For international students studying in theUSA, it can be a very rewarding expe-

rience and can provide them with theopportunity to experience a new culture,meet new people, and forge new friend-ships.

However, with these experiencesyou have many challenges such as finance.Many students are faced with the realiza-tion that paying for college can cost morethan some people's yearly salaries. The riseof inflation, the budget crisis and otherannual expenses are among of the reasonscolleges have become financially unattain-able for some individuals.

While there are government grants andfinancial aid for American citizen, this isnot the case for many international stu-dents. I recently sat with a high school prin-cipal in Jamaica who expressed thatalthough there are scholarships for interna-tional students such as students from Asia,there is a lack of funding for Caribbean stu-dents especially Jamaicans who want tostudy in USA, Canada, UK, etc.

While I fully support President ObamaPresident Obama's initiative where hewants “100,000 Caribbean students in theUSA over the next three years,” we stillneed infrastructure in place to support thisinitiative. For example, international stu-dents have to pay higher tuition to universi-ties, compared to local students.

For international students comingfrom developing countries, the exchangerate between US dollar and their domesticcurrencies is very high. I would love alluniversities in the USA to maintain thesame tuition rate for all their students andnot to charge more money because they arefrom another country.

I am trying to do my part, by trans-forming the Dr. Neva’s foundation into theStudents Aid Inc. (www.studentsaid.org).Students Aid aims to be a part of the solu-tion. This is a non-profit 501(c)(3) organi-zation that focuses on aid for internationalstudents by providing gap funding.

We have a lot of bright minds in theCaribbean but too many of our students arenot able to complete their education inAmerica because of money.

These students should be given an opportu- nity to expand beyond their boarders.

The United Nations Office onDrugs and Crime ranks

Jamaica as 10th place and theUnited States at 3rd for the use ofillegal drugs, including marijuana(ganja, pot, or weed).

Marijuana is without a doubtone of the most popular and con-troversial plants in the world.Since the early 20th century theplant has been subjected to legalrestrictions with the possession,use, and sale of cannabis prepara-tions containing psychoactivecannabinoids currently illegal inmost countries of the world.

The United Nations (UN)deems it the most-used illicit drugin the world. In 2004, the UN esti-mated global annual consumptionof cannabis at approximately 4percent of the adult world popula-tion (162 million people) and daily

cannabis use of about 0.6 percent(22.5 million).

Furthermore, Cannabis plantas a physician-recommendedherbal therapy is mushroomingacross the world, including inCanada, Belgium, Australia, theNetherlands, Spain, and severalU.S. states.

The marijuana industry isnow being valued in the billions ofdollars and several countries areseeking to profit from its nutrition-al and medical values.

According to the UN data,less than 10 percent of theJamaican population useMarijuana. However, the island isknown to be a major producer anddistributor of the herb to the USAand Canada.

With pressure from the US,Jamaica has been forced to honor

several Conventions on NarcoticDrugs, pledging internationalcooperation to limit the spread ofillegal substances.

While the production and useof Marijuana continues to be ille-gal in most countries, the cam-paign for legalization is rapidlyoutpacing opposition.

Scores of countries and fourUSA states–Colorado, Washin-gton, Oregon and Alaska, as wellas the District of Columbia -- havepassed measures to legalize mari-juana use, while an additional 14states have decriminalized certainamounts of marijuana possession,while nearly half of the statesallow medical marijuana.

With pressure from the US,Jamaica during the past 50 yearscontinues to uphold “anti-marijua-na laws” and put thousands of its

citizens into criminals, while fail-ing to explore the profit and otheradvantages of the plant.

However, the Jamaican gov-ernment smells the weed and istaking the right steps to stop the“anti-marijuana regulations.” TheJamaican Justice Minister MarkGolding last Thursday announceda proposal to decriminalize per-sonal possession of Marijuana,known locally as ‘ganja.’ The pro-posal would also allow the plant’suse in medical, scientific and reli-gious settings. Along with reduc-ing the burden of harsh marijuanapenalties, the new laws aim to“secure the economic and medicalbenefits of ganja.”

