A. Budget R e q u e s t S u m m a r y

The Department of Resources Recycl ing and Recovery (CalRecycle) requests seven (7.0) permanent ful l- t ime posit ions to replace temporary permanent- intermit tent posit ions.

The fol lowing requested posit ions will support the Tire Hauler Compl iance Unit within CalRecycle 's Waste Permitt ing Compl iance and Mit igation Division: four (4.0) Program Technic ian I posit ions, two (2.0) Program Technic ian II posit ions and one (1.0) Program Technic ian III posit ion. CalRecycle will absorb the costs of the posit ions.

B. Background/His tory

Chapter 5 1 1 , Statutes of 1993 (SB 744), created the first waste tire hauler registration and manifest program. Due to the historical difficulty in gett ing adequate full t ime staff to carry out primary waste tire facil it ies permitt ing and enforcement activit ies; student assistants conducted key essential functions of the program from its inception.

In 2000, the program signif icantly grew after the passage of Chapter 838, Statutes 2000 (SB 876). This bill expanded the Was te Tire Enforcement Program and created the California Uniform Was te and Used Tire Manifest System. The new system revised the requirement which previously required haulers to manifest loads and now requires generators, haulers, and end-use facilit ies to submit manifests. CalRecycle is now required to track the generat ion, transport and disposal of waste and used tires f rom approximately 31,000 generators, haulers, and end-use facil it ies, and to provide audits of the manifest systems. The law also requires that the depar tment register waste and used tire haulers each year and assure that the haulers have a surety bond to protect against the liability of il legal waste tire disposal c leanup.

In February 2004, a proposal was approved for three (3.0) one year l imited-term Key Data Operator posit ions, to help alleviate a 60,000+ unit backlog of manifest forms, along with 12 one year limited term student assistant posit ions that helped prepare the manifest forms and scanned them for the Key Data Operators. These addit ional resources were critical in handl ing the backlog. However, they did not address the resource need associated with the ongoing duties of the program.

Start ing in 2005, to maximize eff iciency and prevent the backlog f rom occurr ing again, the Department hired an external contractor (student assistants) to scan the manifest forms for download into CalRecycle 's Was te Tire Management System (WTMS) database. The Program cont inued to use a student contract, and students carr ied out the ful l- t ime, recurr ing, and essential program duties until 2012.

W h e n the student contract was cancel led in 2012, the most feasible option to keep the program running was to hire Permanent- Intermit tent Program Technic ians (PT). Nine (9.0) Permanent- Intermit tent Program Technic ians were hired to cover the work previously conducted by the students. However, a chal lenge with PT's is that the Program Technic ians have permanent intermittent status and cannot work more than 1,500 hours per year.

C . State Level Cons idera t ions

CalRecycle is responsible for ensuring successful waste tire management in the state. This responsibil i ty includes an effective manifest system linking all waste and used tire t ransact ions between waste tire generators, haulers, and end-use facil it ies and for the increased enforcement of waste tire haul ing and storage regulations of waste and used tires. CalRecycle, however, remains the sole regulatory agency overseeing the storage and transportat ion of waste and used tires within Cali fornia. This responsibil i ty has not been, and is not author ized to be, delegated to local governments. There is no federal authority overseeing the transportat ion or handl ing of waste and used tires.

Under its enforcement authority, CalRecycle processes and reconci les the documents required by W T M S , thus enabl ing it to provide a comprehensive enforcement program for waste and used tires. In addit ion to the benefits of public safety and environmental protection provided by a strong enforcement program, the legit imate industry participants in the waste tire market have benef i ted f rom a level playing field with the el imination of the unregistered waste tire haulers and illegal dumping locations that threaten public health and the environment.

D. Just i f icat ion

These posit ions are necessary to provide secure, permanent resources to conduct key ongoing enforcement activities that enable the department to achieve the statutory mandates and protect the public health and safety and the environment.

The law provides a comprehensive enforcement approach which includes a hauler registration program and manifest system and subsequent inspection and enforcement as necessary. The current temporary help posit ions do not provide secure resources for such essential , ful l-t ime and ongoing work. The current temporary workforce maintains the Waste Tire Management System (WTMS) database on a full-t ime basis, processes waste tire hauler appl icat ions and renewals, which are t ime sensit ive in nature and require attention to detai l . The current staff processes more than 1,400 renewal

appl icat ions annually, including more than 7,500 vehicle decals and registration certi f icates in a short per iod of t ime. In addit ion to processing these renewals, the Program Technic ians need to verify the authentici ty of the Waste Tire Surety Bonds. The Program Technic ians communicate with law enforcement , the general public, and the regulatory communi ty on the waste tire toll-free phone line to determine if violations exist, and to provide program guidance. Addit ionally, they assist the Tire Hauler f ield staff in the deve lopment of was te tire hauler enforcement cases.

