13 Amendment of Sarasota County Ordinance No 89-35 is necessary to correct the scriveners error and to achieve consistency with Apoxsee the Revised and Updated Sarasota County Comprehensive Plan

14 Figure 1 of Ordinance No 89-35 is hereby amended such that the area illustrated in Figure A attached hereto is designated Veri Low Density Residential (less than 1 o DUAC)

1 5 The Board has received and considered the report of the Sarasota County Planning Commission concerning Ordinance No 90-4~ correcting the scriveners error

16 The Board has held a public hearing on Ordinance No 90-45 and has considered the information and testimony received at said public hearing

17 The Board sitting as the Sarasota County Land Development Regulation Commission has reviewed Ordinance No 90-45 and has found that it is consistent with the Sarasota County Comprehensiv~ Plan

18 In all other respects Ordinance No 89-35 remains unchanged

Section 2 Effective Date This Ordinance shall take effect immediately upon receipt of official acknowledgment from the Department of the State of Florida that this Ordinance has been filed with said Department

1 The Sarasota County Board of county Commissioners ac~ing as agent has filed an application for approval of an implementation and regulation program for the I-7 5 Corridor Plan for the hereinafter described area in Sarasota county pursuant to the Sarasota County Cornprehensive Plan and the Sector Planning Guidelines adopted by Ordinance 84-57 as amended

The area extending outward 2640 plusmn from both sides of the I-75 right-of-way from the ManateeSarasota County line to the city limits of the City of North Port

2 The criteria and boundaries for preparation of the I~75 Corridor Study were duly reviewed and approved pursuant to said Sector Plan Guidelines

3 bull The Sarasota County I-7 5 Corridor Plan as prepared was duly reviewed by the Development Review Committee and a recommendation was made thereon by the Planning Department to the Sarasota County Planning Commission and the Sarasota county Interstate Planning Advisory Committee (IPAC) which is an advisory committee to the Board of County Commissioners concerned with making recommendations on land use adjacent to Interstate 75 in Sarasota County

6 The Board of County Commissioners after due public notice held public hearings to consider said Sarasotci County_ I-7 5 Corridor Plan (Sector Plan No 86-1-SP) the r~commendations of the Intetstate Planning Advisory Committee (IPAC) the County Planning Commission and all matters relevant to said application including the testimony of the general public

7 On March 13 1989 the Board of County Commissioners (the BOARD) adopted the future land use designations of the proposed Sarasota County I-75 Corridor Plan (Sector Plan No 86-1-SP) as ilmended by the Board as part of the Sarasota County Comprehensive Plan The I-75 Corridor study Future Land Use Plan Map as amended by the Board attached hereto as Figure 1 and incorporated herein by reference is compatible with and furthers the goals objectives policies land uses densities and intensities in said Comprehensive Plan

8 The Board of County Commissioners sitting as the Sarasota County Land Development Regulation Commission has reviewed the proposed ordinance and has found that -it is consistent with - the Sarasota County Comprehensive Plan middot

Section 2 Adoption of the Implementation and Regulation Framework of the I-75 Corridor Plan

1 A true copy of the document entitled Sarasota County I-75 Corridor Plan and Appendices as amended by the Board of County Commissioners shall be maintained by the Sarasota County Planning Department

2 Pursuant to the Sarasota County Comprehensive Plan and the provisions of the regulations adopted by Sarasota County Ordinance No 84-57 as amended and based on the evidence and testimony and the foregoing findings the Board of county Commissioners hereby adopts the I-75 Corridor Study Future Land Use Plan Map as amended by the Board attached hereto as Figure 1 and incorporated herein by reference

3 Future development orders for Developments of Regional Impact rezonings site and development plans preliminary subdivision plans and final subdivision plans and approvals of critical area study plans shall be consistent with the I-75 Corridor Study Future Land qse Plan Eap adopted herein and the provisions contained in Exhibit A ottached hereto and incorporated herein by reference

4 The Board of County Commissioners hereby approves Chapter 7 Implementation Framework of the I-75 corridor study as amended by the Board of County Commissioners attached hereto as Exhibits B and C and incorporated herein by reference

Section 3 Relationship to Other Reaulations and Applicabilitv

l The above-referenced I-75 Corridor Plan does not in itself grant development approval nor guarantee such approval nor does it modify the requirements of the Comprehensive Plan or exempt any person or development activity from the requirements thereof