Jamaica should continue toseek appropriate ways to profitfrom decriminalizing ofMarijuana.

Former Democratic state Sen.Malcolm Smith has been found

guilty of scheming to bribe Republicanparty leaders so he could run on the GOPline in a New York City mayoral race,making him the latest ex-Albany leaderto be convicted of corruption.

A federal jury convicted SmithThursday of all four charges, includingbribery conspiracy, wire fraud, use ofinterstate facilities to commit briberyand extortion.

Smith and former councilman DanHalloran were arrested in April 2013 onconspiracy, wire fraud and extortioncharges after the pair allegedly plotted toget Smith onto the ballot by paying offGOP county chairmen. Because he's aDemocrat, Smith would have neededthree leaders' permission.

The indictment alleged twoRepublican Party leaders, includingSmith's co-defendant, former QueensRepublican Vice Chairman VincentTabone, accepted tens of thousands ofdollars in exchange for helping getSmith on the ballot.

Tabone was convicted Thursday ofbribery and witness tampering, amongother crimes.

A first trial for Smith ended in amistrial in June 2014 because of con-flicts with jurors' schedules.

The jurors had only committed tostay with the case through late June and,because of their schedules, could notcommit for another month, the judgesaid.

Smith is the latest line in Albany'scorrupt legacy. Sheldon Silver, speakerof the State Assembly for more than twodecades, was arrested late last month onfederal corruption charges. He has saidhe will be vindicated. Last week, NBC 4New York reported federal investigatorsare looking into state Senate MajorityLeader Dean Skelos' sources of incomein connection with a broader corruptionprobe.

Standard & Poor’s Financial Services LLC(S&P) and its parent company, McGraw-

Hill Financial Inc., entered into a $210 millionsettlement to resolve federal and state civilclaims related to S&P’s conduct in inflatingratings of residential mortgage-backed securi-ties and structured investment vehicle notes.

Combined with a separate settlementresolving a lawsuit filed by the CaliforniaPublic Employees’ Retirement System(CalPERS), S&P will pay a total of $1.5 bil-lion to federal and state government entities.The State of California, through its AttorneyGeneral, will recover $210 million in dam-ages, from which CalPERS and the CaliforniaState Teachers’ Retirement System (CalSTRS)will receive allocations for their losses on

investments of certain S&P-rated securities.Separately, S&P will also pay CalPERS $125million to settle CalPERS’ specific lawsuit.The remainder of the total settlement proceedswill be distributed amongst the U.S.Department of Justice and the other nineteenattorneys general.

An investigation showed that S&P sys-tematically misrepresented to the public, andto CalPERS and CalSTRS, that its ratings ofstructured finance securities were based on anobjective and reliable analysis and not influ-enced by S&P’s economic interests. Investorsrelied on these ratings to invest in the struc-tured finance securities, the collapse of whichled to the financial crisis.

New York City agreed last Friday to pay$3.9 million to the family of a black

Bronx teenager shot to death by a white policeofficer in 2012.

The deal settled a federal lawsuit broughtby the family of 18-year-old RamarleyGraham. Besides emotional damages, the fam-ily also sought compensation for their allegedmistreatment by police who detained themafter the shooting.

City Law Department spokesman NickPaolucci said: “This was a tragic case. Afterevaluating all the facts, and consulting withkey stakeholders such as the NYPD, it wasdetermined that settling the matter was in thebest interest of the City.”

Graham’s estate will receive $2.95 mil-lion; his brother will receive $500,000 and hisgrandmother $450,000 because they were inthe home at the time of the shooting, sourcessaid. Graham’s mother, Constance Malcolm,will also receive $40,000.

"This was a tragic case," said New YorkLaw Department spokesman NicholasPaolucci. "After evaluating all the facts, andconsulting with key stakeholders such as theNYPD, it was determined that settling the mat-ter was in the best interest of the city."

