Introduction
Summary
• Overall contracting increased by 5.7% last year, from $515.8 million in FY12 to $545.4 million in FY13. • State agency contracting increased by 7.3% last year, from $390.4 million in FY12 to $418.9 million in
FY13. • University of Wisconsin System, including UW Madison, contracting increased by .8% last year, from
$125.3 million in FY12 to $126.4 million in FY13. • State agency contractual spending has decreased by $7.8 million from FY05 ($426.7 million) to FY13
($418.9 million). • State agencies and campuses produced 374 cost-benefit analyses in FY13.
Statutory Background
Contractual Service Procurements. §16.705(8), Wis. Stats., provides that DOA "shall, annually on or before October 15, submit to the governor, the joint committee on finance, the joint legislative audit committee and the chief clerk of each house of the legislature for distribution to the appropriate standing committees under s. 13.172 (3), a report concerning the number, value and nature of contractual service procurements authorized for each agency during the preceding fiscal year”.
Cost-Benefit Analyses. §16.705(8), Wis. Stats., provides that "the report shall also include, with respect to contractual service procurements by agencies for the preceding fiscal year:
"(a) A summary of the cost-benefit analyses completed by agencies in compliance with rules promulgated by the department under sub. (2).
(b) Recommendations for elimination of unneeded contractual service procurements and for consolidation or resolicitation of existing contractual service procurements."
Division of Legal Services. Pursuant to section 16.004(15)(bm) the DOA Division of Legal Services assists in efforts to reduce the state’s use of contracted employees. In order to meet this mission, the Division of Legal Services meets weekly with the State Bureau of Procurement to review and discuss all enterprise-wide contracts and DOA contracts, and provides regular consultation to State Bureau of Procurement on CBA issues. The Division of Legal Services also provides direct assistance to executive branch agencies on contract matters to help agencies negotiate, amend, consolidate or terminate contractual services to gain efficiencies and to lower state costs.
Data Sources The contractual services expenditure data provided in this report for state agencies was extracted from WiSMART, the State’s accounting system. Several agencies including the Departments of Workforce Development, Corrections, Health Services, Transportation and UW System use separate systems and some use different account codes. Each of these agencies reviewed their data for accuracy.
The report data excludes spending authorized outside of §16.75, Wis. Stats., such as interagency or municipal spend, conservation, fellowships and scholarships, services provided in conjunction with building or road construction projects, § 16.855 and Chapter 84 respectively, and Chapter 36 research or instructional services. This report includes the following 19 object code categories of expenditures for services:

Summary of Fiscal Year 2013 Cost-Benefit Analyses and Recommendations
Background
2006 Wisconsin Act 89 provided that DOA "prescribe uniform procedures for determining whether services are appropriate for contracting." To that end, DOA published administrative rules—Wis. Adm. Code Chapter Adm. 10.035, 10.037, 10.038—that specify the manner and form of cost-benefit analyses (CBA) that must be conducted by agencies prior to entering into service contracts greater than $25,000.
In addition to requiring the completion of CBAs, statutes require DOA to report certain information as part of its annual contractual services report to the Legislature. Specifically:
§16.706 (8) (a), Wis. Stats., requires that DOA submit a "summary of the cost−benefit analyses completed by agencies in compliance with rules promulgated by the department."
§16.706 (8) (b), Wis. Stats., requires that DOA provide "recommendations for elimination of unneeded contractual service procurements and for consolidation or resolicitation of existing contractual service procurements."
Act 89 CBAs are used by agencies to compare the estimated costs of contracting with the estimated costs of using state employees to perform a specific task. Agencies complete CBAs prior to contracting for services. In some cases, agencies have used CBA results to determine it is not appropriate to contract out. As such, the reader is cautioned that the production of a CBA does not mean a contract was eventually issued for the contemplated service.
Summary and Analysis of FY13 Cost-Benefit Analyses
Agencies and campuses completed 374 CBAs and 342 continued appropriateness analyses (CA) during FY13. The Department of Transportation (51), the University of Wisconsin (38), Department of Administration, Department of Natural Resources and the University of Wisconsin System (35), and the Department of Children & Families (33) produced the highest volumes of CBAs. A complete listing of FY13 CBAs including agency, estimated total state cost and estimated total contractor cost appears on page 15. A listing of CAs by agency appears on page 25. Readers should contact the agency responsible for the CBA or CA for more information. By statute, CBAs include narrative descriptions of quality, technical expertise, and timeliness considerations. CBAs also provide the total estimated costs of service delivery through both state employees and contractors. Estimated state employee costs include estimated wage and salary, fringe benefits, administrative overhead and other operating costs. Estimated contracting costs include estimated contract price, contract development and monitoring and one-time conversion costs. The FY13 CBAs included several services that must be performed by contractors due to legal, regulatory or contractual requirements, or because the service provided is unique and unavailable in State government. For example:
• State law requires the use of a depository institution (i.e., bank, credit union, savings and loan) for cash
management, checks presentment and related financial services. State agencies and employees may not perform such services.
• The State, from time to time, purchases software that requires regular maintenance. Some software vendors require authorized technicians to maintain the software; failure to use authorized technicians may void original warranties and violate licensing agreements.

• The State periodically contracts for the management of hazardous waste. State agencies and employees lack the equipment and facilities necessary to remove, transport and store dangerous materials.
• Federal law requires the state to contract with a third party to conduct independent program assessments of managed long term care.
In such cases, agencies and campuses completed CBAs that estimated the state employee cost at zero or not applicable (n/a) due to such restrictions. The following table provides dollar ranges of the listed amounts of state employee and contracting costs for all FY13 CBAs:

An estimated 59% of all CBAs were related to services for information technology efforts. Other common services sought among agencies included health, environmental and social services. In most cases, however, services related to the particular mission of an agency or campus.
Recommendations
1 Information Technology Services Provider Contract. Agencies should continue to examine the availability of state employees before contracting for information technology services providers. The State Bureau of Procurement will continue to examine the appropriateness and breadth of services available on information technology services provider contracts.
2 Inter-Agency Solicitations. FY13 CBA data indicates that agencies tend to contract for services that advance their individual missions. However, agencies are encouraged to examine the data to determine whether other agencies are contracting for similar services. Significant cost savings may be available by combining volume. The State Bureau of Procurement is available to advise on or in some cases lead solicitations that cross multiple agencies.
3 Intra-Agency Solicitations. Large agencies should determine whether similar service solicitations will be issued by different programs within the agency. In those cases, effort should be undertaken to issue a

single solicitation to combine volume and generate optimum cost savings. 4 Bid Threshold. Wisconsin 2011 Act 32 increased the bid threshold from $25,000 to $50,000 for all
Chapter 16 procurements as of July 1, 2011. However, agencies still needed to complete cost-benefit analyses and continued appropriateness prior to entering into service contracts greater than $25,000. Wisconsin 2013 Act 20 increased the threshold for cost-benefit analysis to $50,000 effective for FY2014. The State Bureau of Procurement will assist agencies in communicating this requirement as well as eliminating the need for CBA’s for the following:
Services that federal or state law requires to be performed by contract.
Services that must be provided per a contract, license or warranty by the original equipment manufacturer or publisher.
Services that cannot be performed by state employees because the state lacks the infrastructure.
Web-based software application services that are delivered and managed remotely.
