Ras-el-Bandar Narrative

There are no fairy stories or rags to riches to herald the existence of the ReB Arabians. It came about simply because of an innate passion for the horse.

An inexplicable event took place 61 years ago (1955) when a truck load of cows was delivered to Bachers Farm and amongst the cows was a pony. A very young Rob Bandini (5 years old) saw this pony coming down the cattle ramp and, considering that, he had never before seen neither a horse nor a movie nor seen anyone ever ride, he knew that this creature was meant to be ridden. He promptly jumped on its back while in the cattle crush and rode it out into the yard, holding onto the pony’s mane.

Fortunately for him the horse had been backed and did not try to unseat him. But when he was taken off Robs’ seat was very much warmer than it had been previously. The pony was promptly sold and the yearning for a horse

began. This yearning was never satisfied, but instead intensified with reading and later by the silver screen.

In 1972 another event took Rob on a farm visit between Hartebeesfontein and Klerksdorp namely the farm of Nanette Ford where he was introduced to the Arabian Horse. This increased the yearning to new heights and eventually 28 years later he was in the position to own and look after his own Arabians. He purchased five mares and one stallion and registered the stud name. The name is that of a town in Iran, which no longer exists. For fifteen years he has been involved with the Arabian Horse and to this day the thrill of seeing and being with this amazing creature has never dulled.

A lifetime’s yearning satisfied at last, culminating in this the very first Premium Genetics Auction.

Rules of Auction Terms and Conditions1. This auction will be held on behalf of Bandini Farms (Pty) Ltd (hereinafter referred to as the “Seller”) by Mike Killassy Auctioneering (hereinafter called the “Auctioneer” at the premises called Redhill Farm district Potchefstroom. The relationship between the Auctioneer and the Seller will be governed by the Mike Killassy Auctioneering Services Terms and Conditions separately signed. 2. The Auctioneer is hereby appointed by the Purchaser and the Seller to act for and on behalf of the Purchaser and the Seller as agent and as facilitator of the auction process.3. Any person attending the auction to enter a bid must, prior to the auction, register as a buyer on the bidders’ roll and comply with the conditions set out in Chapter 1 of FICA 2001. The Purchaser shall sign the roll card.4. Any person who attends the auction to enter a bid on behalf of another person, must be duly authorised thereto by means of a written letter of authority from the principal. Such a person, together with his principal, must both register prior to the auction on the bidders’ roll and provide all necessary information as required in Chapter 1 of the regulation issued in terms of FICA 2001, with regard to proof of identity. The bidders’ roll card must be signed by such a person on behalf of his principal, and by the signature on the letter of authority and the bidders’ roll card both parties become jointly and severally liable for any outstanding dues.5. The auction shall take place at the date and time as advertised or publicised and will not be postponed or delayed to enable any member or group of the public to partake in the auction.6. All persons entering the sales venue do so at their own risk and neither the Auctioneer nor the Seller will be liable for any injuries, damages or losses of any kind whatsoever.7. All purchasers have a right of inspection to all the lots put up for sale and the Seller shall provide reasonable time and access, prior to the start of the auction, for such inspection. The game will be sold off catalogue. 8. The rules of this auction shall comply with the provisions of Section 45 and all relevant regulations pertinent to the Consumer Protection Act 68 of 2008, barring Section 55 and 56 of the Consumer Protection Act.9. All lots are sold voetstoots and the purchasers do not enjoy the protection of Section 55 and 56 of the Consumer Protection Act.10. Any information provided regarding the quality, breeding, age, date of insemination, condition, reproductive status or any information regarding health, production or mass or any other aspect of the livestock or game is provided by the Seller and any misrepresentation by the Seller is without the cooperation of the Auctioneer. Any right of recourse, as a result of such misrepresentation, shall be against the Seller provided that the misrepresentation was made in writing on a brochure, the sales catalogue or publication. Any verbal declaration by an employee, sales marshal, announcer or any other person whatsoever, will have to be substantiated and recorded in writing by someone who is duly authorised to do so, before the Seller can be held responsible for such statements.11. The Seller warrants that he is entitled to sell the lots, and that there is nothing binding, encumbering or legally prohibiting him from disposing of these lots legally.12. Neither the Seller nor the Auctioneer accept any liability for any withdrawal of any lot from the sale for any reason whatsoever.13. The rules of the auction will only be read out at the auction, if they were not made available to the public either by way of catalogues, on the Seller’s website i.e. (www.mozzarella.co.za) or on the published calendar distributed nationally and internationally.14. Should the Auctioneer become aware of any fault on the advertising material or any other publication or amendment to these rules of auction, the Auctioneer will prior to the auction point out and where necessary amend such mistakes.15. The Auctioneer will only be obliged to give reasons for the auction if such reasons are other than the voluntary sale of the lots by the Seller. 16. Until the fall of the hammer, as contemplated in Section 45(3) of the act, any bid may be retracted or declined by the Auctioneer if this is not compliant with the regulations of the Consumer Protection Act.17. The Seller shall comply, in accordance with Section 54 of the value added Tax Act 1991 in respect of all tax invoices, with credit and debit notes in respect of all lots offered at the Auction. 18. Any bid made does not include vat, which, where applicable will be added to the bidding price. A valid tax invoice will be issued accordingly.

