Details of different tariff schemes of different classes of consumers and various associated terms andconditions are specified in various regulations and in Annexure C1 and Annexure C2 of the WestBengal Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2011 asamended (hereinafter referred to as the Tariff Regulations). Other associated conditions of the tariffof CESC Limited for 2012-13 are as follows:
1. Load Factor Rebate/ Surcharge:
a) In order to reduce the overall system T&D loss and to flatten the load curve by improving theexisting system load factor of CESC Limited, the HT industrial, HT commercial and HTdomestic consumers shall receive voltage wise graded load factor rebate as per thefollowing table:

b) The above load factor rebate shall be applicable on quantum of energy consumed in thebilling period. (For example a 6 kV industrial or commercial or domestic consumer at 85%load factor shall be eligible for a rebate @ 30 paise / kWh on the total quantum of energyconsumed in the billing period).
c)
Load factor surcharge shall continue at the prevailing rate.d) The load factor shall be computed in terms of regulations 3.9.2, 3.9.3 and 3.9.4 of the Tariff
Regulations and load factor rebate and load factor surcharge shall be computed as per ratesas mentioned in paragraphs 1.a) and 1.c) above.
2. Fixed / Demand Charge:
a) The fixed charge shall be applicable to different categories of consumers at the rates asshown herein.
b) The demand charge shall be applicable to different categories of consumers as per rate asshown herein on the basis of recorded demand as specified in regulation 4.3.3 of the TariffRegulations subject to conditions as specified in the Tariff Regulations.
c) When a new consumer gets connected to the system, the computation of fixed charge ordemand charge for that month shall be made pro-rata for the number of days of supply inthat particular month.
3. Subject to conditions as specified in regulation 4.13 of the Tariff Regulations, for all consumers,minimum charge shall continue at the existing level.
4. In case of short term supply to Pandals for community religious ceremonies, a rebate of 10 paise/ kWh on energy charge of each unit will be given if the entire illumination is done with LED.
5. For all consumers, excluding consumers having pre-paid meters, rebate shall be given @ 1% ofthe amount of the bill excluding meter rent, taxes, duties, levies and arrears (not being the arrearsdue to revision of tariff) if the payment is made within the due date.
6. In addition to the rebate under paragraphs 4 and 5 above, if the payment is made within duedate, then an additional rebate of 1% of the amount of the bill excluding meter rent, taxes, duties,levies and arrears (not being arrears due to revision of tariff) would be allowed to the consumerswho would pay their energy bills through e-payment facility (through web by using net banking,debit card, credit card, electronic clearing scheme) on introduction of it by CESC Limited throughnotification in the newspapers in future. Such rebate will be allowed prospectively after the date ofissuance of the order dated 1 December 2012. This rebate will be given after giving effect underparagraphs 4 & 5.
7. Power Factor Rebate/ Surcharge:
a) The power factor rebate and surcharge shall continue for those categories of consumers towhom these are applicable at present. The rate of rebate and surcharge and the methods of
calculation of such rebate and surcharge for the year 2012-13 are given below:

b) The rebate and surcharge against different time periods shall be reflected in the billseparately and shall be treated separately.
8. For short term supply, emergency supply and for supply of construction power, there shall be norebate or surcharge for load factor and power factor.
9. Delayed payment surcharge shall be applicable as per regulation 4.14 of the Tariff Regulations.
10. All existing charges relating to meter rent, meter testing, meter replacement, fuse call charges,disconnection and reconnection charges etc. shall continue.
11. A consumer opting for pre-paid meter shall not be required to make any security deposit for theenergy charge.
12. All statutory levies like electricity duty or any other taxes, duties etc. imposed by the StateGovernment / Central Government or any other competent authority shall be extra and shall not
be a part of the tariff determined under the tariff order.
13. All the rates and conditions of tariff are effective from 1 April 2012 and onwards. This rate willcontinue till further order.
14. For 2012-13 the consumer/licensee shall further have to pay /be refunded the difference of thefollowing two.
a) tariff as declared under the order for 2012-13, and
b) what they actually already paid for the concerned period as tariff and the MVCA if any for theconcerned month.