The family of Ramarley Graham in apress statement said: “No amount of money orsettlement will bring back Ramarley. We wantNYPD officer Richard Haste and all other offi-cers who were present and responsible heldaccountable. They should be charged and pros-

ecuted for murderingour son. Haste andothers responsibleshould be removedfrom the police forceand punished for theircrime. We won’t restuntil we get justice forRamarley. We call onU.S. Attorney PreetBharara to prosecuteHaste and others tothe fullest extent of the

law,” said Constance Malcolm, RamarleyGraham’s mother.

Graham died after he was shot once in thechest in February 2012 in the bathroom of thethree-family home where he lived with hisgrandmother and other relatives. RichardHaste, the officer who shot him, said he firedhis weapon because he thought he was goingto be shot. No weapons were found in theapartment.

Haste was indicted on manslaughtercharges in the summer of 2012, but chargeswere dismissed by a judge who said prosecu-tors improperly instructed grand jurors toimply they should disregard testimony frompolice officers that they radioed Haste inadvance to warn him that they thought Grahamhad a pistol. A second grand jury declined tore-indict the officer.

Manhattan federal prosecutors are con-ducting a civil rights investigation.

Carl Heastie of The Bronx was electedSpeaker of the New York State

Assembly on Feb. 3, 2015, replacing dis-graced ex-leader Sheldon Silver.

Heastie, 47, became the state’s firstAfrican-American speaker and the firstspeaker to hail from the Bronx. He repre-sents the 83rd District and is also thecounty leader of the Democratic Party inthe Bronx.

The State Assembly, for the first timein two decades, voted overwhelmingly inAlbany to elect Heastie to lead the 150-member body.

The new leader promised to focus onethics and integrity after colleagues elect-

ed him speaker, replacing Silver whosetwo-decade reign ended with federal cor-ruption charges.

Heastie vowed to create a new officeof ethics compliance and take other stepsto clean up Albany's tradition of corrup-tion and backroom dealing. "We willchange the cynicism into trust," Heastiesaid. "Our state deserves a government asgood as its people."

“New York City needs a strong voicein Albany -- and the election of CarlHeastie as Speaker of the State Assemblywill ensure that our needs are heard andmet,” Mayor Bill de Blasio said.

The speaker is one of the mostimportant positions in state government.Heastie will direct the flow of legislation,set committee assignments and direct

budget negotiations with Gov. AndrewCuomo and the Republican-controlledstate Senate.

Since joining the Assembly, Heastiebecame one of the lead negotiators for theconstruction of a new K-8 school in hisdistrict. He has also sponsored legislationto require mandatory reporting of allegedchild abuse of students in New York City.

He earned a BS in AppliedMathematics/Statistics from the StonyBrook University (then the StateUniversity of New York at Stony Brook)and an MBA from the Bernard M. BaruchCollege at the City University of NewYork. Before his election to theAssembly, Heastie worked as a budgetanalyst for the New York CityComptroller.

Bronx Tax Preparer on Felony Tax Charges

Bronx resident Raul Kelley, 48, wasarrested Monday (January 26) on three

felony charges stemming from his businessas a tax preparer, Attorney General Eric T.Schneiderman and New York StateDepartment of Taxation and FinanceCommissioner Thomas H. Mattoxannounced.

A complaint filed with Albany CityCourt charged Kelley with the followingcrimes: Criminal Tax Fraud in the FourthDegree, a class E felony; Offering a FalseInstrument for Filing in the First Degree, aclass E felony; and, Attempted Grand

Larceny in the Third Degree, a class Efelony.

According to the complaint, the investi-gation revealed that Kelley, of 1019 E.222nd St., Bronx, had been hired to preparea personal income tax return for two taxpay-ers and file it with the State of New York,despite not being registered with the State asa tax preparer. The complaint accusesKelley, who worked on returns from hishome address, of grossly inflating the tax-payers' job expenses for 2012 from $1,500to $97,120 against wages of $98,212. Thisresulted in the return showing a refund of

$4,432, to which the taxpayers were notentitled. In contrast, the complaint furtheralleges that had job expenses of only $1,500been claimed, the return should have report-ed that the taxpayers owed the State $1,434.

