CHAPTER 1

FOREWORD BYTHEMINISTER

I am honoured to present the fifth Annual Report of theIndependent ComplaintsDirectorate (ICD)coveringtheperiodApril2000 March2001.

My obligation to present this report emanates from Section 222 of the InterimConstitution,1993andSection53(1)(a)oftheSouthAfricanPoliceServiceActno.68of1995. I am pleased to report that financial discipline, redefinition of managementprioritiesand strict adherence to time-frameshavecontributedtothesuccessoftheoperationsoftheICDduringtheperiodunderreview.

Iamparticularlypleasedwith the work of the ICD over thepas t financial year despitethedire financial constraints under which they haveoperated. I am alsothankfulforthe dedication of each individual staff member in making sure that the departmentexecutedtheobligationsforwhichitwasestablishedeffectively.

In thenewfinancialyear,weshallstrivetoensurethattheICD’sfinancialresourcesaresufficiently augmented to enable the department to raise the level of its servicedelivery. The momentumoftheraisedprofile,whichitreceivedinthepastyear,mustbe maintained. The latest available statistics are evidence of increased awarenessamongmembersofthepublicwithregardtotheexistenceandmandateoftheICD.

The level of interaction between the ICD and other Government departments ingeneral and,betweentheICDandtheMinistryforSafetyandSecurityinparticularhasbeenquitesatisfactoryandwillbefurtherencouragedinthecomingyear. TheICDisapartofGovernmentandwillreceivesupportandrecognitionassuch.

It is our desire to encourage greater networking between the ICD and otherinternationalorganizations involved in the protectionofhumanrights. Progressin thisregardwasachievedinthepastyear,butmoreworkstillneedstobedone.

The ICD will further dedicate itselftothetransformationofpolicingin our country andcontribute to ensuring that the police service earns and receives the respect andconfidenceitdeservesfromthecommunity.

INTRODUCTIONBYTHEEXECUTIVE DIRECTOR

TheICD hasbeeninoperationforfouryearssinceitopeneditsdoorstothepublicon01April 1997. In spite of a general lack ofresources, the ICD has made incredibleinroadsand currentlyboasts a presence ineachofthenine(9)provinces.

The investigation of all deaths in policecustody or as a result of police action hasbeen, and continues tobe, a major focusarea and priority of the investigativecomponentof theICD. Previously,theICDhad, in addition, also identified theinvestigationofallseriouscriminaloffencesas a prior i ty for the investigativecomponent. However, as a result of thelack of key strategic resources, and aneffective nett decrease in its operationalbudget,ithasbeennecessaryfortheICDtore-examine and re-prioritise its strategicobjectives, with respect to, inter alia,investigativepriorities.

The ICD has also identified the issue ofcorruption within the SAPS as aninvestigative priority. Certain other caseseg. femicide,rape, spousal abuse, racism,crimesagainstchildren,policebrutalityandthe use of excessive force in terms ofSection 49 of the Criminal Procedure Act,whichareinlinewithnationalpriorities,wereidentified as being priority cases to whichinvestigativeresourceswillbeallocated.

Our government has placed “crimeprevention” on its national agenda. Byimplication,the roleoftheICDasbeingtheonly independent body in South Africa toimpact on the transformation of policing,becomesincreasinglyimportant.

A notable case that received agreat deal of media attentionduring the year under reviewwasthatofthedeathofMrBhekiMkhize,a Member of Parliament. The ICDtook immediate control of theinvestigation and recommendedthat 4 police members beprosecuted for murder anddefeating theendsofjustice. Theirtrial has commenced in thePietermaritzburg High Court. Thiswasindeedasadindictmentforourcountrysinceitwasalawmakerwhowas killed by law enforcementofficers.

In 2000, the frightening abuse ofpowerbymembersoftheNorthEastRand Dog Unit was televisednationally as well as internationally.The incident understandablysparked outrage from the public.Many interviews were requestedfromtheICD,bothfromthenationalas well as the international media.Both the aforesaid incidents havejustifiedtheexistenceoftheICD.

Violence Act (DVA) by the South African Police Service. This obligation hasplaced additional pressure on the limited resources of the ICD. Further, thesuccessful monitoring of the aforementioned Act has been hampered by ageneral lack oftrainingofSAPSmembersinrespectoftheirstatutorydutiesinthisregard.

WhilsttheICDwillperseveretoexposeactsofmisconductandcriminalitybySAPSmembers, it must be emphasized thatthere are many SAPS members who gotheextramile,beyondthecallofduty,inservingthepublic. I wishtoapplaudthecontinued efforts of these police members sometimes during very difficultcircumstances.

During theyearunderreviewtherehasalsobeenmanydeathsofpoliceofficersatthehands of thecriminal elements in our communities. As the ICD, we arecommittedtoassistingwhereverwecan,witheffortsandinterventionsaimedateradicatingthisslaughterandinculcatingrespectfortheblue.

IapplaudmembersofmyDepartmentforworkingunderdifficultcircumstances,with the minimum of resources, and still pursuing a high level of excellence.Whilstmuchhasbeenaccomplishedinashortspaceoftime,werecognizethatmany milestones lie ahead. Our struggletoobtainanincreasedbudgetgoeshandinhandwithoureffortstocreateamorecrediblepoliceservice.

CORE BUSINESS OF THE ICD

3.1INTRODUCTION

The core function of theICD has three sub-divisionsviz.

ComplaintsRegistryInvestigationsMonitoringandDevelopment

Complaints Registry is charged with theresponsibility of receiving, processing andregisteringcomplaintsreportedtotheICD.

Thepastfinancialyear has been a verybusyone,both intermsoftheintakeofcomplaints,which again increased dramatically duringthe period under review, and other relatedactivities.

The number of new matters received andregistered during the period under reviewincreased from 4380 in the previous financialyear to 5225 in the current one and thisrepresents an increase of about 19%. TheincreasehasbeenparticularlyhighintheClassV category of complaints. This categoryspecifically dealswith those complaints thateither occurred before the date ofestablishment of the ICD or it relates tocomplaintsand / orissuesdealt with by otherStatedepartmentsorpublicinstitutionssuchasthe Office of the Public Protector. The highnumberofsuchcasesthatneedtobereferredto other relevant State organs suggests thatthe public may still be ignorant about themandate oftheICDandthefactthattheICDcannot address cases thatoccurredbeforeitwas established in April 1997. This is hardlysurprising as the ICD has not, because of

resourceconstraints,beenabletoreachout toandeducate the public about itsmandate and priorities, as widely as ithadhoped.

However,aswasthecaseinthepreviousfinancial year, weagainexperiencedadecrease in the number of police-related deaths, albeit a marginal one.The number of deaths increased byabout 0,8% from 681 in the 99/2000financial year to 687 in the year underreview.Wethinkthatitisfairtosaythatourefforts,which seemto enjoy thesupportof SAPS management, in seeking toreduce the number of police-relateddeaths arenow beginning to bear fruit.The ICD w illcontinue to explorewaysofreducing drastically the number ofpolice-relateddeaths,sothat weremaintrue to the principle of the sanctity ofhuman life that underpins ourConstitution.

