Details of the Investigation:

1. On 02/13/2017 while patrolling Interstate 75 I observed a silver Chevrolet Cruze FL tag

#EFBD31 traveliug westbound on I75. As the vehicle drove past me I noticed the windows

appeared to be illegally tinted.

2. I conducted a traffic stop on the vehicle at the 98 mile marker on I 75 westbound.

3. As I approached the passenger side of the vehicle I could smell an overwhelming odor of

cologne or air freshener coming from the open front passenger side window.

4. I made contact with the driver who was the single occupant of the vehicle (Jose E. Mejia

Reigada 09/16/1999) and told him the reason for the stop. I asked him what percentage were

the window tints and he stated he recently had the windows tinted and he asked for the

darkest legal limit when he had them installed.

5. I asked for his driver's license and proof of insurance. While he was gathering the

information I requested I continued to smell the strong odor of cologne coming from within his car but I could also smell a faint odor of marijuana as the wind blew through his

vehicle. He handed me the information I requested and I returned to my patrol car.

6. I verified his information through FCIC/NCIC then returned to his car to measure his window tints which resulted in a reading of 16% on the front passengers side window which is under the legal limit of 28% or higher. I also noticed that the tint strip on the front windshield was below the AS1 line limit.

7. I then retrieved my warning citation book and asked Jose to exit his vehicle and meet me by my patrol car.

8 . I began issuing him a warning while Cpl. Meyer #2578 .began speaking with him. (See Cpl. Meyer's supplemental report).

9. Cpl. Meyer asked Jose when the last time he had smoked marijuana. Jose indicated that he had smoked recently and that he had a marijuana cigarette inside the glove compartment of the vehicle. He also asked if we would let him keep it so he could smoke it later. I told him that I suspected there was marijuana inside the vehicle because it smelled like he sprayed something to hide the smell of marijuana but that it was still faint. He admitted that he did spray the cologne before I pulled him over.

10. Based on the plain smell of marijuana coming from within his car and his admission that there was more marijuana inside the car Cpl. Meyer began searching the car while I finished writing the warning.

11. As Cpl. Meyer began walking towards Jose's car, Jose began following him until Cpl. Meyer asked him to stand by my patrol car.

12. Cpl. Meyer opened the trunk of the vehicle and noticed a single red and black gym bag in the trunk, inside the bag we located two clear heat sealed bags containing a green leafy substance that based on our knowledge, training and experience we identifi~d as marijuana.

13. I placed handcuffs on Jose, checked for fit and double locked them an~ he was placed in my patrol car.

14. I finished searching the car and located a marijuana cigarette inside the glove compartment exactly where Jose stated it was. I also noticed there were two bottles of cologne inside.

16. I then read him his Miranda warnings but he decided to not speak without his attorney.

17. His vehicle was towed by Dave's Towing and he was transported to the Naples Jail Center where he was released to the detention deputies.

18. The marijuana was field tested using a marijuana test kit which resulted in a positive reading for the presence of THC. It was weighed and resulted in a total package weight of 954 . 16 TPW for ~oth the cigarette and the two large packages of marijuana.

19. The marijuana and the packaging material were placed into evidence and the plastic bags were submitted for latent prints.
