor and even destroy it.

7. It must be distinctly understood that the conditions of the contract and of claims in respect of extra

work will not be allowed, unless the works to which they relate is clearly without the spirit and meaning of the specifications or unless such work are ordered in writing by the Engineer-in-charge and claimed for in specified manner.

8. On completion of the work, the site shall be cleared by the contractors within the stipulated period, and ground brought to original state and they shall not be entitled for any extra claim on this account.

9. General specification of the latest edition of the P.W.D. Hand Book volume I & II shall also apply. 10. When cement is obtained through or with the recommendation or issued by the Corporation it

should be understood that the contractors will have to be very careful regarding the handling of the cement bag so as to preserve their serviceability and quality.

11. DAMAGE CAUSES TO WORKS : The work whether fully constructed or not, and all materials, machinery plant tools, temporary building and other things connected there shall be at the risk and in the sole charge of the contractor until the works have been delivered, completed to the Engineer- in-charge and certificate from him to that effect obtained until such delivery the contractor shall at their own cost take all the precautions reasonably necessary to keep all the aforesaid works materials machinery, plant, tools, temporary building and other things connected with the work, free from any loss or damage and in the event to the same or any part there of being lost or damage shall from with within possible speed, reinstate and make good such loss or damage at contractor's own cost.

12. Supply of controlled articles will be invariably recommended after the actual requirements have

been carefully scrutinized. In the event of any such materials remaining in surplus in charge of the contract, on account of some modifications either in the design or changes in construction or any other reason will be returned to the department.

13. There will be generally no objection on the component parts of the works being given over to

responsible sub contractors but it must be borne in mind that this department would under no circumstances recognize these sub contractors and responsibility of executing the work in accordance with the condition of the contract will entirely rest on the main contractors. The main contractors will therefore always have the very responsible member preferably a technical hand, present on the works with power to sign all work order issued on the site of work and to take requisite actions in the interest of very efficient execution of works.

14. With a view to ensure rapid progress on the works purchaser may store at work sites certain

quantities of the materials such as cement etc. and it will be incumbent on the tender to purchase these materials, at the rates mentioned in schedule `A' of tender form for supply of necessary articles, all necessary help will be tendered but in must be clearly understood that the purchases does not accepted and responsibility for the delay that may be cause in their supply on account of circumstances beyond the purchaser's control.

15. The Engineer-in-charge will fix the hours of work and no work shall be executed beyond that period during night time or in absence of the Engineer-in-charge or his authorized agent. The box measures shall be filled only in the presence of the Engineer-in-charge or his authorized agent.

16. Contractor will be asked to present the sample of materials and the approved sampled will be preserved at the site of work and no change in the approved sample will be allowed without the written permission of the Engineer-in-charge.

17. If any work is not executed according to the specifications and the directions of the Engineer-in-charge the same will be rejected or reduced rate will be allowed as deemed fit by the Engineer-in-charge.

18. Contract will have to communicate the name of his authorized agent who shall be presentation

the works and shall be authorized to sign the materials requisitions receive instruction given verbally, or on the order book on behalf of the contractor.

19. The materials issued to the contractor as per schedule `A' of the tender shall not be removed

from the work and all surplus material at the end of the works which is considered serviceable shall be returned to the organization even the unserviceable material shall be removed only with the prior permission to the E.E. in writing.

20. The contractor will have to sign the conditions of the contract and execute the agreement, send the list of previous works executed solvency certificates and pay up the security deposits, failing

C- to that the tender will be rejected and earnest money deposit will be forfeited. The value of the stamp paper and stamp duty charges shall be borne by the contactor.

21. The contractor must arrange for all transport of materials weighting of material issued at

department stores and all such cost include in the rates of schedule `B' with the loss or above percentage quoted by the contractor for finished work.

22. The competent authorities can delete to any items in the schedule `B' of the tender order if they

fill that the items is not essential to be executed. 23. A schedule of quantities is included in the tender document it shall definitely understood that the

Corporation does not accept any responsibility for the correctness or complication of this schedules and this schedule is liable to alterations by commissions, deduction or additions at the description of the Chief Engineer of as set forth in conditions of contract specific percentage less or above shall be quoted by the contractor below the total amount of schedule `B'. The tender documents shall be written legibly and free from grouser, over written on conversion of figures correction where unavoidable shall be made by crossing out initialing dating and rewriting both in figures and in words in case of my discrepancy in figures the price quoted in words shall prevail.