For the first time since the ICD wasestablished,therehasbeena decreasein the number of serious criminaloffences. Ascompared to thepreviousfinancial year the number of seriouscriminal offences reported to the ICDdecreased b y a bout 27,4%. While thedecrease mustbewelcomed,onemustalsobear inmind theveryrealpossibilityof under-reportingand that it ispossiblethatthenumber ofcomplaintsreceivedby the ICDmightnotaccurately reflectthe extent of police involvement incriminalactivities.The number of service - relatedcomplaints represents about 32,8% ofthe totalnumberofcomplaintsreceivedby the I C D and it would appearthat theSAPSservicedelivery machinery needsto beimproved before we cansee anysubstantial or significant reduction in thiscategoryofcomplaints.

Anumberofkeyobjectivesforthiscomponentwereidentifiedandtheyare:-

Oneofourkeystrategicobjectivesisto ensurethatwe provide prompt and quality service inline with the White Paper on public servicedelivery (Batho Pele). This has in practicetranslated itself into two main performanceindicators.

Firstly, we have toensurethat members of thepublic attending our offices to lodge theircomplaintsareattendedtowithin30minutesoftheirarrival.

Secondly, wehavetoensurethatallcomplaintsthatarereceivedbytheICDareprocessedandregisteredwithinonedayofreceiptthereofandthat where the complaints fall outside ourmandate, the complainants are informedaccordingly within one week of the receipt oftheircomplaints.

Whilewe have endeavoured to adhere strictlyto these time-frames, as the number ofcomplaints increases, it equally becomesincreasinglydifficult,particularlyintheprovinceswhich receive the highest number ofcomplaints,to maintainthese standards. If theincreases do not atsomestageleveloff,wewillhavetoreviewthesestandardsandsetnewandmore realistic ones. We are also constantlyevaluating our performance as a departmentnot only to ensure uniformity, but also todeterminewhethertheperformanceindicatorsthat we have set for ourselves are beingadheredto.

One of the objectives that we set forourselves during the period underreview, was to establish a fullycomputerised database system thatwould,inter alia,enableustoproduces tat i s t ica l in fo rmat ion o n ouroperations. Although we havelargelyaccomplished this objective,a lot stillremains to be done, particularly, withrespect to the updating of thedatabase, which exercise has turnedout to b e a very laborious and time-consuming one. However, t heautomation of the case-registrationsystemhasbroughtaboutuniformityinthe way we deal with t h e c ases andclearly, once the database is fullyoperational, the task of producingreliable statistical information willbecomemucheasierthan isthecaseatthemoment.One of the areas that require urgentattentionisthetrainingofpersonnelonstat is t ical analys i s and t rendsidentification. In this regard, we havealready set in motion processesdesignedtoachievethisobjectiveandhave approached a number ofinstitutions, including Statistics SouthAfrica (SSA) and the Council forScientific and Industrial Research(CSIR). Statist ics South Africaundertook,atnocosttotheICD,totrainour personnel in the abovementionedareas.Thetrainingwilltakeplaceduringthe2001/2002financialyear.

We continued to maintain regularcontact with other complaints-handling bodies bothnationally andinternationally.

handling bodies, not only to avoidduplication as we l l a s unnecessaryjurisdictional conflicts, but also to glean bestpractices f rom other institutions. Throughoutthe yearwemaintainedregularcontact withinstitutions such as the Human RightsCommission, Public Protector etc andsimilarorganizations abroad. These exchanges ofinformation and ideas have assisted usconsiderably in inter alia, streamlining ourcase-intakesystem.

Also,in an efforttoeducatethepublicaboutour complaint system and processes, wehave added to our existing informationpackages, a pamphlet which explains indetail the processes thata complainthastofollowfromthemomentof receptionuntilitisfinalised, in order to bring about a betterunderstanding of the functions, mandateandoperationsoftheICD.

SeveralClass IV complaints were referred tothe SAPS and other institutions for monitoringandinvestigation. This referral reduced theintakeofnewcomplaintsdrastically. Ofmoreimportance, the referral ofthesecomplaintsfacilitated a focus on more seriouscomplaintssuch as theClass I and Class IIIcomplaints. Although quite often ourcomplainantshavebeenunwillingtoreturntothe police with their complaints, in a fewinstances, we received positive feedbackfromour complainants, following the referraloftheirmatterstotheSAPS.

Thisisanindicationthatthepolicethemselvesare taking these complaints seriously, andthatthey are endeavouringtoresolvethemasquicklyaspossible.

We are also exploring the possibility ofreferringsome,ifnotall,oftheservice-relatedcomplaints to the Office of the Inspector-General of the Police oralternativelyto the

Secretariat for Safety and Security. Theofficeof theInspector-Generalisspeciallytasked to deal and oversee all servicedelivery relatedcomplaints. ItishousedatSAPSHeadquartersbut has a mandate tooversee such complaints across thecountry. We have also discussed thispossibilitywith the Secretariat forSafetyandSecurity,which appears keen totakeovertheservice-relatedcomplaints.

Asindicatedin ourprevious AnnualReportsthere are indeed some complaints anddisputes thatcanbestberesolvedthroughconciliation and mediation. Although wearestilltoagreewith thepoliceonwhetherwe should be mediating at alland, if s o,how should the conciliation / mediationproceed,certain complaints areofsuch anaturethatitwouldbetotallyinappropriateand costly to subject them to a fullinvest igation. They could on ly beappropriately dealt with by way ofconciliation/ m e diation andinevitablywefound ourselves mediating a sizeablenumberofthesemattersinspiteof thelackofagreementwiththepoliceonthisissue.

The number of complaints resolved inthismannerincludeddisputesbetween ontheone hand taxi organisations,tribal leadersetcand thepoliceontheotherhand.

The ICD receivedatotalof5225cases,ofwhich4538werepubliccomplaints and687 were notifications ofdeaths i n p olicecustody dur ing the financial year2000/2001.Comparedtothefinancialyear1999/2000,the number ofcasesreceivedwas4380,ofwhich681werenotificationsofdeaths in police custody while publiccomplaints numbered 3699. The largest number of complaints ingeneral was recordedin Gauteng (1437)followed b y theWestern Cape (742) andNorthernProvince (690). Theprovince withthe least number of complaints was theNorthernCape(287)

Ofthesecases,therewere687notificationsofdeathsin police custody oras a resultofpolice action. Thisnumberhasdecreasedby ten deaths over the previous yearrepresentinga0,8%decrease.

With regard to the number of casesregistered in terms of death in policecustody or as a result o f police action,KwaZulu Natal recorded the highestnumber (181) followed b y Gauteng (131)with the Northern Cape recording thelowestnumber(15).The number of serious criminal offencessuch as assaultwith intent to d o grievousbodily harm, theft,torture, abuse ofpower,arson, rape, corruption, robbery andfraudcommitted by members of the SAPStotalled 554 during 2000/2001 comparedto 764 in 1999/2000. This represents adecreaseof 210cases or 27.5% over thepreviousyear. The Western Cape (134)andGauteng (103) recorded the highestnumberofcriminaloffencescommittedbySAPSmembers.

