The Shaker Heights Board of Education met in regular session on Wednesday, June 20, 2007 at 5:07 p.m. at Shaker Heights Board of Education Administration Building, 15600 Parkland Drive, Shaker Heights, Ohio 44120. Members present: Mr. Norman A. Bliss, Mrs. Mary S. Johnson, Ms. Annette Tucker Sutherland, and Ms. Freda J. Levenson. Mr. F. Drexel Feeling joined the meeting in progress at 5:24 p.m. President Freda J. Levenson presided. Upon the presentation of the Minutes of the May 8, 2007 regular meeting, Mrs. Johnson moved, seconded by Ms. Sutherland to approve the Minutes as presented. Roll Call: Ayes: Mr. Bliss, Mrs. Johnson, Ms. Sutherland, Ms. Levenson. The motion carried. 07-06-72 PUBLIC MEETING ON THE ISSUE OF REEMPLOYMENT At this time a public meeting was held on the issue of reemployment of Barbara Safier and Karen Sher. New reemployment guidelines have been established by Ohio law in House Bill No. 95. Under this bill, when a board of education wants to consider reemploying a retiree in the same position held prior to retirement, a prescribed process must be followed. First, a public notice announcing a public meeting considering the reemployment must be placed at least sixty days prior to the reemployment action (expected to be on July 17, 2007). The Treasurer has certified that such notice was placed in the May 17, 2007 edition of the Sun Press. Second, such public meeting must take place between 15 and 30 days before the reemployment action. As announced in that notice, the meeting this evening satisfies the second requirement for any member of the public to provide input on the reemployment of Barbara Safier and Karen Sher. At this time the public was invited to provide input on the issue of these reemployments. There being no comments or questions from the public, the Superintendent continued with the Business Report. BUSINESS Upon the recommendation of Superintendent Freeman, Ms. Sutherland moved, seconded by Mr. Bliss that the Board of Education approve the following resolution: WHEREAS, the District’s buildings are significant physical structures located throughout the District territory which consists primarily of residential property, which has resulted in the administration of the Shaker Heights Board of Education being approached about utilizing District buildings upon which to place mobile phone antenna facilities; and WHEREAS, the administration of the Shaker Heights Board of Education has investigated the possibility of allowing the placement of mobile phone antenna facilities on District buildings, and determined it to be safe, practical and non-invasive to the educational functions carried out by the District, while at the same time providing an economic return to the District in the form of monthly rental payments over a multi-year time period;

TREASURER’S REPORT AND RECOMMENDATIONS Upon the recommendation of Mr. Bryan Christman, Treasurer, Ms. Sutherland moved, seconded by Mr. Bliss that the financial statements for May 2007 (Exhibit T-1) be accepted and placed on file for audit. President Levenson asked Mr. Christman to review the highlights of the May 2007 financial statements. He commented on items as delineated in the financial and miscellaneous briefs as follows: • Real estate tax settlement was received in May. Overall this category is $661,497 or

1.2% above budget for YTD. • Other State Sources - $738,644 or 52.6% more than the amount received in the prior

year. $399,445 of the variance is due to higher payments received under the House Bill No. 66 tangible personal property tax loss reimbursements payout schedule, $109,044 of which was received in May 2007 vs. $58,080 received in May 2006. $378,618 of the variance is due to a higher payment received for the annual special education catastrophic aid reimbursement. Receipts in May 2007 for this item included $869,525 at approximately 59.5% (vs. last year 46.7%) of the 100% calculated amounts.

• Classified Overtime paid YTD through May 2007, was $219,356 or 20.5% less than YTD through May 2006. Sick leave severance payments this YTD totaled $594,949, representing a $233,969 or 64.8 increase from the prior YTD total of $360,980.

• Total Expenditures – On a cash basis, total expenses were $517,883 or 0.7% less than the YTD expenditure level for the prior fiscal year. The cash basis budget to actual variance is a favorable $1,723,916, or 2.4%.

• Levy Election Results – May 2007 – Of the 164 Ohio school district funding issues (154 school districts) on the May 8th ballot, 54.3%, or 89 passed. 56.0%, or 61 of the 109 operating issues were approved, while 50.9% or 28 of 55 of the capital issues passed. Cuyahoga County issues fared better overall than the State results with 5 out of 8 or 62.5% passing, including 1 of 4, or 25.0% of operating issues; and 4 of 4 or 100.0% of capital issues passing.

