CONDITIONS OF SALE

Bidding on items indicates acceptance of the following terms:

• A 25% buyer’s premium will be added to the hammer price on each lot sold on a house paddle; 28% will be added to lots purchased online.

• All lots are sold “AS IS” and all sales are final. Neither we, nor the consignor are responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by local law any warranty of any kind whatsoever is excluded by this paragraph.

• The auctioneer has the sole right to settle disputed bids and decide whether or not to reoffer the lot.

• The record of sale kept by the auction house will be taken as final in the event of any dispute.

• The purchaser assumes complete responsibility for items at the fall of the auctioneer’s hammer. SUSANIN’S claims no liabilities as to the conditions of lots past this point.

• Some lots carry reserves. This is a confidential minimum set by the consignor and the auction house below which a lot will not sell. The reserve will not exceed the low estimate.

• Absentee bids will be executed when possible as a convenience to our clients. SUSANIN’S will not be held responsible for any errors or failures to execute bids.

• Payment is due upon receipt of invoice. SUSANIN’S does NOT provide shipping services. Contact information for independent local shipping firms can be provided upon request. Obtaining a pre-auction shipping estimate is strongly recommended to potential bidders prior to sale date.

• Items may be withdrawn at any time prior to the offering of each lot for a fee of 40% of the median of the catalogued estimate.

• The auctioneer reserves the right to reject an opening bid that, in his or her opinion, is not commensurate with the value of the lot.

• SUSANIN’S requires a valid Visa or MasterCard on file in the bidder’s name to complete registration for each auction. Payment must be made at the end of the sale unless prior arrangements have been made. SUSANIN’S accepts cash, certified checks and money orders. Personal checks may be accepted if credit has been established with us prior to sale date. All invoices totaling over $5,000 must be paid for via wire transfer, check, cash or money order. Credit card and PayPal payments will not be accepted for invoices over $5,000, nor from international bidders. Combination payment methods are not permitted.

• All purchases must be paid for within three business days after an auction; items must be picked up within seven business days after an auction. Property which is not paid for within the three day period will be charged to the purchaser’s credit card. If property is paid for but not removed within seven business days after the auction, it may be sent to a storage facility, the cost of which is assumed solely by the purchaser. SUSANIN’S reserves the right to decide how property may be disposed after seven business days.

Buyer Credits* (Including Gift Certificates) will expire at one year from their application unless otherwise specified.

FREQUENTLY ASKED QUESTIONS

How can I get information on SUSANIN’S upcoming auctions?Details about upcoming auctions are available at www.susanins.com, or by phone at 312-832-9800

Where can I get an auction catalogue?SUSANIN’S offers a fully illustrated catalogue for $10.00 which can be purchased at the front desk during auctions and exhibitions. Each catalogue is also viewable and can be downloaded at www.susanins.com.

Can I see the items prior to the auction?Yes, and we recommend that you view pieces before placing bids. Viewing is an opportunityto evaluate pieces first hand. Auction preview begins the Monday prior to the auction and remains open throughout the week from 10am-5pm. Extended viewing hours are offered on the Thursday prior to auction day from 10am-7pm, and Saturday morning from 9am-12pm.

Is there an admission fee? There is no charge to view or attend an auction. The public is invited and welcome!

What are “Condition Reports,” and where do I get them?Condition reports are supplemental to the catalogue and provide additional information as to the complete condition of a piece. If you are planning to bid on an item without viewing it first hand, requesting condition reports is suggested.

What kind of information do I need to register?First time bidders will need a driver’s license or equivalent form of identification in order to create an account. Each potential bidder is also required to have a valid Visa or MasterCard in their name on file. You may also register online through our secure registration form. Your bidder number is permanent, valid for all auctions, and can be used online or in person.

How do I bid?Bidding at auction is a very straightforward process. The auction will follow the numerical order given in the catalogue. Once your lot comes up, all you have to do to bid is raise your paddle and wait for the auctioneer to acknowledge you. Higher bids are automatically set by the auctioneer, at his/her discretion, but generally according to the following increments:

Bidding Increments$0—500 | $25 $2,000—5,000 | $200$500—1,000 | $50 $5,000—10,000 | $500$1,000—2,000 | $100 $10,000—20,000 | $1,000

If another bidder does not top your bid and there are no other competing absentee bids left with the auctioneer, the auctioneer brings the hammer down to close the sale. Once you havecompleted your bidding for the day, you may return to the registration table with your paddle to receive an invoice and to make arrangements for payment and pick up. All items (with the possible exception of larger pieces) are available to be picked up immediately following a successful bid and payment. Please note the final purchase price is determined by adding the buyer’s premium plus any applicable sales tax to the hammer price.

Where does the bidding start?Bidding generally starts at the low estimate of a lot and is at the discretion of the auctioneer. The estimated price range for each lot is printed in the catalogue.

How do I make an absentee bid, and does it cost anything? For those who cannot attend the auction, absentee bidding prior to the auction can be placed and monitored at www.susanins.com. There is no fee to place an absentee bid. The absentee bid you place indicates only the upper limit which you are prepared to pay. The auctioneer will bid on your behalf considering competing bids and the reserve. If your bid is successful, you will also need to pay the customary 25% buyer’s premium along with any applicable sales tax. It is your responsibility to ascertain if your bids were successful and to make sure they are paid for within three business days of the sale and picked up within seven business days of the sale. SUSANIN’S will also notify you of successful bids by mailing an invoice to the ad-dress in your records.