The total number ofcases ofmisconductcommitted by members of the SAPS andreportedduring2000/2001represents1707cases compared to 1675 in 1999/2000whichrepresentsanincreaseof2%.

Themajorityofthesecomplaintsareservicerelated cases, where people complain

abouttheserviceprovidedbytheSAPS. Inthiscategory it was found that Gauteng (609)WesternCape(468) Eastern Cape (216) andNorthern Cape (134) recorded the highest

number o f complaints o f pol icemisconduct while the North West (20),KwaZulu Natal (41) and the NorthernProvince(44)recordedthelowestnumber.

Areas of misconduct among the policehave been largely found tobe neglectofdutyorperforming theirdutyinanimpropermanner, failure to perform duties andresponsibilities, assault of people incustody, gross discourtesy, acting incontravention of the SAPS Act andvictimisation.

The majority of cases, about half thenumberofcomplaintsreceivedbytheICD,are those which fall outside the ICDmandate andare referredto therelevantState Departments andorganisations. Thefigures for this category of complaintsduring2000/2001 was 2265 comparedto1237 in 1999/2000 representing anincrease of 1028 complaints or 83%.Again Gauteng (590) takesthe lead w hilethe Northern Province (539) and theNorthWest Province (403) follow closely. TheWestern Cape (65) recorded the lowestfigure.

Thenumberofcompletedcases,meaningcases which were substantiated,unsubstantiated, dismissed, withdrawn ormediated totalled 1786 throughout thecountry. Those casessent totheDPPforadecision,numbered456.

Ofthosecaseswhi chwenttotheDPPfora

decision, 206are pending, 79 are to beprosecuted, while the DPPdecided notto

prosecute in 46 cases. Inquests were heldin125cases.

Completedcases

Of the 109caseswhichwentfor criminaltrial, 981 are still pending and 18convictions wererecorded. Ten acquittalswererecorded.

In 61 of those cases where internalSAPSd i s c i p l i n a r y p r o c e e d i n g s w e r e

recommended,44cases arepending,13convictions have been secured and 4

acquittalswererecorded.

The ICD investigated, monitored orsupervised 1120 cases, while those

referred tothe SAPS and other institutionsforactionnumbered2028.

3.3. INVESTIGATIONS

3.3.1 INTRODUCTION

The a im of Programme 2:is to investigate deaths in police

custody or a s a r e s ult o f p olice a ction, as wellas other complaints lodged with theDirectorate, effectively andefficiently, with aview toestablishing whether or not therewasanywrongdoingon the partofapoliceofficer.The programme consists of a single sub-programme: Investigation of Complaints,whichprovidesfortheinvestigationofanysuchdeaths a f u nction prescribed interms oftheSouthAfricanPoliceService(SAPS)Actof1995.In addition, the programme provides for theinvestigation of any matter referred to theDirectorate by the Minister or M ember oftheExecutive Council, as well as for theinvestigation of anyallegation ofmisconductor offence c ommitted by any member oftheSAPS. The Act also provides that theDirectorate may investigateanymatterwhichfallswithinitsmandate.

The ICD’s investigative priorities for the year2000/2001wereidentifiedasfollows:

Deathsinpolicecustodyorasaresultofpoliceaction;Policecorruption,focussingspecificallyon:Allegedsale,theftand/ordestruction ofpolicedockets;Allegedsale,theftand/ordisposalofexhibits;Escapesfrompolicecustody;Crimesagainstchildren;Crimes against women, especially spousalabuseandfemicide;Racism;The use o f excessive forcein terms of section49oftheCriminalProcedureAct.

TheICDhas,duringthecourseofthefinancialyear2000/2001, actively investigated 582 cases interms of our investigative priorities mentionedabove. In the courseofsuchinvestigations, ICDinvestigators, who number 45 in total, havetravelleda totalof 428,397kms atacostofR506764.00. A total of 687 ClassI cases (deaths inpolicecustodyorasaresu ltofpoliceaction)werereportedtotheICD during theperiod1 April2000to31 March 2001 andpreliminary investigationswereconductedin almosteach andeverycase.

Where evidenceofpoliceinvolvementinacoveruporincriminalconduct was detected during suchpreliminary investigation, the matterwas act i ve l y i nves t iga ted tocompletion. Cases that revealed nofoulplayon thepart of the SAPS werereferred back to the SAPS forcompletion. Our Monitoring divisionthenclosely monitoredthe progressofs u c h i n v e s t i g a t i o n s . W h e r eappropriate, discipl inary actionaga in s t SAPS membe r s wasrecommended. ICDinvestigatorsalsoactively investigated numerous othercases falling within the ambit of thestated investigative priorities,the mostnoteworthyofwhich werethefollowing(listed perpriorityandper SAPSstationwheretheincidentoccurred):

Mr. Bhekhi Mkhize, MP, was shot andkilled on30July2000,whenmembersofthe SAPS Public Order Policing Unit,stationedatUlundi,wereconductingasearchforillegalfirearms.TheICDtookc h a r g e o f the inves t igat ionimmediately after the incident. Theinvestigation revealed that thedeceased (who was unarmed anddefenceless atthe time), was shotatpoint blankrange, intheface,withanR5 rifle. It wasalso ascertained thatafter theincident, thescenewas leftunattended for aperiod of time, andthereafter tampered with so that itwould appear thatthedeceased h ad

diedduringthecourseofastruggle. As a r esultofthe investigation, three SAPSmemberswerearrested and appeared at the EmpangeniMagistrate’s Court where they were grantedbail. The DPP eventually accepted ourrecommendations that the suspects bechargedwith murder, accessory after t he factto the commission of the crime of murder,alternatively, defeatingorattemptingtodefeatorobstruct the courseofjustice. The trial istocommence on 17 Apr i l 2001 in thePietermaritzburgHighCourt.

Thisincident occurredinAlexandra,Gauteng,on30 May 2000. A learner at Realogile HighSchoolwasshotandkil ledbythepolice whenthey wereattempting to disperse a group ofangry learners who were marching in protestagainst thedeathofanotherlearnerallegedlykilled by a local shop owner. The ICD tookcharge of the investigation and afterfinalization thereof handed over the casedockettotheDPPwitharecommendationthatthe suspects be indicted for murder andattempted murder. The DPP accepted ourrecommendation and decided to chargeSergeantBuhlebenkosiNdlovuwithmurderandattemptedmurder. The first appearance wason 23 January 2001 while the next courtappearancewil lbe on28-29May 2001 intheWynbergMagistrate’sCourt.

