About Th is Audit

In 2013, the State Legislature passed Engrossed Substitute Senate Bill 5946, codifi ed in RCW 28A.232.010, requiring the State Auditor’s Offi ce to conduct fi nancial audits of Alternative Learning Experience (ALE) programs in the state. In the past two years, we have performed enrollment audits of every ALE program in the state that reported more than 10 Average Annual Full Time Equivalent (AAFTE) students. Th is resulted in audits of 99 percent of the students reported for ALE funding in 223 programs provided by 124 school districts. Many school districts operate multiple programs and a mix of program course types (remote, site-based, or online). In our most recent audits of school fi scal year 2014, OSPI identifi ed 307 programs statewide reporting approximately 27,660 students for funding. Programs vary in size from less than one average annual full time equivalent (AAFTE) student to programs with more than 3,300 AAFTE students. (See Appendix A for an alphabetical list of districts and Appendix B for a list of district programs ordered by size.)

Audit Results and Recommendations

Overall, we saw improvements with compliance requirements necessary to claim funding for ALE programs. Th e primary causes of reporting errors have not changed signifi cantly but the number of districts out of compliance has decreased. For fi scal year 2011, we audited 67 districts for compliance and reported issues at 52 of them (78 percent), resulting in possible overpayments of almost $27 million. For the school fi scal years 2013 and 2014 (September 1, 2012 through August 31, 2014), we audited 223 ALE programs off ered in 124 school districts, and identifi ed issues in only 25 percent of them. We found possible overpayments of about $2 million – a reduction in questioned expendures of better than 90 percent.School districts are required by state law to maintain documentation to support the ALE program funding they receive. Th e requirements appear in statute, and in rules developed by the Offi ce of Superintendent of Public Instruction (OSPI), which also provides guidance for following these rules and regulations to districts. When documentation is missing, inadequate or unclear, we question ALE funding for lack of compliance with state requirements. Our audit work concentrated on the areas that support ALE funding at the state level. Th ey are important because they are required to qualify a student for ALE funding. In this report, the issues we found are organized by the number of times they appeared in our audits, from the most to the least frequent. Th e six areas where we most oft en identifi ed problems include:

1. Written Student Learning Plans:

Documentation that sets the expectation for student participation

is also used to allocate funding based on their Full-Time Equivalent

(FTE) hoursEvery ALE student is required to have a written student learning plan that has been approved by an instructor with a Washington state teaching certifi cate. Th is is especially important for ALE programs in which the parent helps design the plan, select the learning materials, and provide the daily instruction. Th e certifi cated instructor’s approval indicates the district has taken responsibility for the learning plan, ensuring that it meets all the ALE requirements, including one or more of the state’s essential academic learning requirements or grade-level expectations, as well as any other academic goals and requirements defi ned by the school district. In our audits, we examined plans for the dates of approval and question ALE funding for months claimed prior to the plan approval date.

• We found 19 programs in which a student was counted for one or more months before the plan was approved by the certifi cated instructor at the school district.

Beginning and ending dates of planWritten student learning plans must state the dates they are in eff ect: students may only be claimed for funding between the beginning and ending dates identifi ed in the plan.

• In 11 programs, we either could not identify the beginning and ending dates for learning plans or students were counted for funding outside the dates in their plans.

FTE funding hoursFunding for ALE students is based on the hours identifi ed in their written student learning plan. In school fi scal year 2014, an ALE student generated $5,297 in basic education allocation funding if they were enrolled for one FTE, for the full ten months of the school year (September through June). Districts may document hours in a learning plan either as a total number of hours for the plan, or by assigning hours for each course in the plan and adding them up to arrive at the plan’s total hours.

• In 18 programs, we found instances in which enrolled hours were not clearly identifi ed or students were claimed for more or fewer hours than identifi ed in their plans.

We recommended: Districts report only those students with a learning plan in place, including beginning and ending dates and estimated hours of learning activity per week, that has been approved by certifi cated instructional staff .