CONDITIONS OF DEVELOPMEHT APPROVAL FOR I-75 CORRIDOR PLAN (HO middot 86-1-SP)

1 - Until applicable Level of Service (LOS) s ~andards become effective as a result of the ~poxsee update andor the Land Development Regulations (LDR) all future development within the I-75 Corridor shall demonstrate prior to rezoning approval capacity and availability of essential urban services including roadways central water and sewer police fire and emergency medical services Documents from the appropriate service providers andor County- Departments shall be submitted to the Planning Department as part of the rezoriing application

2 All future development requiring rezoning shall connect to a County approved utility providing central water and wastewater treatment service to the I~75 Corridor Temporary on-site water and sewage treatment systems may be allowed consistent with Chapter 381272 Florida Statutes until central facilities become available Such temporary systems if authorized by the Board of County Commissioners must be approved by the County Pollution Control Division and the County Health Department These systems may be developed and utilized only on a scale and to the extent necessary to serve actual development up to the time that the central utility service becomes available Temporary systems shall connect to central facilities when they become available

3 Actual residential densities for those areas designated for residential use on the I-7 5 Corridor Future Land Use Plan Map (Figure 1) and designated in Urban or Urban Enclave Areas on the Aooxsee Future Land Use Plan Map shall be determined through the application of the Apoxsee Urban Area Residential Checklist and Density Matrix as a guide at the time of rezoning All future moderate-density development as shown on Figure 1 shall be allowed a density of at least 46 DUacre consistent with the Environmenshytal Plan Element of the Aooxsee update Residential densities for those areas designated within either Semi-Rural or Rural Areas on the Aooxsee Future Land Use Plan Map shall not exceed one unit per two acres or one unit per five acres respectively

4 A new Critical Area Plan or an amendment to an adopted Sector Plan shall be required prior to or concurrent with rezoning for each of the designated Commercial Highway Interchange (CHI) Areas (ie Clark Road and River RoadI-75 interchange areas) Major Employment Centers (MEC) (ie expansion areas for the Frmicroitville Industrial Area the northeast quadrant of the Bee Ridge RoadI-75 interchange area and northeast quadrant of the Jacaranda BoulevardI-75 inte~change area) and Hajor Employment Center Interstate Regional Office Park (MECIROP) areas (j_e southwest and southeast quadrants of the University ParkwayI-75 interchange area orthwest quadrant of the Fruitville RoadI-75 _intercha~ge area and the southeast quadrant of the Jacaranda BoulevardI-75 interchange area) This shall also include a redevelop~ent plan for the Palmer Boulevard area west of I-75 The key i~3ues for each area as presented in this ordinance (Exhibit B) shall be addressed and i mpacts mitigated through the Critical Area Planning Stndv T)--- - middot-- - -~-- - )~- ron-no-t-cmiddot ~hi-h t rp re au iren ~ -0

indicated in the Environmental systems section Chapter 6 of the I-7 5 Corridor Study The widths of these buffe~ _ areas may be variable as established through middot detailed basin-wide or local drainage studies which address a variety of localized f~c~ors including native habitat protection future land use compat1b1l1 ty water quality considerations flood potentials and existing flood regulations However i~ li~~ of such ~tudies ~uffer ~reas a~ong watercourses which have s1gn1f1cant environmental or native habitat values associated with them (refer to Chapter 6 of the I-75 corridor Plan) as determined by the County Natural Resources Transportation and Planning Departments shall be a minimum of 200 feet in width measured from the top of the bank of the watercourse Watercourses which are primarily man-made or have no or few significant environmental features associated with them (eg mesic hammocks) shall have a minimum buffer of 30 feet in width measured from the top of the bank unless otherwise established through a basimdde or local drainage study If mesic hammocks have become established along a man-made ditch the buffer shall be 30 feet in width measured from the top of the bank or shall extend to the upland edge middotof the hammock whichever is farther Modifications of these buffer requirements may bemiddot approved by the appropriate departments (Natural Resources Transportation and Planning) in considering native habitat protection future land use compatibility water quality protection flood potentials and existing flood regulations Applications for development approvals shall depict the buffer area including widths and any proposed limited areas of passive recreation landscaping stormwater retentiondetention fences andor other man-made barriers on all appropriate preliminary plans and site and development plans middot subject to review and approval by the County Transportation Planning and Natural Resources Departments

