(a) IN GENERAL.—The amendments made by this 5

title apply to goods entered, or withdrawn from warehouse 6

for consumption, on or after the 15th day after the date 7


(b) RETROACTIVE APPLICABILITY.— 9

(1) IN GENERAL.—Notwithstanding section 514 10

of the Tariff Act of 1930 (19 U.S.C. 1514) or any 11

other provision of law and subject to paragraph (2), 12

the entry of an article described in any heading of 13

subchapter II of chapter 99 of the Harmonized Tar-14

iff Schedule of the United States (as amended by 15

this title)— 16

(A) which was made on or after January 17

1, 2010, and before the 15th day after the date 18

of the enactment of this Act, and 19

(B) with respect to which there would have 20

been no duty or a reduced duty (as the case 21

may be) if the amendment or amendments 22

made by this title applied to such entry, 23

shall be liquidated or reliquidated as though the 1

entry had been made on the 15th day after the date 2


(2) REQUESTS.—A liquidation or reliquidation 4

may be made under paragraph (1) with respect to 5

an entry only if a request therefor is filed with U.S. 6

Customs and Border Protection not later than 180 7

days after the date of the enactment of this Act that 8

contains sufficient information to enable U.S. Cus-9

toms and Border Protection— 10

(A) to locate the entry; or 11

(B) to reconstruct the entry if it cannot be 12

located. 13

(3) PAYMENT OF AMOUNTS OWED.—Any 14

amounts owed by the United States pursuant to the 15

liquidation or reliquidation of an entry of an article 16

under paragraph (1) shall be paid, without interest, 17

not later than 90 days after the date of the liquida-18

tion or reliquidation (as the case may be). 19

(4) DEFINITION.—As used in this subsection, 20

the term ‘‘entry’’ includes a withdrawal from ware-21

house for consumption. 22