2. Monthly progress evaluations:

An important tool that is not always used with precision to

measure satisfactory or unsastifactory progress in ALETh e progress of students in ALE programs must be evaluated on a monthly basis. Under the current rules, progress for each month (including September) must be conducted by the fi ft h school day of the following month, and each student must be assessed as making either satisfactory or unsatisfactory progress. If progress is unsatisfactory, the certifi cated ALE instructor must devise and implement an intervention plan to help the student get back on track within fi ve additional school days. Our audits verify that evaluations, and intervention plans if required, are conducted on a timely basis. We identifi ed six common errors related to timely progress evaluations that resulted in questioned funding for ALE programs. Th ey are:

• Progress reviews did not clearly identify whether progress was satisfactory or unsatisfactory in 19 programs.

• No evidence that progress reviews were conducted every month a student was enrolled in 15 programs.

• Progress reviews or intervention plans were not conducted timely in seven programs.

• Intervention plans were not completed when required in fi ve programs.• Progress reviews were conducted, but not dated. When evaluations are

not dated, we cannot verify the district met the requirement to have an evaluation in place within fi ve school days of the end of the previous month. If evaluations are not completed within fi ve days, students cannot be counted for funding in the following month. We found this occurred in three programs.

• Progress was not communicated to the student and/or parent as required in three programs.

Progress reviews in programs where a parent of a student is the daily provider of instruction must clearly document and provide evidence that the certifi cated instructor took responsibility for supervising, monitoring, evaluating and documenting the student’s progress as required by statute. Without evidence of the instructor’s review of progress, we cannot assure proper accountability for student progress.

Assessment of students’ monthly progress varies widely

from district to districtSatisfactory progress must be based on the learning goals and performance objectives defi ned in the written student learning plan. How satisfactory progress is measured is defi ned by each school district and the professional judgment of the certifi cated teacher. Some stakeholders argue that it is appropriate to allow districts and individual programs to decide what to measure as evidence of student progress and what is considered acceptable progress, based on the program and the needs of the students within their school. However, this can lead to striking disparity from program to progam in what constitutes satisfactory progress, making it diffi cult to assess compliance with state requirements regarding progress.

OSPI’s Digital Learning Department created the standardized Choice Transfer form for districts to document when they release students for online courses or program enrollment.

• We noted a high degree of variation in how progress is measured between programs. In one program, students were considered successful only if they achieved a grade/score above 80 percent in all of their courses. In another program, students were considered successful if they obtained a passing score in either reading or math.

We recommended: Districts report students for ALE funding only aft er a progress review is conducted and documented by certifi cated instructional staff and, when necessary, an intervention plan has been implemented.

3. Statements of Understanding for ALE students Since 2005, state regulations have required that the parents of a prospective ALE student receive a description of the diff erence between home-based instruction (also called homeschooling) and ALE. Th e parents must sign a document – the Statement of Understanding, also called the Attestation Letter – confi rming that they understand the diff erence between ALE and homeschooling. In 2012, state regulations changed requiring the statement to be signed and dated by the parent within three days of their request for ALE enrollment, but the school may enroll the student conditionally for 30 calendar days. Th e district must dis-enroll the student from the ALE program if it has not received the statement before the end of the conditional enrollment period. Th is requirement applies to all ALE programs: online, remote and site-based.

• We found that 16 programs either were missing the form or counted a student for funding before receiving the form.

We recommended: Districts should obtain signed acknowledgements that parents understand the diff erence between ALE and home-based instruction (home schooling).

4. Student Releases From Resident DistrictAlmost half of the 27,660 students enrolled in ALE courses statewide are enrolled in courses that are delivered by a school outside the district they live in. Forty-eight programs reported more than half their ALE enrollment were nonresident students, and 23 of these programs reported that nonresident students made up more than 90 percent of their enrollment. (See Appendix C for a list of the nonresident programs by percentage of enrollment, and Appendix D for a list of the districts by ALE students as a percent of the district’s basic enrollment.)When students live in one district and attend school in another, either part-time or full-time, the resident and nonresident districts must coordinate how they report FTE to ensure that no student is counted for more than one FTE in the aggregate. As of March 31, 2014, OSPI required districts to use its Standard Choice Transfer System (SCTS) to record all students who are “choicing out” of their resident district to a nonresident district for the purpose of enrolling in an online school program. Districts must use the SCTS for transferring students into online school enrollment, but the system is also able to process requests for other nonresident enrollments and interdistrict agreements.

• We identifi ed eight programs that were missing a release form or counted a student as enrolled before the student was released by the resident school district.