6 As part of the special conservation management area for the Myakka River the mesic hammock habitat between River Road and the Myakka River shall be preserved and the slough-type system located on both sides of River Road shall be conserved (see Figure 20 Chapter 2 of the I-75 Corridor study) The CHI designation in proximity to the River RoadI-75 interchange shall be allowed to proceed consistent with Condition No 4 above

7 Proper and effective measures shall be taken to ensure protection of endangered threatened and rare wildlife and plants identified prior to future development Such measures including__ possible integration of critical habitat into open space areas shall be reviewed and approved by the County Natural Resources Department in consultation with the Florida Game and Fresh Water Fish Commission (FGFWFC) at the preliminary or site and developmentplan stage

8 Proper and effective measures shall be taken to ensure protection or preservation of historical and archaeological esour~es identified prior to future development Such measures including possible removal for study purposes or integration into open space are~s shlt1ll be reviewed and approved by the County Depar~rnent of Historical Resources in consultation with the County Planni~g De~artment at ~he preliminary plan or site and development plan_s~age if not earlier resolved through Critical Area Planning Studies Developments of Reg~onal Impact or rezonings

(m) a positive image for I-75 through the establishment of quality development within a part-like setting

To ensure successful implementction of this Plan further strategies for publicprivate sector cooperation and intergovernmental coordination a-e essential The following subsections present the principal implementation framework vital to the fo~ndation of the I-75 Corridor Plan

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

c Areawide ORI Process

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

e Targetino Studies for IROPs and MECs

2 All future development requiring rezoning shall connect to a County approved utility providing central water and wastewater treatment service to the I~75 Corridor Temporary on-site water and sewage treatment systems may be allowed consistent with Chapter 381272 Florida Statutes until central facilities become available Such temporary systems if authorized by the Board of County Commissioners must be approved by the County Pollution Control Division and the County Health Department These systems may be developed and utilized only on a scale and to the extent necessary to serve actual development up to the time that the central utility service becomes available Temporary systems shall connect to central facilities when they become available

3 Actual residential densities for those areas designated for residential use on the I-7 5 Corridor Future Land Use Plan Map (Figure 1) and designated in Urban or Urban Enclave Areas on the Aooxsee Future Land Use Plan Map shall be determined through the application of the Apoxsee Urban Area Residential Checklist and Density Matrix as a guide at the time of rezoning All future moderate-density development as shown on Figure 1 shall be allowed a density of at least 46 DUacre consistent with the Environmenshytal Plan Element of the Aooxsee update Residential densities for those areas designated within either Semi-Rural or Rural Areas on the Aooxsee Future Land Use Plan Map shall not exceed one unit per two acres or one unit per five acres respectively

7 Proper and effective measures shall be taken to ensure protection of endangered threatened and rare wildlife and plants identified prior to future development Such measures including__ possible integration of critical habitat into open space areas shall be reviewed and approved by the County Natural Resources Department in consultation with the Florida Game and Fresh Water Fish Commission (FGFWFC) at the preliminary or site and developmentplan stage

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

CONDITIONS OF DEVELOPMEHT APPROVAL FOR I-75 CORRIDOR PLAN (HO middot 86-1-SP)

1 - Until applicable Level of Service (LOS) s ~andards become effective as a result of the ~poxsee update andor the Land Development Regulations (LDR) all future development within the I-75 Corridor shall demonstrate prior to rezoning approval capacity and availability of essential urban services including roadways central water and sewer police fire and emergency medical services Documents from the appropriate service providers andor County- Departments shall be submitted to the Planning Department as part of the rezoriing application

2 All future development requiring rezoning shall connect to a County approved utility providing central water and wastewater treatment service to the I~75 Corridor Temporary on-site water and sewage treatment systems may be allowed consistent with Chapter 381272 Florida Statutes until central facilities become available Such temporary systems if authorized by the Board of County Commissioners must be approved by the County Pollution Control Division and the County Health Department These systems may be developed and utilized only on a scale and to the extent necessary to serve actual development up to the time that the central utility service becomes available Temporary systems shall connect to central facilities when they become available