Since SB 876, the temporary work force has also been required to monitor waste and used tires from "cradle to grave." Every t ransact ion is recorded on a manifest form, which, when comple ted, is submi t ted to CalRecycle. As a consequence, CalRecycle now receives over 640,000 manifest records per year; of which 379,000 are paper documents and 287,000 are Electronic Data Transfer (EDT) records submit ted by 60+ waste tire haulers via an internet link to CalRecycle. To assure that illegal dumping , haul ing, or unpermit ted facil ity operat ions are not occurr ing, these records must be audited and reconci led to verify that waste and used tires are being managed legally and safely.

Wi th the cancel lat ion of the student contract and transit ion to permanent- intermit tent PT's, CalRecycle has exper ienced an increasing number of documents that are not being reviewed in a t imely manner. Wi thout reconci l iat ion, the accuracy of W T M S is in jeopardy, and CalRecycle cannot determine whether the 40+ mill ion waste tires generated each year in Cali fornia have adequately and appropriately been d isposed of in accordance with appl icable statutes.

The Hauler Registrat ion and Manifest System program has never been al located permanent posit ions to handle the other ongoing dut ies required to carry out the law. The fol lowing essential duties need to be addressed in an ongoing manner:

Processing waste tire hauler appl icat ions and renewals, ensuring that the forms are complete and accurate for electronic fil ing Receiving and processing 1,400 or more registrat ions, hauler appl icat ions, and renewals, including processing waste tire surety bonds, and other appl icat ion information Issuing legally required registration certi f icates and decals to waste tire haulers Sending hauler registration packages and manifest forms to businesses

• Veri fying the authentici ty of Surety Bonds Issuing Tire Program Identif ication certif icates for 3,000 or more new Businesses added to the W T M S system each year Answer Tire Hotl ine quest ions from businesses, TEAs , law enforcement, the general public and the regulated communi ty . This includes answer ing an average of 1,500 calls per month (approximately 10 percent are Spanish speaking) to assist the regulatory communi ty and tire enforcement agencies with quest ions pertaining to the waste tire hauler registration process and manifest ing requirements.

• Processing (audit ing, reviewing, and reconci l ing) manifest records submit ted by the tire haulers to CalRecycle, and when necessary, preparing notice of violat ions, and streamline not ices of penalt ies to violat ing business for management and legal review and act ion

• Assist ing Tire Hauler Compl iance Unit staff in the technical development of waste tire hauler enforcement cases

• Maintaining W T M S database

Failure to secure permanent posit ions which can maintain the program and increase the number of reconci l iat ions of mani fests jeopard izes the public health and the envi ronment by al lowing the illegal d isposal of waste t ires, which can grow exponential ly. This in turn creates nuisance, vector and fire problems. Was te tires easily collect rainwater, which provides an ideal envi ronment for mosqui to breeding. Wi th the arrival of Wes t Nile and now the Zika viruses in Cali fornia, any breeding source must be eradicated. In addit ion, waste tire piles also pose an immense fire hazard such as demonstrated in the catastrophic tire f ires in the late 1990s, such as: the 1996 Panoche Tire Fire (2 mill ion tires burned), the 1997 West ley Tire Fire (10 mill ion tires burned), and the 1998 Royster Tire Fire (8 mill ion tires burned) .

CalRecycle currently al locates four field staff-level posit ions (Environmental Scientist / Integrated Was te Management Special ist) and nine (9.0) Permanent- Intermit tent Program Technic ian posit ions in the Tire Hauler Compl iance Unit. However, the work per formed by the PT staff is permanent and ongoing in nature, and should be permanent ly author ized.

The Environmental Scientists are tasked with inspect ions of tire haulers, survei l lance activit ies and developing enforcement cases for the most egregious violators. They do not carry out the duties covered by the Program Technic ians. The four (4.0) Environmental Scientists cannot carry out the duties of the Program Technic ians because the duties are inconsistent with their classif icat ion, and the work load exceeds the resources available. Partial Coverage of this work load would result in less oversight of hauler facil it ies, and in loss of protection of the public health and safety and the environment. If the temporary help is reduced or e l iminated, the work load would need to be addressed.

Currently, the program is utilizing Permanent-Intermit tent Program Technic ian I classif icat ions. However, there is a need to use intermediate and advanced level Program Technic ian posit ions for more compl icated issues. The department has had difficulty in attracting and maintaining exper ienced and competent staff, due to the lack of upward mobil ity, lack of full t ime work (current Permanent-Intermittent Program Technic ians are limited to 1500 hours per year), and relatively low start ing pay. Spanish speaking staff are a critical component of the Tire Hauler Compl iance Program and have been more difficult to retain. Al lowing for two (2.0) Program Technic ian II and one (1.0) Program Technic ian III will help ensure long-term program stability and increased professional competence of staff within the Tire Hauler Compl iance Unit. This will also appropriately align and al locate posit ions with the ful l-t ime, permanent nature of the work load that exists.

If the need for these addit ional resources is not addressed, the current Program Technic ian staffing levels are not secured and are subject to potential reduction and/or el imination f rom the program thereby al lowing for the potential of illegal haulers, and the dumping of waste t ires to go undetected and undeterred.