• Property Tax Base Protection Efforts – Increase Complaints Filed by the District: The District filed 19 increase complaints with the Cuyahoga County Board of Revision. These filings were made based upon recent recorded sales. The total increased market value requested is $2,690,998, which approximates $941,849 of assessed value, which would produce additional annual (or at least until the next year that H.B. 920 would take effect) tax revenue approximating $90,000 for the District. Decrease Complaints Filed by Taxpayers: Taxpayers filed 72 decrease complaints, 29 commercial and 43 residential. The requested decrease in market value amounts to $15.4 million for commercial and $5.2 million for residential properties, which if awarded would result in collective tax reduction amounts of $515,000 and $128,000, respectively. In addition to filing counter-complaints against commercial property decrease complaints, we have reviewed the current year residential decrease filings and reassessed our normal policy of not filing against residential properties, and decided to also file counter-complaints on 22 of the 43 residential decrease complaints. We only filed counter-complaints in those instances where we felt the decrease request was either not warranted or the justification reasons given were questionable or not valid. The market value reduction requested for these 22 properties amounts to $3 million, which equates to a collective tax reduction amount of $75,000. Board of Revision and Board of Tax Appeals Activity in 2006: Attached to the financial briefs are reports that summarize the activity at both the Board of Revision and the Board of Tax Appeals level during 2006. This activity relates to increase and decrease complaints filed in prior years. These reports indicate the amount of market

and assessed value dollars protected. The estimated tax dollar savings from our efforts at the Board of Revision level approximated $126,000. The estimated tax dollar savings from our efforts at the Board of Tax Appeals level (the second level in the property tax appeal process) approximated $137,000.

Mr. Christman also commented on the following legislative items: Fiscal 2008 and 2009 State Budget • The Ohio Senate unanimously approved the Budget House Bill No. 119 (33-0). • The Bill was sent to the Conference Committee based on the House vote on June

19th. • Primary unresolved issue is how short the revenue projections will be. New revenue

estimates to be released when Office of Budget and Management Director testifies to the Conference Committee.

• One of the possible concessions in the conference bill may be the implementation of means testing for the senior citizen property tax cut.

• Senate changes from the House Bill had no significant impact to K-12 funding portion of the budget.

The motion carried. 07-06-84 BOARD COMMITTEE REPORTS At this time President Levenson asked for Board committee reports. Ms. Sutherland commented briefly on the Legislative Committee regarding the Ohio School Boards Association request for school boards to take action to lobby legislators on the pending budget bill that is in Conference Committee. Copies of final actions will be provided the Board. At this time President Levenson asked for comments or questions from the audience. Mr. Dan Hoffman inquired about the process taxpayers have available to them to contest their real estate appraisal valuations. Mr. Christman explained that the application of House Bill No. 920 has a different impact to the District depending on when the change in appraised value is granted: either before or after the duplicate values are certified to the State. If they are changed after, then the District suffers a permanent loss of revenue until the ensuing tax year when H.B. No. 920 is applied to the newly adjusted values. If the change occurs before, then the H.B. No. 920 automatically adjusts before the bills are sent out. Mr. Hoffman also commented on the new State budget being acted upon by the State legislature. At 6:07 p.m., upon the recommendation of President Levenson, Mrs. Johnson moved, seconded by Ms. Sutherland that the Board recess to executive session to discuss personnel matters, including the Superintendent’s evaluation. Roll Call: Ayes: Mr. Bliss, Mr. Feeling, Mrs. Johnson, Ms. Sutherland, Ms. Levenson. The motion carried. 07-06-85 The Board concluded the executive session and reconvened the public session at 12:20 a.m., Thursday, June 21, 2007. Upon the recommendation of President Levenson, Mrs. Johnson moved, seconded by Mr. Bliss that the following resolution be approved: WHEREAS, the Board of Education has performed its required annual evaluation of the Superintendent’s performance as required under the terms of the Superintendent’s contract; and WHEREAS, the Board of Education acknowledges and recognizes that due to the budget reductions implemented at the beginning of fiscal 2006-07, the Superintendent’s last annual base salary adjustment was July 1, 2005; now THEREFORE, BE IT RESOLVED, that the Board of Education hereby approves a 6% salary adjustment to the base salary of Superintendent Mark Freeman effective July 1, 2007.
