หัวหน้าคณะรักษาความสงบแห่งชาติที่ใช้บังคับอยู่ในวันก่อนวันประกาศใช้ รัฐธรรมนูญนี้ หรือที่จะออกใช้บังคับต่อไปตามมาตรา 265 วรรคสอง ไม่ว่าจะเป็น ประกาศ คำสั่ง หรือการกระทำที่มีผลใช้บังคับในทางรัฐธรรมนูญ ทางนิติบัญญัติ ทาง บริหาร หรือทางตุลาการ ให้ประกาศ คำสั่ง การกระทำ ตลอดจนการปฏิบัติตาม ประกาศ คำสั่ง หรือการกระทำนั้น เป็นประกาศ คำสั่ง การกระทำ หรือการปฏิบัติที่ชอบ ด้วยรัฐธรรมนูญนี้และกฎหมาย และมีผลใช้บังคับโดยชอบด้วยรัฐธรรมนูญนี้ต่อไป การยกเลิกหรือแก้ไขเพิ่มเติมประกาศหรือคำสั่งดังกล่าว ให้กระทำเป็นพระราชบัญญัติ เว้นแต่ประกาศหรือคำสั่งที่มีลักษณะเป็นการใช้อำนาจทางบริหาร การยกเลิกหรือ แก้ไขเพิ่มเติมให้กระทำโดยคำสั่งนายกรัฐมนตรีหรือมติคณะรัฐมนตรี แล้วแต่กรณี

บรรดาการใดๆ ที่ได้รับรองไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช 2557 ซึ่งแก้ไขเพิ่มเติมโดยรัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับ ชั่วคราว) พุทธศักราช 2557 แก้ไขเพิ่มเติม (ฉบับที่ 1) พุทธศักราช 2558 และ รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช 2557 แก้ไขเพิ่มเติม (ฉบับที่ 2) พุทธศักราช 2559 ว่าเป็นการชอบด้วยรัฐธรรมนูญและกฎหมาย รวมทั้ง การกระทำที่เกี่ยวเนื่องกับกรณีดังกล่าว ให้ถือว่าการนั้นและการกระทำนั้นชอบด้วย รัฐธรรมนูญนี้และกฎหมาย”