3 Actual residential densities for those areas designated for residential use on the I-7 5 Corridor Future Land Use Plan Map (Figure 1) and designated in Urban or Urban Enclave Areas on the Aooxsee Future Land Use Plan Map shall be determined through the application of the Apoxsee Urban Area Residential Checklist and Density Matrix as a guide at the time of rezoning All future moderate-density development as shown on Figure 1 shall be allowed a density of at least 46 DUacre consistent with the Environmenshytal Plan Element of the Aooxsee update Residential densities for those areas designated within either Semi-Rural or Rural Areas on the Aooxsee Future Land Use Plan Map shall not exceed one unit per two acres or one unit per five acres respectively

indicated in the Environmental systems section Chapter 6 of the I-7 5 Corridor Study The widths of these buffe~ _ areas may be variable as established through middot detailed basin-wide or local drainage studies which address a variety of localized f~c~ors including native habitat protection future land use compat1b1l1 ty water quality considerations flood potentials and existing flood regulations However i~ li~~ of such ~tudies ~uffer ~reas a~ong watercourses which have s1gn1f1cant environmental or native habitat values associated with them (refer to Chapter 6 of the I-75 corridor Plan) as determined by the County Natural Resources Transportation and Planning Departments shall be a minimum of 200 feet in width measured from the top of the bank of the watercourse Watercourses which are primarily man-made or have no or few significant environmental features associated with them (eg mesic hammocks) shall have a minimum buffer of 30 feet in width measured from the top of the bank unless otherwise established through a basimdde or local drainage study If mesic hammocks have become established along a man-made ditch the buffer shall be 30 feet in width measured from the top of the bank or shall extend to the upland edge middotof the hammock whichever is farther Modifications of these buffer requirements may bemiddot approved by the appropriate departments (Natural Resources Transportation and Planning) in considering native habitat protection future land use compatibility water quality protection flood potentials and existing flood regulations Applications for development approvals shall depict the buffer area including widths and any proposed limited areas of passive recreation landscaping stormwater retentiondetention fences andor other man-made barriers on all appropriate preliminary plans and site and development plans middot subject to review and approval by the County Transportation Planning and Natural Resources Departments

6 As part of the special conservation management area for the Myakka River the mesic hammock habitat between River Road and the Myakka River shall be preserved and the slough-type system located on both sides of River Road shall be conserved (see Figure 20 Chapter 2 of the I-75 Corridor study) The CHI designation in proximity to the River RoadI-75 interchange shall be allowed to proceed consistent with Condition No 4 above

7 Proper and effective measures shall be taken to ensure protection of endangered threatened and rare wildlife and plants identified prior to future development Such measures including__ possible integration of critical habitat into open space areas shall be reviewed and approved by the County Natural Resources Department in consultation with the Florida Game and Fresh Water Fish Commission (FGFWFC) at the preliminary or site and developmentplan stage

8 Proper and effective measures shall be taken to ensure protection or preservation of historical and archaeological esour~es identified prior to future development Such measures including possible removal for study purposes or integration into open space are~s shlt1ll be reviewed and approved by the County Depar~rnent of Historical Resources in consultation with the County Planni~g De~artment at ~he preliminary plan or site and development plan_s~age if not earlier resolved through Critical Area Planning Studies Developments of Reg~onal Impact or rezonings

In recognition of I-75 as an area of critical concern all critical Area Plans 11 within the I-75 Critical Area of Concern shall be consistent with the following where applicable

(b) protection of the environment natural and historical resources of the I-75 Corridor

(c) protection of watersheds used as public potable water supplies

( d) the values and functions of floodplains and the protection of lives and property from potenti~l flood damage

(m) a positive image for I-75 through the establishment of quality development within a part-like setting

Where the DRI process takes the place of a Critical Area Plan the DRI Development Order shall address these same issues

To ensure successful implementction of this Plan further strategies for publicprivate sector cooperation and intergovernmental coordination a-e essential The following subsections present the principal implementation framework vital to the fo~ndation of the I-75 Corridor Plan

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

c Areawide ORI Process

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

e Targetino Studies for IROPs and MECs

6 The Board of County Commissioners after due public notice held public hearings to consider said Sarasotci County_ I-7 5 Corridor Plan (Sector Plan No 86-1-SP) the r~commendations of the Intetstate Planning Advisory Committee (IPAC) the County Planning Commission and all matters relevant to said application including the testimony of the general public