This incident occurredinBelfast, Mpumalangaon 16 January 2001 when the deceased’smothercontacted thepolicefor assistanceasher son, the deceased, was aggressive andinsultingthem.The failure of the police to effect his arrestresulted in the deceased’s mother asking for

assistance from an officer who livednearby and was at his home at thattime. The officer,accompanied by acolleague attended the scene. It isalleged that the twoofficers assaultedMr Mashininiwithaknob-kierie. It isalsoalleged that theydragged himon theground from the house to the policevehiclebypulling him b y histrousers. Asa result he bled through the nose,mouth and ears while his face andhead were covered with blood. Hediedasaresultofhisinjuries. Thebrainscans confirmed that he sufferedsevere headinjuries. TheICD tookoverthe docket anda r restedthe twopoliceofficers implicated, on Wednesday, 24January2001,andtheyarenowfacinga charge of murder. They applied forandwere grantedbail of R1000eachby the Belfast Magistrate’s Court. Werecommended that the suspects besuspendedwithoutpay. Noresponsetothis recommendation has beenr e c e i v e d f r o m t h e P rov inc ia lCommissioner. They f irst appeared inthe Belfast Magistrate’s Court on 02March 2001and willappear again on27August2001.

This incident occurred on 12 February2000, whenaSAPSmember stationedat Khayelitsha became involved in anargument at a tavern, where he hadbeen d r in k i ng . The m emberdischargedhisservice pistolnumeroustimes, fatally wounding an unarmedcivilian. TheICD investigated the caseand ultimately recommended to theD P P thatthememberbechargedwithmurder. The DPP agreed with our

findings and instructed that the member bechargedwithmurder,attemptedmurderandthree (3)countsofcontraveningS.39(1)oftheFirearmsandAmmunitionAct75of1969.

This incident occurred on 14 February 2001when a SAPS member shot dead thedeceased after suspecting him of being inlove with his (the SAPS member’s) fiancée.Thememberwasarrested and c harged. Heis due to appear in the Pinetown RegionalCourton14June2001.

This incident occurred in Newcastle on 24January 2001 after two members of theNewcastle D og Unithad arresteda man forurinatingin public attheNewcastletaxirank.The police alleged that the crowd at thescene became unruly and began throwingstonesand bottles at the police. It wasalsoallegedthatMr Nhlapho who hadallegedlybeen part ofthe unruly group, produced afirearm and fired a t t h e police. The policereturned fire and Mr Nhlapo was fatallyinjured. The ICD took charge of the casedocket and arrested the police officersimplicated onFriday, 09 February2001andthey are now facing a charge of murder.They applied for and were granted bail ofR1000 each by the Newcastle RegionalCourt. Their first appearance was on 22March2001 when the case was postponedto11June2001.

The incidenttook place on Wednesday,14 February2001 when police on patrolfound four boys dismantl ing anabandonedcar. When the boyssawthepolice they fled the scene and uponregrouping,they discovered thatoneofthemwasmissing. Membersofhisfamilyfiledacomplaint about the missing b oy,believing that the policehad killed h im.On Monday, 26 February 2001, thedecomposedbodyoftheboywasfoundwith aseveredhead lyingnear the body.The ICD attended a post-mortemexamination at Medunsa in Pretoria onFriday, 02 March 2001 and the resultsrevealed no bullet wounds. Policecomplicity in the case could not beestablishedandtheICDclosedthecase.

We investigated the circumstancessurrounding the death ofNimrod FanieMohlabakoeinpolicecustody.

The incidentoccurred in Hoopstad, FreeState on 06 October 2000 where Mr.Mohlabakoe was arrested for allegedlystealingmoney. On08October2000 hewas found dead inacellhangingfromawindow frame, withinjuries tohismouth.Thepost-mortemrevealedthatthecauseofdeathisconsistentwithhanging.

We took chargeoftheinvestigation a ndafterfinalizationthereofhandedoverthecase docket to the DPP with arecommendation that a formal inquestbe c onducted. TheDPPdecidedtoholdaninformalinquest. Weawaittheresults.

W e have been inves t iga t i ng thecircumstances surrounding the death ofAndriesMangwane.

Theincident occurredon 01March2001inTshamahanzi inthe NorthernProvince whereInsp. Matjeke and his son arrested Mr.Mangwane f o r an alleged housebreaking atMatjeke’shouse. It is allegedthat both Insp.Matjeke and his son assaulted the suspectand lockedhimup intheirgarage for furtherinterrogation. He was later taken to theMokopane Hospital since he sustainedseriousinjuries.

The ICD took over the case docket andarrested Insp. Matjeke and his son onThursday, 1 5 March 2001. They applied forandweregrantedbailof R1000 each bythePotgietersrust Magistrate’s Court. Their firstappearanceincourtwason23April2001.

We are investigating the circumstancessurroundingthedeathofMr.GivenNkuna thatoccurredon12March2001inCulcutta intheNorthern Province. Mr. Nkuna wasshot forallegedlyresisting arresta f te ra warrant wasissued forhis arrest. Itisalsoallegedthatthesuspect overpowered a police officer whowasassignedtoexecutethearrest. Thelatterthen called for policereinforcement. Afterthearrival of the reinforcements Mr. Nkunawasfatallywounded.

The ICD took over the case docket andconducted a post-mortem on Friday, 06March 2001attheMapulanengHospital. Thepost mortem revealed that Mr. Nkuna wasstruck bythree bullets,two enteredhis backand the other bulletenteredunder the knee

The ICD investigated thecircumstancessurroundingthedeathofJamesRakwena.

Theincidentoccurredon13January2001inBathointheFreeStatewhereRakwenawas i nvolvedinan argument withapoliceofficerwhofatallyshothim.

We took over the investigation andarrested thesuspect. Heappliedforandwas granted R 1000. 00bai l . His firstappearancewason23March 2001,andthedateforthesecondappearancehasbeen set for 07 June 2001 in theBloemfonteinRegionalCourt.

The ICD investigated thecircumstancessurroundingthedeathofacivi l ian on 16September 2000 inKanyamazane in theMpumalangaProvince. Itisallegedthatapoliceofficer who was in thecompanyofhis friend when visiting relatives atKanyamazane, had a n argument w i thacivilianthat resultedinhimfatallyshootingthecivilian.

We took over the investigation and afterfinalization handeditovertotheDPPforadecision. TheDPPdecidedtoprosecutethe police officer. The first appearancewillbeon02August2001intheNelspruitRegionalCourt.

Althoughtheincidentitselfoccurredduring1998,thisincident only became public knowledge on 7November 2000, when video footage of sixmembersoftheNorthEastRandDogUnitusingillegalimmigrantsas“livebait”duringa“training exercise”,wasaired on national television. Ajointinvestigationteam of SAPS and ICD members was set up toinvestigatethematter. All sixsuspectswerearrestedandthen releasedon bail ofR2000 each. The DPPhas decided to chargethe members concernedwithassaultwith intent to do grievousbodilyharm,corruption an d d efeatingthe ends ofjustice. Theyappeared in the Pretoria Magistrate’s Court on 1March 2001, and the matter has now beentransferredto thePretoriaHighCourtfortrial.