If I place an absentee bid, is that the amount I will have to pay?The absentee bid you make indicates only the upper limit which you are prepared to pay. If you are not actually outbid on the piece, the chances are you may purchase the lot for less than your top amount. If you place or monitor your bids online, you will see that at any time you only need to outbid any competition (or the minimum - see “reserve” price) by one increment. Should any questions arise about the bidding process or results, we are happy to provide as in-depth an explanation as possible to ease any doubts or concerns.

Do I have to pay taxes? If you pick up your auction purchases at SUSANIN’S, you may be liable for the local sales tax. SUSANIN’S will not collect tax on items shipped out of the state of Illinois. Please note that thealphanumeric codes located next to the estimated time on some lots in the catalogue refer to a list of sellers also located in the catalogue. If that code is present, it is an indication that the seller has agreed to use of name and is not regularly engaged in the business of sellingthat type of property. These factors make an item tax exempt.

If I am a dealer, how do I register my resale number?SUSANIN’S will accept applicable U.S. resale licenses to apply to your auction purchases. A copy of this license must be on file with us.

How soon do I need to pay for and pick up a purchase?Payment is due within three business days following an auction. An item must be picked up or shipped out of the SUSANIN’S warehouse within seven business days following an auction.Items not picked up within seven business days will be charged storage fees at a rate of $25 per lot per day. Note: SUSANIN’S does not perform any shipping in-house. For a complete listof recommended shippers, visit www.susanins.com or call us at 312-832-9800.

Do you take credit cards for payment?SUSANIN’S accepts payments via either Visa or MasterCard for purchases made totaling under $5,000. Check, cash, money order, or wire transfer are also acceptable means of payment. Personal checks may be accepted if credit has been established with us prior to sale date. Purchased items can leave the SUSANIN’S warehouse only after payment for these items have been cleared.

GLOSSARY

Absentee BidA chance to bid on a lot without actually attending the auction. To make an absentee bid, go online and visit our absentee bid page. Monitor your bids and see exactly where you stand prior to the live auction. Alternately, fill in an ‘Absentee Bid Form’ (found in the back of our catalogues) with the name and lot number of the piece and your price limit, and return the form to SUSANIN’S.

AppraisalFor an additional fee, a formal written appraisal can be provided for either fair market value or for insurance purposes. Fair market value represents what we believe an item will bring at auction. Insurance values reflect what we believe is the replacement value for a particular item.

Formal written appraisals are not necessary to determine a presale auction estimate. If you are interested in selling an item at auction,SUSANIN’S offers complimentary auction estimates to help you begin the process. Please email photos of your piece(s) to [email protected] and the consignment staff will be more than happy to assist with market research.

As IsProperty is sold with all existing faults and imperfections. Potential buyers are encouraged to inspect each item carefully before bidding.

Bought InIf a lot fails to acquire a bid at or above the minimum sale price (see Reserve Price) set by the owner. The piece remains the property of the owner. Synonyms included ‘withdrawn,’‘returned to owner,’ and ‘passed.’

Buyer’s PremiumA commission paid by the buyer that is added to every lot purchased at auction. In-house buyer’s premium is 25%; online buyer’s premium is 28%.

Conditions of SaleThe terms under which SUSANIN’S and the consignor agree to sell alot to the purchaser.

ConsignmentThe physical transfer of property (not ownership) to SUSANIN’S for sale at auction. SUSANIN’S acts as the agent for the consignor.

Fair WarningA warning given by the auctioneer that a lot is about to be sold. The fair warning gives bidders a final chance to increase the bidding. If there are no subsequent bids, the auctioneer’s hammer falls and the sale is completed.

Hammer PriceThe final bid made before the hammer falls and closes the sale of a lot. The hammer price is distinct from the final purchase price as it does not include buyer’s premium or any applicable taxes.

IncrementThe amount by which the current high bid is raised each time a higher bid is placed.

LotAn individual item or group of items that is sold as one unit at an auction.

Paddle/Bidder#A permanent number assigned to a bidder in order to participate in an auction. SUSANIN’S bidder numbers can be used for any auction.

Pre-Sale EstimateThe price range in which an item is expected to sell at auction. This estimate is based on our examination of the item and our knowledge of the prices achieved by similar objects sold previously. The pre-sale estimate provides prospective buyers with an important preliminary guide to value. Unlike formal written appraisals, pre-sale estimates are based on our best judgment and opinion of the market for that particular item. However, they are not guarantees that an item will sell within the estimate at auction.

Price ListA list recording the final sale price of each lot. Price lists are available at www.susanins.com under the ‘Results’ tab.

ProvenanceThe history of ownership of the property being sold. Provenance is an important part of the authentication process as it can establish the chain of ownership back to the time a piece was created.

Reserve PriceThe reserve is the confidential minimum price agreed to between the consignor and SUSANIN’S, below which the property will not ordinarily be sold. If bidding at auction fails to reach the reserve, the piece is ‘bought in’ and returned to its original owner. To protect the consignor’s interests, SUSANIN’S keeps reserves confidential.

Sale NumberEvery auction at SUSANIN’S is given an individual sale number to distinguish it from previous and subsequent sales. It is important to have this information when contacting SUSANIN’S regarding specific lots and when searching catalogues on our website.

Phone BiddingSUSANIN’S will accept phone bids from bidders for lots with low estimates of $500 or greater. An auctioneer’s assistant in the auction room will relay the bidding information during thelive auction.

Internet BiddingSUSANIN’S offers the option of bidding in an auction live through an online bidding platform, LiveAuctioneers.com. Bidding live on LiveAuctioneers.com allows bidders the ability to bid during an auction anonymously and from outside the actual auction room. Online buyer’s premium is 28%.