Rules of Auction Terms and Conditions19. All sales are for payment which can be effected in one of the three ways: 19.1Payment by EFT: Hammer Price + Vat before collection of lot. 19.2Payment by Cash: Hammer Price + 5% + Vat before collection of lot. 19.3Payment by Credit Arrangement: Hammer Price + 5% + Vat before collection of lot provided that the necessary contract and insurance is in place.20. If a prospective Purchaser wants credit terms this must be arranged prior to the auction, with all the relevant conditions and the appropriate credit institution being contacted and approval obtained, or by special arrangement with the Seller.21. All game lots will be sold for Cash or EFT only.22. Should the Purchaser not pay their purchase price immediately by EFT and should he fail to make arrangement for payment with the Seller, then the Auctioneer can/will cancel the sale and treat the lots as unsold. These lots may be presented again for sale on auction or be sold out of hand by means of liaison, depending on the Seller’s mandate to the Auctioneer.23. In the event that the Purchaser has made the necessary instalment arrangement, a separate agreement with its own terms and conditions will be applied in addition to the auction rules.24. Ownership in the lot will remain that of the Seller, until the purchase price has been paid in full, with the provision that the risk in the lot passes to the Purchaser at the fall of the hammer.25. For as long as any amount is owed to the Seller by the Purchaser, the purchaser may not relinquish possession of the said lot nor may he cede the lot or any of its rights or obligations in terms of this agreement to a third party or otherwise encumber, sell or dispossess the said lot or allow it to become the subject of any right of retention hypothec.26. Each lot shall immediately after the fall of the hammer be deemed to be delivered to the Purchaser, at which time the risk will pass to the Purchaser, who will at his own risk and cost, remove the lots from the auction terrain. Removal of any lots will, however, not be allowed until payment of the purchase price by the Purchaser or acceptable arrangements for payment thereof have been made with the Seller. 27. The game lots will be sold “loaded onto the buyers transport”. The buyer must ensure that adequate insurance is taken out to cover the game from the time that it enters the buyers transport vehicle, whether it be his own vehicle or a hired transport contractor.28. Any party requiring permits, removal certificates, documentation of identification or any other statutory prescribed document, will be responsible for obtaining the requirement in his own capacity. Any instructions to the Seller with regards to the loading, choice of transporter, insurance or choice of insurers, will be executed at the sole risk of the person acquiring such services and neither the Auctioneer nor the Seller will be held responsible for any losses, whether direct or indirect, which may be suffered as a result of giving effect to the instruction by the Auctioneer or the Seller. 29. Under no circumstance will the Auctioneer or the Seller be held liable for any loss or damage of any cause whatsoever, albeit direct or indirect damage, suffered by anyone if the lots at the auction premises have to be placed under quarantine, as a result of a disease. In such an event the Auctioneer will have the right to cancel the auction as well as any already complete sales and no party will be entitled to or have a right of recourse against the other parties and vice versa.30. Both the Seller, the Purchaser and the Auctioneer consent to the jurisdiction of the magistrate court as contemplated in Section 45 of Act 32 of 1994. Notwithstanding t he aforesaid, the Seller will have the sole and absolute discretion to institute action in any High Court with the appropriate jurisdiction. 31. Any legal costs that the Seller may have or will incur as a result of non-compliance of the Purchaser, in terms of the obligations herein, shall be recoverable by the Seller together with the auctioneering commissions, from the Purchaser on a scale as between attorney and own client.32. No variation, amendment, novation or addition to these terms and conditions will have the effect of the Seller renouncing any of his rights in terms hereof, unless it is reduced in writing and signed by the Seller. 33. No relaxation or indulgence by the Auctioneer or the Seller must be interpreted as a waiver of any of the rules of the auction. Such relaxation and indulgence must also not be interpreted as a novation hereof.34. Should any condition be unlawful or become retrospectively unlawful that condition shall be deemed to be amended to the extent and manner as is necessary to make it lawful or should such amendment be impossible, the unlawful condition shall be deemed devisable from the remainder of the conditions and pro non scripto.