This incident occurred on 1 March 2001 when theStation Commissioner ofOlifantshoekPoliceStationallegedly fired liverounds of R1 ammunitioninto acrowd o f p rotesters. Eightprotesterswerewounded.TheICDtookchargeoftheinvestigationandarrestedthe Station Commissioner who was subsequentlyreleased on bail of R500 by the PostmasburgMagistrate’sCourt. His first appearance wason22March, and the matterhas now been postponeduntil2July 2001intheKathuMagistrate’sCourt.

Thisincidentoccurred on3 March 2001 in Avilla ParkinformalsettlementinVredendal, wheremembersofthe SAPS a nd SANDF conducteda raid. It is allegedthat a police officer assaulted an elderly man,whereuponmembers of the community becameunruly a n d startedthrowing stones a t t he police. Itisfurtherallegedthatthepolicethenfiredliveroundsof

ammunition at members of thecommunity, resu l t ing in anexchange of fire between thepolice and community members.Six civilians and twopoliceofficialswere woundedduringtheshooting.Theinvestigationisstillcontinuing.

This incident occurred on 26January 2001inPortAlfred,whenamember of the community wasarrestedfor allegedlydrinkingliquorin public. It is alleged that thecomplainantresisted arrest and asaresulthewasassaultedanddogswere seton him. TheICDhastakenchargeoftheinvestigation,whichisstillcontinuing.

TheMECforSafetyandSecuritywasr u d e l y t r e a t e d w h e n sheconducted a routine visit to thepolice station. A number of SAPSmembers a re being investigatedon charges of racism and racialdiscrimination.

Thisincidentoccurred on 09March2001 in Hillbrow when a t eacheratSt Edna’s Community College inHillbrow was allegedly assaultedand detained by two policemen

Theinvestigation h a s been finalizedandthedockethasbeenforwardedtotheDPPforadecision.

This incident occurred during February2001 in King William’s Town when a SAPSmemberapproacheda member of thepublic and demanded payment of theamountofR500inexchangeforwhichthememberwouldnot executea warrant ofarrest of which he was in possession inrespect of t h e civilian for an admission ofguilt fineforatraffic offence. The ICDwasinformed of this and decided to takechargeoftheinvestigation. Atrapwassetforthe SAPSmemberand hewasarrestedafter themoneyhadbeenhandedover.On 16 February2001, the member wascharged wi th fraud, alternat ivelycorruption.

Heapplied f o r and wasgrantedbai l inanamount of R2000. Heappearedincourton23 March2001andthecase hasbeenpostponed until 8 June 2001 in theZwelitshaMagistrate’sCourt.

Thethreepolice officers implicated in themurderofaminor(14)andtheassaultoffiveother teenagers will appear in the ElliotRegional Court on 14 August 2001. TheincidentoccurredinBarklyEastintheEasternCapeon10April2000wherepolicearrestedsix teenagers who allegedly committed aburglary. The boyswereallegedlyassaultedby the police and two of them weredragged behinda police van. Oneyouthcollapsedasa result ofexhaustion andwaskilledwhenthevehicledroveoverhim.

TheICD tookcharge ofthe investigation on13 April 2000 and after finalization thereof,handedove rthecasedockettotheDPPwitha recommendation that the three policeofficers be indicted for murder, assault,assault with intent to do grievous bodilyharm, theft andattempting to defeat theendsofjustice,respectively.

Thecasewas first heardon 07September2000. The accused have made severalcourtappearances, thelast ofwhichwason26 March 2001, when the case waspostponeduntil 14 August 2001 in theElliotRegionalCourt.

Thisincident occurred at FraserburgPoliceStation intheNorthernCapeon15July2000when a police officer arrested thedeceased for trespassing and stock theft.On16 July the deceased was discoveredhanging in a police cell. The ICD tookcharge ofthe investigation on18July2000.A post-mortem conducted on21 July2000revealed that the deceased had multipleinjuries but according to the doctor who

conductedthat post-mortem, those injurieswere n o t t he cause o f death. The cause ofdeath, accordingtothedoctor,wasfoundtobe consistent withhanging.TheMECforSafetyandLiaisonin theNorthern Cape, Ms ConnieSeoposengwe, after visiting the FraserburgPoliceStation on03August 2000requestedasecond post-mortem that was arranged bythe ICD and performedby anindependentpathologist,on08Augus t 2000. A secondpost-mortem revealed multipleinjuries. Thedocketwashanded tothe DPPforadecision.WeawaittheDPP’sdecision.

Anaccusedminorwasarrestedanddetainedon a charge of motor vehicle theft. Theaccused was placed with adult detaineeswhere he was assaultedand died asaresult.TheICDreferredthemattertotheDPPandhasfurther recommended that certain membersbe charged with contravening SAPSRegulations. The outcome of the case is stillawaited.

An incidentwhereit wasalleged thatpoliceset dogs on two boys was investigated inPietersburgon 03November 2000. The twoboyswereplaying next to a rubbish dumpwhenallegedlypoliceletthedogsloose. Theboys were badly injured and one of themevenhadaneareatenaway.

The ICD took the investigation overand afterfinalization thereof handed over the casedocket to the DPPforprosecution. We alsorecommended to the SAPS managementthat members involved be chargeddepartmentally. Decisions frombothDPP andtheSAPSareawaited.

This incident occurred on 1 January 2000,when a police officer, stationed at SunrisePoliceStation shotand killed hiswifewith hisservice pistol. The ICD took over theinvest igation and, upon finalisation,recommended to the DPP that the memberbe prosecuted on a charge of murder. TheD P P w a s i n a g r e e m e n t w i t h o u rrecommendation. On 23 November 2000,the memberwasfoundguiltyofmurderintheKimberley High Court and sentenced to 15years’imprisonment.

Thisincidentoccurredon28July2000whenaSAPSmembershotandkilledhiswife. TheICDtook chargeoftheinvestigationand arrestedthe member who was charged with murder.The member applied for and was grantedbail. Thereafter, ICD investigators receivedinformation that the accused member wasthreatening witnesses. An application wasbrought before the courtby theICD tohavethe bail of the accused member withdrawn.The application was successful and theaccused wasplaced backincustody. Uponfinalisation of the investigation the ICDsubmitted its recommendations to the DPPwho decided that the member beprosecuted. He was found guilty of murder,pointing a firearm and two counts ofintimidation. On 28 March 2001 he wassentenced to 20 years, 18 months and 10yearsrespectively. Theprisontermsaretorunconcurrentlyand hewillserveaneffective20yearsinprison.

3.4.1 INTRODUCTION

3.4.2 RESEARCH INTOPOLICEVIOLENCE

The rationale behind the establishment of thiscomponentwasthenotionthat the departmentshouldnotonlyfocusonincidentsofmisconduct,but also, on the causes thereof and systemicproblems. This approach is premised on thenotion that the department should contributepositively to policing in the country and wherenecessary recommend interventions whichwould curb errant police behaviour. Already,variousinitiativeshavebeenundertakeninpursuitofthatgoal. Itwouldthereforebeappropriatetorefertosomeoftheseinitiatives:

Most of the complaints of misconduct andcriminalitycommitted by members of thepolicerelate to the use of excessive force by policeofficers against suspects. While the ICDacknowledges that police officers often findthemselvesinlife-threateningsituationsandhaveto defend themselves, indications are that attimes police resort to the use of forceunnecessarily. In certain instances, the forceusedisexcessive.