7 On March 13 1989 the Board of County Commissioners (the BOARD) adopted the future land use designations of the proposed Sarasota County I-75 Corridor Plan (Sector Plan No 86-1-SP) as ilmended by the Board as part of the Sarasota County Comprehensive Plan The I-75 Corridor study Future Land Use Plan Map as amended by the Board attached hereto as Figure 1 and incorporated herein by reference is compatible with and furthers the goals objectives policies land uses densities and intensities in said Comprehensive Plan

8 The Board of County Commissioners sitting as the Sarasota County Land Development Regulation Commission has reviewed the proposed ordinance and has found that -it is consistent with - the Sarasota County Comprehensive Plan middot

3 Future development orders for Developments of Regional Impact rezonings site and development plans preliminary subdivision plans and final subdivision plans and approvals of critical area study plans shall be consistent with the I-75 Corridor Study Future Land qse Plan Eap adopted herein and the provisions contained in Exhibit A ottached hereto and incorporated herein by reference

CONDITIONS OF DEVELOPMEHT APPROVAL FOR I-75 CORRIDOR PLAN (HO middot 86-1-SP)

1 - Until applicable Level of Service (LOS) s ~andards become effective as a result of the ~poxsee update andor the Land Development Regulations (LDR) all future development within the I-75 Corridor shall demonstrate prior to rezoning approval capacity and availability of essential urban services including roadways central water and sewer police fire and emergency medical services Documents from the appropriate service providers andor County- Departments shall be submitted to the Planning Department as part of the rezoriing application

2 All future development requiring rezoning shall connect to a County approved utility providing central water and wastewater treatment service to the I~75 Corridor Temporary on-site water and sewage treatment systems may be allowed consistent with Chapter 381272 Florida Statutes until central facilities become available Such temporary systems if authorized by the Board of County Commissioners must be approved by the County Pollution Control Division and the County Health Department These systems may be developed and utilized only on a scale and to the extent necessary to serve actual development up to the time that the central utility service becomes available Temporary systems shall connect to central facilities when they become available

3 Actual residential densities for those areas designated for residential use on the I-7 5 Corridor Future Land Use Plan Map (Figure 1) and designated in Urban or Urban Enclave Areas on the Aooxsee Future Land Use Plan Map shall be determined through the application of the Apoxsee Urban Area Residential Checklist and Density Matrix as a guide at the time of rezoning All future moderate-density development as shown on Figure 1 shall be allowed a density of at least 46 DUacre consistent with the Environmenshytal Plan Element of the Aooxsee update Residential densities for those areas designated within either Semi-Rural or Rural Areas on the Aooxsee Future Land Use Plan Map shall not exceed one unit per two acres or one unit per five acres respectively

7 Proper and effective measures shall be taken to ensure protection of endangered threatened and rare wildlife and plants identified prior to future development Such measures including__ possible integration of critical habitat into open space areas shall be reviewed and approved by the County Natural Resources Department in consultation with the Florida Game and Fresh Water Fish Commission (FGFWFC) at the preliminary or site and developmentplan stage

(m) a positive image for I-75 through the establishment of quality development within a part-like setting

Where the DRI process takes the place of a Critical Area Plan the DRI Development Order shall address these same issues

To ensure successful implementction of this Plan further strategies for publicprivate sector cooperation and intergovernmental coordination a-e essential The following subsections present the principal implementation framework vital to the fo~ndation of the I-75 Corridor Plan

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

c Areawide ORI Process

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

e Targetino Studies for IROPs and MECs

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

d Interstate Regional Office Park Zoning District

1 - Until applicable Level of Service (LOS) s ~andards become effective as a result of the ~poxsee update andor the Land Development Regulations (LDR) all future development within the I-75 Corridor shall demonstrate prior to rezoning approval capacity and availability of essential urban services including roadways central water and sewer police fire and emergency medical services Documents from the appropriate service providers andor County- Departments shall be submitted to the Planning Department as part of the rezoriing application