Earlier problems with release forms in interdistrict cooperatives

have been correctedOur ALE audits of school fi scal year 2011 resulted in fi ndings at several ALE interdistrict cooperatives that did not follow the rules about student release forms. Audits conducted for the period September 1, 2012, through August 31, 2014 found this issue has been corrected: release forms in the cooperative districts clearly present releases from the resident districts to the serving districts. We recommended: Districts report nonresident students only aft er receiving release forms from the resident district.

5. Evidence of contact between student and certifi cated

instructor must be timely and substantiatedWe examined the documentation school districts retained to substantiate two-way contact between the certifi cated instructor and student. Students are required to participate in at least one course within the fi rst four days of September and must have two-way contact within 20 school days prior to count date for the months of October through June. If students have regularly scheduled onsite or online classes, contact may be established through attendance records or logs when the student participates in synchronous digital instruction. Electronic contact may be supported by the actual two-way email or notes of telephone or Skype discussions.

• We found 12 districts did not adequately document two-way contact within the fi rst four days of September or within 20 school days prior to one of the other monthly count dates.

We recommended: Districts report only students they can document have had student-instructor contact with certifi cated instructional staff within the fi rst four days of September and within 20 days prior to count dates for the months of October through June.

6. Requirements to be claimed for ALE funding

Course of study must lead to a high school diplomaHigh-school level ALE courses must satisfy OSPI’s requirements for courses of study and equivalencies as provided in Washington Administrative Code (WAC): they must be off ered for high school credit, lead to a high school diploma, and satisfy the State Board Of Education’s high school credit and graduation requirements.

• We found one program did not provide courses leading to a high school diploma.

Documentation to support ALE compliance requirementsALE students must have a written student learning plan in place containing all elements defi ned in statute to support the individualized learning as well as documentation to support weekly contact and monthly progress evaluations.

• We found one program failed to meet any of the documentation criteria necessary to report students for ALE enrollment funding.

We recommended: Districts report for ALE funding only those programs that maintain documentation required by state regulation and off er a course of study leading to a high school diploma.

ALE Substantially Similar Expenditure Analysis In 2012, the Legislature amended regulations regarding “substantially similar experiences and services” and redefi ned them to mean that

…”for each purchased or contracted instructional or cocurricular course, lesson, trip or other experience, service or activity identifi ed on an alternative learning experience written student learning plan, there is an identical or similar experience, service or activity made available to students enrolled in the district’s regular instructional program.”

Districts are required to report details of their substantially similar experience to OSPI on an annual basis, and include the number of students served and the cost of instruction, including fees paid to non-certifi cated community-based instructors. For the school fi scal year 2014, we did not audit substantially similar expenditures at school districts, but we did analyze costs charged to this area over the last three years. On a statewide basis, substantially similar expenditures decreased by almost 65 percent between the 2011-12 fi scal year and 2013-14, as shown in Exhibit 1.

What has prompted the reduction in “substantially similar”

reporting?Several districts that reported high spending in the fi rst year of required reporting did not report any spending in school fi scal year 2014. Some school districts have moved towards hiring community-based instructors as school district employees. ALE rules do not require districts to report expenditures made to district employees who provide services to ALE programs. Nor must districts report whether the services or experiences provided by these employees are also made available to students enrolled in the district’s regular instructional program.We performed a limited review at two districts that are still reporting signifi cant spending in this area and found both districts have established processes to monitor community-based instructors and to obtain input regarding student participation and progress on a periodic basis.

Next steps: Planned fi scal year 2015 ALE auditsOSPI has provided information about ALE enrollment reported for the 2014-2015 school year: it identifi es 327 programs with approximately 26,750 AAFTE in 158 districts. Based on data provided by OSPI, and ALE audit results from the prior two years, we expect to perform onsite audits of 41 programs and desk audits of 48 programs for fi scal year 2015. We will conduct onsite audits of smaller programs with identifi ed risk that were previously desk audits, and a selection of programs with annual average enrollment greater than 100. We will continue to limit our selections to those programs with at least 10 AAFTE, which will provide coverage of 99 percent of all ALE programs reported for funding. We also plan to collect information on programs that allow the use of “educational expense funds.” Th ese funds are allocated by the school district to individual students enrolled in their ALE programs. Th e school district allows parents to direct district spending through the selection of either learning materials or activities.