Against this background, the departmentcommissioned research into theuseofforce bypoliceofficers. TheresearchisconductedbytheInstitute o f H uman Rights andCriminal Justice atthe Technikon South Africa. The aim of theresearch is, amongothers, to assess theextent,natureand commonformsofviolenceaswellasrecidivism among officers and ultimately, todevelop a profiling technique to identifymemberswhoarepronetoviolentbehaviour. Atconclusion hereof,the d epartment w illdeveloprecommendations aimed at addressing theproblemin theshort,mediumandlongterm. Atthetimeofwriting hereof, the research isnearingcompletion and therecommendation report will

bereleasedtowardstheendof2001.

One of the systemic problems that thedepartmenthasidentifiedisthemannerinwhich the police handle service-relatedcomplaints. Apparent dissatisfaction withthe manner in whichthe police deal withservice-related complaints has ledmembers ofthepublictolodgenumerouscomplaints with our offices countrywide.The conduct that leads to complaintsunder reference include failure to reportprogress on investigation and failure tog e n e r a l l y c o m m u n i c a t e w i t hcomplainants.

Inviewoftheaforegoing,thedepartmentends up dealing with a considerablenumberofservice-relatedcomplaints. Thisclearly is contrary to the department’spolicy ofnotdealingwithmanagementorlabour relatedproblems. Worst ofal l , thesituationdivertsthedepartment’sattentionfrom its statutorymandate of investigatingonly acts of misconduct and criminaloffences. Equally,thisstateofaffairsresultsin the department’s limited resourcesbeingdepletedbyactivitiesfallingoutsideofitscorefunctions.

Toaddress theproblem under discussion,during April 2000, the departmentconducted a study aimed at establishingwhetherornot the police haveasystemormechanism to deal with service-relatedcomplaintsandifso,whetherthesystemormechanismiseffectiveornot.

come up withrecommendationsforthepoliceto introduce mechanisms to deal with theproblem. Followingthatstudy,thedepartmenthas made recommendations for thedevelopment of a mechanism to handleservice - related complaints. This report wasforwarded to the Minister and NationalCommissionerinJanuary2001.

FollowingthesubmissionofadetailedresearchprogrammetotheICDbytheWITSCent re forthe Study of Violence and Reconciliation, aworkshop was heldin April2000. This workshop,which was attended by al l relevantstakeholders, considered the findings of theresearch and much of the ensuing debaterevolvedaroundthedevelopmentofastrategytoreducetheriskofdeathsinpolicecustodyoras a result of police action. A task team,consisting of representatives of the ICD, SAPS,NGO’s, the Department of Justice and policeunions was established to take the processforward.

The strategyisintheprocessofbeingfinalizedand it is envisaged that it will be completedtowardstheendof2001.

Various initiatives have been undertaken todeveloppolicies pertaining t o the handling ofc o m p l a i n t s a n d t h e m a k i n g o frecommendations. Three of these initiativesdeservemention.

White Paper it was anticipated that theprocess would belongand complex. Thusthe processofdevelopingaWhitePaperthatstarted in 1999 c ontinuedinto the 2000/2001financial year. After the consultativeworkshopswhich were c onductedduringJuly- August in 1999, a Draft Green Paper wascompleted. TheDraft was presented to theMinister forSafety and Security. The Ministertabledthedocumentfordiscussionatoneofthe meetings of the Safety and SecurityMINMEC.

Subsequent to the discussion of the DraftGreen Paper in the MINMEC, it was felt thatalthough the department consulted widelyduring the consultative workshops, i t sconsultationhas notbeenadequate. Also, itwasfeltthatthepositionofthedepartmentoncertain aspectsstillremainsunclear. For thatreason, the department was requested torevisethe document and continue to furtherengage keystakeholders. Itwasalsofeltthatthe processshouldbeshort-circuited. Insteadof coming up with and publishing a GreenPaper,thedepartment should publisha draftWhitePaper.

In view of the a foregoing, t he draft WhitePaper is currently under revision. It isenvisaged that the revision would becompleted at the end of July 2001. Thecompleteddocumentwouldbepresentedtothe Ministerandifapproved;bepublishedasa D raft White Paper thatwould be sent to alldepartments and other stakeholders forcomment. During thatstage,presentationswould also be made to the ParliamentaryPortfolioCommitteeonSafetyandSecurity.

ICD hasbeengiventheadditional mandateofensuring that disciplinarysteps are being takenagainstthoseSAPSmemberswhodo notcomplywiththeirobligationsintermsoftheAct. TheICDisexpected to report on a six monthly basis toParliamentontheimplementationofthisAct.

Apol icypertainingtotheprocessing ofsuchDVAcaseshasbeendraftedandreportstoParliamenthavebeen tabled.The firstreport was tabledon30 August2000, whilethesecondwastabledon15March2001.

Our WesternCapeofficeconvened workshopson theDVAwhereinstakeholdersincluding SAPSwere made aware of the new DVA. Suitableshelters wereidentified as well as NGO’s whichcan assist with thecounselling of victims wherenecessary. Inotherworkshopsconvened,NGO’s,members of the community, abused womenand men, scholars, Court representatives, SAPSas well as members of Community Police Fora(CPF’s) were invited to address their roles inrespectofassistingabusedvictimsandhow theycouldwork togetherwi thboth the ICDand thepolicestationsinfuture.

VIOLENCEAGAINSTWOMEN.

On the firstdayofactivism of the 16 daysof noviolence against women (25 November 2000)the Executive Director visited SAPS PietersburgwheresheaddressedpoliceofficersontheDVA.Katlehong Victim Empowerment as wel las theNational Institute for Crime and Reintegration o fOffenders (Nicro) in conjunction with SAPS andKatlehongCPForganizedamassmarchthatwasaimed at the creation of awareness aboutintimatefemicide.

The following police stations around Gauteng(SAPS Moroka,SAPS Katlehong, SAPS Mamelodi,SAPS Rietgat, SAPS Jabulani, SAPS Dobsonville,SAPSSebokeng)and SAPSMabopaneintheNorthWest Province were visited. The main aim ofvisiting those police stationswas toobservetheirreadinessinimplementingtheDVA. Thefollowingmethodswereusedintheobservationprocess:

(i)Interviews - SAPS members wereinterviewedparticularly Station Commissioners, Officersresponsible fordomestic violence matters andCommanders of the Community ServiceCentres.

(ii) Perusal of SAPS 508, 9 Domestic ViolenceRegisters.

(iii) Inspection of the Trauma Centres whereavailable.