Adjustments, if any, for over recovery / under recovery for 2012-13 from the energy recipients tillNovember 2012, shall be made in 8 (eight) equal monthly instalments through bills for December2012 onwards.
15. There will be no separate Monthly Variable Cost Adjustment (MVCA) for CESC Limited on andfrom the date of effect of the order dated 1 December, 2012 till MVCA becomes applicable interms of the Tariff Regulations. The MVCA realized by CESC Limited during the year 2012 2013 till November 2012 shall be adjusted in computation of any adjustments for over-recovery /
under-recovery from the energy recipients as mentioned in paragraph 14 above.
16. In addition to the tariff determined under the order dated 1 December, 2012 of the HonbleCommission, CESC Limited will be further entitled to additional sums towards enhanced cost offuel and power purchase, if any, after the date from which the tariff order takes effect. The fueland power purchase cost shall be subject to adjustment in accordance with the Tariff Regulationsthrough MVCA and/or FPPCA.
17. Optional TOD tariff scheme for LT Commercial, LT Industrial and LT Public Water Workscategories of consumers having minimum load of 30 KVA, which was directed to be introduced inthe tariff order for 2007-08, shall continue and energy charge under such scheme shall becomputed according to regulation 4.12 of the Tariff Regulations, wherever applicable, if no tariffrates for such consumers are mentioned in the tariff schedule.
18. For any pre-paid and TOD tariff scheme, other charges shall be the charges applicable toconsumers under respective category of non-TOD tariff.
19. An applicant for short term supplies through pre-paid meter shall have to comply with allnecessary formalities for obtaining supply including payment in accordance with the Regulationsmade by the Honble Commission. The same will be subject to the following conditions:
a) Provision of requisite meter security deposit to be kept with the licensee;
b) Provision of space for installing weather-proof, safe and secure terminal services apparatusto protect sophisticated meter; and
c) Availability of prepaid-meter of appropriate capacity.
20. To avail Rate - C2 for street lighting, the supply should be metered and all the street lights underthe same meter shall be illuminated with LED. For mixed type of street lights under one meterRate-C shall be applicable.
21. For a consumer with prepaid meter who has purchased voucher prior to issue of the order dated1 December, 2012, the existing voucher will continue till such voucher is exhausted.
22. The tariffs determined under the tariff order for different categories of consumers are themaximum ceilings for supply of electricity at any agreed price to the consumers only for thoseareas of supply of CESC Limited where multiple licensees exist. However, if supply is effected toa consumer at a price lesser than the upper ceiling, and as a result the licensee incurs loss, suchloss shall not be allowed to be passed on to any other consumers or any other distributionlicensees under the purview of the Honble Commission.
23. No other rebate shall be applicable except which are specifically mentioned under this order or inany regulation(s).
24. Any matter, which has not been explicitly mentioned in the orderdated 1 December, 2012 of theHonble Commission, shall be guided by regulations 2.9.8 and 2.9.9 of the Tariff Regulationssubject to fulfilling the condition under paragraph 23.
25. It shall be clearly indicated in the consumer/consumers bill (a) the amount payable in terms ofthe tariff determined by the Commission (b) the amount of the state government subsidy if anyand (c) the net amount payable as per provisions of the Tariff Regulations.
26. It is open to the State Government to grant any subsidy to any consumer or any class ofconsumers in the tariff determined by the Honble Commission for CESC Limited. If at all anysuch subsidy under the provisions of the Act is intimated to CESC Limited and to the HonbleCommission by the Government of West Bengal with clear indication of the consumer or class ofconsumers to be subsidized and the amount of the subsidy proposed to be given is paid inadvance, the tariff of such consumer and / or the class of consumers shall be deemed to havebeen reduced accordingly as has been indicated by the State Government. However, suchdirection of the State Government shall not be operative till the payment is made by the StateGovernment in accordance with the provisions of the Act and the Regulations made thereunder,
and the tariff as fixed by the Honble Commission shall remain applicable. In accordance with theTariff Regulations, the State Government is required to communicate, within 15 days from thedate of receipt of a tariff order, whether it shall give any subsidy to any group of consumers etc.
