What is a Conservation Easement?

Conservation easements are restrictions that landowners voluntarily place on their property that legally bind the actions of present and future owners of the property. Property ownership includes certain priviledges that allow a landowner to exercise certain property rights (for example, continued farming, subdivide a property.) A conservation easement restricts the landowner’s ability to exercise some of these rights. The rights given

up and those retained by the owner are set forth in a legal document (the conservation easement) which is then transferred to a qualified organization, such as a land trust or CEDARENA.

Why do we need a conservation easement in the three fincas?

To conserve a vital link in the biological network of the San Luis valley essential for the movement ofspecies.

To provide security for families living and working in the three properties.

The conservation easement for the three fincas are unique for its agricultural easements.

How is a conservation easement acquired?

A tour of the property.

A baseline inventory of landuse, existing structures, natural features, plants and animals.

A real estate appraisal.

A title report.

Mineral and hazardous waste reports.

Discussion of the easement’s terms between the land owner and the land trust.

Recording the completed easement with the proper agencies.

To inventory current conditions of the area through the use of existing maps, aerial photographs, field work, photography, planos, etc.Para producir un mapa de las presentes condiciones de parte de la zona a través del uso de los mapas existentes, fotografías aéreas, observaciones desde el suelo y medidas, planos, etc.

To create maps of these current conditions.

To create a map to serve as a negotiating document for the purpose of mediating boundaries for a proposed conservation easement in all three of the properties.