"New Yorkers should take every pre-caution to ensure their tax preparers arelegitimate and registered with the State,"said Attorney General Schneiderman. "Wewill do everything in our power to punishthose who rip off New Yorkers, whether it'san illegal tax preparer or an individual filingfalse insurance claims. Tax preparers who

engage in fraud will be held accountable."Commissioner Mattox encouraged tax-

payers to ensure that tax preparers are regis-tered with New York State by using the TaxDepartment's searchable online database of40,000 tax preparers. Certified publicaccountants, attorneys and enrolled agentshave other professional requirements andare, therefore, not required to be registered.

The Honorable Rachel Kretserarraigned Kelley on the complaint Mondayand set bail in the amount of $7,500bond/$3,000 cash.

Jamaican Spelling BeeChampion Coach NeedsFinancial Support

By Anika Gumbs, CCNPORT OF SPAIN, Trinidad -- Just 48 hoursafter Garvin Nicholas was appointed as thecountry’s new attorney general, a matterinvolving him has been referred to the LawAssociation of Trinidad and Tobago (LATT)for investigation.

The issue is he may have attempted topractice as an attorney, even though he wasnot yet called to the local Bar.

Lawyers familiar with the issue are call-ing on LATT to probe whether due diligencewas conducted before Nicholas was appointedattorney general to replace Anand Ramlogan.

The incident occurred in 2001 whenNicholas was on a six-month pupilage atTrinity Chambers in Port of Spain, when hewas cautioned in writing about breaching theLegal Profession Act (LPA) by DesmondAllum SC (now deceased), who was head ofTrinity Chambers at the time, after it was dis-covered he printed business cards represent-ing himself as an attorney-at law, admitted topractice in Trinidad and Tobago.

A copy of the letter written by Allum wassent to LATT late Wednesday. Nicholas’ cur-riculum vitae (CV) states he was awarded a

barrister-at-law degree in 2001 and was a doortenant at 3PB Chambers in the UnitedKingdom. The CV states he was called to thelocal Bar in 2002.

However, at the time Nicholas wasundergoing his pupilage (2001), he had nopermission to practice at the local Bar or dis-tribute business cards to solicit new legalbusiness.

Allum had also frowned upon a matterwhere it was alleged Nicholas was requestinga percentage of fees from work he hadreferred to attorneys while at the chambers.

Excerpts of a letter from Allum written toNicholas and obtained by the Express read: “Irefer to the meeting held with you in the pre -sence of attorney Gregory Delzin, in thecourse of which during the meeting, Iexpressed concern over the printing of callcards which, when taken at face value, couldbe construed as calling yourself a practicingmember of Trinity Chambers. You will recallthat you were reminded that it is a breach ofthe LPA to hold yourself out as being entitledto practise law without having been admittedto practise, in accordance with the provisionsof the LPA.

New Trinidad and Tobago attor-ney general under investigation

SIPARIA, TRINIDAD & TOBAGO:

In Trinidad & Tobago, residents of CooraBranch Road, in the Siparia constituencyof Prime Minister Kamla Persad Bissessar,staged a fiery protest on Monday to demandimproved road conditions. That followedother protests elsewhere in the constituencyon Sunday.

According to the Trinidad Expressnewspaper, the angry residents blocked theroadway with burning debris preventing chil-dren from arriving at a nearby primaryschool, kindergarten and daycare centre.

The newspaper said businesses in thecommunity were affected, including an oilservice company.

Coora Branch Road was reportedly lastpaved about 14 years. Mindy Ganga, a localresident, said the main road was in very poorcondition and two landslips had developed.

She said attempts to meet Persad-Bissessar at her Siparia constituency officeand letters to Siparia Regional Corporationchairman Leo Doonath proved futile. "Thelast time we saw our MP in the area was fiveyears ago when she came to ask for our sup-port.