E . O u t c o m e s and Accountabi l i ty

Funct ions of the Program Technic ian III would include, but not be l imited to: a) the coordinat ion conducted by the Program Technic ian II and Program Technic ian I; b) perform technical and advanced audit reviews of tire hauler manifest ing records; c) draft Streaml ined Penalty Letters; d) provide technical and regulatory assistance to CalRecycle staff. Tire Enforcement Agenc ies , law enforcement agencies, the regulated communi ty and the general public; and e) research special issues related to the Waste Tire Hauler Registration and Manifest Program and formulate recommendat ions or solut ions to address the issues.

The Program Technic ian II and Program Technic ian I funct ions I would include, but not be l imited to; a) conduct daily processing of tire hauler appl icat ions and renewals, surety bond updates, and issue decals and certif icates to registered tire haulers; b) provide technical and regulatory assistance to CalRecycle staff. Tire Enforcement Agencies, law enforcement agencies, the regulated communi ty and the general public; c) perform audit reviews of tire hauler manifest ing records; and d) draft Streaml ined Penalty Letters.

Alternat ive 1 - Establish 7.0 posit ions (4.0 Program Technic ian I, 2.0 Program Technic ian II, and 1.0 Program Technic ian III) to provide a reliable and permanent resource base for ongoing critical tasks associated with California's waste tire laws associated with the Tire Hauler Registrat ion process and the Uniform Waste and Used Tire Manifest System. CalRecycle will absorb the cost of the posit ions.

Pro: This proposal will provide a reliable and permanent resource base for ongoing work load. It would also reduce program instability that could allow future illegal hauling and dumping of waste tires to go undetected and undeterred with all the unacceptable consequences SB 876 sought to prevent.

Con: This would result in an increase in posit ion authority.

Alternative 2 - Establish 5.0 posit ions (1.0 Program Technic ian III, 1.0 Program Technic ian II, and 3.0 Program Technic ian I) to provide a reliable and permanent resource base for ongoing critical tasks associated with California's waste tire laws associated with the Tire Hauler Registrat ion process and the Uniform Waste and Used Tire Manifest System.

Pro: This proposal will provide a reliable and permanent resource base, albeit less than historical work load demands, for many of the ongoing critical tasks associated with carrying out California's waste tire laws associated with the Tire Hauler Registrat ion process and the Uniform Was te and Used Tire Manifest System.

Con: The review, audit, and reconcil iat ion of manifest ing records would be reduced and the remaining work would need to be handled by four field inspection staff, thus reducing their inspection funct ions by 50percent. The four Tire Hauler Compl iance inspectors conducted a combined total of 348 waste and used tire haulers inspect ions in 2015-16, a 50 percent reduct ion would result in 174 fewer annual inspect ions.

Alternat ive 3 - Deny Request, move to amend the requirements of the program to meet the budgetary constraints as detai led under "Con."

Pro: The Department would save $500,000 per year.

Con: If the requested resources are not obtained the only opt ion would be to reduce the staffing of the Permanent- Intermit tent Program Technic ians result ing in insufficient staffing to maintain the current work load.

G . Implementation Plan

If Al ternat ive 1 or 2 is approved, CalRecycle will be able to advert ise and rapidly hire those most quali f ied to implement the changes stated above in early 2017-18.

Total Hours: 450 Act as coordinate work conducted by Program Technician I I & I staff of the Waste Tire Hauler Registration & Manifest Program.

Total Hours: 350 In depth manifest records review on problematic haulers to determine i f there is substantial evidence showing errors and/or omissions on the Comprehensive Trip Log forms to determine i f punitive sanctions are warranted after looking at the performance history of the hauler.;

Total Hours: 500 Review audits performed by other PT I or IPs concerning haulers and determine i f there is substantial violations with the manifesting requirements and/or other tire hauling requirements to warrant punitive actions. Then review the Streamlined Penalty Letters written by the PT I or IPs for accuracy and completeness prior to forwarding the Streamlined Penalty Letters to the Unit Supervisor for approval.

Task #4 Provide technical and regulatory assistance to CalRecycle staff, Tire Enforcement Agencies, law enforcement agencies, the regulated community and the general public

Task #5 Research special issues related to the Waste Tire Hauler Registration and Manifest Program and their recommendations or solutions to address the issues.

Total Hours: 275 Coordinate Waste Tire Hauler compliance and enforcement actions with the Department, Federal, State and local agencies. Prepare any necessary documentation, coordinate with Legal staff and take appropriate compliance and enforcement action against waste tire haulers, generators, and end-use facilities in violation of Public Resources Code and the Califomia Code of Regulations.

Total Hours: 930 Currently, the Waste Tire Hauler Program processes new tire hauler applications ongoing throughout the year and renewals commencing from October L ' through to the end of the year. Approximately 1,400 haulers and 7,500 vehicles are issued decals and registration certificates during this annual renewal period. In addition continued interaction with Surety Bond companies and updating surety bonds occurs throughout the year