24. This notice to tenders shall form a part of the contract.

25. The entire work is to be completed within the stipulated time limit from the date of work order. The

contractor will not be eligible for any extra for the idle period of work or waiting period that may be required to suit other considerations and no claim for compensation on account of such will be considered. However in case or delay due to circumstances beyond the control contractor either in date of commencement or due to waiting during construction extension time may be considered for completion of work.

26. In case contractor is unable to account for full quantity of materials issued to him from the department stores, recovery will be effected from him at cost rates or market rates prevailing at the time of issue whichever is higher, plus 15% to cover Corporation's departmental supervision charges for all material unaccounted for.

27. Scrap from reinforcement (bars below 1.25 M lengths) not be accepted back and the contractor will be authorized to remove it from the site after completion of works and rendering of accounts with written permission of Engineer in charge not below the rank of Executive Engineer. The corporation will not be responsible for any delay in supply of controlled materials such as M.S. Reinforcement Bars cement etc. however it will hand over to see that there in no delay of materials. Due consideration will be given in granting extension of time for completion of the work if found necessary on account of delay supply of materials. No claim for compensation or for damages for extension in time shall be entertained in this account. All materials inquired by the contractor shall be drawn from the stores by requisition given in writing by the contractor at least one week before the requirement of work. The recoveries will be affected in running payment for all material issued up to the date of measurements for the particular bill or the quantities used in the works measured at the description of the Executive Engineer in charge of work.

28. The contractor shall keep one full time qualified Civil engineer at site who shall be fully authorized to receive and comply with such instructions as given by the Executive Engineer. The names of such Engineer with his qualification and experience shall be intimated by the contractor. The E.E. shall have the right to demand the removal of any technical person. Skilled or unskilled work men

C- who in his opinion are considered to cause bad workmanship in the execution of work or to cause indiscipline.

29. Bill shall be submitted by the contractor monthly on or before the date fixed by the E.E. for all

works executed in the previous months. 30. SUPPLY OF WATER AND ELECTRICITY: If possible water for construction purpose only may be

supplied by the Corporation at one point as decided by the Engineer & recovery for water charges shall be effected at two percent of cost of time as executed in which the water supplied by the Corporation is used as certified by the Engineer in charge Electric supply is required the contractor shall be given Free of cost by GSECL.

31. Should this tender be accepted I/We have agreed to abide by and full fill all the terms and

provision of `Tender and Contract of works' as applicable and in default there to forfeit and pay to the Corporation the some of money due.

32. The work will have to be carried out in co ordination with other Agencies on the same site on

account of this in case the contractor has to stop or delay his works for same time he will not claim anything extra only Corporation may consider to give suitable extension in time limit if necessary on such account.

33. Any disputes arising out of the contract if not settled mutually, than the same shall be settle by

Gujarat Public Work Arbitration Tribunal act-1992. ---------------------------------------------------x--------------------------------------------

SCOPE OF WORK (A) Maintenance of Air Compressors: 1. Dismantling of 1st or IInd stage suction / discharge valve, overhauling and

reassembly & fitting in position after testing by Kerosene for passing. 2. Replacing work of both side piston, gaskets and oil catcher ring & pickings. 3. Cleaning of oil filter as & when requires. 4. Cleaning of inter cooler/after cooler/oil cooler tubes as & when requires and checking

of tube leakage by hydro test & plugging of the leaky tube/tubes. 5. Opening of both side cylinder end cover for dismantling of piston, checking of sealing

ring/bearing ring/piston rings clearances, replacing of piston ring, bearing rings & sealing rings if requires. Reassembling of piston, locking the piston nut with weld tagged & fitting in position. Setting of the end clearance on both end of piston.

6. For leaky tube in inter cooler, after cooler, dismantled the cooler with outer shell from position, take hydro test & plug i.e. leakage tube on both side, again refitting in position. If the quantity of plugged tubes per cooler is more than 25% of total Nos. of tubes than the cooler /tube bundle is to be replaced.