2 All future development requiring rezoning shall connect to a County approved utility providing central water and wastewater treatment service to the I~75 Corridor Temporary on-site water and sewage treatment systems may be allowed consistent with Chapter 381272 Florida Statutes until central facilities become available Such temporary systems if authorized by the Board of County Commissioners must be approved by the County Pollution Control Division and the County Health Department These systems may be developed and utilized only on a scale and to the extent necessary to serve actual development up to the time that the central utility service becomes available Temporary systems shall connect to central facilities when they become available

To ensure successful implementction of this Plan further strategies for publicprivate sector cooperation and intergovernmental coordination a-e essential The following subsections present the principal implementation framework vital to the fo~ndation of the I-75 Corridor Plan

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

e Targetino Studies for IROPs and MECs

To ensure successful implementction of this Plan further strategies for publicprivate sector cooperation and intergovernmental coordination a-e essential The following subsections present the principal implementation framework vital to the fo~ndation of the I-75 Corridor Plan

1 REGULATORY CONTROLS

To successfully implement the I-75 Corridor Plan _certain regulatory controls middotmust be developed This would involve modifications to existing regulations and creation of new approaches to regulatory control More specifically amendments to adopted Sector Plans within the I-75 Corridor for CHI and industrial areas are necessary Otherpossible regulatory approaches include creation of an IROP Zoning District an overlay zoning district formiddot the entire I-75 Corridor or special regulations and a reauirement for areawide ORI s for each Planning Segment - However to ensure better success in implementation of certain regulations on an areawide basis these investigations shall be a cooperative approach by the publ~c and private sectors of the community

With this perspective the County Planning Department shall develop appropriate urban design measures and regulatory controls for the I-75 Corridor These investigations by the Planning Department shall be coordinated through ccnsul tat-ion with the Street Tree Advisory Council FDCT community or civic groups property owners within the I-75 Corridor the County Forestry Division the County Transportation Department the County Utilities Department and -the Planning Departments of the Ci ties of Venice North Port and Sarasota and Manatee County

a Consistency with Existing Requlations

A number of Sector Plan Resolutions adopted for Commercial Highway Interchanges (CHI) and an industrial area need to be amended to allow full implementation of the I-75 Corridor Plan This includes Resolution Nos 88-375 and 88-414 to allow expansion of MEC uses within the Fruitville Industrial Area and Resolution Nos 85-373 and 87-613 to allow MECIROPs within the southeastern quadrant of the Jacaranda BoulevardI-75 interchange area and northwestern quadrant of the Fruitville RoadI-75 interchange area respectively These amendments shall occur after the adopt~on of the I-75 Corridor Plan to clarify the intent middotand improve the effectiveness of the adopted plan

c Areawide ORI Process

To complement the coordinated planning for the I-7 5 Corridor options shall be considered to coordinate the impact assessment and development approval process Since the I-75 Corridor was divided into planning segments based on similar characteristics such as physical features and development patterns future development could bemiddot assess~d within these sub-areas An option which is available would be the areawide DRI process provided for in Chapter 38006 FS Under this program either a public or privately initiated areawide ORI could be processed for each of the planning segments to ensure development approvals are coordinated and impacts are uniformly assessed and mitigated on an areawide basis In conjunction with Sarasota Countys limited ORI Certification Demonstration Program this areawide approach could be further refined to address the unique characteristics and needs of the I-75 Corridor

d Interstate Regional Office Park Zoning District

To implement the potential IROP component within the MECIROP areas designated by the I-75 Corridor Plan it shall be necessary to create an Interstate Regional Office Park (IROP) Zoning District to be applied to MECIROP designations through the Critical Area Plan process Development of this ordinance would be a continuation of the wor~ already completed on an IROP zoning district through a contract with Frelich and Leitner in 1987 (see Chapter 1 Background of the I-75 Corridor Study) The draft ordinance prepared was patterned after the County PCD Ordinance but geared specifically to regional office pars This ordinance shall be reviewed and may have to be modified to account for new requirements resulting from the Apoxsee update the I-75 Corridor Plan and the PHH Fantus study

General design guidelines shall be considered to ensure a compatible mix of architectural design criteria and building designs which may include the submission of architectural renderings for review and approval by the County The inclusion of specific urban design requirements in an IROP Zoning District or at other phases of planning or development approval shall be addressed as part of an overall urban design program for the I-75 Corridor_

e Targetino Studies for IROPs and MECs
