NOTICE OF CHANGE OF HOLDER OR CONTACT

1. The NSW Office of Water is to be advised of any change of Approval Holder. This will occur whenever there is a change of ownership of works shown in this approval. The advice should be accompanied by evidence of transfer of ownership of the works.

2. If the Approval Holder wishes to nominate a new contact person a written statement signed by the Holder should be submitted to the NSW Office of Water.

3. The contact person should advise the NSW Office of Water of any change of mailing address as soon as possible.

Schedule 1 – Conditions INTRODUCTION Under section 100 (1) (a) of the Water Management Act 2000 this approval is subject to such conditions as are from time to time required to be imposed on the approval by the Water Sharing Plan for the Greater Metropolitan Region Unregulated River Water Sources 2011 (hereinafter referred to as the Water Sharing Plan). Under section 100 (1) (b) of the Water Management Act 2000 this approval is also subject to such other conditions as the Minister may from time to time impose on the approval, including conditions relating to the protection of the environment. Under section 102 (1) of the Water Management Act 2000 the Minister may impose conditions on the approval after it has been granted. AUTHORISED WATER SUPPLY WORKS AND WATER USE

1. The Approval Holder is authorised to construct and use the water supply works described and listed in Attachments 1 and 2 of this Schedule (‘the authorised water supply works’) to interchange water in accordance with the Water Sharing Plan or any direction from the Minister.

Note 1: Under section 90 (2) of the Water Management Act 2000 the term ‘construct’ is defined to

include install, maintain, repair, alter or extend the work. Note 2: The authorised water supply works are also used to transfer water from the Shoalhaven River

Water Source to the Upper Nepean and Upstream Warragamba Water Source by the Approval Holder as an agent of the Sydney Catchment Authority.

2. The use and operation of the authorised water supply works are subject to the

conditions of this approval.

3. Notwithstanding condition one (1) of this approval, the Approval Holder is not authorised to do anything to the authorised water supply works which would change the capacity of the works as described in Attachment 2 of this Schedule to affect the flow, volume, quality and behaviour of the water, without the written approval of the Minister.

Note 1: To amend an approval the process in section 107 of the Water Management Act 2000 must be

followed.

4. The Approval Holder must not use the authorised water supply works to interchange water under an access licence unless in accordance with the conditions for the interchanging of water of the relevant access licence.

5. Subject to the conditions of this approval, the Approval Holder is authorised to use water

for the purpose of power generation. The Approval Holder is also authorised to transfer water from the Shoalhaven River Water Source to the Upper Nepean and Upstream Warragamba Water Source using the water supply works authorised by this approval as an agent of the Sydney Catchment Authority.

ENVIRONMENTAL MANAGEMENT

6. The Approval Holder must not interchange water when the levels of cyanobacteria in the most recently collected samples are greater than or equal to 50,000 cells/mL Microcystis aeruginosa or the biovolume equivalent is greater than or equal to 4 mm3/L for the combined total of all cyanobacteria where a known potential toxin producer is dominant in the total biovolume, except for when the storage is spilling, or as directed by the Minister.

Note 1: The requirement of condition six (6) does not apply when an interchange is required for the

purpose of a Black Start in accordance with condition seven (7) of this approval. Note 2: The maximum levels of cyanobacteria are that specified in the ‘Guidelines for Managing Risks

in Recreational Water 2008’ which are set by the National Health and Medical Research Council of Australia and are endorsed by the State Algal Advisory Group or its current equivalent.

Note 3: The definition of ‘dominant’ is where the known potential toxin producer comprises 75% or more

of the total biovolume of cyanobacteria in a representative sample.

7. Notwithstanding condition six (6) of this approval, the Approval Holder may undertake power generation in the event that an interchange of water is required for the purposes of a Black Start for the period required to restore the State electrical system.

Note 1: Black Start is the provision of power generation in the national interest to the Australian Energy

Market Operator (AEMO) in order to restore system operation or the interconnected power system after a partial or complete system shutdown. Any power generation which occurs during a Black Start will be under the direction and control of AEMO in accordance with the powers given to it via the National Electricity Code.

MONITORING

Water Quantity Monitoring 8. The Approval Holder must install metering equipment with the following minimum

requirements:

a) the metering equipment must measure and record the flow of all water taken through the authorised water supply works;

b) the metering equipment must comply with the NSW Interim Water Meter Standards (issued by the NSW Office of Water) as may be updated or replaced from time to time;

c) the metering equipment must be operated and maintained in a proper and efficient manner at all times;

d) the metering equipment must be sited and installed at a place in the pipe, channel or conduit between the water source and the first discharge outlet. There must be no flow of water into or out of the pipe, channel or conduit between the water source and the metering equipment; and

e) any other requirements as to type, standard or other criteria for the metering equipment specified by the Minister by notice in writing.

Note 1: Eraring Energy currently utilises the Kangaroo Valley SCADA Control system to determine

interchange volumes between the Fitzroy Falls Reservoir, Bendeela Pondage and Lake Yarrunga. The interchange volumes are currently calculated using generator/pump operating times, turbine and pump performance characteristics and water levels for the three water

storages. Eraring Energy is working with the Sydney Catchment Authority to improve the accuracy of these measurements.