7. Tightening of belts of compressors as & when requires, for replacement of belts, party has to collect material from store.

8. For overhauling of crank case assembly, which consists of 2 nos. connecting rod, 1 no. crank shaft, 3 nos. crank shaft bearings and 2 nos. x 2 connecting rod bearings, cross head & its guide, for checking diameter of bearings & clearances, fly wheel has to be removed & refitted. Checking of cross head clearances, flushing of oil lines inside the case, checking of oil pump & servicing the gear replacing & setting the oil pressure, cleaning of crank case & fitting of the oil pump.

9. Cleaning of compressor suction filter by dismantling from position air cleaning & refitting in position.

10. 1st & 2nd stage cylinder water jackets, cleaning from inside the cylinder. 11. Compressor’s air side suction, discharge valves & connected water side valves

repairing / replacing work. 12. Over hauling /gland filling of compressor & air driyer water side isolating Valves. 13. Repairing / replacement of compressor NRV’s. (B) Air dryer & Receiver Tank Maintenance:

1. Overhauling of 4-Way valve, traps, Safety valves & other miscellaneous valves by dismantling of valves, replacement of spares if required and refit in position without any defects.

2. Heat exchangers, coolers are required tube cleaning by wire brush and water jetting, replacement of leakage joint and attending tube puncture if found during hydro test.

3. Cleaning of pre filter and after filter by compressed air, replacement of filter if any. Over hauling/repairing of various valves associated with dryers system.

4. Inside cleaning of receiver tanks including overhauling /gland filling of inlet /outlet, & drain valves.

WORK TERMS & CONDITION: 1. The scope of work as above is for guide line only. Actual work is to be carried out as

per general engineering practice adopted for similar work. 2. Necessary skilled man power , T &P , O & M service Engineer required for execution

of work under the scope of this contract are to be arrange by contractor which is covered under quoted rates.

3. Required spares will be provided by GSECL free of cost. However contractor must provide list of probable spares immediately after issue of written order by GSECL and studying problems of compressors in consultation with GSECL engineer.

4. All the electrical and instrumentation work shall be in GSECL scope. 5. To and Fro transport and conveyance charges shall be borne by the party. 6. Services to be rendered from time to time and as and when required basis. 7. Following facilities will be provided by GSECL free of cost. a. Air, water and electrical supply and consumption for this work at one point. b. Open space for storing the spares. c. Special T & P supplied by manufacturer. d. Necessary lubricants and spares. e. Steel material (MS angles, Plates, Rods etc), (as applicable) f. Spares & paints g. Welding m/c & cutting gases for the job. h. EOT crane/ W/S facility. 8. Following items will be the responsibility of t he contractor : No additional payment over and above the quoted rates will be made to contractor on

the account of these items.

b. All normal T & P like spanners screw drivers, pliers, hammers etc . c. Welding cable , Welding accessories, General purpose welding rod, cutting hoses

etc., including loss of spares will be recovered from party. 10. Work is to be carried out by contractor as per instruction of Engineer-in- charge. 11. Contractor will have to collect spares / material from main store / TMD.III for above

work. 12. Contractor has to work as per the general terms & condition of booklet of GSECL &

has to obey all rules & regulations of SAFETY. 13. In case of any dispute, C.E.(C&O) decision will be final & shall be binding to

contractor.. 14. All the work as listed in schedule-B are to be carried out on as & when required

bases. The work as above is to be taken up with in 04 hrs. of telephonic information. 15. PERFORMANCE GAURANTEE PERIOD : Work carried out against this contract

must be guaranteed for the period of 04 months for poor workmanship from the date of returning of the equipment after work completion. Any defect observed in work carried out by contractor during performance guarantee period and if defect is attributable to workmanship of contractor, same is to be attended free of cost by contractor.

16. PERFORMANCE GUARANTEE : 10% of the order amount of work carried out shall

be retained by corporation till completion of performance guarantee period of 04 months.

17.Quantity shown in work order is approximate and is liable to change .Payment will be made accordingly to actual quantity of work executed.