4.3 INFORMATION TECHNOLOGY

Theprimary roleof thesub-directorate is toensurethecomputerisationoftheICDonanationalbasis.All Information Technology (IT) functions arecentralised at the National Office due to lack ofresources. Two members, namely, a DeputyDirectorand a PrincipalNetworkController,staffthecomponent.

The sub-directorate: IT identified the following keyprioritiesforthefinancialyear2000/2001:

· LinkingofremainingprovincialofficestotheWideAreaNetwork(WAN);

· Upgradingofallsoftware;· ExtendingInternetaccesstoallICDoffices;

4.3.1 Mainpriorities

· Increasingthesecurityofthenetwork;· Extendingcomputer training to more

personnel;· Completing the conversion of "old

cases"onthedatabase.

We were fortunate in that despite theproblems of understaffing and lack ofresources we were able to achieve all ourpriorities identified at the beginning of thefinancialyear.

In pursuit of theabove-mentioned prioritiesthefollowingactivitieswereperformed.

All offices o f the ICD are now linkedto thenetworkmostlyvialeased dataline. However,twoof theICD'soff icesuse remote dial-upservices but have access to all of the ICD'snetworkresources. Admittedlythissituationisnot ideal but is necessitated by lack ofresources. Itisourmissiontoupgradethetwoofficesto

datalinesinthenewfinancialyear. Linkageofall officesmadeitpossible to extendInternetaccesstoallofficesofthe ICD. ThesituationatpresentisasshowninTable4.14.

The IT industry changes rapidly. Thesechanges are especially pronounced i n t h erapid wayin which newsoftware enters themarket. Legal Services commenced its duties with apersonnel component consisting of oneDirector, one Legal Administration Officer andoneSeniorClerk.However,on1August2000theLegal AdministrationOfficer leftthis componentto take up office as deputy-director andprovincial head of the ICD’s MpumalangaprovincialofficeinNelspruit.

The for the existence o f t he LegalServices componentfundamentally istoprovidelegalservicesto all componentswithinthe ICD.Thisall-embracingtaskwascompliedwithduringthis reporting year in the form ofrendering numerous legal advices and/oropinions on a rather regular basis to variouscomponentsandcommitteeswithintheICD,inparticularthesub-directorateHumanResourcesManagement.

AstheICDenteredits fourth year ofexistenceitexperienced an unexpected number ofpersonnel-relatedproblems suchasgrievancesand misconduct allegedly committed by itsemployees.LegalServicesnotonly assisted thes u b - d i r e c t o r a t e : H u m a n Resou rcesManagement indealingwith andsolving someof these cases, but alsolodged a concertedeffort with that sub-directorate in makingpersonneloftheICDawareofwhichconductwi llamount tomisconduct, as wellas thepossibleconsequences which may flow fromcommittingmisconduct. As far as grievancesare concerned, Legal Servicessucceeded, byway of mediating and the offering ofappropriate counselling services, to solve all

Apart fromthe above, Legal Servicesalsoregularly provided the Directorate:Monitoring and Development with legalopinionsand/oradvicesregarding aspectsdealt with by thiscomponent. With regardto this component, we had to look and/orsearch for and retrieve (at some stagesquitea largevolume of) information fromtheJutastatand,toa lesserextent,forothercomponents andthe ProvincialOffices oftheICD.

Legal Services alsogavevaluable supportto the Directorate: Finance with theimplementation of the Public FinanceManagement Act, Act No. 1 of 1999(PFMA), as amended, by assisting in theexplanation to staff members o f whatconduct wi l l amount to f inancialmisconductintermsofthesaidAct. I talsosubmitted comments o n the draftRegulations on Payroll Deductions for thePublicService onbehalfoftheICD. Uponpromulgation of these Regulations, itimmediately circulated informationregardingthemeaningand effectoftheseRegulationsamong staffmembers inoneof its monthly Information Bulletins. It isfurthertobementionedthat LegalServicesnot only submittednumerous advicesandopinions tothe ExecutiveDirector, butalsocompiled, o n her behalf, requestedcomments to some important draft Billssuch as the Promotion of Access toInformation Bill, the Promotion o fAdministrative Justice Bill(as it was at thatstage), theDefence Amendment Act(theLegal Administration Officer in factappearedon invitation before the PortfolioCommitteeon Defencetoorallycomment

on and make suggestions regarding this Bill)andtheFireArmsControlBill.

Asfar asthis lastmentioned Bill is concerned,theDirector: LegalServicesaccompaniedtheExecutive Director to appear, on invitation,before the Portfolio Committee o n Safety andSecurity,tomakeoral presentationsregardingthose aspects of the Bill on which theICDhadpreviously submitted written comments andsubmissions.

Finally,Legal Servicessubmittedandpublishedon a monthly basis a contribution to the ICDGazette (the ICD’s internal newspaper) intheform of a series of columns in which theconcept“misconduct”andthevarious ways inwhich it may becommitted were explained.This p rocess will continue throughout the nextreportingyear.Thepurposewiththesecolumnsis to c reate animproved sense of work ethicamong staff members. Legal Services alsopublished on a monthly basis an InformationBulletin, thepurpose ofwhichistobring totheattentionof staffmembersrecentand topicallegal issues affectingtheperformance of theirduties. Some of the issues that were soaddressedincluded explanatory notes o n howsome important current and pendinglegislationmight affect the ICD asemployer,such a s t hePromotionofAccesstoInformationAct,thePromotionofAdministrativeJusticeAct,theProtectiveDisclosuresAct,the EmploymentEquity Act, amendments to the LabourRelations Act and the South African PoliceServiceAmendmentAct.

4.6 FINANCE

Thepast yearwasachallengingyear intermsof theimplementationofthePFMA,its Regulations and in addition, thecompilation of the financial statementsrequiredintermsofthesaidAct.

In termsoftheimplementationofthesaidAct, the ICD could not yet establish anInternalAuditcomponentor makeuseofthe expertise of an established AuditCommittee. The Department obtainedapproval from National Treasury toapproach any other department in theJustice, Crime Prevention and SecurityCluster(JCPS)withtheviewto share suchan Internal Audit component and AuditCommittee. The South African PoliceService, theNationalIntelligenceAgencyas wellastheSouthAfricanSecretServicehas been requested to consider thesharingofsuchserviceswiththeICD.

The sub-directorate: Communication andMarketing Services renders both internal a ndexternal communication services to the ICD.Internal communication includes theorganization of staffmeetings, the p roductionof internal publications and providinginformationofa general naturetoallwithin thedepartment.

Externalcommunicationentailsinteractionwithour stakeholders, providing media liaisonservices, performing the parliamentary liaisonfunction, representing the department onvarious governmental bodies such as theGovernmentCommunication and InformationSystem and maintaining contact withinternational organizations and diplomaticrepresentatives.

The following are some of the activities andachievementsattainedbythesub-directorate:

* T h e Basel ine Survey o n Publ icAwareness: The HSRC was commissionedbythe ICDto conductabaseline surveytodeterminethelevel ofpublicawarenessofthe ICD and its activities. The resultsrevealedthatmuch workneedsto be donebythe ICD to raise the levelof a warenessamongitsstakeholders.

