EARSI has prepared this brief Statement of Qualifications to describe the Firm’s services, capabilities, and

staffing. EARSI is a full service Project Management, Entitlement and Environmental firm composed of

seasoned professionals with an average experience level of 25 years.

EARSI and its staff have worked on well over one thousand projects ranging in size from small housing and

commercial tracts to large-scale mixed-use master planned communities and multi-state infrastructure

projects. EARSI has extensive experience contracting with both public agencies and private developers and is

a certified Small Business Enterprise.

EARSI can assist its clients during the acquisition and due diligence phase and with development of a

conceptual land plan. We can then provide Project Management services throughout the entitlement phase

including preparation of environmental studies. Following approval of entitlements, EARSI can obtain

wetland and endangered species permits, if required, and can provide construction and post construction

mitigation and compliance monitoring.

Environmental & Regulatory Specialists, Inc. (EARSI) was

founded in January 2000 to provide a full range of

environmental and regulatory services to meet the needs of

private and public clients. Initially a partnership between

David Tanner and Dr. Mark Sudol (who is currently National

Chief of the Regulatory Branch of the Army Corps of

Engineers in Washington DC), EARSI has grown both in the

number of experienced professionals on its staff and the scope

of services offered.

Collectively, the resumes in this Statement of Qualifications

show 400 years experience. EARSI staff members have

authored and/or managed roughly 1,600 successful

CEQA/NEPA documents. No CEQA/NEPA document

prepared by EARSI or any of its staff has ever been found

inadequate in a court of law and, to our knowledge, Dave

Tanner still holds the record for writing and processing a

Federal EIS in the shortest timeframe (Robinson Ridge

project, County of Orange, 1988).

EARSI excels in wetland permitting, habitat restoration, landscape architecture, and other related services.

EARSI’s staff of senior Project Managers establishes EARSI as a one-stop shop for environmental and

regulatory services needed to undertake most development projects. EARSI’s Project Managers work

personally with each client to understand a project and its objectives. We then work to identify potential

roadblocks and to develop a strategic course to obtain entitlements in a timely and cost-efficient manner.

Timothy F. Brick, Director of Watershed Management

Tim Brick has 30 years experience with Water Policy,

Planning and Implementation. A specialist in watershed and

water policy development, engineering and environmental

projects, he has participated in some of the largest and most

important projects throughout California.

Tim is Managing Director for the Arroyo Seco Foundation, a

non-profit with a $200,000 annual budget raised from a

variety of sources and dedicated to coordinated development

of natural resources, environmental enhancement, and

recreational opportunities throughout the 47 square miles of

the Arroyo Seco Watershed.

As the Executive Director of Hahamongna Operating

Company and consultant to the City of Pasadena, Tim

oversaw the rehabilitation of Devil’s Gate Dam and

developed the Hahamongna Watershed Park, a 1300-acre

multi-use project near JPL.

Since 1985, Tim has served on the Board of Directors of the

Metropolitan Water District (MWD) of Southern California,

the largest US water utility. As senior member of the board,

he has considerable expertise in integrated resources

planning, rates, financing, water quality, conservation, and

Raymond H. C. Brantley, Director of Environmental Services

Ray has worked as an Urban Planner for over 30 years. For 20 of these, he was employed by the

County of Orange as a land use and environmental planner and served as the Chief of four

Sections of OCEMA and OCPDSD. He has also consulted for other governmental bodies,

provided services to private developers, and taught regulatory compliance workshops. Ray has

Bruce Cook, Project Manager

Mr. Cook is a professional land use planner with 28 year

of experience working for various California cities. Mr.

Cook served 21 years in senior management, with

responsibilities including land use planning,

environmental management and sustainable

development.

During Mr. Cook’s tenure at the City of Yorba Linda,

Mr. Cook was the project manager for a wide variety of

task specific programs. These programs tended to be

identified as one of three task types: Planning,

Environmental, Sustainability. Planning involved

projects and/or issues related to General Plan, Zoning or

site/project specific land planning issues.

Environmental, involved projects undertaken to comply

with the requirements of the California Environmental

Quality Act (CEQA). Sustainability involved activities

related to compliance with the requirements of AB32

CEQA Experience

During Mr. Cook’s tenure at the City of Yorba Linda, Mr. Cook was the project manager for a wide variety of

CEQA projects. A partial list includes:

Zazarra - Negative Declaration

The project was for a two-story addition at the back of a historic house. I wrote the Negative Declaration for

the project stating that there would be no negative impact as the project was consistent with the Secretary of

the Interior Standards. The project was approved, and because of the adequacy and completeness of the ND,

it successfully withstood a legal challenge from project opponents. The two-story addition was constructed.