9. The Approval Holder must keep a Logbook and record the following in the Logbook:

a) each date on which water was taken for interchange under the access licence; b) the access licence number of the access licence under which water was taken for

interchange on that date; c) the volume of water that was taken for interchange on that date; d) where metering equipment has been installed for use in connection with the

authorised water supply work, the meter reading before water was taken for interchange; and

e) any other information required to be recorded in the Logbook under the rules of the Water Sharing Plan.

Note 1: A “Logbook” means a record, kept in hard copy or electronic form, which accurately records all

information required to be kept for this approval.

10. The Approval Holder must produce the Logbook to the Minister for inspection, when requested.

11. The Approval Holder must retain the information required to be recorded in the Logbook

for 5 years from the date to which that information relates.

Cyanobacteria Monitoring 12. The Approval Holder must undertake cyanobacteria monitoring at least weekly from 1

October to 31 May, and at least monthly from 1 June to 30 September inclusive at the sites specified in Attachment 3 of this Schedule in accordance with sampling procedures described in Attachment 4 of this Schedule, or as directed by the Minister.

Note 1: The requirement in condition twelve (12) does not apply where the Sydney Catchment Authority

undertakes cyanobacteria monitoring on behalf of the Approval Holder and provides the Approval Holder with access to these data.

13. The Approval Holder must undertake weekly cyanobacteria monitoring during the period

of 1 June to 30 September if cyanobacteria levels for a given storage exceed the recreational guidelines described in condition six (6) of this approval until such time as two consecutive weekly results indicate that the cyanobacteria levels for that storage are below the recreational guidelines, or as directed by the Minister.

Note 1: The requirement in condition thirteen (13) does not apply where the Sydney Catchment

Authority undertakes cyanobacteria monitoring on behalf of the Approval Holder and provides the Approval Holder with access to these data.

Measurement and Data Quality Standards

14. The Approval Holder must undertake all monitoring as required by this approval consistent with appropriate quality assurance and quality control procedures, and national standards, or as required by the Minister. The Approval Holder may include data of acceptable quality from other sources to meet the monitoring requirements of this approval.

REPORTING

Event Notification 15. The Approval Holder must notify the Minister in writing at the earliest practical

opportunity following any event/incident, but not exceeding seven (7) working days that has caused, or is likely to cause, non-compliance with any of the conditions of this approval as a result of an emergency including accident, equipment failure or any such other causes. The notification must include, but need not be limited to, the following information:

a) whether the incident has resulted in any non-compliance; b) the date, time and location of the event; c) the authorised water supply works involved or likely to be involved; d) the cause and nature of the event, including details of any probable or actual harm

or damage to the environment, property and public health and safety; e) any action taken to prevent, control or mitigate the non-compliance; and f) any action that has been, or will be taken to prevent a recurrence of the non-

compliance event.

Black Start Monitoring Report 16. The Approval Holder must advise the Minister in writing as soon as practically possible

in the event of an interchange of water for a Black Start. This information should include, but need not be limited to:

a) the timing of the diversion; b) the volume of water diverted; and c) the amount of power generated.

Cyanobacteria Monitoring Report 17. The Approval Holder must provide the results of the cyanobacteria monitoring required

under conditions twelve (12) and thirteen (13) of this approval to the South Sydney Regional Algal Coordinating Committee within one (1) working day after receipt of the results.

Note 1: The requirement in condition seventeen (17) does not apply where the Sydney Catchment

Authority provides the South Sydney Regional Algal Coordinating Committee with the cyanobacteria monitoring results.

Annual Compliance Report 18. The Approval Holder must, by 31 August each year, submit an Annual Compliance

Report for the preceding water year. The report must be provided in the form of one electronic copy and one hard copy. The report must contain, but need not be limited to, the following:

a) an introduction, including an overview of the Approval Holder’s water management and water movement activities associated with these water sources and the authorised water supply works listed in Attachment 1 of this Schedule;

b) a map depicting the location of the water sources, the authorised water supply works and sampling sites;

c) a section detailing the performance against the environmental management requirements described in conditions six (6) and seven (7) of this approval;

d) a description of the methodologies used to monitor cyanobacteria samples in accordance with conditions twelve (12) and thirteen (13) of this approval, including sampling methods, sampling frequency and analytical methods;

e) a section detailing the results of cyanobacteria monitoring required by conditions twelve (12) and thirteen (13) of this approval, including data, graphs and discussion of results;

f) a summary of any Black Start event report required by condition sixteen (16) of this approval for the previous water year;

g) a summary of all notifiable events, including non-compliance associated with the requirements of this approval for the previous water year;

h) any other significant events that may have, or are likely to have, any direct relation to the conditions of this approval;

i) evidence verifying that the devices used for measuring and recording extractions and releases were subject to appropriate quality assurance and quality control procedures and complied with mandatory or appropriate standards; and

j) an electronic appendix that includes all raw data used in the preparation of this report.