18. VALIDITY OF CONTRACT : Validity of order will be 11 months from the date of order. However corporation can extend the validity of order for a further period of 03 months at the same rate, terms & conditions. Contractor has to carry out work during contract validity period on as & when required basis.

GENERAL TERMS & CONDITION : 1. The condition mentioned in the Book of tender & Contract for work will be binding to

the party & in case of dispute the decision of chief engineer will be final. 2. Successful bidder shall have to pay security deposit as per GSECL rules. 3. Party shall have to execute agreement worth Rs. 50.00 to sign the contract booklet of

works cost of stamp papers should borne by party. Any correspondence against this work will be part of the job.

4. Party shall have to execute indemnity bond of Rs. 100.00. 5. If the work of party will not found satisfactory and not as per the terms & conditions of

contract, GSCEL reserve the right to cancel the contract and contract will be executed at party’s risk & cost.

6. Party shall have to submit material account or otherwise GSECL will prepare material account as per GSECL own record. Based on material account, GSECL will recover the cost of spares issued free of cost and remains unutilized in the custody of contractor.

7. Party shall have to appoint supervisor along with team to supervise the work and to carry out the instruction given by the GSECL.

C- 8. Party shall have to co operated in measurement, otherwise GSECL will measure the

work done by party and payment will be made accordingly. 9. Income tax shall be recovered as per prevailing rates and necessary certificates will

be given by GSECL. 10. Party shall have to produce Solvency certificate, Labor License, Income tax clearance

certificate, PAN card no, PF Code etc. for bid qualification. 11.If any defect found unsolved , same will be carried out by contractor. No extra

payment will be made for re-work. 12. Party has to submit in past five years executed work order copy of same work,

otherwise offer will be ignored

13.EARNEST MONEY DEPOSIT: The Bidders are required to submit Earnest money deposit 1% of the estimated value of this tender. Earnest money deposit should be paid either in cash or by DD drawn in favor of GSECL, WTPS payable at Dena Bank, Wanakbori and receipt no. and date of the same must be written on envelope of tender documents. Any cash kept with the tender documents will not be accepted. In case DD is sent along with offer, it should be kept in separate sealed cover indicating DD no. and amount on envelope. Sealed offer should be in separate cover and this cover should be sent under the final envelope indicating no. and DD details.

14.0PENALTY: Any delay that may take place in the subjected work beyond contractual cut off date/ stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of ½ % of the contract price / order price per day or part thereof to a maximum of 10% of the total contract value/order value (i.e. End cost including taxes & duties)

15.0 SECURITY DEPOSIT: The firm shall be required to deposit 5% of the order value, It is mandatory to submit security deposit before order placement,. Party shal have to pay security deposit of 5% of contract value within 15 days from the date of Letter of Intent. Such Security Deposit will be payable either in D.D./ Bank Guarantees. Bank Guarantees from Scheduled / Nationalized Banks will be acceptable if the amount of security deposit payable exceed Rs. 5,000/- The Bank Guarantees will be executed on the standard form prescribed by the corporation. In case of the Bank Guarantees furnished / submitted, they should have clear one time validity till the completion of the order in all respects and up to the expiry of Guarantee period from the date of the work completion. Bank Guarantee for Interim period will not be allowed. If by any reasons the work period is extended then contractor should undertake to renew the Bank Guarantee at least one month before the expiry of the validity failing which GSECL will be at liberty to Ancash the same. If the full Security Deposit amount is not paid immediately after the receipt of the Letter of Intent, then the order will not be placed (at the discretion of GSECL) and without entering into any correspondences and this will be binding on the Tenderer. If the Tenderer fails to pay the Security Deposit or defaults in execution of the orders placed or if GSECL suffers any financial loss due to this, the GSECL will be at liberty to adjust the amount from other orders of the same firm or by encasing the Bank Guarantee. Failure to deposit the SD will entail for failure of EMD and the contract shall be treated as terminated. You shall not be, allowed to start the work if, SD is not paid. Any loss to the GSECK due to late start of work because of late payment of SD shall be contractor’s liability.