Brush Family Single Family Residence EIR

The project was to demolish an existing historic home and to build a new custom home. The project was

approved and the home constructed.

Chavez Family Single Family Residence EIR

The project was to demolish an existing historic home and to build a new custom SFR home in its place. The

EIR was approved, but the CUP and DR to build the home were denied. The City purchased the property for

preservation.

Environmental Record of Action for Clean Up of El Nino Storms

The project was to write an “after-the-fact” record of environmental action to allow for FEMA reimbursement

of City action taken during the 1997 El Nino storms to protect life and property. After submittal of the

document to FEMA, the City was able to receive its reimbursement.

Box Canyon Park Improvements

The project was to write a Mitigated Negative Declaration for park improvements on property that included

wetlands. The MND was certified and park improvements were constructed.

Eastside Park Improvements

The project was to write a Mitigated Negative Declaration for park improvements on property that included

wetlands. The MND was certified and park improvements were constructed.

Rolling Hills Storm Drain Improvements

The project was to write a Mitigated Negative Declaration for park for storm drain improvements in a canyon

that had suffered hillside collapse. The canyon included sensitive habitat subject to “taking” under the

Endangered Species Act. The MND was certified and storm drain improvements were constructed.

Vista Del Verde (Shell Property) Mitigation Monitoring & Reporting

The project was to prepare and implement the Mitigation Monitoring & Reporting Program for the Vista Del

Verde Master Planned Golf Course Community built atop an abandoned oil field. The completed Monitoring

& Reporting Program for totals 8 bound volumes, each approximately 12” thick.

Philip Watts, Ph.D., Environmental Engineer

Phil holds a BS and MS in Mechanical Engineering and a PhD in Environmental Engineering Sciences from

CalTech. His dissertation created a new field of science, "landslide tsunamis", based on his research on the

1998 Papua New Guinea tsunami. Dr. Watts’ consulting firm Applied Fluids Engineering, Inc. designs wind

turbines, undertakes studies of tsunami hazards (e.g. San Pedro Bay), and develops tsunami-warning systems.

He holds several patents and pending patents including a design that increases the profit of existing wind

Karleen received her Ph.D. from the Department of Organismic Biology, Ecology and

Evolution at UCLA. Her background includes training in Biostatistics, Coastal

Ms. Boyle’s most recent coastal projects include serving as lead scientist of the coastal dune trace

metal component of the LAX/El Segundo Dunes Environmental Impact Assessment. This study

evaluated the impacts of air traffic-derived trace metal deposition on the El Segundo Dunes Reserve,

habitat of the endangered El Segundo Blue Butterfly. Results of this study will be incorporated into

the EIR/EIS for the proposed expansion of the Los Angeles International Airport. Ms. Boyle’s duties

included leading all aspects of experimental design, field deployment and maintenance of a network

of 15 Minivol air samplers, data analysis, assessing the biological impacts of measured trace metal

levels and communicating the results to policy-makers, resource agencies, technical audiences and the

general public.

Ms. Boyle is also currently working with Defend the Bay to design and implement a long term

monitoring program in Upper Newport Bay assessing trends in nutrient and contaminant inputs,

macroalgal blooms and populations of indicator species over time.

Ms. Boyle has served as a scientific advisor to the Technical Advisory Committee, Upper Newport

Bay, California.

She also serves as an invited member of the National Academy of Sciences, Transportation Research

Board’s (TRB) Task Force on the Environmental Impacts of Aviation, and is the editor of TRB’s

Joe received his BSEE from the Massachusetts Institute

of Technology and his MBA from the University of

California at Irvine. His undergraduate thesis examined

the performance of non-metallic solar collectors. He is

an expert in thermal processes to heat and cool buildings

and to provide energy through renewable sources. Joe

began with EARSI doing on-call computer support. His

writing skills and ability to understand technical studies

quickly made him invaluable to the production of CEQA

documents. 28 years ago, he wrote a paper on the

physics of global warming for the energy caucus at the

Massachusetts State House (nothing has changed). Now

that we are paying attention, his expertise in energy

This project was heavily opposed from the onset. There was a ballot initiative against this project and other

development in the area, which failed. In addition, there was a legal challenge from the same group. The

court ruled in January 2006 to uphold the adequacy of the EIR. EARSI assisted the City of Santee through

the CEQA and public hearing process. EARSI prepared the Preliminary, Draft and Final EIR, Findings of

Fact, Statement of Overriding Consideration, and Mitigation Monitoring Plan for the 377.5-acre residential

community. The Project involved construction of 224 single-family homes, 149 multi-family housing units, a

1.3-acre public mini-park, dedication of 231.6 acres of open space preservation, and the extension of an

existing multi-use trail system and construction of a trailhead atop the mist prominent hill within the city.

through the CEQA and public hearing process replacing another firm who had prepared a Screencheck EIR.