KINGSTON, JAMAICA:New data show Jamaica has been importingmore goods from the United States, result-ing in an increase in the trade deficit with itsmajor trading partner.During the period January to October last

year, the value of imports from the US grewby US$165.6 million, or 9.8%.

Total imports were valued at US$1.85billion, compared to $1.69 billion during thecorresponding period in 2013.

Expenditure on goods from the USaccounted for 38.6 per cent of Jamaica’stotal imports during the ten months.

Exports downAnd according to the Statistical

Institute of Jamaica, during that period, thevalue of Jamaican exports to America fellby US$166 million, or 25%, to US$487 mil-lion. This comprised nearly 40 per cent ofthe country's total earnings from exports.

In considering property acquisition in Jamaica, youwould have viewed or seen photographs of the propertythat influenced you to purchase the property and mayhave signed an offer to purchase. Also, you inspected acopy of the Certificate of Title and conducted a caveatsearch, which did not reveal any caveats. In proceedingwith the purchase you may want to consider the followingsteps.

The Vendor would need to instruct his Attorney-at-Law to draft an Agreement for Sale. You should providethe Vendor or your Attorney-at-Law with pertinentdetails, such as the names, occupations, addresses,Taxpayer Registration Numbers and the way that owner-ship of the property would be shared in the case of multi-ples purchasers. You should also provide the name of yourAttorney-at-Law, his address, telephone number and/oremail address.

Upon receipt of the draft Agreement for Sale fromthe Vendor’s Attorney-at-Law, your Attorney wouldreview its terms and conditions, bringing his legal knowl-edge to bear on the process and advise you on the impli-cations of relevant terms of the Agreement. It is the roleof the Attorney to make sure that your interest is well pro-tected. For instance, the Attorney should make sure, withexceptions, that in the event that the sale is cancelled thatyour deposited will be refunded. In the case of tenantedproperty, it is the duty of your Attorney to make sure thatthe Agreement for Sale requires the Vendor to give vacantpossession upon completion.

Property Acquisition, though a daunting task, can bea major accomplishment for many. One would advise aprospective purchaser to seek professional assistance inembarking on the process.

The Agreement for Sale is a vital part of propertyacquisition and contains the terms by which the partiesvoluntarily agree to be bound. It is therefore imperativethat the Attorney representing the purchaser ensure thatthe terms of the Agreement, as much as possible, favorshis client. The Agreement will contain special conditionswhich the parties must observe in order to satisfactorilycomplete the transaction.

It is important that the purchaser observe the timeperiod allotted under the Agreement for completion of thepurchase. There are further deadlines contained within thetime period of the contract, which is calculated from thedate of the Agreement for Sale.

The Agreement would dictate the time for the pay-ment of the deposit, which is usually on signing theAgreement, the time for further payments, if any and thetime for the balance to be paid.

The purchaser would also have to adhere to the timefor the submission of a letter of undertaking from a rep-utable financial institution or a firm of attorneys, confirm-ing how the balance will be paid. Sometimes time is alsomade of the essence under the Agreement, which meansthat time will be strictly adhered to, otherwise either partycould run the risk of breaching the terms of theAgreement.

The Purchaser’s Attorney ought to assist his client inobserving these deadlines so that the Purchaser complieswith the terms of the Agreement.

Digicel Grand Prix Series will see highschool athletes competing in six meets, witha point-scoring system identical to the ISSAGrace Kennedy Boys' and Girls'Championships used to judge competitors.

Seven events, the 100, 200, 400 and800 metre races, the long jump, discus and 4x 400 metre relay will carry points at the sixdesignated meets.

The top three athletes from each meetin each class will then qualify for the GrandPrix finals at the final meet in the series.

The boys will compete in the under-19and under-17 categories, while the girls willcompete in the under-19 and under-16 cate-gories.

This weekend's Youngster GoldsmithClassic starts the series and will also includethe Camperdown Classic, the AnthricCorporate Area Development meet, Westernand Central Championships as well as theG.C. Foster Classic where the series culmi-nates on March 14.