Reporting Current and Historical Data

19. The Minister may, from time to time, request data arising from the operation of the

authorised water supply works to undertake its power generation functions. Within one (1) month of the Minister making such a request, the Approval Holder must provide the required data.

Note 1: Data/information may include, but need not be limited to, the recorded historical pumping and

power generation data (water volumes) and cyanobacteria monitoring data relating to the impact of the authorised water supply works on any river, or other water source, affected by the Approval Holder’s operations.

SCHEDULE 1 – ATTACHMENT 2: DETAILS OF AUTHORISED WATER SUPPLY WORKS The following tables provide the technical specifications, locations, storage capacities and other information for each of the water supply works authorised by this approval.

Bendeela Pumping/Power Station

Description Bendeela Pumping/Power Station is a concrete surface station housed at the bottom of a cylindrical reinforced concrete substructure. The structure is located on the right bank of the Kangaroo River on the upper reaches of Lake Yarrunga and is used to pump water to Bendeela Pondage, with water returning to Lake Yarrunga during hydro-electric power generation.

SCHEDULE 1 – ATTACHMENT 4: CYANOBACTERIA SAMPLING AND ANALYSIS Sampling will be undertaken in accordance with NATA accredited Australian standards at the sites listed below:

a) Fitzroy Falls Reservoir: a horizontal composite of four samples taken at DFF6, DFF7, DFF8 and DFF9 (Figure 2);

b) Bendeela Pondage: water samples taken below the surface at site DBP1 (Figure 3); and c) Lake Yarrunga: water samples taken below the surface at sites DTA8 (inside Bendeela

Power Station boom) and DPAE (Bendeela Camping Area) (Figure 3). Analyses should be undertaken by a laboratory that is NATA accredited for freshwater cyanobacteria enumeration, biovolume and microcystin analysis.

Testing must include:

a) total cyanobacteria, with known toxin producers reported; b) total biovolume of all cyanobacteria species (mm3/L); c) species count (cells/mL); and d) microcystin toxin (µg/L).

Appropriate quality assurance and quality control procedures must be maintained in accordance with condition fourteen (14) of this approval. In relation to sampling and analysis of cyanobacteria, these procedures should include the following as a minimum:

a) a sampling program that includes field duplicates and blanks; and b) a laboratory program that includes verification of algal identification and analysis through

both inter- and intra- laboratory comparisons.

Note 1: The requirements regarding cyanobacteria sampling specified above do not apply where the Sydney Catchment Authority undertakes cyanobacteria sampling on behalf of the Approval Holder and provides the monitoring results to the South Sydney Regional Algal Coordinating Committee.

Schedule 2 DICTIONARY Words and expressions that appear in this approval have the meanings set out in this Dictionary. Words and expressions defined in this Dictionary that appear in the Dictionary of the Water Management Act 2000 (WMA) are the same. A reference in this Dictionary to a section is a reference to a section of the WMA. Black Start means the provision of power generation in the national interest to the Australian Energy Market Operator in order to restore system operation or the interconnected power system after a partial or complete system shutdown.

Biovolume is the total volume of cyanobacteria cells, in mm3/L, present in a water sample. The risk of recreational users suffering an allergic reaction to cyanobacteria increases with increasing biovolume.

Cyanobacteria are photosynthetic bacteria naturally present in all waterways. They are commonly known as blue green algae. Cyanobacteria can have irritant or allergic effects in some people, and some species are known to be capable of producing highly potent toxins that can damage liver and nerve tissues.

Divert means the transfer of water by artificial means from a water source to another water source by a route which differs from the route the water otherwise would have taken.

Emergency may include an event that is pending, or an event that has already occurred but could not be reasonably foreseen or scheduled, including occurrences such as:

• major infrastructure failures within the scheme; • a water contamination incident that may place Eraring Energy in serious breach of the

Protection of the Environment Operations Act 1997; • cyanobacteria blooms; • frequency control and voltage control measures as directed by the Australian Energy

Market Operator ; or • declared disasters or any event considered by the Minister to constitute an actual or

potential emergency.

Guideline for cyanobacteria is the upper concentration of cyanobacteria, or the maximum biovolume of cyanobacteria, that can be present in a waterway and be unlikely to affect the health of recreational water users. Above this limit, the health risk to recreational users is thought to be unacceptable. Guidelines are constantly being revised and updated as new scientific and medical information becomes available. Refer to the National Health and Medical Research Council’s website for up-to-date information.

Interchange, for the purpose of this Approval, means the movement, by the works specified in Schedule 1 – Attachment 1, of water from one water source to another, and the return of that water to the original source.

Spilling from Fitzroy Falls Reservoir is defined as water flowing over the spillway caused by stormwater runoff or excessive inflows.

Toxigenic means those cyanobacteria that are known to be capable of producing toxins. Refer to the Regional Algal Coordinating Committee’s Freshwater Algal Contingency Plan for a list of potentially toxic genera and species.