EARSI prepared the revised Screencheck, Draft and Final EIR, Findings of Fact, Statement of Overriding

Considerations, and Mitigation Monitoring Plan for the 1,800-acre master planned residential community.

The project involved establishment of a 1,200-acre mitigation bank for protection of endangered species,

wildlife movement corridors and protection of riparian resources on site. This project was finished under an

accelerated timeline and was highly controversial.

EARSI assisted Richland Communities in obtaining 404, 1602, and 401 permits, including a USFWS Section

7 Biological Opinion on 600 acres containing two sensitive species (California gnatcatcher and least Bell’s

vireo). Once permits were issued, EARSI was retained to provide permit compliance as well as habitat

mitigation implementation. Limitations to the permits included clearing and grubbing windows, endangered

species monitoring, noise monitoring during the breeding season, and monitoring to ensure preservation of

existing habitat. Habitat mitigation oversight included numerous factors. Preservation, restoration, and

enhancement included over 80 acres of wetland and riparian habitat and coastal sage scrub. The project

included plan preparations, specifications, construction oversight, and monitoring. Specific tasks included

coordination with federal and state agencies, assistance with grading and planting plans, compliance

monitoring, field inspection, and biological and horticultural monitoring.

San Luis Rey Hydrogeomorphic Functional Assessment

EARSI conducted this study to characterize and evaluate the functional capacity of an 8-mile segment of the

San Luis Rey River for the U.S. Army Corps of Engineers as part of their San Luis Rey River Flood Control

Project. In 1986, prior to construction of the project, the least Bell’s vireo (Vireo bellii pusillus) was listed as

endangered under the federal Endangered Species Act. Presence of this and other sensitive species within the

project reach complicated periodic maintenance. Consequently, the vegetation growth within the channel

reduced the level of flood protection of the channel to slightly greater than 100-year flood event. If no

maintenance were performed on the channel, the level of flood protection would continue to decrease

resulting in the potential for significant flood damage to the surrounding residential and commercial

development for relatively frequent flood events. The HGM Assessment provided information on the

functional capacity of the San Luis Rey River and identified the least environmentally damaging, practicable

alternative for maintenance.

The Colonies at San Antonio (TT 16198) - Compliance Monitoring

The Colonies is a roughly 450-acre mixed-use residential project that had potentially hazardous materials

present on site. Compliance oversight performed by EARSI included observation during the removal of the

unsuitable materials and during grading, storm water pollution prevention, erosion control, and other pertinent

inspections related to the California Department of Fish and Game (CDFG) and the Regional Water Quality

Control Board (RWQCB) regulatory permits. Work included coordination with and reporting to the project

team, client and regulatory agents. EARSI also created a Habitat Mitigation and Monitoring Plan and

oversaw the implementation of this plan for the restoration of a 67-acre multiple use basin.

Boulder Springs Specific Plan (786 acres)/Daily Ranch (117 Acres) - Permitting (etc.)

The Boulder Springs and Daily Ranch Projects border each other and are held by the same developer. The

projects are mixed use with predominately single family residential and open space uses. EARSI has

performed a Phase I Environmental Site Assessment, Jurisdictional Delineations, prepared and processed a

Section 404 Permit through the Army Corps of Engineers, a Section 401 Permit Water Quality Certification

through the Regional Water Quality Control Board, and a Section 1602 Streambed Alteration Agreement

through the California Department of Fish and Game, performed a comprehensive Biological Assessment,

performed focused surveys for endangered species including the burrowing owl, coastal California

gnatcatcher, least Bell’s vireo, Quino checkerspot butterfly, and southwest willow flycatcher, developed

mitigation strategies to compensate for project impacts to biological resources, prepared a section 404(B)(1)

Alternatives Analysis, prepared a Habitat Mitigation and Monitoring Program, and prepared CEQA

Documentation for the amended Specific Plan. EARSI has also undertaken similar work on several other

large properties within the immediate area for other landowners.