C- 16.0 SUBMISSION OF BOND & AGREEMENT: The contractor shall execute an

agreement as well as indemnity bond within 7 days from the date of receipt of order on non judicial stamp paper worth Rs. 100/- and Rs. 100/- respectively. The agreement will have to be executed in prescribed form of GSECL.

“GENERAL SAFETY RULES / NORMS” TO BE OBSERVED BY THE

CONTRACTORS.

All the contractors working at Wanakbori Thermal Power Station shall have to strictly observe the following Safety Rules. Concerned Contractors are responsible for

informing & observance of these rules by their supervisors/employees/labours as well as the supervisors/ employees/ labours of agencies/ sub-Contractors engaged, if any, by them for the work contract awarded to them. Prior to commencement of the

work, Contractor shall have to submit a written assurance on their letterhead to the concerned Sectional Head / Engineer-in-charge that they have thoroughly gone

through these Rules, have educated their employees / employees of their sub contractor and will strictly observe the said Rules while execution of work under work contract awarded to them. They will have to indemnify the Corporation for any loss

or damage / accident / injury to the Corporation’s property / employee or employee

of their own in default of non - observing these rules.

01 Persons to be employed for carrying out the work shall possess required qualification, are fully trained and conversant for works to be done. All persons should have gate pass. Register consisting the full details i.e.

address, ph no, nearest relative,.. of all persons to be maintained. During

the work execution, one trained & competent supervisor should always

remain present at site.

02 The contractor shall take all the required safety measures prior to commencement of work on dangerous substances, machineries or area at

which cautionary notice is displayed and obtain “Line Clear” or “Work Permit” through the concerned Department / Section.

03 Prior to carrying out welding, gas cutting, furnace heating or any other hot work job, remove all the inflammable material lying at or

nearby worksite or cover it properly by suitable protective covering. Also, special care shall be taken before carrying out such job & see that all possible contributing factors to set fire shall be removed / vanished prior to commencement of the work. Advance intimation

shall be given to concern section / fire section to commence the work in fire prone areas. They should also keep ready all the First Aid Fire

Extinguishers / equipments & fire extinguishing media / material like sand / water buckets or other appropriate equipment at such place.

04 While carrying out work in confined space or inside vessel, obtain

necessary “Confined Space / Vessel Entry Permit” from concerned department prior to commencement of the work. For lighting in such areas, only 24-volt (ISI certified & with proper guard) hand lamp shall be used.

For taking care of the persons working inside the confined space /

vessel, a supervisor / person capable to keep continuous watch on

person(s) working inside, assist them incase of emergency or arrange to get immediate outside help, shall remain present at entry point.

Use full body safety belt without failed. While working inside sewage, trench or in-depth, a person to warn

outsiders / entrants / passers etc shall remain available near entry point or the entry point shall be cordoned by a barricaded tape with a cautionary notice. After completion of the works, all the lids / covers / grills / grits opened, shall be re-fixed / re-placed in the original

position as it were prior to commencement of the work and leave the work place in safe condition in all respect, so as to prevent accident to fellow workers.

05 Do not work on or block (by stacking material, spare parts, tools-tackles, equipments etc), any passages / walkways / gangways /

aisles / staircases / ladders / lifts or any other approaches / roads leading to plans or its auxiliaries, on which there is traffic movements

or possible traffic movements in case of emergency. Such passages are meant for safe escape in the event of emergency. If it is utmost

necessary to carry out work in such area with blocking of passage, prior permission of Competent Authority or the Engineer-In-Charge

shall be obtained. To demarcate / declare the area as UNSAFE, cordon it using barricading tape & display suitable caution notice or

keep a person to restrict / divert the traffic on this route through other safe passage.

06 Prior to use power / electrically operated hand tools / equipments / machines / gadgets like welding machine, hand grinder, hand drill etc,

ensure for its safe operation & use it only if it is found safe to use. Do not use defective, unsafe or improperly maintained equipments.