* Public Service announcements: Thep r o d u c t i o n o f p u b l i c s e r v i c e

announcements on audiotapeculminated in ourpresentingthemtothe GCIS forflightingonvariouscommunity and commercialradiofacilities.

* It is during this period that allICD employees w ere connectedtothe Internetwith assistancefromIT.

* With the assistance of theGCIS, meetings have been heldwithNGOsandCBOstoexplain tothese fora the activities of theICD and to find out about theexpectationsofcommunitiesfromthedepartment.

* W e have continuedto useourcampaigns as well as those ofother departments to spread theword about the ICD and itsactivities. These campaignsinclude the “16 Days of N oViolence Against Women” heldduring November December2000.

Theywerefurther meant to ensure that departmentsfollow the correct guidelines in drawing uptheircommunicationstrategies.

GovernmentCommunicators’ Forum:

The Government Communicators’ Forum(GCF) convenes on a regular basis, anddepartments are advised on the seriousnessw i t h w h i c h G o v e r n m e n t t a k e scommunication. One oftheindicatorsisthatHeads of Communication i n GovernmentdepartmentsshouldbeappointedatthelevelofChiefDirector.

Pre-Cabinet Meetings:

Government Communicators meet onceevery two weeks to examine the Cabinetagenda as well as to look into issues whichhavecommunicationimplications.

Duringtheperiodunderreview,wewerevisitedby Professor Richard Terill of Georgia StateUniversity intheUnited States, membersf romAmnesty International, the Finish EmbassydelegationandtheHeadofDelegationoftheInternational Committee of the Red Cross in

The ICD has developed policies within thenational framework i n all the special programmes.SpecialProgrammeshaveaninternal standingcommitteethatregulates,inconsultationwiththeExecutiveDirector,theseprogrammes withinthedepartment.SpecialProgrammeshasaquarterlynewsletter (SP News)inplacethatcoversallmentionedprogrammes.Noticeboards havebeen

TheICDisacutely awareoftheenormityofthe taskimposedon it not onlyby itsoriginalmandatebutalso b y later legislationwhichnow oblige the ICDtoinvestigate complaintsrelating to Municipal PoliceServices and complaintsagainst theSAPSrelatingtotheDVA.

As much as 2000/2001 was a difficult year, it isanticipated thatnextyearwillbeevenmoredifficultifthecurrentresourcesituationremainsunchanged.However we hope and believe that with morepersuasion,thosewhohavethepowers to do s o willfinditprudenttoaugmenttheICDcofferstoenableittocarryoutitsaddedresponsibilitiesefficiently.

Even though the revisitation of ICD investigativepriorities in the past has brought about thedesiredimpact,itwillbenecessarythatmoreemphasisbeplacedon the active i nvestigationofallClass I andmost Class III cases in accordance with themandateofthedepartment. Thiswillrequireaddedresources to enable the department to have thedesired impact both on fulfilling its statutoryobligations and on achieving its service deliveryobjectives.

The ICD’s contribution to the Government’s crimeprevention strategy, however modest, hasconcentrated on somenotable highprofilecases.Thestabilizationofstatistics ofbothClass I and ClassIII cases is an indication of the meaningfulcontribution thattheICDhasmadeto thestrategy,especiallywithintheSAPS.

The need to have a meaningful presence inMpumalanga, the Free State and the NorthernCape hasbecome more imperativein ourquesttomarch with the Government’s desire to improve

service delivery. This service deliveryconcept m ust b e r egarded qualitativelyrather than quantitatively. This meansthat the transformation of policing inSouth Africa must be meant to steerpolicing towards a positive publicperception of the police so thatconfidence in the service can berestored.

The ICD has to b e equipped withbetterdetection techniques to enable it t omatchthe sophistication of the criminalelement. Increased resources andbetter trained staff would provide ananswertothischallenge.

ThetotalBudget allocation fo r theIndependentComplaintsDirectorateforthe2000/2001

financial year amounted to R25 512 000. Globally the Department succeeded in

spending an amountofR25511808.73,leavinganamountofR191,27tobesurrendered

backtoNationalTreasury.

Duetothefactthatrestructuring oftheDepartment was conducted a nd a d ecisionwas

takentodecentralisecertainadministrativeexpenditurecarriedinthepastbyProgramme

1: Administration, it translated into a saving on Programme 1: Administration and an

overspendingonProgramme2:InvestigationofComplaintsandProgramme3:Monitoring

andDevelopment. Thisnowreflectsamoreaccuratecostingofthevariousprogrammes.

Another factor that contributed to the overspending on Programme 2: Investigation of

Complaints,was thehighprofilecasesreceivedduringtheyearunderreview.

TheoverspendingonProgramme3: MonitoringandDevelopmentisduetothe factthat

certain centralised expenditure has been allocated proportionally to the line functions.

Furthermore,this overspendingisanindicationoftheimplementationofastrategicshiftof

theDepartmenttofocusmoreonthemonitoringofcasesbeinginvestigatedbytheSAPS,

sinceweareonlyabletoinvestigatethemostseriousofcases,ourselves.

The main expenditure of the Department remains personnel expenditure and the

administrative expenditure deriving from the travelling of investigators. Furthermore,

GOVNETexpenditurehasalso risen andthiscanbeattributedtothefactthatthePERSAL

and METANET systems have been decentralised and are now operational in the various

provincialoffices.

Duetoalackoffunds,nosignificantfinancialmanagement improvement programme

couldbeembarkedupon. Anawarenesssessionwasconductedateachprovincialoffice

to emphasisetheimpactofthePublicFinanceManagementActandhighlightthecrucial

1.3 ExpenditureThe income statement includes both current and capital expenditure. Unauthorisedexpenditure is not accounted for as expenditure untilsuch expenditure is authorisedbyParliament, recovered from a third party, or funded from the following year’sappropriation.

1.4 AssetsPhysical assets (fixedassets, moveable assets andinventories) are written off in full whenthey are paid for and are accounted for as expenditure in the income statement. Thebalancesheetthereforeexcludesphysicalassetsunlessstatedotherwise.

1.5 ReceivablesandpayablesReceivables and payables are not normally recognised under the cash basis ofaccounting. However, receivables and payables included in the balance sheet arisefromcashpayments,whicharerecoverable,andcashreceiptswhichareduetoeithertheNationalRevenueFundoranotherparty.

Thecomparativefiguresshowninthesefinancialstatementsarelimitedtothefiguresshown in the previous year’s audited financial statements and such othercomparative figures that the department may reasonably have available forreportingintermsofthePublicFinanceManagementAct.

Unauthorised,irregular,andfruitlessandwastefulexpenditureistreatedasacurrentasset in the balance sheet until such expenditure is recovered, authorised byParliament,orsetoffagainstfuturevotedfunds.

No debt has been written off during the year. TheDepartmentis in the process todevelop a new policy in line with the Public Finance Management Act and theTreasuryRegulations,whichwillbeimplementedinthenewfinancialyear.