One million dollars in training equip-ment will go to the school which tops theinaugural series.

Our mission is to get pot legalized, reg-ulated, and taxed like alcohol. Obviously, Isupport Senator Liz Krueger’s MarihuanaRegulation and Taxation Act (MRTA). Shejust reintroduced her bill this year and admitsit doesn’t stand much chance of passing theRepublican controlled Senate. What doesthat mean?

We don’t usually like long dissertation oressays about the history of marijuana or itsmedical benefits. We just want pot legalizedand regulated like alcohol or cigarettes.

We are willing to write letters to legisla-tors in Albany and go to Albany to talk withpoliticians. Whatever it takes to get MRTApassed. Most of us will even go to the streetsand protest if necessary. No Problem.

Some of our people are College gradu-ates and many are married, working folks

with kids who pay taxes and vote in elec-tions. We want to come home after work andrelax by rolling up a joint without worryingabout breaking the law just like many babyboomers pours a drink of a legal alcoholicbeverage to relax.

Ask our community about Pot legaliza-tion and they’ll tell you, “I’m smoking poteven if they don’t legalize it”. The majorityof people in New York say they want legal-ized marijuana according to most surveys.We wonder why politicians in Albany won’tgive the people what they want. What partdon’t they understand? It’s extremely frus-trating to say “give us legalize pot” and ourpolitical leaders say “no can do”.

My personal position on legalize pot ismore complex and nuance than just wantingmy pot to be legal. My position is simple. Iagree with Michelle Alexander, writer of theNew Jim Crow.

She said since Colorado andWashington made the “unprecedented moveto legalize recreational pot a few years ago,”we see stories of the excitement and hugesuccess of the so called new ‘Pot Barons’.

You’ll find that the faces of the PotBarons and the legalization movement areprimarily white and male.

Meanwhile, many of the thousands ofpeople arrested for marijuana possession arepoor black men and women who still sit inprisons for possession of the very plant that’smaking those white guys on TV rich. “Inmany ways the imagery doesn’t sit right”asserts Michelle Alexander.

I couldn’t say it better. On one hand wehave White men poised to run big marijuanabusinesses, dreaming of cashing in big i.e.getting big money from selling pot whileblack men from the hood get prison for sell-ing pot and their families and futures aredestroyed. The same thing is happening inNew York.

White men are planning to get richdoing precisely the same thing: selling pot.Something is wrong with this picture? Weneed to talk about amnesty for the thousandsof young, non violent men and women ofcolor still in prison and expunging the crimi-nal records of those caught up in the revolv-ing door of the criminal justice system as aresult of the failed war on drugs. I might notget heard over the noise of police brutalityand the constant chatter about black survivalin a changed world. Nevertheless, it’s aboutfair play. Don’t you think?

The family tax relief credit is a $350 pay-ment to certain middle-income New

Yorkers.For 2014, the Tax Department has

already mailed checks to eligible taxpayers.Eligible taxpayers did not need to apply. If you

think you are eligible, but did not receive acheck, you will be able to have your casereviewed.

Eligibility requirementsYou are entitled to this credit for 2014 if, onyour 2012 personal income tax return, you:

• were a resident of New York State for theentire year,• claimed at least one child under age 17 as adependent,• had New York State adjusted gross income(line 33 of your Form IT-201) between$40,000 and $300,000, and had a New YorkState liability after credits that was zero orgreater.

How to claim the creditIf you filed a 2012 return and met the

four eligibility requirements above, youshould have received your 2014 credit in themail sometime between late September andearly October.

In 2015 and 2016, eligible taxpayers willclaim the credit when they file their incometax returns. Eligibility for those years will bebased on that year's return.

How to file your 2014 returnWhen you file your 2014 New York State

income tax return, you must indicate on thereturn whether you received the $350 checkfor the family tax relief credit. The amount ofthe credit does not need to be reported in yourtaxable income and will not be included in any1099-G you receive.