The electrical power supply required to run such equipments shall not be taken directly at their own but shall be obtained through concerned Electrical Maintenance Departments or their authorized persons or under

their observations / guidance only. The Electrical Section shall provide temporary electrical connection up to contractor’s Mains Board on which it is

compulsory to install mains switch, ELCB & fuses of adequate capacity. All such equipments shall invariably be earthed adequately to prevent electrical shock, sparking, short circuit etc. Power cord to be used shall be of

adequate capacity, without any joint & shall consist of earth wire also. Hence, it is necessary to use adequate capacity 3-wire power cord for single

& 5-wire power cord for three phase power connections. The plugs, receptacles, pins, holders etc shall be of adequate capacity & safe to use.

All electrical & mechanical equipments / tools-tackles viz. welding machine, cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks etc

required to be used during work execution shall be of standard make & bear ISI certification mark on it. The consumables like welding electrodes, grinding wheels / discs etc which has specific prescribed life span shall not

be used in any case if its expiry date is over.

07 It is compulsory to use standard make Personal Protective Equipments

(P.P.Es.) as per the job requirement. Do not work without use of required P.P.Es. Contractor is responsible to provide standard make (ISI approved)

Personal Protective Equipments / Safety Gadgets suitable to give sufficient protection against hazards involved in their work / job to their staff, as per the job requirement and insist / enforce their staff to put on the same while

at works. The ongoing work is liable to be stopped at any time if your staff found

working without P.P.Es. Following is the list of various P.P.Es. to be used for various works / worksites.

Before using lifting machines / tackles (like C.P.Bs., Hook chooks, winch, forklift, mobile

crane, EOT crane etc) & its attachments (like D-shackles, slings, U-clamps, Eye bolts or

any fixtures), it shall be checked and used only if found safe to use. Also, ensure that

these are tested, examined & certified in form no 9/10 by Competent Person as per the

C-

Factory act-1948 and its validity does not expired. Further, it shall be fixed properly and

firmly prior to lifting the weight.

09 Scaffoldings to be used for working at height shall be of adequate size & capacity.

Obtain the work permit when working at height. While climbing on such scaffolding or

working on any structure at height, use of full body safety belt & Helmet is compulsory.

It is also necessary to fasten

chinstraps of the helmet.

10 Contractor or their employee shall not interfere in day-today routine plant activities /

works except the work assigned to them, shall not loiter in the

areas other than their work jurisdiction, as well as shall not temper / operate / touch

the machineries/equipments/auxiliaries with which they are not concerned. Also, the

contractor shall strictly instruct their staff for not to sit or take rest at/near/below

running plants, auxiliaries, systems or any place which is risky, hazardous & prone to

accident.

11 The cylinders containing poisonous / toxic or inflammable / explosive gas like Oxygen,

Acetylene, LPG, Hydrogen, Ammonia, Chlorine, CO2 etc shall be handled safely taking

due care. To handle / shift such cylinders a special trolley /cage meant for it must be

used but in no case it should be rolled.

12 On completion of the work, cotton waste, spilled oil / grease, pieces of welding rod &

other waste material shall be removed from work site and the area shall be left safe,

neat & clean.

13 In case of any injury / accident while working, it shall immediately be reported to

Safety Department through concerned Sectional Head / Engineer. The prescribed Form

No. 21 may be obtained from concern section or Safety Officer.

For any incident occurred but have no injury to any persons should also informed to

safety officer as Near Miss Incident.

14 In all risky job, before start the work contractor should obtained General Safety Work

Permit through concerned section from safety dept in well advance.

15 For performance evaluation of contractor safety factors of work accident, fire incident &

near miss accident will be consider. Steps can be taken to review the job assignment up

to cancellation for negligence.

16 In case of noticing smoke or fire during their work execution, they shall

make immediate efforts to extinguish / control it and simultaneously inform the Fire

Brigade on phone No. 222 or 666. Shift the casualty to nearby hospital after rendering

first aid in case of accident.

17 Over & above these, contractor shall have to follow all the safety requirements / rules &

regulations / norms and legal provisions laid down in various statutes. Particularly the

provisions of The Factories Act-1948 & The Gujarat State Factories Rules-1963

(Amended up to date) shall be followed strictly. The contractor shall also obey the rules

/ regulations / instructions of the local Competent Authority for safety requirements.

18 The above rules shall be scrupulously followed and where required, they may contact the Safety Officer in case of any ambiguity or needs further guidance in this regard.
